New York’s Attorney General Makes A Fool Of The Governor

Two weeks ago, on February 16, in a case brought by New York Attorney General Letitia James, Justice Arthur Engoron of the New York State Supreme Court issued his decision ordering Donald Trump to pay some $355 million of “disgorgement” penalties. The stated basis for imposing these extraordinary penalties was Trump’s supposed “fraud” of exaggerating the value of some of his properties on financial statements submitted to a bank. No one had been damaged by Trump’s conduct, and the bank in question had neither complained nor sought any relief; however, the Attorney General asserted, and the judge agreed, that a legal basis existed for imposing the penalties under New York’s Executive Law Section 63(12), which allows the AG to prosecute “persistent fraud or illegality” without need for showing traditional elements of fraud like intent and damages, let alone a victim.

The issuance of Justice Engoron’s decision brought forth an immediate reaction from many quarters (Manhattan Contrarian ). James had campaigned for office on a platform of “getting Trump,” a major political adversary, and had sought and obtained penalties far larger than any previously awarded under this statute, for conduct far less egregious. If the AG can use a broad statute to target a politically-disfavored individual like Trump in this way, how could any person doing business in New York think they are safe from similar legal abuse?

Recognizing the problem, our lightweight Governor Kathy Hochul went on a radio talk show on February 18 in an effort to reassure the New York business community. RealClearPolitics on February 19 has an audio clip and a partial transcript of Governor Hochul’s remarks. The key line was that Trump’s case was an “extraordinary, unusual circumstance,” and therefore “law-abiding and rule-following New Yorkers . . . have nothing to worry about because they’re very different than Donald Trump and his behavior.”

Law-abiding New Yorkers “have nothing to worry about”? Really, Governor Hochul? AG James waited all of ten days before making a complete fool of Hochul. On February 28 James dropped her latest over-the-top politicized case. The new target is something called JBS USA Food Company Holdings — the U.S. subsidiary of the world’s largest producer of beef. Here is the AG’s press release announcing the filling of the case; and here is a copy of the Complaint.

The crazed and delusional ambition evidenced in this case is even wilder than what was just seen in the Trump case. This time we’re not just going to keep a hated politician out of office; we’re going to save the planet!

JBS USA has claimed that it will achieve net zero greenhouse gas emissions by 2040, despite documented plans to increase production, and therefore increase its carbon footprint. Beef production emits the most greenhouse gasses of any major food commodity, and animal agriculture accounts for 14.5 percent of annual global greenhouse gas emissions. In 2021, the JBS Group, JBS USA’s global parent company, reported total global greenhouse gas emissions of over 71 million tons, more than the total emissions of some countries. Attorney General James seeks to stop JBS USA from continuing these false and misleading marketing practices, pay disgorgement of all ill-gotten profits, and penalties.

The heart of the alleged “fraud” is JBS’s claim that it plans to achieve “net zero” greenhouse gas emissions by 2040. From Complaint, paragraphs 6 and 7:

6. Across its marketing materials, the JBS Group has made sweeping representations to consumers about its commitment to reducing its greenhouse gas emissions, claiming that it will be “Net Zero by 2040.”

7. The JBS Group, however, has had no viable plan to meet its commitment to be “Net Zero by 2040.”

And from there, this case then turns into Trump 2.0. They have learned how to do this in the Trump case and they are following the form. Like the Trump case, this case is at least in theory civil, rather than criminal. The main legal basis? You guessed it — Executive Law Section 63(12). And the main relief sought? You guessed it again — “disgorgement.” Hey, if they can draw Engoron as the judge they might get an order requiring JBS to “disgorge” all of its revenues for the last 20 years. This time it will be in the multi-billions of dollars. That’ll teach them!

And so, Governor Hochul, is there anything “extraordinary and unusual” about JBS? Definitely not, any more than there was about Trump. Surely now every other beef company is in line for the same treatment, and every other food company right after that. And why stop there? Every company that has made any kind of promises of “net zero” by some far out date will be an obvious target. That’s a very large numbers of companies. And even the ones who haven’t promised “net zero” have almost always made some kind of promise of greenhouse gas reductions, none of which are achievable in the real world.

And guess what entity has made the most extreme promises of “net zero” that can’t possibly be met? That would be the State of New York. As discussed here in many prior posts (examples here, here and here), New York in 2019 adopted a Climate Act, committing the State to “net zero” emissions by 2050, and in 2022 adopted a Scoping Plan supposedly laying out how we are going to get there. But the Scoping Plan is completely delusional and deceptive, and does not come remotely close to setting forth a realistic way to get to net zero. It’s just like the delusional JBS promises!

So, Attorney General James, when are you going to bring your case under Executive Law 63(12) against New York State? I think you should demand “disgorgement” back to the taxpayers of all taxes paid at least since 2019, when they started making these fraudulent promises.

Meanwhile, it is high time for the business and legal communities of New York to start calling out our Attorney General for completely politicizing and degrading her office. You corporate CEOs and law firm leaders — do you think that if you just lie low the crocodile will eat you last? Your tolerance of this politicized AG is completely shameful.

The introduction of fluoride into the drinking water supply in the 1950s caused perturbations in this social magnetic field (calcifying the pineal gland amongst other harms).

