US State Department ‘firmly opposes’ ICC probe into Israeli war crimes allegations, insisting court lacks jurisdiction

US Secretary of State Mike Pompeo has voiced “firm” opposition to a bid in the International Criminal Court (ICC) to investigate alleged war crimes committed by Israel in the occupied Palestinian territories.

After nearly four years of preliminary investigation, the ICC’s top prosecutor Fatou Bensouda said on Friday that the war crimes probe would be expanded into a full-scale inquiry, looking into whether Israel has carried out atrocities in the occupied West Bank and East Jerusalem, as well as Gaza. In a statement echoing earlier remarks by Israeli Prime Minister Benjamin Netanyahu, Pompeo said the case had no merit.

“We firmly oppose this and any other action that seeks to target Israel unfairly,” Pompeo said on Friday, arguing that because Palestine does not qualify as a “sovereign state” and is not a party to the ICC’s founding charter, the Rome Statute, it cannot bring cases before the court.

The top US diplomat also reiterated a “long standing objection” to any claim that the ICC has jurisdiction over non-member states, such as Israel and the United States, “absent a referral from the UN Security Council” or explicit cooperation from the nation in question. While then-President Bill Clinton signed the Rome Statute in 2000, it was never formally ratified by the Senate. Israel, too, was an early signer to the statute, but also never finalized its membership in the organization.

PM Netanyahu made a nearly identical argument to Pompeo’s earlier on Friday, insisting the court had no jurisdiction and that Palestine had not achieved statehood – a goal Palestinians have pursued for decades despite tooth-and-nail opposition from both Tel Aviv and its American benefactor.

While Palestine has yet to achieve statehood, the quasi-governmental Palestinian Authority was accepted into the ICC in 2015. Nonetheless, Bensouda signaled that she will convene with the court to confirm exactly how far its jurisdiction extends before moving ahead with the investigation.

Tel Aviv has been accused repeatedly over the years of carrying out war crimes against Palestinians, including the demolition and shelling of civilian homes and other structures, forcible relocation of residents and the use of live ammunition on unarmed demonstrators. Many of the allegations stem from Israel’s settlement project in the occupied territories.

In November, Pompeo declared that Israeli settlements in the occupied West Bank were legitimate under international law, overturning long-standing US policy on the question. Palestinians and their advocates argue the settlements make the long-sought statehood project increasingly unlikely, as Israel’s Jewish-only housing units sprawl across Palestinian land and tie up important resources. Much of the international community and the UN have long considered the settlements illegal and continue to do so, despite the American about-face.

    Well, he would say that, wouldn’t he? He and the hierarchy in the American government get their instructions directly from Israel. They give preference to Israel, over the USA, in so many important matters. The USA Government cannot function without getting the “OK” from Israel.
    “The most powerful Nation on Earth” cannot stand up for itself in the face of Israel.

  4. Wow. No “investigation”.

    No “jurisdiction”.

    No “statehood”.

    What ‘reasoning’ Israel and its partisans present.

    It’s a ‘coalition of the willing…’ but a coalition of the willingly manipulated.

    It’s too well crafted. It’s too well formulated. It defies deconstructing it.

    But it’s all bullshit. Lies. Deceit. “By way of deception…” we will make war. And Israeli motto.

    After reading some of the reasoning, as so-well constructed, put out by Israel and its ‘coalition of the complicit’, to paraphrase what Israel’s puppet George Bush presented, the reasoning becomes more and more absurd: “wildly unreasonable, illogical…”

    Do sane people believe these rationalizations? Perhaps sane is not accurate. More accurate would be those who know only what the American government and the American news media puts in front of America. As well as what all the media doing the beckoning as Israel wants.

    How can Americas go along with this? Are they brain dead? Are they so afraid of the Israeli influence, the American government officials working on behalf of Israel, the threat of the uber vicious, aggressive and tactically destroying people employed to the war effort of Israel, as to turn from, more, to run from how the Israeli war has blinded and enslaved them?

    And the Israeli war has been on-going since before the inception of the state of Israel. It’s one of the longest wars in history. The war is waged on every conceivable front. Including the enlistment of the American taxpayer, the American government, the American foreign policy and the American mind…

    the American mind is made of, or was made of a spirit of independence, of virtue, that is. That mind is made rotten by a fifth column. An invader, which seeks to make it a vassal, a bought and owned and commanded to be a slave.

    America: you must not commit to it. To do so is to abandon your inheritance, abandon your liberty and freedom and soul.

    • Well and cogently presented! But, after attaining the age of 76 and suffering vicariously with the Palestinians for 56 or those years, I can state that it is too late. The entanglement, the vise, the focus, the cleverness, are all too emplaced (oh: also “the Benjamins”). I simply cannot see my America extracting itself from this quagmire, this quicksand that is sucking, sucking, sucking….

      Pity the Palestinians.

      • Thank you. Too many dangers are being put in place to not be alarmed. Or more than alarmed.

        America’s hour is nigh. Of all the political perils now at work, capable of engulfing it into a catastrophic maelstrom, certainly a war perpetrated by and for Israel is in place and deadly. Deadly, not only for America, but for the middle east and the people living there. Secondly, if Israel put together another false flag and cries for American assistance, that is in place. Quick to combine will be the response. The flow of fuel, fuel for energy, to manufacturing, to trade will bring chaos and societal ruin. And will Israel pull out its arsenal? A nuclear war has already been waged. In Iraq, the use of depleted uranium for munitions has spread mutation, disease and deformity. And that was done by America. Along with the coalition of the willing.

        Were they really willing to contaminate with radiation? They went along with it. Who benefited? For whose benefit was that war really fought?

        If that question and its answer is to be deemed “anti-Semitic” then there is no hope for a sane solution to the ever building edge to war in the middle east.

        This is not an “end-time” prophesy. It’s so very simple to deduct, so logical as to be incontrovertible.

        Should pity be given to Americans? Or, America betrayed. Betrayed into complicity, by one of the most relentless, the most cleverly presented cause, the most ruthless and genocidal country, and the country which presents itself as an ally, a needy victim, and worthy of endless money. Who else has ever used money as a weapon in so many ways, historically for so long?

        Is the last true or not?

        Not the Americans who have been elected and fallen from moral integrity by the Zionist juggernaut. Not the Americans of Zionist affiliation or commitment, who have worked, or more accurately wormed their way into government to do the bidding of Israel; or the Jewish mind-set of Israel regardless of anything other than Israel first, not those who, at first, bought into the narrative of the Zionist enterprise of making the desert bloom; or the idiocy of “A land without people for a people without a land,” et cetera, ad nauseam; and on and on.

        Israel and its lumbering. mercenary, and increasingly messianic giant, America, are lurching toward their next victim. And one of the victims of this saddled enterprise, this war for the Zionist supremacy in the middle east and beyond, is America.
