Nuking Itself… How Russophobia Led the U.S. to Bomb its Own Citizens

Generations of countless Americans have been contaminated and sickened by the first-ever atomic bomb test. The Trinity explosion on July 16, 1945, was carried out in the New Mexico desert. Three weeks later, two A-bombs were dropped on Japan, killing up to 200,000 people.
But the number of American victims caused by radiation fallout from the Trinity test is reckoned to be also imponderably high. The American government conducted the explosion in secret, unbeknownst to the population of New Mexico. That was in spite of warnings from Manhattan Project scientists of a high risk to public health from the extreme radiation. Without a warning to the public and because of a cover-up about the event, countless Americans were exposed to carcinogenic radiation.
In a recent interview with Karl Grossman, New Mexican resident Tina Cordova tells how her community has been campaigning for decades to find out the truth behind the Trinity test and to seek reparations from the federal government. Incredibly, there has never been a federal investigation into establishing the human health impact from that atomic test explosion. But Cordova and her community estimate that the number is huge. She is the fourth generation in her family to have suffered from cancer. Countless others tell of high numbers of infant mortality over the decades and other morbidities that stretch across the entire state of New Mexico.
A combination of factors conspired to wreak a heavy toll on the people of New Mexico. It is one of the poorest states in the U.S., with large numbers of native Americans and Latinos. In selecting the test site for the A-bomb, there was a tacit racism among planners in Washington who viewed the area and its population as expendable. By not warning the people of the explosion, local populations were given no chance to take protective measures such as evacuation or avoiding consumption of contaminated water and food produced from the soil. The people were deceived into continuing their livelihoods as normal following the explosion, drinking contaminated water and breathing radioactive air. The New York Times was instrumental in the cover-up, issuing reports that the explosion was due to a conventional munitions incident. It was only after the horrific bombings of Hiroshima and Nagasaki on August 6 an 9 that the people of New Mexico realized what had really happened at the Trinity site. Even then they were kept in the dark by Washington stonewalling about the event for decades to come.
Still another factor that maximized the damage on public health was the rush by the American government to weaponize the A-bomb technology. As Karl Grossman points out, the rationale behind the Manhattan Project was said to be to preempt Nazi Germany. But by July 1945, Nazi Germany was defeated and imperial Japan was on its knees. The inescapable implication is that President Harry Truman and the Pentagon wanted to display the new awesome weapon of mass destruction to the Soviet Union in what would be a chilling demarcation of the postwar globe according to American power.
Truman eagerly awaited the news of the Trinity test while attending the Potsdam allies’ conference in Germany along with Britain’s Winston Churchill and the Soviet Union’s Josef Stalin. On receiving news of the successful explosion, Truman immediately adopted a more strident attitude towards Stalin. In that moment, a new Cold War was born.
Thus, it was Russophobia among the American ruling class that rushed the Trinity A-bomb explosion, even though that event would lead to generations of American citizens stricken with fatal diseases from the fallout. In a very real and frightening way, the U.S. rulers took a decision to “nuke” their own people such was their obsession with confronting the Soviet Union.
Subsequent U.S. nuclear weapons testing in the 1950s and 60s was conducted in remote areas of Nevada and in the Pacific Ocean. Those tests also took a deadly toll on the environment and local populations on Pacific islands.
But the recklessness and callous conditions of the New Mexico test is unparalleled in the toxic exposure it imposed on unsuspecting populations.
The stone-cold willingness to, in effect, bomb its own citizens by the federal government is a shuddering testimony as to the nefarious lengths the planners in Washington were prepared to go in their obsessive Russophobia.
When we survey the relentless fixation today in Washington and the U.S. political class with blaming Russia for all sorts of alleged malign intent, one can easily discern that this endemic Russophobia among America’s rulers has not waned.
The barbarity of what happened in New Mexico 75 years ago is alive and well. If it can be inflicted without apology on American citizens, then what does that say about the danger to the rest of the world?

Target: ‘Nuclear Alley,’ New Mexico
In the past few weeks – un-reported in the scandal/crisis-pre-occupied American main stream media – New Mexico has become the epicenter of an on-going national controversy: how to responsibly manage the tons of radioactive waste accumulated at all the nuclear energy reactors around the country so far in the Nuclear Age.
Why, New Mexicans and others around the country are asking, has this region suddenly become the potential target destination for all of America’s radioactive waste?
Will the Shimkus Bill ‘Bring Death to New Mexico’?
New Mexico cattle rancher Ed Hughs is one of the many around that state and the country who think so.
Having, with his neighbors, just successfully fought off a proposed deep bore hole nuclear waste depository next to his ranch in Quey County, NM, Hughs told a recent Roswell, New Mexico NRC meeting to rousing applause,
“There are a lot of questions that have not been answered. One of the questions, how do you retrieve if there are accidents? How do you monitor? How do you repair? Those questions have not been answered. So I guess in summing up I want to say that the Holtec and Eddy-Lea Energy Alliance, and I agree with an earlier statement that, you know, you aren’t bad people in the sense that you are trying to do us harm, but you are making a huge mistake…. You are in fact proposing to bring death to New Mexico.”
Yucca Redux and the ‘Fukushima Freeway’
The Congressional trigger to this rising national controversy is the Nuclear Waste Policy Act of 2018, HR 3053, known as the Shimkus Bill, which recently passed the House on its way to the Senate.
It calls for restarting the failed Yucca Mountain Project in Nevada, and establishing a system of Consolidated Interim Storage (CIS) sites for radioactive waste around the country until Yucca is operational.
First on the list of possible ‘temporary’ CIS nuke dumps is a site proposed by Holtec International and the local Eddy-Lea Alliance just outside Hobbs, New Mexico. It’s just over the border from Andrews, Co., Texas – where another high level nuke waste dump is also being proposed by Waste Control Specialists, which already operates a controversial toxic materials dump in the area.
In early may, the Nuclear Regulatory Commission (NRC) held a series of five so-called ‘scoping’ meeting around New Mexico to take public comments on the Holtec/Eddy-Lea site proposal.
Proponents of the dump tout it as a regional economic boon and a patriotic service to the nation.
Opponents see it as a public health, environmental and economic disaster waiting to happen that could ruin the region’s thriving dairy ranching, pecan growing and oil drilling industries.
Planned to eventually hold more metric tons of waste than Yucca Mtn. itself will be designed for, the Hobbs site could well become – if the Yucca site never gets built – America’s de facto national dump site, and make the region a national ‘nuclear sacrifice area.’
The region targeted for the proposed ‘interim’ radioactive waste storage sites is already known to the region’s population as ‘nuclear alley.’
Welcome to Nuclear Alley
Nuclear Alley is on the edge of one of the world’s richest and – currently on pace to be – most productive petroleum patches: the Permian Basin, which straddles the New Mexico-Texas border.
We traveled there recently for our forthcoming documentary series on the shutdown and decommissioning of California’s last remaining nuclear energy plants at San Onofre and Diablo Canyon. We also wanted to express our support of the groups resisting the ill-conceived consolidated interim storage agenda.
Along with the coming cascade of waste from other scheduled nuclear power reactor shutdowns around the country, California’s radioactive waste could well be headed for New Mexico… if the proposed Holtec and WCS ‘Consolidated Interim Storage’ sites are licensed by the industry-captured NRC.
Oil Patch Central
To get to this region we flew into Midland, Texas. The thriving city is a prime beneficiary of the area’s present oil- and gas-fueled economic boom. As we got off the plane, we entered a bustling airport space dominated by a battery of animated electronic screens showing glitzy ads – not for consumer goods – but for the region’s thriving, readily available, fracking and oil drilling services and products.
From Midland we headed to Eunice, New Mexico, an epicenter of New Mexico’s Nuclear Alley. To get there, we drove through endlessly flat countryside dotted every few yards stretching to the horizon with temporarily dormant or busily functioning oil pumps.
Rose Gardner is a feisty Hispanic grandmother and co-founder of the Alliance for Environmental Strategies organization in opposition to the Holtec dump. In keeping with her name, she runs a flower shop on the Main Street of Eunice.
The little town’s local landscape is dominated by the presence, just five minutes up the highway, of Waste Control Specialists’ toxic waste materials site – where WCS is proposing adding a new CIS ‘parking lot’ nuclear dumpsite.
Just next-door to WCS is the Urenco uranium enrichment facility, which supplies much of the fuel for the country’s nuclear power reactors. [A January, 2018 NRC Inspection Report noted both a security violation and the loss of criticality controls at this Urenco plant.]
Both proposed sites are about 40 miles from the now infamous Waste Isolation Pilot Project (WIPP), where more than 171,000 waste containers are stored in salt caverns 2,100 feet underground.
Touted as the demonstration ‘Flagship’ model for the feasibility of long-term deep geological radioactive storage facilities for nuclear weapons waste, and advertised to last for thousands of years, WIPP experienced underground fires and explosions on February 14, 2014, after only 15 years of operation.
The disaster caused a major radiation release of plutonium and americium that contaminated at least 22 workers. The release was tracked by monitors and acknowledged by DOE as far away as 26 miles.
Reports the LA Times “the explosion ranks among the costliest nuclear accidents in U.S. history, according to a Times analysis. The long-term cost of the mishap could top $2 billion, an amount roughly in the range of the cleanup after the 1979 partial meltdown at the Three Mile Island nuclear power plant in Pennsylvania.”
But, says the Southwest Research and Information Center’s Dan Hancock, “There is no question the Energy Department has downplayed the significance of the accident.”
Diagnosed as being caused by the use of the use of ‘organic cat litter’ in the storage barrels, the WIPP disaster was dubbed a ‘comedy of errors’ by commentators around the world. Not to worry. Sustaining such huge potential costs (that are charged to the state of New Mexico) WIPP is now again accepting waste – presumably packed with the right brand of inorganic kitty litter.
Cui Bono?
Guiding us on a tour of the local Eunice roadside attractions, Rose showed us a sprawling, sun-baked trailer park, on land owned by a local politician. The bleak dusty field is home for many of the workers at the town’s two dominant facilities.