The introduction of mass vaccination campaigns caused further disruptions of the magnetic field thus throwing confusion into the relationships between people.

The widespread use of SSRI’s starting in the early 1990s and the vast deployment of electromagnetic fields for wireless (mobile phone) communication expanded this assault on the social magnetic field.

Over time the field weakened.

In 2019/2020 we got hit with a triple whammy — the release of SARS-CoV-2, the largest propaganda campaign in history, and the rollout of 5G. By this point, most progressives no longer had a working moral compass because the social magnetic field that formerly guided them was gone. They no longer felt a connection with the poor, working class, or the disadvantaged. The subaltern was objectified and viewed as unclean. The working class was turned into delivery drivers so that the laptop class could continue on with their Elysium lifestyle.

I argue that this disconnection is what happened to all knowledge production fields as a result of the waves of mass poisonings over the last seventy-five years.

Which terrifies me given the surge in SSRI prescriptions among Gen Z. In the UK, 1 in 3 teenagers aged 12 to 18 has been prescribed antidepressants. In 2022 alone, the number of children aged 13 to 19 taking antidepressants rose by 6,000 to 173,000. That’s kids taking drugs known to cause sexual dysfunction—drugs that the Royal College of Psychiatrists admits to using to castrate sex offenders—right during puberty.

This seems especially true for girls and young women. In the US, 86% of those identifying as asexual are female, and 91% are aged between 18 to 27. Which is also the demographic with some of the fastest-rising rates in the use of mental health medication. Women and adults aged 18 to 29 in America have the highest rates of current depression or depression treatment. Women are also twice as likely to take antidepressants than men.

Then there is Risperdal for autism, Ritalin for ADHD, and Epi pens for severe allergic reactions, and these drugs generate several billion dollars a year in revenue as well.

What most people don’t realize is that these are all treatments for vaccine injuries. The childhood vaccine schedule creates customers for life.

As for the producer side, it hasn’t been truly free since 1910. That’s when the so-called Flexner Report came out to push for an allopathic cartel that came to control medical schools, driving up the price of services through a credentialing racket, while blocking alternative forms of care. As for pharma, it has not operated in a free market for nearly half a century. The Bayh-Dole Act of 1980 allowed private companies to keep “intellectual property”—a wholly unnecessary monopoly—and pay patent royalties to government agencies, thus integrating the two sectors in a financial racket.

The 1986 Vaccine Injury Act was also a catastrophe, allowing mass distribution of untested products on people who have no recourse when they go wrong. The PREP Act of 2006 expanded that to all medical countermeasures used in an emergency.

On February 14, the French National Assembly passed article 223-1-2 du code pénal. Contained therein, in Article 4 of that law, Robert Kogon writes:

Article 4 introduces a new crime into the French penal code: incitation to abandon or refrain from medical treatment or to adopt a would-be treatment, if, “in the current state of medical knowledge”, doing so “clearly” may cause harm to the person or persons in question. This crime is made punishable by one year in prison and a fine of €30,000 (£26,000) or, if the “incitation” has effect, i.e. the medical advice is followed, three years in prison and a fine of €45,000 (£39,000).

In effect, this is an extreme gag order on physicians, other health care personnel, and indeed anyone who dares speak out against official medical orthodoxy. In terrifyingly broad wording, it criminalizes – with hard time and crippling fines – advising against the received medical wisdom, even if the advice is not followed.

It does not take a doctor, lawyer, or medical ethicist to imagine the effect this will have on medical practice. Put simply, this law will destroy the doctor-patient relationship.

Syrian FM: ‘Western leaders are little puppets of the Zionist enemy’

Syrian Foreign and Expatriates Minister, Faisal Mekdad, emphasized that what is happening in Gaza is a genocide perpetrated by Israeli Prime Minister Benjamin Netanyahu, who has killed over 12,000 children and 8,000 women, and completely destroyed the Gaza Strip.

In a statement on the ministry’s X account, Mikdad said “What European Union strategists say about building a world based on rules and regulations has faded. The murderer Netanyahu has not left any rule unbroken: International law, international humanitarian law, the Universal Declaration of Human Rights, the United Nations Charter, children’s rights, women’s rights, democracy, disarmament, and peace.”

He continued to say what is more dangerous than Netanyahu and his ruling “gang’s” crimes, is the support he received from many EU leaders and the blind trust Washington has given him.

“Everyone knows that much of what the European Union leaders did before and after was a form of clowning, hypocrisy, and lies, and their defense of Netanyahu’s crimes led to pulling the rug from under all of their feet and showed them as they really are, little puppets in the hands of Zionism and enemies of peoples’ rights and aspirations,” he said, slamming the West.

Gaza’s last remaining children relief fund razed in Israeli raid

Palestine Children’s Relief Fund (PCRF), an independent humanitarian organization, says its last remaining office in the Gaza Strip has been destroyed after Israeli military aircraft carried out a strike against a neighborhood in the besieged coastal territory.

On Saturday, PCRF in a post on X (formerly Twitter), shared pictures of a building reduced to rubble, as Israel’s genocidal war against Gaza enters its fifth month.

“PCRF’s last office in Gaza was destroyed by one of Israel’s air raids today. Two other offices were destroyed in previous months by Israeli air attacks as well.

“We are thankful that no one was killed or severely injured during these bombings,” the group said.

