Unlearned lessons from the Steven Hatfill case

By Glenn Greenwald | April 21, 2010

Andrew Sullivan rightly recommends this new Atlantic article by David Freed, which details how the FBI and a mindless, stenographic American media combined to destroy the life of Steven Hatfill.  Hatfill is the former U.S. Government scientist who for years was publicly depicted as the anthrax attacker and subjected to Government investigations so invasive and relentless that they forced him into almost total seclusion, paralysis and mental instability, only to have the Government years later (in 2008) acknowledge that he had nothing to do with those attacks and to pay him $5.8 million to settle the lawsuit he brought.  There are two crucial lessons that ought to be learned from this horrible — though far-from-rare — travesty:

(1) It requires an extreme level of irrationality to read what happened to Hatfill and simultaneously to have faith that the “real anthrax attacker” has now been identified as a result of the FBI’s wholly untested and uninvestigated case against Bruce Ivins.  The parallels are so overwhelming as to be self-evident.

Just as was true for the case against Hatfill, the FBI’s case against Ivins is riddled with scientific and evidentiary holes.  Much of the public case against Ivins, as was true for Hatfill, was made by subservient establishment reporters mindlessly passing on dubious claims leaked by their anonymous government sources.  So unconvincing is the case against Ivins that even the most establishment, government-trusting voices — including key members of Congress, leading scientific journals and biological weapons experts, and the editorial pages of The New York Times, The Washington Post and The Wall St. Journal — have all expressed serious doubts over the FBI’s case and have called for further, independent investigations.

Yet just as was true for years with the Hatfill accusations, no independent investigations are taking place.  That’s true for three reasons.

First, the FBI drove Ivins to suicide, thus creating an unwarranted public assumption of guilt and ensuring the FBI’s case would never be subjected to the critical scrutiny of a trial — exactly what would have happened with Hatfill had he, like Ivins, succumbed to that temptation, as Freed describes:

The next morning, driving through Georgetown on the way to visit one of his friends in suburban Maryland, I ask Hatfill how close he came to suicide. The muscles in his jaw tighten.

“That was never an option,” Hatfill says, staring straight ahead. “If I would’ve killed myself, I would’ve been automatically judged by the press and the FBI to be guilty.”

Second, the American media — with some notable exceptions — continued to do to Ivins what it did to Hatfill and what it does in general:  uncritically disseminate government claims rather than questioning or investigating them for accuracy.  As a result, many Americans continue to blindly assume any accusations that come from the Government must be true.  As Freed writes, in a passage with significance far beyond the Hatfill case:

The same, Hatfill believes, cannot be said about American civil liberties. “I was a guy who trusted the government,” he says. “Now, I don’t trust a damn thing they do.” He trusts reporters even less, dismissing them as little more than lapdogs for law enforcement.

The media’s general willingness to report what was spoon-fed to them, in an effort to reassure a frightened public that an arrest was not far off, is somewhat understandable considering the level of fear that gripped the nation following 9/11. But that doesn’t “justify the sliming of Steven Hatfill,” says Edward Wasserman, who is the Knight Professor of Journalism Ethics at Washington and Lee University, in Virginia. “If anything, it’s a reminder that an unquestioning media serves as a potential lever of power to be activated by the government, almost at will.“

No matter how many times the Government and media jointly disseminate outright lies to the American citizenry — remember Iraq, or Jessica Lynch’s heroic Rambo-like firefight with Evil Iraqi Villains, or Pat Tillman’s death at the hands of Al Qaeda Monsters, or all the gloriously successful air strikes and raids on Terrorists that never happened? — that propagandistic process never weakens.  As a result, many Americans (especially when their party is in power) simply place blind faith in whatever the Government claims (even when the claims are issued anonymously and accompanied by no tested evidence).  Hence, the Government claims it knows that Ivins is the anthrax killer; the American media largely affirms that claim; and, for so many people, that’s the end of the story, no matter how many times that exact process has so woefully misled them and no matter how many credible and even mainstream sources question it.