If WCS succeeds in getting an NRC license for a CIS site here, the workers’ ranks will expand, and so will the trailer park owner’s profits. That’s one of the ‘economic benefits,’ Rose noted to us wryly, that are loudly touted by the region’s CIS advocates.
“This crap that could kill us!”
Speaking at the NRC’s first regional meeting in Roswell, Gardner told the standing-room-only crowd,
This isn’t the right thing to do. It’s an injustice to this state, to this community…. Most of the people in this area are like me, Brown-skinned or darker. We’re already poor. We don’t have insurance. We speak another language and we’re at least 50 percent here. And that’s an environmental injustice because they’re basically saying it’s okay… because those people aren’t going to speak up, because they can get run over just like they’ve been run over for the last several hundred years.
I’m here to tell Holtec, ‘Hell No, we don’t want it!’ I am so sick and tired of all these big companies coming into New Mexico or close to my town in Eunice, wanting to give us all this crap. This crap that could kill us!
New Mexico as ‘National Sacrifice Area?’
Leona Morgan, a fiery young Diné [Navajo] community organizer and co-founder of New Mexico’s Nuclear Issues Study Group, expands on Rose’s points.
“Starting with uranium mining and milling,” she says, “to modern weapons production, uranium enrichment, and storage of low-level and transuranic wastes, New Mexico has been targeted as a national sacrifice zone for too long,”
“New Mexico is the birthplace of nuclear colonialism,” Morgan points out. “We have been impacted by just about every step in the nuclear fuel chain! We did not generate this waste from nuclear reactors that is intended to come here. So why should we take it? As a state with many indigenous nations and people of color, and being at the tail end of several measures of quality of life, it is environmental racism at its core to keep dumping on New Mexico. And it’s time to stop!”
Speaking to the NRC meeting in Hobbs, New Mexico, Morgan gave a greeting in her native language and went on to remind the group that they were assembling on land originally stolen from the Mescalero Apache and Comanche tribes. “The things I want to talk about,” she said, “have to do with indigenous rights across the nation.“
“How many of you from the NRC or any of the regulating Agencies are aware,” she asked, “of the United Nations Declaration on the Rights of Indigenous Peoples? Or, for that matter, any of the elected officials here, how many of you know about this document called the United Nations Declaration on the Rights of Indigenous Peoples passed in 2008?”
She scanned the crowd.
“Okay, let the record show no hands going up. How many of you are aware of the Organization of American States’ Declaration on the Rights of Indigenous Peoples?“
She glanced around at the blank official faces.
“Okay, again, nobody’s hands went up. This was passed in 2016 and so I’d like to read directly from this Declaration.”
She went on to quote language from the Declarations’ Articles declaring that
Article 19: Indigenous peoples are entitled to be protected against the introduction of abandonment, dispersion, transit, indiscriminate use or deposit of any harmful substance that could negatively affect indigenous communities’ lands, territories, and resources.
And that
Article 22: The indigenous law and legal systems shall be recognized and respected by the national, regional, and international legal systems
“The reason I’m reading this,” she told the meeting, “is because it cites that the Federal Government needs to recognize tribal law.”
“Specifically with my tribe, the Navajo nation, we have a law against the transport of radioactive materials through our lands.
“So, if this transport should occur, it’s directly violating our tribe’s laws that were put in place because of all the history and the health impacts of the horrendous things that the United States did, not just going back to the genocide of our people but more recently, the exploitation of uranium on our lands.
“And so we have a law against uranium mining and we have a law against transport because we’ve already suffered the impacts from these industries for United States imperialism and capitalism. And so that did not benefit our people. We wrote these laws for the protection of our future generations, however, they are not being respected here.”
Based on indigenous historical experience, it would be a pleasant surprise if such legal provisions were ruled to be within the scope of the NRC’s consideration of the Eddy-Lea/Holtec license application for their proposed project.
Jobs! Jobs! Jobs!
The Eddy-Lea Alliance Project’s point man and lead salesman is John Heaton, a former member of the NM state legislature and current Chairman of the Alliance.
The Alliance is a limited liability corporation made up of 8 people appointed by the Councils of Hobbs, Lea, Eddy and Carlsbad counties. According to its promotional material it was “Formed Under the Local Economic Development Act (LEDA) for Economic Development Purposes in 2006 & to Respond to Global Nuclear Energy Partnership (GNEP) Proposal from DOE.”
Heaton qualifies as what Eric Hoffer called a ‘True Believer’ in his 1951 best seller of that title. Heaton’s energetic sales-pitch is persuasive… at least to the uninformed.
As Heaton tells it, seeing opportunity in a recommendation by Obama’s Blue Ribbon Commission on America’ Nuclear Future for creation of ‘consent-based’ Centralized Interim Storage sites around the country, the Alliance believed it had secured what Heaton calls ‘an ideal site.’ It’s located 35 miles outside the town of Hobbs, and about equidistant from the Waste Isolation Pilot Project (WIPP) outside Carlsbad.
Although ‘consent-based siting’ was recommended by Obama’s Blue Ribbon Commission, the DOE has not finalized rules for how a state or community gives or denies consent. Already some cities have forced construction of highway bypasses around their metropolitan jurisdictions.
New Mexico’s ‘High Nuclear IQ’ vs. ‘Fear Mongering’
Heaton describes the proposed Eddy-Lea site as ‘dry’ and ‘seismically stable.’ In addition he says, because of all the existing neighboring facilities in Nuclear Alley, “we have what I call an area of the country with a very high nuclear IQ. The local population understands nuclear materials,” he claims, “and know they can now be handled competently.”
“This is deja vu for us,” an irritated Heaton told the NRC in its Hobbs meeting. “We went through this same thing with WIPP. We went through all the fear mongering. WIPP has shipped more than 12,000 shipments and traveled over 14 million miles. That’s like going to the moon and back 28 times, without a serious accident and absolutely no release.”
However, there are many members of that regional ‘high nuclear IQ population’ Heaton refers to who also remember that – touted as the country’s flagship deep geological nuclear waste repository, designed to remain secure for ten thousand years – WIPP suffered an explosion and release of plutonium in 2014, after a mere15 years of operation.
An ‘Ideal Site’ for Holtec
Having secured their ‘ideal site,’ the Alliance issued an RFP to potential contractors and chose Holtec. “Because,” Heaton says, “they are a great company with a fabulous record [and] have the best, safest, most secure system in the world.”
Joy Russell is a Holtec Vice President and nuclear engineer who is proud, she told us, of being both a West Point graduate and a co-designer of the Holtec transport cask modeled by the scaled-down inflatable replica being toured around the state by opponents as the growing Halt Holtec campaign gathers momentum.
She boasts that her company has been in the radioactive waste storage business for over 30 years, and that “sixty per cent of nuclear plants in the U.S. use Holtec dry storage equipment.”
“We have an impeccable safety record,” Russell told an NRC community meeting in Roswell, NM. “None of our equipment has ever experienced a safety issue, ‘leak,’ as you so call it.
But, I would like to point out,” she told the Roswell auditorium – packed 5-1 with opponents of the proposed project – in a tone dripping with ill-concealed condescension, “spent nuclear fuel is not a liquid, it can’t ‘leak’.”
Opponents cite a number of disquieting facts, which call Heaton and Russell’s confident public relations assertions into question.
Halt Holtec!
A group of New Mexico and Texas organizations, including the Nuclear Waste Study Group, the SEEDS Coalition, and Alliance For Environmental Strategies, started a ‘Halt Holtec’ campaign. They toured an inflated, scaled-down model of the kind of transport cask proposed by Holtec that would carry thousands of shipments of highly radioactive waste shipments through the nation’s towns and metropolitan areas on dilapidated highways, bridges and railway lines for the next 20 years or more.
One significant result of their campaign is that on Monday, May 21, the Albuquerque City Council, in a 4-3 vote, approved what it called a ‘memorial’ against the transportation of nuclear waste through the Albuquerque metropolitan area.
Similar measures by other municipalities and counties along the potential shipment routes around the country are in the works.

‘Strange Bedfellows’
The Halt Holtec Campaign has quickly gathered strong momentum surprising both to its organizers, and the Holtec dump proponents, whose claim of ‘wide-spread regional public support’ has been totally debunked by the turnout in opposition to the project. Public statements have so far run 5-1 ‘against’ the proposed site in all five New Mexico NRC meetings.
At the recent series of NRC community meetings, this opposition was strong from a wide cross section of New Mexico and Texas demographic sectors, including Native American Tribes, growers, ranchers, the Jewish and Christian faith communities, and the powerful oil and gas fracking industry.
A regional leader of that booming industry is the Fasken Oil and Ranch company, which has been in business since 1913. Their representative, Jimmy Carlisle, explained his company’s position to the visiting NRC officials.
I work for Fasken Oil and Ranch based in Midland. We are an oil and gas company, but we also are a major landowner in the State of Texas.
We own some 200,000 net acres in the State of Texas. Our largest ranch is a 165,000 acre contiguous ranch just north and west of Midland.
The WCS site definitely comes into play in this discussion. The Holtec side, however, has the same issues … groundwater issues.
On our ranches [we depend on] everything we look at: we look at vegetation, we look at soil characteristics, we look at moisture in the soil, but the thing we watch the closest is the quantity and the quality of our groundwater.
Our company is the first one really in West Texas that made the determination to get off of use of fresh water in our drilling and fracking operations and we started recycling produced water and using brackish water as a result.
So we believe firmly that the freshwater issue is a major significance that has to be addressed.
Stressing that the State Engineer’s Office lacks definitive maps of the ground water aquifer locations in New Mexico, Carlisle told the NRC panel, “We’re not alone in this fight.”
Explaining that it had taken ‘less than two hours to get four letters of opposition from major landowners in West Texas, Carlisle concluded,
Groundwater, folks, is the lifeblood of the ranching business. If you don’t have groundwater you’d just own dirt. Think about that for a second.
The bottom line is we believe that this [Holtec] application and the WCS application need to be withdrawn.