The PCRF was founded in 1991 by Steve Sosebee, who currently serves as the organization’s president.

According to its website, the non-governmental organization provides free medical care to thousands of injured and ill children annually who lack local access to care within the local healthcare system in Palestine and other countries in the West Asia region.

NGO worker killed in Israeli attack

Meanwhile, a Palestinian aid worker employed at a US charity has been killed in an Israeli attack on his shelter in the central Gaza Strip city of Deir al-Balah.

The non-governmental organization Anera – which helps refugees in Palestine, Jordan, and Lebanon – said Mousa Shawwa was killed on Friday.

It said the bombing comes despite the fact that coordinates of Shawwa’s shelter had been provided to the Israeli military for the staff safety on several occasions, including just days before the attack.

Shawwa is the fifth member of a US humanitarian aid group killed in the war on Gaza, Anera added.

At least 30,960 Palestinians, most of them women and children, have been confirmed killed and 72,524 others injured so far during Israel’s genocidal war on Gaza. The war began after Gaza-based resistance movements carried out Operation al-Aqsa Storm into the occupied territories on October 7, 2023.

The Israeli military campaign has devastated large swathes of Gaza and displaced a staggering 85 percent of the Strip’s 2.3 million population.

According to the UN Agency for Palestinian Refugees (UNRWA), more than 70 percent of civilian infrastructure in the Gaza Strip has been destroyed or severely damaged by intense Israeli attacks.

Israel has also imposed a “complete siege” on the coastal sliver, cutting off fuel, electricity, food, and water to the more than two million Palestinians living there.

The hunger killing Gaza’s children has a clear cause that few are willing to name out loud

Following the February 29 Israeli slaughter of at least 115 starving Palestinians lined up for food aid, there was little or no outrage by the same Western media which would have howled if the perpetrator were Russia or Syria.

According to the Gaza Health Ministry, early morning on Thursday, February 29, Israeli forces opened fire on unarmed Palestinians waiting just southwest of Gaza City for desperately needed food aid. As a result, 115 civilians were killed and over 750 wounded.

Popular US commenter Judge Andrew Napolitano said in a recent interview with award-winning analyst Professor Jeffery Sachs, “Innocent Gaza civilians were lined up to receive flour and water from an aid truck, and more than 100 were slaughtered, mowed down, by Israeli troops. This has got to be one of the most reprehensible and public slaughterings that they’ve engaged in.”

The official Israeli version of events, unsurprisingly, puts the blame on the Palestinians themselves. The deaths and injuries were supposedly caused by a stampede, and the Israeli soldiers only fired when they felt they were endangered by the crowd. The BBC even cited one army lieutenant as saying that troops had “cautiously [tried] to disperse the mob with a few warning shots.” Mark Regev, a special adviser to the Israeli prime minister, went as far as to tell CNN that Israeli troops had not been involved directly in any way and that the gunfire had come from “Palestinian armed groups.”

Testimonies from survivors and doctors tell a different story, though, saying the majority of those treated after the incident had been shot by Israeli forces. Legacy media reports, however, use characteristically neutral wording when evidence starts to stack up against Israel. “112 dead in chaotic scenes as Israeli troops open fire near aid trucks, say Gaza officials,” a Guardian headline reads. Palestinians always seem to just “die,” not get killed, and Israeli troops seem to have just “opened fire” nearby. The skewed wording conventions persist even despite the attribution to Palestinian officials present in that same headline – officials like the Palestinian Foreign Ministry, which was quite clear in accusing Israel of perpetrating a ”massacre” as part of a “genocidal war.”

The article does eventually cite the acting Director of al-Awda hospital as saying most of the 161 casualties treated appeared to have been shot. The confusing headline was likely intentional, counting on most people not bothering to read the article in full.

In a report published on March 3, Euro-Med stated members of its field team were present at the time of the incident and “documented Israeli tanks firing heavily towards Palestinian civilians while trying to receive humanitarian aid.” The report goes on to cite Dr Jadallah Al-Shafi’i, head of nursing at Shifa, Gaza’s main hospital, saying, “paramedics and rescue workers were among the victims,” and that at Shifa “they observed dozens of dead and injured, hit by Israeli gunfire.”

The report also cites Dr Amjad Aliwa, an emergency specialist at Shifa who was also on site when Israel opened fire. According to Aliwa, the Israeli fire began, “as soon as the trucks arrived on Thursday at 4 am”

But the February 29 massacre, tragic as it is, is only a part of the current stage of Israel’s war on Gaza: the deliberate starvation of Palestinians. And like the massacre itself, the whole issue is being subjected to the hands-off wording treatment by establishment media.

On February 29, the New York Times published an article whose headline, “Starvation Is Stalking Gaza’s Children,” suggests starvation is a mysterious malicious force with a will of its own, skirting the mention of the Israeli siege as its obvious cause.

Again, as with the Guardian article, a few paragraphs in, the NYT piece does state that the “hunger is a man-made catastrophe,” describing how Israeli forces prevent food delivery and how Israeli bombardments make aid distribution dangerous.

As Professor Sachs stated, ”… Israel has deliberately starved the people of Gaza. Starved! I’m not using an exaggeration, I’m talking literally starving a population. Israel is a criminal, is in non-stop, war crime, status now. I believe in genocidal status.”