Third, the Obama administration is actively and aggressively blocking any efforts to investigate the FBI’s case against Ivins through an Obama veto threat, based on the Orwellian, backward claim that such an investigation “would undermine public confidence” in the FBI’s case “and unfairly cast doubt on its conclusions.”  As explained in a letter to the Obama administration by Rep. Rush Holt, the former physicist who represents the New Jersey district from which the anthrax letters were sent:

The Bureau has asserted repeatedly and with confidence that the “Amerithrax” investigation is the most thorough they have ever conducted — claims they made even as they were erroneously pursuing Dr. Steven Hatfill. . . . Many critical questions in this case remain unanswered, and there are many reasons why there is not, nor ever has been, public confidence in the investigation or the FBI’s conclusions, precisely because it was botched at multiple points over more than eight years. Indeed, opposing an independent examination of any aspect of the investigation will only fuel the public’s belief that the FBI’s case could not hold up in court, and that in fact the real killer may still be at large.

The anthrax attacks were one of the most significant political events of this generation — as significant as the 9/11 attack, if not more so, in creating the climate of fear that prevailed (and still prevails) in the U.S., which, in turn, spawned so much expansion of government power.  It is worth remembering what happened in the Hatfill case in order to be reminded of just how inexcusable it is that there has been no independent investigation of the case against Ivins and that the current administration is now aggressively and quite strangely blocking any efforts to do so.

(2) More generally, it is hard to overstate the authoritarian impulses necessary for someone — even in the wake of numerous cases like Steven Hatfill’s — to place blind faith in government accusations without needing to see any evidence or have that evidence subjected to adversarial scrutiny.  Yet that is exactly the blind faith that dominates so many of our political debates.

Throughout the Bush years, anyone who argued against warrantless surveillance, or torture, or lawless detention and rendition, was met with this response:  but this is all being done to Terrorists. What they actually meant was:  these are people accused by the Government, with no evidence or trials, of being Terrorists.  But the authoritarian mind, by definition, recognizes no distinction between “Our leaders claim X” and “X is true.”  For them, the former is proof of the latter.  Identically, those who now argue against due-process-free presidential assassinations of American citizens and charge-less indefinite detentions are met with a similar response:  but these are dangerous people who are trying to kill Americans, when what they actually mean is:  Obama officials claim, with no evidence shown and no process given, that these are dangerous people trying to kill Americans.  The authoritarian mind refuses to recognize any distinction between those two very different propositions.

No matter how many Steven Hatfills there are — indeed, no matter how undeniable is the evidence that the Government repeatedly accused people of being Terrorists who were no such thing, even while knowing the accusations were false — the authoritarians among us continue to blindly recite unproven Government accusations (but he’s a Terrorist!) to justify the most extreme detention, surveillance and even assassination policies, all without needing or wanting any due process or evidence.  No matter how many times it is shown how unreliable those kinds of untested government accusations are (either due to abuse or error), there is no shortage of people willing to place blind faith in such pronouncements and to vest political leaders with all sorts of unchecked powers to act on them.

University told to hand over tree ring data

BBC | April 19, 2010

Queen’s University in Belfast has been told by the Information Commissioner to hand over 40 years of research data on tree rings, used for climate research.

Douglas Keenan, from London, had asked for the information in 2007 under the Freedom of Information Act. Mr Keenan is well-known for his questioning of scientists who propose a human cause for climate change.

Queen’s University refused his request saying it was too expensive, but it is now considering its position. The university claimed that as the information was unfinished, had intellectual property rights and was commercially confidential information, it did not have to pass it on. After a series of counter claims from Mr Keenan and the intervention of the Information Commissioner, Queen’s have now been told that they could be in contempt of court if they do not hand the data over.

In his legal decision, the commissioner said that Queen’s had failed in its procedural requirements and had wrongly used legal exemptions to withhold the requested information.

Mr Keenan, who hopes to use the data to reconstruct temperatures during the Medieval Warm period, said “this has taken three years, but it is worth it. “It is an important victory for FoI on research data,” he said.

Tree ring data is used by climate scientists to study historical climate information.