A group letter from oil industry representatives to Holtec warned that Holtec and the Eddy-Lea Alliance would ‘need more money than God’ to compensate them if their project damaged the thriving drilling industry in the oil- and gas-rich Permian Basin, which is currently on pace to become the world’s most booming region of petroleum production.
“I don’t intend to let this thing run over us.”
Randy Prude, an influential county commissioner from Midland, Texas, told the Roswell NRC meeting that he had spent $2000 of his own money to fly Fasken representative Jimmy Carlisle and other opposition speakers to the event.
“I intend to organize all the ranchers and all the commissioner’s courts and everybody in all the governments in all this whole region,” Commissioner Prude went on.
I will tell you, I am an odd duck, I am a Republican — (Laughter) and this is not a Republican or a Democrat issue, this is an important issue to all of us….
I just cannot tell you the horror that could happen if we ever have an accident. And so I intend to organize all of our governments that are willing to listen….
I am going to get to all the ranchers and all the ranch oil men to contact their commissioners and their mayors and their representatives, house representatives, senators, and so forth, and I don’t intend to let this thing run over us.
The Permeable Permian
The contentions by dump proponents that the Eddy-Lea/Holtec site is ‘dry and seismically stable’ were repeatedly debunked by facts presented by opposing speakers.
Activists visiting the site, despite Heaton’s attempts to stop them, discovered clear signs that it contains a ‘playa,’ where seasonal rain water collects, feeding the ground water deposits and aquifer below.
The region’s most famous tourist attraction – the Carlsbad Cavern – was formed by such a subterranean body of water, the Capitan Reef Aquifer.
“It’s hard to think of a worse place to choose for placing an interim waste site,” consulting geologist Dr. Steve Schafersman told the meeting.
The area is surrounded by aquifers, some close, some far. The sediments and the sedimentary rock are porous and permeable. The thin barrier they claim is on the top is not sufficient. It’s just like the WCS site, which is really no better. So this is not a good place to put a hazardous waste site, especially one for nuclear waste.
There are soluble rocks below the site, limestone and rock salt. There is karst limestone in the area, which is a soluble limestone that develops caverns, the caverns collapse and sinkholes develop.
It is conceivable that a sinkhole would collapse and take down the depository with it, which would be a terrible, colossal tragedy. In addition there is the soluble Salado formation below that.
In West Texas unplugged wells carry fluids to this formation, the salt dissolves, and sinkholes develop. This is a matter of fact.
An Earth-Shaking Announcement of Seismic Significance
Several of the opposition speakers referred to a recently-published, peer-reviewed study in the March 16, 2018 issue of Nature, with the catchy title, ‘Association between localized geohazards in West Texas and human activities, recognized by Sentinel-1A/B satellite radar imagery.’
The study by Southern Methodist University geophysicists Jin-Woo Kim and Zhong Lu reported literally earth-shaking findings.
It showed that, in the last two and a half years, large sections of the four Texas counties they studied, spanning a 4000-square-mile area, had shown ‘vertical deformation,’ that is, sunk or uplifted as much as 40 centimeters or nearly 16 inches.
“The ground movement we’re seeing is not normal. The ground doesn’t typically do this without some cause,” said co-author Zhong Lu, a recognized global expert in satellite radar imagery research.
“These hazards represent a danger to residents, roads, railroads, levees, dams, and oil and gas pipelines, as well as potential pollution of ground water,” Lu declared.
Co-author Jin-Woo Kim notes that, “This region of Texas has been punctured like a pin cushion with oil wells and injection wells since the 1940s and our findings associate that activity with ground movement.”
In fracking, liquid is injected into bore holes under pressure, then extracted, causing uplift while the wells are in operation, and subsidence when they are abandoned.
The researchers’ Nature article states,
… the rapid subsidence is likely induced by the freshwater impoundments from the nearby abandoned wells. During our field trip, we observed numerous recent ground fissures…. These growing fissures can allow the rainwater to swiftly flow down to the Salado formation and promote the dissolution of the salt layers. [ Thus causing subsidence. ]
Although their analysis focused on just that one 4000-square-mile area, Kim says, “We’re fairly certain that when we look further, and we are, that we’ll find there’s ground movement even beyond that.”
The area they’ve studied so far lies just adjacent to the two proposed storage sites in New Mexico and Texas.
The Oil Drilling and Fracking Connection – Oil & Nuclear Waste Don’t Mix
Evidence of the links between oil and gas extraction and earth movement are clear. Researching an unprecedented swarm of earthquakes in Oklahoma and Texas, a 2016 Stanford University study published in Science found a direct connection between a quake series in Texas in 2012 and 2013, which included the largest on record, and the high volume injection of wastewater into oil and gas fracking wells that happened between 2005 and 2007. The high pressure forced water into fault zones and triggered the subsequent quakes, the study showed. Read more
One of the people Commissioner Randy Prude flew in to speak at the Roswell meeting was Cody Rogers. “I am an ex-Navy nuke,” he told the NRC. “I have operated nuclear reactors for eight years. I am a huge proponent of nuclear power. I think we need it. We have 99 operating nuclear reactors. We do not have anywhere to dispose of the spent fuel. This is a major, major problem and we have to fix it.
“I know we need a site” Rogers told the group. But the Eddy-Lea/Holtec site, he said emphatically, “is not it.”
“We [the U.S.] are on the cusp of being the world’s largest energy producer, okay. We are going to control oil very soon. We are going to control our own destiny. So West Texas is one of the most valuable places in the world right now, especially in the United States, and, because of this I implore you to look up the study from SMU. West Texas is sinking… fast!
“I know we need a site. This is not it. If this thing sinks and we get something like the WIPP accident, that was never supposed to happen, the environmental impact is forever, and if we lose West Texas oil, natural gas, the people of Roswell, the people of New Mexico, the people of Texas, the United States, we’re done.
”We’re not going back to Saudi Arabia and getting their oil. We need independence and this site is sinking and I truly believe that we need to look at that and study its environmental impact.”
Reputations and Rap Sheets
Opponents stress that entrusting the economic and environmental future of this area to companies with corporate histories like those of Holtec and Waste Control Specialists is a highly risky proposition.
Growth Industry
With aging reactors closing down around the country in an accelerating cascade – and with no ‘national permanent geological repository’ for their accumulated SNF in sight – decommissioning and radwaste storage are on pace to become major growth industries for some time to come.
Holtec’s visionary head Dr. Krishna Singh is positioning his huge company, based in Camden, New Jersey, to dominate both industries, as well as to be a leader in the manufacture of small modular reactors (SMRs), the failing nuclear energy industry’s latest bid for survival.
Back in October 2010, based on the results of a criminal investigation of bribery, conducted by its Office of Inspector General (OIG), the Tennessee Valley Authority (TVA) debarred Holtec International, Inc. for sixty days. And fined it $2 million.
According to a TVA document,
Holtec agreed to pay a $2 million administrative fee and submit to independent monitoring of its operations for one year. The TVA Board’s Audit, Risk, and Regulation Committee and TVA management fully supported the OIG’s recommendation to create a suspension and debarment process and submit Holtec to that process. TVA’s Supply Chain organization and Office of General Counsel worked collaboratively with the OIG to achieve this milestone in TVA history. Why wasn’t the company permanently debarred? A subsequent Department of Justice document seems to suggest that a TVA employee may have been bribed by Holtec to falsify a financial disclosure report. Read more.
Meanwhile, just miles away on the other side of the state border in Texas, Waste Control Specialists (WCS) and its new French partner Orano each have their own checkered pasts.
WCS was founded in 1989 as a landfill company by Texas billionaire Harold Simmons, who controlled it until his death in 2013. During that time, Simmons used his financial muscle and political connections to morph the site into a licensed low level waste dump with some highly questionable maneuvers.
His generous support for then Texas Governor, now Energy Secretary Rick Perry, no doubt eased his path. Critics allege that “Radioactive Rick” Perry appointees at key regulatory agencies bent rules on WCS’s behalf, including the Texas Water Development Board’s altering of maps showing that Simmons’ waste facility is located over part of the Ogallala Aquifer, which underlies and supplies drinking and agricultural water for eight western bread basket states. Another water body, the Dockum Aquifer lies nearby as well. Many Texas environmental officials resigned in protest.
For its part, WCS’s new partner Orano, parent company of Orano USA, is a recent reincarnation of the radically reorganized French government-owned struggling reactor maker AREVA, after years of business losses brought it to the brink of bankruptcy.
These are the strange bedfellows hoping to profit from the nuclear energy industry’s decline by making New Mexico’s ‘nuclear alley’ America’s de facto radioactive waste repository for the foreseeable future.
There are several things wrong with this scenario, not the least of which, as noted, is that poor and minority residents make up a large portion of the population in and around ‘Nuclear Alley.’
Until and unless the existing Nuclear Waste Policy Act is changed by currently proposed, but not yet enacted legislation, licensing of these CIS sites will be illegal. This is because the Act requires that a permanent repository is approved before any consolidated interim storage site can be licensed.
If the NRC were to license the sites without a central repository being established, they would likely become in effect the national dump, because utilities would probably stop lobbying for – and lawmakers could be less inclined to authorize funding for – establishing a central repository.
If that happens, thousands of shipments of deadly radioactive waste will be moving daily along rail and truck transportation corridors, through our nation’s population centers, for decades to come.
A Shell Game of Nuclear Russian Roulette on Wheels
Eddy-Lea/Holtec project proponents are fond of citing the transport record claimed by the Navy, which proudly states that it has been shipping both new and used nuclear fuel cross-country by rail for over 60 years without mishap.
However the Navy admits that, “All shipments [are] classified (security) and invoke the Department of Transportation (DOT) National Security Exemption (49CFR173.7b).” It claims that 850 spent fuel containers have been safely shipped from March, 1957 to the present.
However, no radioactive labels and placards are ever used in these boxcar and flatcar shipments, and there is no advance notification given to authorities along the route, so reports of any incidents that may have occurred would also be classified – secret for ‘security reasons.’
Those 850 shipments over 6 decades are far fewer than the estimated 17,000 shipments it would take to move the projected 173,000 metric tons of radioactive SNF from US nuclear plants to the Eddy-Lea/Holtec site across the entire lower 48 states in the coming years.