Anyone who’s been paying attention knows that the February 29 massacre was not the first such incident, and likely not the last. A thread on Twitter/X outlines this, noting, ”Before yesterday’s “Flour Massacre”, the IDF has been shooting indiscriminately for WEEKS at starved Gazans awaiting aid trucks at the exact same spot, virtually every single day!”

The thread (warning: graphic images!), compiled by Gazan analyst and Euro-Med chief of communications Muhammad Shehada, gives examples of Israeli soldiers firing on Palestinians every single day in the week prior to February 29.

You can bet that, were these Syrian or Russian soldiers firing on starving civilians, the outrage would be front page, 24/7, for weeks. Scratch that, they wouldn’t even have to do it – just a hint of an accusation would have been enough to get the presses going.

Starvation in Syria was another matter

The NYT article mentioned above notes that “Reports of death by starvation are difficult to verify from a distance.” But ‘verifying from a distance’ is precisely what the NYT and other Western media did repeatedly in Syria over the years.

In areas occupied by (then) al-Nusra, Jaysh al-Islam, and the other extremist terrorist gangs which the West and corporate media dubbed “rebels,” food aid was always taken by the respective terrorists and withheld from the civilian population, causing starvation in some districts. Madaya, to the west of Damascus, eastern Aleppo, and later eastern Ghouta were districts most loudly campaigned over in legacy media, providing covering fire for the broader US-led campaign to overthrow the Syrian government.

Backing the claims that the government was starving civilians were mostly “unnamed activists” or activists whose allegiance to Nusra, or even ISIS, was very overt.

As I would see and hear whenever one of these regions was liberated, ample food and medicine had been sent in, but civilians never saw it. Time and again, in eastern Aleppo, Madaya, al-Waereastern Ghouta, to name key areas, civilians complained that terrorist factions hoarded food and medicine, and if they sold it to the population, it was at extortionist prices people couldn’t afford.

In the old city of Homs in 2014, back then dubbed by legacy media as the “capital of the revolution,” starved residents I met told me the West’s precious “rebels” had stolen every morsel of food from them, stealing anything of value as well.

Yet, media headlines about these regions screamed about starvation, outright blaming the Syrian government, and were accompanied by disturbing images of emaciated civilians (some of which were not even from Syria) meant to evoke strong emotions among readers and viewers. The same media largely opts not to show you gaunt, starving, Palestinians in Gaza.

Tellingly, Syrian towns surrounded by terrorist forces, besieged, bombed, sniped and starved, got virtually no media coverage. It didn’t fit NATO’s narrative of “rebels”=good, Assad=bad.

But in Gaza the world watches in real time as Palestinians die from the ongoing, preventable, starvation.

Some days ago, the CEO of Medical aid for Palestinians, Melanie Ward, in an interview with CNN, named Israel as the cause of starvation in Gaza.

“It’s very simple: it’s because the Israeli military won’t let it in. We could end this starvation tomorrow very simply if they would just let us have access to people there. But it’s not being allowed. This is what they said [on October 9], ‘Nothing will go in’,” Ward said.

She described the starvation as “the fastest decline in a population’s nutrition status ever recorded. What that means is that children are being starved at the fastest rate the world has ever seen. And we could finish it tomorrow, we could save them all. But we’re not being able to.”

This is echoed by UNICEF. The press-release for its February 2024 report notes that 15.6 % (one in six children) under two years of age are “acutely malnourished” in Gaza’s north. “Of these, almost 3% suffer from severe wasting, the most life-threatening form of malnutrition, which puts young children at highest risk of medical complications and death unless they receive urgent treatment,” UNICEF notes.

Even worse, “since the data were collected in January, the situation is likely to be even graver today,” UNICEF warns, likewise noting the rapid increase of malnutrition is “dangerous and entirely preventable.”

Professor Sachs made an important point: “This will stop when the United States stops providing the munitions to Israel. It will not stop by any self control in Israel, there is none… They believe in ethnic cleansing or worse. And it is the United States which is the sole support… that is not stopping this slaughter.”

Air-dropping paltry amounts of food aid into Gaza is not the answer. It both legitimizes Israel’s deliberate starvation of Gaza and also makes those Palestinians who run toward the aid sitting ducks for the Israeli army to maim or kill. The only solution is to immediately open the borders and allow in the hundreds of aid trucks parked in Egypt. And end the Israeli bombardment of Gaza.

Zionist Jews in Biden administration calling the shots on Israeli war on Gaza

One of the key but underreported factors of the unwavering US support for the Israeli genocidal war on Gaza is the overwhelming presence of Zionist Jews in the Joe Biden administration.

These Zionist Jews exert enormous influence in the American power corridors and enjoy unconditional support from the US president who has on numerous occasions boasted of being a “Zionist” himself.

The presence and influence of Zionist Jews in the White House has always been a point of discussion, however, since the events of October 7, it has manifested itself in many ways.

Biden administration’s vetoes of ceasefire resolutions in the UN Security Council, which drew widespread condemnation from pro-Palestine groups, rekindled the debate about the Zionist influence.

Raising the issue of the dominance of Zionist Jews in the US administration and policy circles is often seen through the prism of “anti-Semitism” in the West, even though the same people paradoxically like to boast about the disproportionate number of Jews in other fields.