Government documents show that other details of Navy shipping methods make them significantly different than those anticipated for the Shimkus Bill’s proposed nation-wide rail, highway and barge transport network:
+ Transport has been along only one specific rail route;
+ The Navy uses a different containment system than the Holtec transport cask;
+ Each Navy transport cask holds just 1/10th of what is planned for each Holtec spent fuel canister.
Itemizing Nuclear Transport Risks
Kevin Kamps from the Washington DC-based group Beyond Nuclear traveled to New Mexico to show his organization’s solidarity with the Halt Holtec movement and to share knowledge gained from a professional life spent campaigning for nuclear safety.
His hand-out list of the documented high risks involved in transporting highly radioactive irradiated nuclear fuel, whether by train, truck, or barge, on rails, roads, or waterways included “high-speed crashes into immovable objects, like bridge abutments, or high-temperature long-duration fires, or long-duration underwater submergence.”
“Intentional attacks,” he warned, “such as by anti-tank missiles or shaped charges, could also breach shipping containers and release their contents into the environment.”
Since Holtec has claimed in its license application that any and all NRC certified canisters can be accommodated at this facility, Kamps explained, not only rail-sized shipping containers must be worried about, but also legal weight limits for the truck casks which would travel on interstate highways throughout the country.
“X-Ray Machines that can’t be Turned Off”
Contrary to Holtec VP Joy Russell’s reassurance that, since spent fuel shipments aren’t liquid, “they can’t leak,” all shipments would emit dangerous gamma and neutron radiation for several yards in every direction, dissipating with distance. Because of the large expense and added weight necessary to provide shielding against these gamma and neutron emissions, the NRC has set ‘allowable’ limits.
“But,” Kamps reminded the meeting, “Allowable does not mean safe. Any exposure to ionizing radioactivity carries a health risk, and these risks accumulate over a lifetime.”
According to NRC guidelines, at six feet away from the container’s exterior surface, a dose rate of 10 millirem per hour is allowed – about one to two chest x-rays’ worth per hour.
At the exterior surface of the container, the allowable dose rate increases dramatically to 200 millirem per hour. That’s 20 to 40 chest x-rays’ worth.
But workers, such as truck drivers, locomotive engineers, inspectors, security guards, and the like, who come in very close physical proximity into the shipping container would be exposed to the highest radiation dose rates.
Even innocent passersby and bystanders in the general public would also be exposed, including those who live close to transport routes exposed to large numbers of shipments going by over time.
Some people, Kamps noted, such as pregnant women, should not be exposed to any radiation dose that can be avoided due to the high risk of harm caused to the fetus in the womb.
He reported that the state of Nevada, based on federal government data, has documented 49 incidents of accidental surface contamination on these highly radioactive waste shipments between the years of 1949 and 1996.
And in France, Areva Corporation has had many hundreds of externally contaminated shipments, a full one-quarter to one-third of all shipments bound for the La Hague reprocessing facility. On average, these French contamination incidents emitted 500 times the allowable radiation dose rates. One even emitted 3,300 times the allowable dose rate.
De Facto National Dump in Disguise?
But, perhaps the greatest danger to be considered by New Mexicans, Kamps, warned, is the “question of temporary versus permanent.”
This is the danger, Kemps says, of so-called centralized or consolidated interim storage facilities becoming actually de facto permanent surface storage parking lot dumps.
Holtec-ELEA have applied for a permit to NRC to store irradiated nuclear fuel here for 40 years. But this time period could, as they admit, be extended to 120 years.
But, Kamps’ research shows that, on page 12 of a January 27th, 2017 report that Holtec prepared and submitted to the U.S. Department of Energy’s Andrew Griffith over company Vice President Joy Russell’s signature, Holtec’s response to the DOE request for proposal on centralized interim storage, stated that “the CIS should have a minimum service life of 300 years.”
“How can 40 years be called temporary, let alone 300?” Kemps asked the gathering. “That’s longer than the United States has been a country.”
“So, just to end with some political reality,” he said, “If this waste comes out here, it would turn out to be one New Mexico member of the United States House of Representatives versus 434 others for it to ever move again. And in the U.S. Senate it would be a vote of 98 against 2.”
“So,” Kemps concluded, “folks had better think about this deeply before it’s allowed to come out here.”
‘Chernobyl in a Can’
Expanding on the theme of transportation risks, EON producer, Mary Beth Brangan pointed out that “Every one of these canisters that would be coming would contain roughly as much cesium alone, as was released in the Chernobyl accident. Every canister. […]
“My partner and I are here,” Brangan told the meeting, “because we’re very, very concerned about this. And I want to assure you there are other Californians who do not want to send their radioactive waste here.
“We don’t want to do that for a great many reasons but the first one is its environmental racism, and we really object to the concept of putting anymore of the burden of the nation’s radioactivity on your communities,” she said to appreciative applause.
We were not the only concerned Californians who came to the NRC’s New Mexico scoping meetings to say, “We don’t want our radioactive waste dumped on you.”
Another was Southern California urban planner and community organizer Torgen Johnson, whose efforts helped shut down San Onofre’s reactors. He flew in to the Albuquerque meeting to show support for the Halt Holtec Campaign and network with regional organizers.
“The New Mexico people hammered Holtec and the NRC,” he reported. “They didn’t need our help, but they welcomed our solidarity. It was so great and encouraging to hear these well-informed, passionate and articulate people expressing the same concerns we have at the other end of the potential rail line.”
Johnson says he heard testimonies from down-winders of the 1945 Trinity test with long, tragic family histories of cancer and health impacts. Being among them, he says, deepened his understanding of the human rights, social justice and environmental issues at stake, and his commitment to continued public education about them.
What impressed him, he says, is the realization of the “Link between the low income, red and brown people in New Mexico and wealthy white people in Southern California – both being victimized by the plans and decisions of Holtec and the NRC.”
“Its a representative cross-section of America” he says, “united against the onslaught of the nuclear waste disposal industry.”
Sharon and Ace Hoffman, whose efforts had also contributed to the shutdown of the San Onofre nuclear plant, attended several of the meetings to share their experience and voice their solidarity with the Halt Holtec movement.
“We are very happy that San Onofre is closed,” Sharon Hoffman said. “It is a really bad place for the waste. But that doesn’t mean that we solve the problem by moving it to a different place. We have to look at the transportation. We are talking about moving the most dangerous stuff on the planet all over the country. And if we moved it all today, we would have more tomorrow.
“So the real question here is, when are we going to shut down all these plants and stop making more waste? That’s really the problem.
“This is a beautiful place,“ she concluded. “And it might be contaminated forever. This is not something that you want to take on for the rest of the country. Yes, you can help the rest of the country. You can say, stop making this, and then let’s figure out together the best thing to do with what is left.”
“I am a stakeholder,” Ace Hoffman told the assembly. “I am from Carlsbad. Not Carlsbad, New Mexico; Carlsbad, California, which is about 15 miles as the crow flies, or the plutonium flies, from San Onofre. So it was very important to me that we do something about this waste.”
Based on his experience of the NRC’s actions during the controversy about shutting down San Onofre, Hoffman warned his New Mexico counterparts, “don’t expect anyone to be telling you the truth about what is possible or what is going to happen. And I strongly advise — even though I would love to get rid of the waste, and I would love to find a sucker that will take it — don’t be that sucker.”
From the Mouths of Babes…
But it was the little daughter of artist and prominent Halt Holtec campaigner Noel Marquez who perhaps best summarized New Mexico’s majority view that emerged from the 5 meetings held around the state on the Elea-Holtec proposed dump site.
When the moderator, Chip Cameron offered to hold the mike for her, she responded, “I can hold it myself. Thank you.”
Handling the mike with confident ease, she continued, “My name is Pakeia Marquez and I am 11 years old. I’m here on behalf of unborn kids and born kids like me. I think this whole situation is very important because it affects everything and everybody. It affects the plants and wildlife around here.
“I have recently been writing an essay about ecosystems. I read that ecosystems can be very easily poisoned through water, air, and soil. Water, if all this radiation leaks into the water, everything that’s living needs water. It’s going to suck up all of that, and it’s going to get poisoned. Who is going to, like, you know, reimburse us for it?
“You may think you might be solving a problem, but really you’re just creating more problems to solve, and they might just be forever, and you might just not be able to solve them.
“Please remember that I cannot vote,” she told the NRC officials. “So please do vote against this horrible mistake. Thank you.”
The applause was loud and long as Pakeia Marquez made her way back to her seat.

Trinity 70 Years On… the Nuclear Horror Still Haunts

America’s New Mexico state saw the birth of nuclear weapons 70 years ago at the Trinity test site, where the world’s first ever atomic explosion occurred. That was on July 16, 1945. Less than one month later, the bomb was dropped on Japanese cities Hiroshima and Nagasaki wiping out some 200,000 lives in an instant.
Now the American state is grappling with the sinister problem of trying to bury seven decades of nuclear waste from America’s military-industrial complex. In many ways, the horror of nuclear weaponry still haunts the very place where it was first unleashed.
US federal and state politicians are planning to make New Mexico the permanent burial site for highly radioactive waste materials that up to now have been kept in temporary storage at other locations across the country, such as at Hanford in northwest Washington state where the nation’s main facility for producing plutonium and uranium for nuclear weapons is located.
There is, to be sure, strong opposition among various community groups and activists, who deplore the plans to scale up New Mexico’s nuclear-waste dumping. They point to an already heavy burden of environmental and public health toxicity in NM that includes not only fallout from the original Trinity test site, but also from Los Alamos Laboratories where the atomic bomb was conceived under the Manhattan Project during the 1940s, as well as from scores of uranium-ore mines, and an existing low-level nuclear waste site.
But the anti-dumping campaigners are up against the formidable US military-industrial complex and what they call a «genocidal ideology» in the east coast Washington political establishment. If plans go ahead, as seems likely, New Mexico will become the sole depository for the most dangerous of all radioactive waste in the US.
Randy Martin is one of the community campaigners trying to prevent the scaling up of nuclear-waste dumping in NM. He has been an activist on the issue for over 30 years. Some of his family relatives who had farms near the Gnome site – another disastrous nuclear-explosion test area hatched on the backs of natives and locals – succumbed to cancers and other diseases, which he believes were caused by the subsequent radioactive fallout. He reckons that thousands of people in New Mexico have been affected by inter-generational nuclear contamination.
«The trouble is that New Mexico has been enslaved to the military-industrial complex», says Martin. «Our relationship to the industry is from the cradle to the grave. This is where nuclear weapons technology was created and tested, and now we are being left with the task of burying its toxic waste».
One of the biggest advocates for the expanded waste facility in New Mexico is Republican state governor Susana Martinez. Martinez is touted to have ambitions of becoming a future vice-president in the White House. The plan is to take in high-level spent radioactive materials from all over the country, including fuel rods and bomb cores, in an expansion of an already existing low-level waste site located at Carlsbad – about 200 km from the Trinity site.
Advocates for the expansion of nuclear-waste dumping in New Mexico appear to have a strong suite of arguments in their favour. The state is one of the poorest in the whole of the US; therefore the development beckons jobs and a boost to local government coffers. There is also a onerous psychological pressure on communities to be «patriotic» in helping to serve the nation’s military. Moreover, since the Second World War, New Mexico has become so entwined with the US military that it seems extremely difficult to live without it.
The state hosts the biggest weapons testing and training sites in the whole country at the White Sands Missile Range covering 8,300 sq. km of desert at the foot of the San Andreas Mountains. The vast area encompasses the Trinity test site. There are also numerous other military bases dotted all over the state. Consequently, much of the civilian sector, even if it is not formally connected to the military, has a preponderant economic dependence on it. The argument that whatever is good for the military is good for New Mexico is a hard one to rebut. That makes it difficult for communities to oppose the plan to accept military nuclear waste even if there is an apprehension about contamination risk. Many livelihoods are at stake by not accommodating the Pentagon.
Indeed campaigners say there is a sinister, but subtle, social atmosphere that pervades the state, whereby open criticism of the environmental and public health impacts from the Pentagon’s activities is frowned upon. That creates a climate of conformity and self-censorship. Jobs and contracts can be lost on a sly say-so.
Furthermore, there is a dearth of official data on the fallout from nuclear activity in New Mexico. Incredible as it might seem, it was only last year that the federal government finally launched a comprehensive epidemiological study into the possible health impact of the Trinity atomic test – some 70 years after it took place. So up to now, no-one was too sure how deleterious that explosion was to local populations, although there is ample anecdotal evidence of high rates of cancer and other environmental impacts.
That lack of impact-data makes it difficult to mount an effective campaign against the latest plans to scale up nuclear dumping.
However, there are warning signs. Last year, there was a serious radioactive leak at the existing waste site at Carlsbad, which resulted in contamination of some dozen workers at the plant. Yet the same facility is now being lined up to take in much greater quantities of higher-level spent radioactive material. The new waste is to be stored in vast underground caverns mined from the salt-rock terrain.
Advocates for the site claim that the geology provides a safe natural deposit. But given that the waste material represents a toxic lifespan of thousands of years it is a worrying assumption that leaks will not occur from future geological events. The New Mexico waste site lies perilously above the Delaware Basin that serves as the only fresh-water source for communities in the region and is a tributary to the Rio Grande River, which outflows to the Gulf of Mexico, potentially affecting millions of lives all along the US-Mexican border.
Campaigners against nuclear-waste dumping point out that the Soviet authorities acted with much greater alacrity to the fallout of the 1986 Chernobyl disaster compared with their American counterparts over New Mexico’s decades-old concerns. Following Chernobyl, medical surveys were carried out to assess human health impacts, and the then Soviet government enacted compensation payments to victims and families. In contrast, the US federal government has tended to suppress investigations into the legacy of nuclear activity in New Mexico, and has been reluctant to provide financial compensation for those allegedly affected by it. The pervasive dominant role of the US military in the state tends to further suppress any public criticism and calls for accountability.
The historical background of colonial conquest is another telling factor. New Mexico was long considered by the Washington establishment as backward «Indian territories». The modern state of New Mexico was only formed in 1912. Prior to that it was known simply as «The Territories» – a vast borderless hinterland populated by native American tribes. The Apache Wars were being waged by the newly formed United States up to the late 1800s – only 70 years before the Trinity test explosion occurred in 1945. During those wars, the Apache tribes were among the last native Americans to be conquered in brutal campaigns of extermination.
It is no coincidence then that the «worthless deserts and conquered people» of New Mexico would be later selected by the Washington establishment as the test site for the first atomic weapon. It must be recalled that even the scientists of the Manhattan Project were not sure whether the nuclear explosion would result in a catastrophic atmospheric reaction within New Mexico and surrounding US states.
Randy Martin, the campaigner, says that horrific atomic experiment at the Trinity site in 1945 was born out of the «genocidal mentality» that the Washington government retained from the earlier conquest of native American tribes.
«That genocidal mentality persists to this day», says Martin. «The United States government and its military-industrial complex unleashed the horror of nuclear weapons in this part of the country because they saw it as a conquered territory containing conquered people. Today, the Washington establishment and its ilk still view New Mexico as a place where they think nuclear problems can be buried and forgotten».
Under the Obama administration, the Pentagon has received a budget of over $350 billion to upgrade the US arsenal of nuclear weapons over the next decade. Some observers have discerned that this nuclear resurgence under Obama is emblematic of a new Cold War with Russia and other perceived global rivals. Notwithstanding the facts that Obama was awarded the Nobel Peace Prize in 2009 in part supposedly for nuclear disarmament, and that the US is obligated to totally disarm under the Nuclear Non-Proliferation Treaty that was signed 40 years ago.
Under Washington’s renewed nuclear arms quest, Los Alamos Laboratories in New Mexico has been assigned to replace plutonium cores in nuclear weapons with new fission devices. That inevitably means much greater volumes of nuclear waste will be dumped in the deserts of New Mexico.
Seventy years after Trinity, New Mexico is still being used in a pernicious nuclear experiment by the Pentagon. The toxic waste might be buried underground, but the horror lives on.

Nuclear Radiation Releases Continue in New Mexico
Something Happened in February, Something is STILL Going On

Environmental radiation releases spiked again in mid-June around the surface site of the only U.S. underground nuclear weapons waste storage facility near Carlsbad, New Mexico. The facility, the Waste Isolation Pilot Project (WIPP), has been shut down since February 14, when its isolation technology failed, releasing unsafe levels of Plutonium, Americium, and other radio-nuclides into the environment around the site.
Radiation levels in the underground storage area, 2,150 feet below the surface vary from near-normal to potentially lethal. At the time of the February accident, more than 20 WIPP workers suffered low level radioactive contamination, even though none of them were underground. WIPP assumes, but cannot confirm, that underground conditions have not changed since May 31, when the last entry team went into the mine, as reported by WIPP field manager Jose Franco on June 5:
As I noted in my previous letter, we have identified the damaged drum believed to be a contributing source of the radiological release. On May 31, an entry team was able to safely and successfully collect six samples from a variety of locations in Panel 7 of Room 7, including from the breached drum and a nearby standard waste box. These sample results are consistent with the contamination previously identified.
In mid-March, WIPP suffered a surface radiation release almost twice the levels released in February. WIPP was designed to isolate highly radioactive nuclear weapons waste from the environment for 10,000 years. It went 15 years before its first leak of radioactivity into the above ground environment.
The latest elevated radiation levels were detected by monitors placed by the New Mexico Environment Department (NMED). The monitors measure radiation only after it has passed through the WIPP filtration system that is designed to minimize radiation from escaping from the storage area half a mile underground. Radiation levels in the storage area where the original leak occurred are possibly as lethal as Fukushima, hampering efforts to determine the source, cause, and scale of the February leak.
What happened underground remains a mystery and a danger
More than five months after the February accident, officials still have no certain understanding of what went wrong. It is generally thought that one 55 gallon drum of waste (perhaps more than one) overheated and burst, spilling radioactive waste in a part of the storage area known as Panel 7, Room 7. This room, designated a “High Contamination Area,” measures 33 by 80 feet and presently has 24 rows of waste containers. The room holds 258 containers, tightly stacked and packed wall-to-wall, with no aisles to allow easy access. There is some clearance between the top of the stacks and the room’s ceiling.
The high contamination in Room 7 is a threat to human inspectors, limiting inspection of the room to date to mechanical means, primarily cameras on extension arms. As a result of these limitations, WIPP teams have inspected only ten of the 24 rows of waste containers in Room 7. Rows #1-14 have been out of reach of the available equipment.
WIPP has begun building a full scale replica of Room 7 above ground, to provide a realistic staging area in which to test methods of remote observation that might reach the 14 uninspected rows. According to WIPP:
Options include a device that uses carbon fiber rods to extend the camera, a gantry camera suspended on wires, or a boom system mounted on a trolley that would move across the waste face from wall to wall and out 90 feet to view all rows of waste.
WIPP has spent much of June improving the air filtration system to the mine, adding filters that reduce escaping radiation and improving underground air flow for the sake of entry teams. WIPP suspended underground entries on May 31, apparently to improve safety conditions. Reporting on June 18, field manager Jose Franco wrote:
Since the radiological event, we have safely entered the underground facility nearly a dozen times. Each time, we learn more and we use those discoveries to refine our tasks moving forward. Our entry teams have identified a breached container and we are using all of the resources at our disposal to find the cause.
No one is more eager than we are to determine what happened and return to normal operations.
Nuclear waste in Los Alamos puts National Lab at risk
“Normal operations” in the past included accepting thousands of waste-filled containers from the Los Alamos National Laboratory (LANL), which is under a June 30 legal deadline to clean up its above ground and shallow underground waste that has accumulated since the 1940s when Los Alamos scientists were building the first atomic bombs.
The contractor packaging LANL waste into containers made a change a while back, substituting organic kitty litter for the standard inorganic product. More than 500 containers with organic kitty litter have been prepared, 368 of them already stored underground at WIPP. One frequently cited theory (promoted by a WIPP booster) is that one or more of these containers underwent a chemical, heat-generating process because of the organic kitty litter and that reaction caused the container to burst.