The Zionist Jewishness of Biden’s cabinet was pointed out recently by The Forward, a progressive media for a Jewish American audience, as well as the Israeli right-wing newspaper Times of Israel.

Being a Jew should not be seen as a problem, but those in the Biden administration have clearly exhibited the tendencies of Zionism – not only justifying the Israeli regime’s genocide in Gaza but also lobbying for more financial and military aid to the occupying regime.

There are also non-Jewish Zionists whose support is motivated by Christian Zionism or belonging to pro-Israel lobbies, a common case in the ranks of the Republican Party.

The problem lies in the fact that everyone in the Biden administration is a radical Zionist who will uncompromisingly justify Israeli war crimes, with slight disagreements over relatively minor issues, such as illegal Israeli settlements in the occupied West Bank.

In the American mainstream media, voting in the UN Security Council and supporting the genocidal destruction of Gaza is treated as common sense and a natural course of action.

Biden made no secret of his Zionist inclinations, uttering the words “I am a Zionist”. And he has proved it through numerous pro-Israeli activities in his decades-long political career.

One of them is the placement of Jewish Zionists in top positions in his administration, which at the beginning of 2021 evoked a popular joke on social networks that the West Wing would have a “minyan.”

The Hebrew term “minyan” means the minimum number of males (10) required to constitute a representative “community of Israel” for liturgical purposes.

Biden’s initial lineup includes Anthony Blinken as Secretary of State, Merrick Garland as Attorney General, Avril Haines as Director of National Intelligence, Ronald Klain as White House Chief of Staff, Rachel Levine as Assistant Secretary for Health, Alejandro Mayorkas as Secretary of Homeland Security, and Janet Yellen as Secretary of the Treasury.

One level down are David Cohen as Deputy CIA Director, Eric Lander as science and technology adviser, Ann Neuberger as Deputy National Security Adviser, and Wendy Sherman as Deputy Secretary of State.

In the meantime, Victoria Nuland took the position of Undersecretary of State for political affairs, Ed Siskel as White House counsel, and Klain was replaced by Jeff Zients as chief of staff.

Others appointed by Biden include Daniel Shapiro as a special liaison to Israel on Iran, Ned Price as spokesman for the Department of State, Jennifer Klein as executive director of the White House Gender Policy Council, as well as a large number of ambassadors.

The Zionist envoys include Michael Adler, David Cohen, Rahm Emanuel, Eric Garcetti, Mark Gitenstein, Amy Gutmann, Jonathan Kaplan, Yael Lempert, Alan Leventhal, Randi Levine, Jack Lew, Jack Markell, Constance Milstein, Marc Nathanson, Marc Ostfield, David Pressman, Daniel Rosenblum, and Marc Stanley, among others.

Blinken, the top American diplomat, comes from a Zionist family. His grandfather Maurice was one of the early American Zionists and the founder of the American Palestine Institute, in the years before the declaration of the Zionist entity.

His institute funded economists to prepare a report on the economic viability of such an entity and lobbied Washington to politically support its creation.

Following Blinken’s appointment as the top US diplomat, replacing Mike Pompeo, the Israeli media praised his and Biden’s close relations with Tel Aviv during the Second Intifada in the early 2000s, noting their “lifelong support for Israel and its security.”

During the Obama administration, Blinken often justified Israeli aggressions in the region with the hackneyed phrase “the right to self-defense” and praised Trump for strengthening Israel’s regional alliances.

He was a close confidant of the Israeli ambassador to the US Ron Dermer who could call him in the middle of the night for pro-Israeli services, such as lobbying hard to have Israel’s Iron Dome air military system financed with American taxpayer money.

In his first days in office, he also made it known that the new Biden administration would support earlier Trump’s decision and keep the American embassy to the occupied territories in occupied al-Quds.

Last year, during the bickering between Biden and Netanyahu, Blinken pledged enduring US ties with Israel, seeing it as a far more important ally than NATO member Turkey.

As for Mayorkas, even the Israeli media boasted of his strong family ties to Tel Aviv and praised him for the data-sharing pact between the United States and the Zionist regime.

Even greater Zionist credit for intelligence sharing goes to CIA deputy chief David Cohen, whose career under Obama focused on sanctioning Israel’s enemies.

Thus, it is no surprise that Americans are bankrolling the genocide of Palestinians in Gaza while harping about ceasefire and aid airdrops to hoodwink the international community.

How NATO Helped Trigger the War in Ukraine and Then Did Nothing to Foil It

Two years ago, in December 2021, Russia formulated its security interests in separate letters to NATO’s Secretary General Stoltenberg and to US President Biden in no uncertain terms. The West’s reaction: no response! There is much to suggest that Russia’s invasion of Ukraine could have been prevented if the West had negotiated and ruled out the country’s membership of NATO, writes Dr Ensel.

OLDENBURG, Germany | 18 January 2024 (IDN) — Western reporting about the war in Ukraine has many remarkable blank spots about the events that led to the war. Hardly anybody in the West knows that Boris Yeltsin, who was otherwise very close to the West, threatened back in March 1997 the then US President Bill Clinton that if Ukraine joined NATO, it would cross a red line for Russia. This was at the time of NATO’s first eastward expansion and long before Vladimir Putin came to power. It shows that Western plans for NATO expansion into Ukraine dated back to the 1990’s and that Russia had vehemently opposed this for just as long.