The rest of these containers with organic matter are temporarily buried at a West Texas site or remain on the LANL property. They are under constant watch and reportedly none have failed to date.
Los Alamos has been under pressure to clean up its radioactive waste for years, if not decades. But it took the approach of wildfires to the LANL waste site for the laboratory to enter into a binding agreement with the state Environment Department to remove all the waste it has accumulated. As the June 30 deadline approached, LANL again asked the state for an extension of the deadline, saying there wasn’t enough money in its federal budget to comply with the court order.
In the past, the state had granted an extension more than 100 times. This time New Mexico said no. That will subject LANL to further sanctions, including fines.
Lawsuit over state-approved high-level waste containers
Almost two years ago, after the state approved new containers for use at WIPP without holding a public hearing on the application, the Southwest Research and Information Center (SRIC) sued to block the containers from coming into use. In the Center’s view, these new, shielded containers were less robust than containers already in use for highly radioactive waste. That issue should have been considered at a public hearing, SRIC argued at the time:
The Appellants and approximately 200 individuals requested that the request to modify the state’s WIPP permit be subject to a public hearing because of the dangers posed by RH [Remote Handled] waste, the technical complexity of handling RH waste at WIPP, and the substantial public interest in the request. NMED ignored those comments and approved the Department of Energy (DOE) request despite the fact that the state agency had in December 2011 and January 2012 rejected virtually the same request.
Remote Handled (RH) waste is so designated because radiation levels are too high to allow close personal contact, so the waste must be handled by remote-controlled machinery. About 10 per cent of WIPP waste is Remote Handled.
In December 2012, NMED had publicly announced a public hearing on the new container issue. The department rescinded the hearing notice four days later, without explaining the change.
The New Mexico Appeals Court heard closing arguments in the case in July 2013, but had not rendered a decision at the time of the February 2014 accident at WIPP.
On June 26, the court held a further hearing to consider whether the radiation release at WIPP was relevant to the use of the new, high-level waste containers. As reported by the New Mexican, this case has a number of anomalies:
The Environment Department said in an email that the shielded containers can be transported in fewer shipments, and the process is quicker and significantly reduces the dosage rates of radiation from the drums.
Moreover, although the department doesn’t know who manufactures the shielded containers, their safety has been vetted by the Nuclear Regulatory Commission and the Environmental Protection Agency….
Regulators and the nuclear watchdog group hope the judges will make a decision sooner rather than later. Even though WIPP is closed for now, a whole lot of highly radioactive waste has to be packaged into containers for temporary storage until shipments resume.
Investigations rampant, answers scarce
On June 16, four months after the radiation release from WIPP, the Department of Energy (DOE), announced its “decision to conduct an investigation into the facts and circumstances associated with potential programmatic deficiencies in the nuclear safety, radiation protection, emergency management, quality assurance, and worker safety and health programs revealed by the February 2014 fire and radiation release at the Waste Isolation Pilot Project.”
Currently there are at least nine investigations into WIPP’s failure, including DOE, which operates the facility largely through private contractors. A few days later, a DOE attorney told the New Mexico Court of Appeals that “Nobody is contemplating a closure of WIPP,” but that WIPP is unlikely to reopen until 2016 at the earliest.
In March, Don Hancok of SRIC published a piece listing questions that were then unanswered:
* What caused the leak?
* How much leaked into the underground salt mine?
* How much leaked into the environment?
* Where are those radioactive and toxic wastes now?
* To what amount of radiation were the workers exposed?
* What are the health effects for those workers?
* What decontamination is necessary in the underground mine?
* What decontamination is necessary on the WIPP site and surrounding area?
* If WIPP reopens, what changes in the operation, monitoring, and safety culture will be implemented?
On June 25, Hancock published another piece in the same online magazine, La Jicarita, pointing out that the questions of March all remained unanswered in June.

U.S. Nuclear Waste Dirty-Bombs New Mexico with Plutonium

It was Valentine’s Day when the nation’s only radioactive nuclear waste facility first released radioactive particles including Plutonium and Americium into the atmosphere of New Mexico and beyond, including Texas, Oklahoma, and Mexico. Earlier that same day, the New Mexico Environment Department opened the public comment period on an application to modify and expand that nuclear waste facility, which the department said it planned to allow.
The first thing the U.S. government and the government contractor running the supposedly secure radioactive waste project did immediately when faced with the first-time-ever release of radioactivity from the underground site was – not tell anyone, anything. They told no one the truth for four days, even though the truth didn’t seem all that bad, as such things go. Unless contradictory data emerged, this would seem to be a brief release of a relatively small amount of very dangerous isotopes from nuclear weapons waste stored half a mile underground in a salt deposit. While the full scope of the release remains unknown weeks later, it seems clear that this was no Fukushima, except for the operators’ default to instant deceit.
The next day, February 15, 2014, the U.S. Dept. of Energy, which is responsible for the project issued “Event News Release No. 1,” a reassuring press release about “a radiological event” (not further defined), misleadingly stating that “a continuous air monitor detected airborne radiation in the underground” (NOT a release into the air). [emphasis added]
The press release expanded on its false reassurance by saying: “Multiple perimeter monitors at the [facility’s] boundary have confirmed there is no danger to human health or the environment. No contamination has been found on any equipment, personnel, or facilities.” No one was exposed, the press release implied, and added further details to reinforce the “no danger to human health or the environment” claim that is so often the first thing the nuclear industry says about any “event,” regardless of what people may or may not know to be true. Other press releases maintained this official story for several days.
Nuclear industry lies are rational in terms of protecting interests
According to that story, “there were no employees working underground at the time,” and the 139 employees at the surface had to be “cleared by radiological control technicians” and test negative for contamination before they were allowed to leave the site, something of an odd precaution for radiation that was reported only underground. The official story did not mention that the underground part of the facility had been closed down for the previous nine days, since February 5, when a 29-year-old salt truck had caught fire, forcing the evacuation of all 86 employees then working underground.
To be fair to the folks running the underground nuclear repository, which bears the anodyne name Waste Isolation Pilot Plant (WIPP), when the continuous air monitoring system first detected radioactivity being released on February 14, 2014, the system automatically shut down air exchange with the outside, at least according to the U.S. Dept. of Energy (DOE), which describes the facility this way:
“WIPP, a cornerstone of DOE’s [nuclear waste] cleanup effort, is the nation’s first repository for the permanent disposal of defense-generated transuranic radioactive waste left from research and production of nuclear weapons. Located in southeastern New Mexico, 26 miles east of Carlsbad, WIPP’s facilities include disposal rooms excavated in an ancient, stable salt formation, 2,150 feet (almost one-half mile) underground. Waste disposal began at WIPP on March 26, 1999.”
The waste isolation mine was designed to last 10,000 years without leaking. As of 2014, WIPP had more than 1,000 employees and a $202 million annual budget.
Among the details that remain unclear about this WIPP accident are how long it took the system to detect the release and how much Plutonium and Americium were released. The government’s initial position was none. That wouldn’t last long.
On February 17, the Carlsbad Environmental Monitoring and Research Center (CERMC) posted on its Facebook page that it “is currently processing and analyzing ambient air filters from our air samplers located near the WIPP facility. We should have results by the end of the week which will give some indication as to whether any radiation was released into the environment. Hopefully CEMRC will get its filters from the exhaust air shaft at the WIPP site soon so we can analyze those for radionuclides as well. Lastly, remember that adults living within a 100-mile radius of the WIPP site can receive a free whole body count to see what types and levels of radiation are in their lungs and/or whole body…”
Government admits radioactive release, says: don’t worry, be happy
It wasn’t until February 19 that the Energy Dept. issued a press release acknowledging the reality of the airborne release of radioactivity. And this was only after that day’s edition of the local newspaper, the Current-Argus in Carlsbad, had already reported on the Carlsbad Environmental Center’s news release about higher than normal levels of radioactivity including Plutonium and Americium. The government belatedly confirmed the report, without apology, instead putting a positive spin on it, even though officials had been denying it (or perhaps had not known about it) for days. Under the headline “Radiological Monitoring Continues at WIPP” – even though the radiation was detected a half mile away – the new DOE release said:
“Recent laboratory analyses by Carlsbad Environmental Monitoring and Research Center (CEMRC) found some trace amounts of americium and plutonium from a sampling station located on the WIPP access road. This is consistent with the fact that HEPA [high-efficiency particulate absorption] filters remove at least 99.97% of contaminants from the air, meaning a minute amount still can pass through the filters. As noted by the CEMRC, an independent environmental monitoring organization, the levels found from the sample are below the levels established by the Environmental Protection Agency to ensure public health is protected.”
The Carlsbad Environmental Center, a division of the College of Engineering at New Mexico State University, is a quasi-governmental agency. Besides monitoring the waste project, the center has been a contractor for government labs – the Los Alamos National Laboratory and the Sandia National Laboratory – as well as the Nuclear Waste Partnership, a private contractor. The center also works with the U.S. Dept. of Homeland Security on issues relating to conventional explosives used to spread radioactive materials (or, in the words of the website: “issues involving Homeland Security particularly those involving radiation dispersal devices (RDDs or dirty bombs).”
Radiation reached Carlsbad by February 24, but officials did not say this publicly until March 10. A week later they denied the report, saying the Carlsbad radiation came from somewhere other than the waste plant. They didn’t say where.
Dirty bomb or accident – different intent, same effects
Anyone making a dirty bomb would be delighted to use Plutonium as a terror weapon, because Plutonium is very deadly, and remains deadly for a long time (Plutonium 239 has a half-life of 24,000 years). A lot of Plutonium will kill you very quickly at close range, especially if it’s been made into a bomb, which the U.S. proved pretty definitively at Nagasaki in 1945. But even a tiny amount of Plutonium, inhaled and lodged in your lungs, can kill you slowly. In that sense, what happened at the nuclear waste isolation facility was that its operators managed to set off a small dirty bomb. No wonder they claimed no one was exposed.
Talking about dirty bombs or even RDDs is not a preferred public relations approach for most of the nuclear industry, even when their facilities actually become radiation dispersal devices (RDDs). The spin is always about how safe everyone is and how trivial the level of radiation exposure is. The public relations pattern with the New Mexico waste project release is standard – and fundamentally dishonest, as it has been always. On February 24, the Energy Dept. produced another press release with the benign headline, “WIPP Reports New Environmental Monitoring Date” with text that included:
“Dose assessment modeling, which calculates potential radioactivity exposure to people, from the release data showed a potential dose of less than one millirem at each of the environmental sampling locations. A person receives about 10 millirems from a single chest x-ray procedure. The average person living in the United States receives an annual dose of about 620 millirem from exposure to naturally occurring and other sources of radiation.”
Even though the basic assertions here may be factually true in a narrow sense, the implied argument – that there’s nothing to be concerned about – is a lie. First note the use of “potential” – twice – which makes clear that the “dose of less than one millirem” – which could potentially be much more – has little meaning for understanding reality. The statement is careful NOT to use “maximum” or any other limiting word. The first sentence implies a full body dose, the next sentence executes a bait and switch, referring to a chest X-ray which delivers a targeted dose. The last sentence pretends to put it all in perspective by trivializing the earlier doses in the context of an average annual dose of 620 millirem.
Plutonium: one millionth of a gram, officially “safe,” can be lethal
In this press release and thousands like it, the government lies with an apparently reasonable tone, good enough to persuade the New York Times and others. But it’s a big lie, because governments know that no radiation exposure is good for anyone, that any exposure is a risk. The honest discussion would be over how much radiation a person can tolerate and remain healthy for a reasonable time. There are many correct answers to that depending on the particular conditions of exposure. It is dishonest to conflate “naturally occurring and other sources of radiation” because “other sources” are mostly from nuclear medicine, power plants and warheads – all sources created by deliberate human choice.
The deeper lie is in the suggestion that, since a person gets 620 millirem a year, what harm can come from a little bit (or a lot) more? The answer is that great harm can come from very limited exposure, although that’s not necessarily likely. The official “acceptable” body dose of Plutonium is less than one millionth of a gram, and even this amount can eventually be lethal, because Plutonium that gets into the human body doesn’t all come out. It tends to concentrate in the blood, muscle and bone. Americium behaves similarly in the human body. Another official lie embedded in government language is the suggestion that 620 millirem is somehow “safe.” It’s not. It’s already too great an exposure, and the effects of radiation are cumulative.
A particularly articulate internet post, Bobby1’s Blog of Februray 22 (and later revisions), challenged the official story as to both the amount of radioactive material released, how far it had spread, and the danger it posed.
But the official spin works. Matthew Wald of the Times has been writing about nuclear issues for years, yet on February 25 he still managed to start his piece with error-filled credulity: “Almost two weeks after an unexplained puff of radioactive materials forced the closing of a salt mine in New Mexico that is used to bury nuclear bomb wastes, managers of the mine are planning to send workers back in and are telling nearby residents that their health is safe.” The mine was already closed when the so-called “puff” of Plutonium and Americium created conditions that no one can honestly call “safe.” The rest of his piece reads like Wald is also on the DOE payroll.
Energy Dept. said no one was contaminated – that was false
On February 26, in a letter to residents of the Carlsbad area, DOE field manager Jose Franco made what appears to be the first official admission that workers at the waste pilot plant had suffered internal radioactive contamination. Franco wrote that “13 Waste Isolation Pilot Plant (WIPP) employees that were on site the evening of February 14 were notified that they have tested positive for radiological contamination.” Previously the agency had said there were 139 employees on site at the time of the release, and no external radiation was detected on any of them.
“It is premature to speculate on the health effects of these preliminary results, or any treatment that may be needed,” Franco wrote, adding that the contamination was “likely at very low levels” and “predominantly americium-241, material which is consistent with the waste disposed of at the WIPP. This is a radionuclide used in consumer smoke detectors and a contaminant in nuclear weapons manufacturing.”
Franco said it would probably take weeks to establish a credible estimate of the contamination dose these 13 employees received. The Times of February 27 carried the story on page A16 and online with Matthew Wald downplaying its importance. Local media gave the development more scrutiny, since the implications were clear: among other things, officials had no idea why there was a Plutonium release, they had no idea how much Plutonium was released, they had no idea how far the Plutonium had traveled, and they had no idea how many people had been contaminated (the number of contaminated employees later rose to 17, and then to 21).
Actually the detected level of Plutonium was millions of times higher than officials first acknowledged
On March 2, another articulate online post, Pissin’ On The Roses, presented a cogent argument that the Plutonium release had been much greater than the official story allowed. Basing the conclusion on public and leaked documents, the blog argues that the numbers are inconsistent and make sense only by assuming that the radioactive release lasted about 33 minutes: “When we ‘followed the math’, the story didn’t square with what the public was told, ie ‘the release was less than EPA reportable requirements’ (supposedly 37bq/m^3 for Plutonium). In fact, the math showed levels thousands of times greater than EPA reportable requirements for Plutonium.” But there was no report to the EPA.
Almost a month later, Southwest Research and Information Center, an independent organization that focuses on health, environmental, and nuclear issues, used Energy Dept. data to reach a similar, but more extreme conclusion: that the release actually lasted more than 15 hours.
Asking questions is a problem: we might find the wrong answers
Actually, the U.S. Environment Protection Agency (EPA) was stalling, apparently reluctant to get involved with protecting the environment around the government’s only underground nuclear weapons waste storage site, now that it had begun releasing radiation for the first time. On February 27, New Mexico’s two U.S. Senators wrote directly to EPA administrator Gina McCarthy, asking for the EPA’s independent assessment of the “event,” as well as deployment of EPA assets to New Mexico to assess the situation independently. Senators Martin Heinrich and Tom Udall, both Democrats, noted that since “the Environmental Protection Agency (EPA) is the primary regulatory authority in regard to any releases of radioactive materials to the environment from the Waste Isolation Pilot Plant,” the EPA should do more than merely monitor the Energy Dept. and other agencies involved.
The EPA stonewalled. In effect, the Democratic administration in Washington had this answer for two Democratic senators: Drop dead. The EPA said it at greater length, but not until March 5, and then in a letter from the regional administrator, not the administrator in Washington. “We are still evaluating the situation,” wrote Ron Curry, without ever saying why the primary regulatory authority was refusing to “conduct independent studies.”
“As you know, the EPA’s primary regulatory responsibility is to ensure that any releases of radioactive material from the WIPP facility are below the EPA exposure limits for members of the public,” the regional bureaucrat began, launching a paragraph of denial and irresponsibility. Curry said that the EPA would “inspect” the work of others and, so far, “it is very unlikely that any exposures would approach these regulatory limits or represent a public health
concern.” EPA doesn’t know this, EPA has no independent way of knowing this, and as of March 5, EPA had no interest in knowing this independently, even as the primarily responsible regulator.
Besides, Curry added, “we note that the available information supports the conclusion that nearly all of the radioactive material was retained within the filtration system… [and] that radiation levels have declined significantly….”
Translation: that’s what we’ve been told officially and that’s good enough for us.
Also on March 5, the Energy Dept. issued a press release asserting more apparently good news: “Follow-up testing of employees who were exposed… shows exposure levels were extremely low and the employees are unlikely to experience any health effects as a result…. [tests] came back negative for plutonium and americium, the two radioactive isotopes that were detected in preliminary bioassays.” The release does not offer an explanation for this reported atypical behavior of ingested Plutonium and Americium.
Area residents received a letter from DOE dated March 5 containing an identical reassurance. It also expressed hope that workers might be able to re-enter the mine the following week, for the first time since the February 5 salt truck fire.
Fear of more Plutonium? Expert says: Don’t lick your iPhone charger!
During February, in response to continued rising public concern, the Energy Dept. started holding regular public meetings. On March 6, five nuclear waste officials appeared at a sparsely attended public forum billed by the Energy Dept. as a “WIPP Recovery Town Hall Meeting” at the Civic Center in Carlsbad. The almost 90-minute session (recorded by DOE with low quality audio) featured David Klaus from the Department of Energy (DOE), David Huizenga from DOE’s Office of Environmental Management, Joe Franco from the DOE Carlsbad Field Office, Farok Sharif from Nuclear Waste Partnerships [he was later removed from the job and replaced] and Fran Williams from Energy Dept. contractor UCOR, who told the audience flatly: “There are no health impacts to you, to your family, the members of your community from the event.”
Williams, Director of Environmental, Safety, Health and Quality for Oak Ridge National Laboratory’s contractor UCOR has 35 years of experience in her field, health physics and occupational medicine. Although the “Town Hall” received little coverage, Williams made the most news with her comments 57 minutes into the meeting, about radiation levels in the region: “They’re down at the levels of licking your iPhone charger. I’m not trying to be funny; I’m trying to equate radiation exposure to something that you can understand…. I hope that helps. ”
“Many left Thursday night’s meeting [March 6] with the Department of Energy uneasy,” reported Albuquerque TV station KRQE. “They pleaded for more information about the underground radiation leak last month that seeped radiation outside, but many remain frustrated and concerned for their safety.
The DOE tried to reassure people they are safe even though the underground storage areas remained sealed off.”
The next night (March 7) the local Republican Congressman, Rep. Steve Pearce, held his own town hall meeting. The long time backer of the Waste Isolation Pilot Plant (whose private contractors contributed to his campaigns) promised to ask tough questions. Pearce said, “I will hold their feet to the fire.”
Other than his meeting with Energy Secretary Ernest Moniz and New Mexico’s two senators the day before, Pearce’s involvement in events at WIPP appears largely limited to cheerleading, as in his February 5 press release saying everything was fine after the fire and his February 15 press release saying everything was fine after the release of radioactivity.
Radioactive waste isolated for 10,000 years – until it’s not
More than three weeks after the detection of airborne Plutonium, no one had been able to re-enter the salt mine to assess conditions underground or to determine the cause of the accident. WIPP was built without underground surveillance cameras. Officials at the Energy Dept. and other agencies have refused to speak publicly about the issues or to answer reporters’ questions on the record. Even their public bromides began to diverge, with DOE suggesting that WIPP would be operational in the near future, while the NM Environmental Dept. issued a legal notice saying WIPP would “be unable to resume normal activities for a protracted period of time.”