The Minsk II agreement was, with the obvious acquiescence of the West, never implemented by the Ukrainian government. The constitutional reforms agreed on in Minsk to provide the Donetsk and Luhansk regions with a special status (like the South Tyrol solution) were ignored by the end of 2015. At the end of 2022, former German Chancellor Angela Merkel confirmed what ‘evil tongues’ had long suspected: The two Minsk Agreements were only to gain time to get the Ukrainian army in shape. Later, France’s former President François Hollande and Ukraine’s former President Petro Poroshenko confirmed this.

It is also little known in the West that in 2021—long before the Russian invasion—Ukraine intensified its attacks against rebel positions in Donetsk with Turkish Bayraktar TB2 combat drones that had “proven their worth in the Karabakh War 2020”. It was also negotiating with Turkey a license to produce them in Ukraine.

Virtually unknown among the Western public is also the fact that since mid-1990, the US armed forces conducted annual military manoeuvres with Ukrainian troops inside the territory of western Ukraine under the code name “Rapid Trident” (formerly named “Peace Shield”). The last US-Ukrainian manoeuvres took place in September -October 2021, together with forces from Bulgaria, Canada, Georgia, Germany, Great Britain, Italy, Jordan, Moldova, Pakistan, and Poland. Since 1997, US naval manoeuvres code-named “Sea Breeze” have regularly taken place off the coast of Ukraine in the Black Sea. In the summer of 2021, these naval manoeuvres involved naval forces from 32 countries.

What would have been the reaction of the West if Russia, together with soldiers from Belarus, Serbia, China, Cuba, Venezuela, Iran and other countries, had conducted regular military exercises in Mexico and held annual naval maneuvers in the Gulf of Mexico off the coast of Florida?

Who knows that on March 24, 2021—exactly eleven months before the Russian invasion—Ukrainian President Volodymyr Zelensky signed Decree No. 117 for a “Strategy for the de-occupation and reintegration of the temporarily occupied territory of the Autonomous Republic of Crimea and the city of Sevastopol”? It aimed to prepare all necessary military measures to “end the temporary occupation” of Crimea and the Donbas.

On August 30, 2021, the USA and Ukraine signed a treaty on military cooperation and, on November 10, 2021, concluded a treaty on “Strategic Partnership”. This treaty stated, among other things: “The United States intends to support Ukraine’s efforts to counter Russia’s armed aggression, including through the maintenance of sanctions and the application of other relevant measures, pending the restoration of Ukraine’s territorial integrity within its internationally recognized borders.” Had the Ukraine, with US encouragement, prepared for war just months before Russia attacked?

And this was not all:

All this took place on the background of other activities that Russia must have seen as existential threats to its security. In 1999 and 2004, NATO expansion brought it directly to the Russian border when 14 Eastern European countries joined the military organization.

By 2001, the US Government under Bush Jr. began dismantling virtually all arms reduction treaties and confidence-building measures with Russia: In 2001, it cancelled the A-CFE Agreement on the Disarmament of Armed Forces and Weapons Systems in Europe and the ABM Treaty on the Limitation of Anti-Ballistic Missile Systems; in 2019, it allowed the phasing out of INF Treaty prohibiting the production and deployment of land-based missiles and cruise missiles with a range of between 500 and 5.500 kilometres and in 2020 it cancelled the Open Skies Treaty, which was intended to create a ‘glasnost’ for both sides in the sense of confidence-building measures through overflight rights. In 2023, Russia responded by suspending the New Strategic Arms Reduction Treaty (New START), the last remaining treaty limiting U.S. and Russian strategic nuclear arsenals. The US had never ratified the Nuclear Test Ban Treaty.

NATO conducted its own wars of aggression, ignoring the UN Charter. In 1999, it attacked illegally the Federal Republic of Yugoslavia and was forced to hand control of Kosovo, formally an autonomous province of Yugoslavia, to NATO forces. In 2003, the US attacked Iraq under false pretext and without a UN mandate. In 2011, it attacked Libya, also under false pretext, ignoring the limitations set in the UN mandate. In a highly “creative” interpretation of the 1997 NATO-Russia Founding Act on Mutual Relations, it began to station NATO troops in countries bordering Russia in 2016. In 2016, the US Aegis Ashore Site became operational in Romania, and in 2023, the US Aegis Ashore Site in Poland became operational. They are all directed against Russia and designed to undermine Russia’s ability to respond to any nuclear attack.

What Russia proposed to NATO and the USA…

On December 17, 2021, Russia sent NATO and the USA a draft treaty to establish legally binding security guarantees for both sides. Are the proposals so absurd and unrealistic as claimed by the US and other NATO states? Was the West justified in ignoring Russia’s security concerns and in taking the position that “Ukraine’s NATO membership is not up for negotiations”? Had NATO fulfilled its obligation under the UN Charter to negotiate any conflict to find a diplomatic solution as and when it arises to prevent war?