On March 8, the Albuquerque Journal News published a story that said, “No one knows yet how or why a waste drum leaked at southeast New Mexico’s Waste Isolation Pilot Plant on Valentine’s Day, triggering alarms, exposing workers and setting off a cascade of events that could cripple the nation’s radioactive waste disposal system.”
Reviewing Dept. of Energy records, the Journal concluded that there were only two likely scenarios for the February 14 accident:
(1) If a waste drum’s contents overheated, that might cause a spontaneous explosion that spread radioactive debris. Planners in 1997 contemplated this possibility before WIPP opened, and gave odds of it happening as 10,000 to 1.
(2) If the roof in one of the salt cavern rooms fell, that might rupture one or more waste drums and lead to the spread of radioactive debris. Planners gave the odds of that happening as one in a million.
The most likely cause of an accident, planners thought, would be mishandling of waste drums by workers, but there were no workers underground on February 14.
The next day, March 9, DOE announced that remote testing of areas not in the path of the radiation release showed “no detectable radioactive contamination
in the air or on the equipment lowered and returned to the surface. Air quality results were also normal. These results were expected….” DOE suggested that workers might be sent down the mine before the end of the week.
The Energy Dept also announced that four more workers had been contaminated by ingesting Plutonium or Americium at “extremely low levels,” bringing the total to 17 workers contaminated. [On March 27, DOE would announce four more being tested for contamination, raising the total to 21.] The DOE also announced that there would be no workforce layoffs during “recovery efforts” for which there is no estimated end point.
A fire suppression system is useful when there’s a fire
One of the problems for the workers underground on February 5, when the 29-year-old salt truck caught fire, was that the truck’s onboard automatic fire suppression system had been deactivated. Emergency teams put out the fire and evacuated the tunnels without any injuries other than six workers needing treatment for smoke inhalation. Rep. Pearce promptly issued a press release calling it a “minor fire” that posed no threat to public health or safety, which appeared true at the time.
But the deactivated fire protection on the truck turned out to be just the first of a host of shortcomings and failures relating to the waste plant, problems that are still being uncovered.
“This accident was preventable” was the understated conclusion of the Accident Investigation Board in the Dept. of Energy in its 187-page report released March 13. The Board’s four-week investigation included at least two pre-accident visits to the mine, which has been inactive since February 5. The Board praised the workers and their supervisors for responding quickly, knowledgeably, and cooperatively to minimize the emergency. The Board found extensive fault with management’s performance over a longer period of time, finding that maintenance programs were ineffective, fire protection was inadequate, preparedness was inadequate, emergency management was ineffective – and that these criticisms had been made before, some more than once. According to one news report:
“At a community meeting in Carlsbad on Thursday to preview the report, the lead investigator, Ted Wyka, praised the 86 workers who were half-mile underground in the mine when the fire started, saying they ‘did everything they could’ to tell others to evacuate.
“But a number of safety systems and processes failed, Mr Wyka said. Emergency strobe lights were not activated for five minutes and not all workers heard the evacuation announcement. One worker also switched the air system from normal to filtration mode, which sent smoke billowing through the tunnels.”
New Mexico’s senators, in a joint statement, found the Board’s report “deeply concerning” and urged DOE management to take the critique seriously and fix the shortcomings. For his part, Rep. Pearce “applauded” the DOE for “a candid, transparent report” that demonstrated how poorly they had been doing their job for many years.

With WIPP closed, Los Alamos waste has to be trucked to Texas
The Los Alamos National Laboratory has been a disaster waiting to happen for years, a disaster that almost happened in 2011 as wildfires approached the facility where radioactive waste was stored in roughly 20,000 steel drums above ground. The fires were held back, but the waste is still there, scheduled for “permanent” storage at the underground waste plant before the next fire season in the summer. Now that can’t happen because WIPP is leaking, and closed.
On March 20, the Energy Dept and its contractor, Nuclear Waste Partnership, announced plans to truck the Los Alamos waste to West Texas for temporary storage at Waste Control Specialists, another government contractor. DOE “has committed to the state of New Mexico to removing several thousand cubic meters of TRU waste from LANL by June 30, 2014. The waste will be moved to WIPP for final disposal once the site reopens. “
According to DOE, it has already moved most of the Los Alamos waste, which “consists of clothing, tools, rags, debris, soil, and other items contaminated with small amounts of radioactive elements, mostly plutonium.”
On March 21, the New Mexico Environment Department withdrew its temporary permit that would have allowed the waste plant to expand. That’s the same permit that the department said on February 14 that it would approve at the end of the 60-day public comment period. The permit would have allowed WIPP to build two new disposal vaults in the salt mine. According to the news release:
“NMED [NM Environment Dept.] cannot move forward on the WIPP’s request to open additional underground storage panels and for the other requested permit modifications until more information is known about the recent events at the WIPP,” said Environment Secretary Ryan Flynn. “Just as NMED needs more information to make informed decisions on permit modifications, the public also needs more information about the radiation release in order to provide informed input during the public comment period. Once NMED has all of our questions answered, we will proceed with consideration of a revised draft Permit.”
With so many other questions to be answered, the question of whether WIPP will ever re-open gets harder to answer with any certainty. There have been numerous reports, by DOE and others, of further radioactive leaks from the site – none of them known to be large and all considered officially “safe.” As Arnie Gundersen at Fairewinds notes, DOE says that when the WIPP ventilation system is set on filtration mode, its air filters collect 99.97% of all the radioactive particles headed for the atmosphere. Accepting that capture rate as correct, Gunderson points out that, mathematically, if the filters are 99.9% effective (which he doubts), that means that out of every 1,000 minutes there is one unfiltered minute. In other words, the radioactive leak continues, albeit slowly, even when the filters work at peak capacity (which is not a constant). Just since February 14, Gundersen calculates, perfectly functioning filters would still have allowed another half hour of contamination into the environment.
Nuclear supporters continue to minimize any danger. Plutonium and Americium are heavy elements, the argument goes, so they fall to the ground quickly. And they stay there unless there’s a lot of wind. No one knows now just how much Plutonium or Americium the waste plant has already emitted, or how much it will emit. But anyone who cares to know knows that this is spring in the southwest, when the winds pick up and dust storms have already happened this year.

US hospital bills man for rectal search he was forced to undergo by police

A minor traffic stop went nightmarishly wrong for a New Mexico man who was detained by police and forced to undergo a series of anal probes and other medical examinations against his will.
David Eckert had just finished shopping at Walmart in Deming, New Mexico when an officer pulled him over for failing to make a complete stop at a stop sign. According to the local KOB TV station, federal documents claim that police noticed Eckert clenching his buttocks when they asked him to step outside of the car, indicating that he may have been carrying drugs in his anal cavity.
After detaining Eckert and requesting a search warrant from a judge, police took him to a local hospital for doctors to perform a search. The doctor refused, saying the search was unethical. Police then took Eckert to the Gila Regional Medical Center, where doctors agreed to cooperate.
The doctors then performed a wide array of procedures, all without the consent of Eckert, who protested each one. First, doctors took an X-Ray of his abdomen, which revealed no narcotics hidden inside the body. Then, doctors performed two anal exams with their fingers, both of which failed to uncover any drugs.
After the failure of these searches, Eckert underwent three different enemas and was forced to defecate in front of doctors and police officers. He watched as each stool search failed to uncover any narcotics.
Another X-Ray was taken, and, finally, doctors sedated Eckert and performed a colonoscopy. Again, no drugs were found.
“The thought that they could do this to a man in our country is terrifying,” Shannon Kennedy, Eckert’s attorney, said to KOB. “Our community should be outraged … This is like something out of a science fiction film, anal probing by government officials and public employees.”
According to Kennedy, not only was the issued search warrant overly broad and lacking in probable cause, but it was also only valid in Luna County, where Deming is located and Eckert was arrested. After the first hospital refused to perform the anal search, police took Eckert to Gila, which is located in a separate county altogether. If that is the case, then doctors performed all eight of the previously mentioned procedures illegally and without the consent of the patient.
To make matters worse, the search warrant expired at 10 p.m. while doctors didn’t even begin prepping Eckert for the colonoscopy until 1 a.m. the next morning, when the warrant had been expired for hours.
The hospital even billed Eckert for the procedures and is threatening to take him to collections if he doesn’t pay.
Deming Police Chief Brandon Gigante refused to comment on the incident due to a pending lawsuit, but said, “We follow the law in every aspect and we follow policies and protocols that we have in place.”
Eckert is suing the city of Deming, Hidalgo County, the police officers behind the incident, the deputy district attorney, and the Gila Regional Medical Center, including Robert Wilcox, M.D. and Okay Odocha, M.D.
“If the officers in Hidalgo County and the City of Deming are seeking warrants for anal cavity searches based on how they’re standing and the warrant allows doctors at the Gila Hospital of Horrors to go in and do enemas and colonoscopies without consent, then anyone can be seized and that’s why the public needs to know about this,” Kennedy said.

The lies about the 1967 war are still more powerful than the truth

In retrospect it can be seen that the 1967 war, the Six Days War, was the turning point in the relationship between the Zionist state of Israel and the Jews of the world (the majority of Jews who prefer to live not in Israel but as citizens of many other nations). Until the 1967 war, and with the exception of a minority of who were politically active, most non-Israeli Jews did not have – how can I put it? – a great empathy with Zionism’s child. Israel was there and, in the sub-consciousness, a refuge of last resort; but the Jewish nationalism it represented had not generated the overtly enthusiastic support of the Jews of the world. The Jews of Israel were in their chosen place and the Jews of the world were in their chosen places. There was not, so to speak, a great feeling of togetherness. At a point David Ben-Gurion, Israel’s founding father and first prime minister, was so disillusioned by the indifference of world Jewry that he went public with his criticism – not enough Jews were coming to live in Israel.