In summary, the draft treaty addressed to NATO contained the following proposals:

  • Both sides should confirm not to regard each other as adversaries;
  • Return to the principles of “equal and indivisible security” (Paris Charter);
  • Renunciation of the use and threat of force;
  • Refraining from creating situations that one side could regard as a threat to its national security;
  • Restraint in military planning and exercises to avoid “dangerous brinkmanship”, especially in the Baltic Sea region and in the Black Sea;
  • Revitalization of the NATO-Russia Council and other bilateral and multilateral discussion formats;
  • Transparency in military exercises and manoeuvres;
  • Establishment of hotlines for emergency contacts (revitalization of the “red telephone”);
  • Withdrawal of Western armed forces and weapons systems to the level prior to NATO’s first eastward expansion;
  • No deployment of land-based short- and medium-range missiles in areas from which they could attack the territory of the other party;
  • No further expansion of NATO (in particular not to include Ukraine);
  • NATO to refrain from military activities on the territory of Ukraine and other states in Eastern Europe, the South Caucasus and Central Asia;
  • Establishment of a largely demilitarized corridor between NATO and Russia.

In summary, the draft treaty addressed to the USA also contained the following proposals:

  • Reaffirmation of the declaration that nuclear war can have no victor and that every effort must be made to avert this danger;
  • Renunciation of measures aimed at preparing for war against the other side on the territory of third countries;
  • Renunciation by the USA of establishing military bases and bilateral military cooperation in and with the states of the post-Soviet space that are not NATO members;
  • Both sides refrain from stationing armed forces and weapons systems outside their territories, which the other side might regard as a threat to its national security;
  • Refraining from flights of heavy bombers and the presence of surface combatants in regions from which they could strike targets in the territory of the other Party;
  • Refraining from stationing nuclear weapons outside its own territory and returning such weapons systems, and destroying the corresponding infrastructure to third countries;
  • There is no training of personnel in the use of nuclear weapons and no military exercises for their use in countries that do not possess them.

As always, the devil is in the details, and all proposals would have required intensive scrutiny by security policy and diplomatic experts. Moreover, the ‘package demands’ and the ultimate tone of the two letters were highly undiplomatic. Nonetheless, NATO and the USA should have taken the two proposed draft agreements seriously as a clear formulation of Russian security interests, examined them carefully and used them as a basis for negotiations aimed at significantly improving the security situation of all signatory states by finding a negotiated solution to the security concerns of Russia and Ukraine. This would have probably prevented the war, saved the lives and health of hundreds of thousands of mostly young men, and left Ukraine as a sovereign state intact.

… and how NATO responded

On January 7, 2022, an extraordinary digital conference call among all 30 NATO foreign ministers took place to work out a common NATO position on how to react to the Russian proposals. NATO’s response was disappointing: They decided not to negotiate any of the core issues raised by Russia.

At the subsequent press conference, Secretary General Stoltenberg—like US President Biden later—responded in the usual fashion: NATO would continue to support Ukraine and Georgia; and that every country, regardless of its size and the concern of its neighbours, had the right to choose its own alliances. However, by claiming that every member of the OSCE, regardless of its neighbours, has the right to become a NATO member, Stoltenberg and Biden contradicted the spirit of the 1990 OSCE “Charter of Paris” for a New Europe and the Istanbul Document of the 1999 OSCE Summit with its stated principles: “Each participating State has an equal right to security… They will not strengthen their security at the expense of the security of other States.”

Gabriele Krone-Schmalz, the former and well-informed ARD correspondent in Moscow, responding to such a claim, said the necessary things about the alleged general right to NATO membership: “All states have the right to apply to NATO for membership. But NATO has every right in the world to reject applicants if overriding political considerations speak against it!”

Adding further to the tensions, Stoltenberg took this opportunity to call on Finland and Sweden to join NATO blatantly—“the partners with whom we are working more and more closely. NATO’s door remains open!”

Six weeks later, Russia launched its military intervention into Ukraine.

‘Novorossiya’ rising from ashes like phoenix

The Russian President Vladimir Putin’s meeting on Wednesday in Moscow with top officials of economic ministries and leaders of the southern and Azov sea regions — ‘Novorossiya’ historically — signifies a significant initiative in the Kremlin’s geo-strategy, with global ramifications, as the conflict in Ukraine meanders toward a new phase.

What lends poignancy to the occasion at once is that Putin is beating swords into ploughshares at a juncture when the US and its allies are sounding bugles. Indeed, one way of looking at Wednesday’s meeting is that it is a riposte to the fanciful conjecture 10 days earlier by French President Emmanuel Macron that European armies might march into Ukraine to push back Russians. 

Putin signalled something profound — that war cries to defeat Russia is already time past. With the capture of the strategic town of Avdiivka and the rapid advance further west since then, cities like Pokrovsk, Kostyantynivka and Kramatorsk are now facing a fast-approaching front line, littered with signs of an approaching Russian army. 

As the Russian forces gain more momentum in the Donetsk region, the question of where they will stop is becoming increasingly difficult to answer. There is much unfinished business still. A big concentration of Russian military facing Kharkov is ominous. Odessa is also in Russian sights. 

The progress of Russian operations may seem ponderous. In the past month, Russian forces gained only around 100 square kilometres of Ukrainian territory (according to Belfer Centre’s latest Russia-Ukraine War Report Card) but then, in a war of attrition, the tipping point comes most unexpectedly, and before one catches their breath, it’s all over. The Wall Street Journal wrote that Ukraine has few remaining military strongholds in Donbass, which means that with each Russian advance, Ukraine must retreat to often underprepared positions. 

A New York Times report on Thursday titled Mutual Frustrations Arise in U.S.-Ukraine Alliance ended on a sombre note citing Western officials and military experts that “a cascading collapse along the front is a real possibility this year.” 

President Joe Biden was conspicuously taciturn in passing judgement on the war in his State of the Union Address at the US Congress on Thursday, except to warn the Kremlin rhetorically that “(we) will not walk away. We will not bow down.” The cryptic remark could mean anything, but he did acknowledge that “Overseas, Putin of Russia is on the march…” 

Importantly, Biden put in cast iron his past commitment not to send troops to participate in the war in Ukraine. And his focus was on the Bipartisan National Security Bill in the pipeline that would resume large-scale military aid to Ukraine whose future is now even more uncertain what with Donald Trump’s unstoppable surge as the candidate of the Republican Party. 

The fear that the US is walking away from the war is gut-wrenching for Europeans. The French President Emmanuel Macron’s remark last week on Monday on the dispatch of Western ground troops to Ukraine was reflective of belligerence and bravado that often accompanies frustration. Earlier this week, Macron urged Ukraine’s allies not to be “cowardly” in supporting Kiev to fight Russian forces; on Thursday, he went further at a meeting with party leaders to advocate a “no limits” approach to counter Russia. 

But there is a big picture, too. On Thursday, Macron met with Moldovan President Maia Sandu, pledging France’s “unwavering support” for her ex-Soviet country as tensions mount between Chisinau and pro-Russian separatists in the breakaway province of Transnistria. During the Macron-Sandu meeting, the two signed a bilateral defence deal, as well as an “economic roadmap,” although no details were provided. 

The timing of France’s defence deal with Moldova, which follows a security pact with Ukraine last month, hints at geopolitical considerations to get a toehold in that vital region — where Dniester River rising on the north side of the Carpathian Mountains and flowing south and east for 1350 kms drains into the Black Sea near Odessa — to challenge the rise of Novorossiya, which is in the throes of renewal and regeneration. 

For more than three decades, Transnistria has been considered a possible flash point for a conflict. The endgame in Ukraine has a domino effect on Moldavia, which, encouraged by the West, step by step, is strategically defying Russia to “erase” its influence, and move into the EU and NATO camp. Russia has been watching closely but patience is wearing thin. 

Sandu is a semi-finished American product — an ethnic Romanian who got transformed as a graduate of John F. Kennedy School of Government at Harvard and had a stint in the World Bank and was pitchforked into the top rungs of Moldavian politics, eventually as the pro-European candidate in the Moldovian president election in 2016. 

Sandu has the same genetic make-up as another colourful figure in the post-Soviet space whom the US groomed for “regime change” in Tbilisi — Mikheil Saakashvili who was the president of Georgia for two consecutive terms from 2004 to 2013 following a colour revolution stage-managed from Washington. The strategic calculus both in Georgia and Moldova basically aims at NATO’s expansion into the Black Sea which has been historically a Russian sphere of influence. 

Therefore, Macron’s recent remarks on western combat deployment in Ukraine must be understood properly. He is by no means spiting the Biden Administration — nor is Germany differing from him — as he pushes the envelope and hopes to salvage victory out of the jaws of NATO’s defeat in Ukraine. The Biden administration will be quietly pleased with Macron’s tantrums against the Russian windmill in the regions of Novorossiya and the Black Sea.

The startling disclosure recently of the discussion between two German generals regarding the logistical complexity of lethally destroying the Crimean Bridge shows that Berlin is very much part of the Ukraine project despite the fault lines in the Franco-German axis.  

France tasted blood in pushing a similar strategy in Armenia, which has virtually moved out of the Russian orbit and is jettisoning CSTO membership while seeking EU and NATO membership. Its focus will be to evict Russian military presence in Transnistria. 

Reacting to the West’s thickening plot in Moldova, Transnistria has sought protection from Moscow. There is a big population of ethnic Russians in that region. The response from the Kremlin has been positive and swift. Shades of Donbass!   

At Wednesday’s meeting in the Kremlin on the economic and infrastructure development in the new territories, Putin stressed the modernisation of the Azov-Black Sea road modernisation plans. He said, “we have big plans to develop roads in the Azov-Black Sea region.” 

Of course, infrastructure development and strengthening of transportation networks will be an important template of Russia’s counter-strategy. Moscow is not waiting for a conclusive end to the conflict in Ukraine for the integration of the new territories into its economy from a long term perspective. 

The crux of the matter, in geopolitical terms, is that Novorossiya is rising from the ashes like the phoenix and becoming, as Catherine the Great envisaged, Russia’s most important all-weather gateway to the world market connecting its vast untold mineral resources and huge  agricultural potential. George Soros knows it; Wall Street knows it; Biden knows it. For France and Germany too, it is invaluable as a resource base if it is to ever regain its economic dynamism. 

But in immediate terms, the challenge lies in the politico-military sphere — that “Russia cannot be allowed to win in Ukraine,” as  Russia’s First Deputy Permanent Representative to the United Nations Dmitry Polyansky summed up. Russia has requested a Security Council meeting on Ukraine for March 22. Polyansky said Russia will expose the diabolical plots of France, Germany and the US.