BBC environment correspondent Richard Black said Mr Keenan’s victory has a wider context.

“This is the latest development in an on-going process that has seen ‘climate sceptics’ attempting to obtain raw data and documentation on methodologies from researchers, especially those working to understand the climate of the past, ” he explained.

“The sceptics’ contention is that academics have, through error or will, mis-represented Earth’s temperature record so as to portray a picture of a warming planet.

“The on-going series of reviews into climate science at the University of East Anglia – the so-called ‘ClimateGate’ affair – has concluded that scientists ought to have been more open with data than has typically been the case.”

Missing Heat Hides From Climate Scientists

By Doug L. Hoffman on 04/18/2010

Climate scientists have decided that as much as half of the heat energy, believed to have built up on Earth in recent years, is hiding somewhere it can’t be found.

By measuring the radiative energy input at the top of Earth’s atmosphere, scientists have a pretty good idea of how much energy is entering the planetary environment—the problem is figuring out where it goes. The most likely place is in the deep ocean, whose waters form a huge potential storage place for heat. Because energy is exchanged between the atmosphere and the ocean, this heat can resurface at a later time to affect weather and climate on a global scale. It has been suggested that last year’s rapidly occurring El Niño may be one way the “missing” solar energy has reappeared—the implication being more sudden El Niño events may be on the way.

Oceans contain around 80% of the climate system’s total energy, so ocean heat is a good measure of what is happening with Earth’s climate. According to a Perspectives article in the April 16, 2010, issue of Science, “Tracking Earth’s Energy,” science has been unable to properly track energy within Earth’s environmental system. Kevin E. Trenberth and John T. Fasullo , both scientists at the National Center for Atmospheric Research (NCAR), warn in the new study that satellite sensors, ocean floats, and other instruments are inadequate to track this “missing” heat. They fear that it may be building up in the deep oceans or elsewhere in the climate system. “The heat will come back to haunt us sooner or later,” says Trenberth, the lead author. “The reprieve we’ve had from warming temperatures in the last few years will not continue. It is critical to track the build-up of energy in our climate system so we can understand what is happening and predict our future climate.”

As noted on the NCAR site, a Science Perspectives piece is not formally peer-reviewed, but is reviewed by editors of the journal. Science reportedly invited Trenberth to submit the article after an editor heard him discuss the research at a scientific conference. Trenberth and his co-author, Fasullo, focused on what they call a central mystery of climate change. Why, since 2003, have scientists been unable to determine where much heat energy Earth receives from the Sun is going. According to the NCAR site:

Satellite measurements indicate that the amount of greenhouse-trapped solar energy has risen over recent years while the increase in heat measured in the top 3,000 feet of the ocean has stalled. Although it is difficult to quantify the amount of solar energy with precision, Trenberth and Fasullo estimate that, based on satellite data, the amount of energy build-up appears to be about 1.0 watts per square meter or higher, while ocean instruments indicate a build-up of about 0.5 watts per square meter. That means about half the total amount of heat is unaccounted for.

Either the satellite observations are incorrect, says Trenberth, or large amounts of heat are penetrating to regions on Earth that are not adequately measured. One such place is the deepest parts of the oceans. Compounding the problem, Earth’s surface temperatures have largely leveled off in recent years. This inability to properly track energy has implications for understanding the way climate works and most definitely on predicting future climate. Obviously, if scientists are at a loss to identify the hiding place of the missing heat climate modelers are unable to include its possible future effects in their programs. With as much as half of the suspected heat energy buildup gone missing, it must be asked how well science understands Earth’s climate.

Where does the energy go?

El Niño, periodic events in which the upper ocean waters across much of the tropical Pacific Ocean become significantly warmer, are seen by many as a mechanism for dumping heat, stored in the ocean, back into space. Trenberth and Fasullo explain the relationship between the ENSO, the El Niño Southern Oscillation, and delayed release of ocean stored energy this way:

To understand how energy is taken up and later released by the climate system, consider the natural variability from El Niño Southern Oscillation. The cold sea surface temperatures in the equatorial Pacific present in normal or La Niña conditions create conditions favorable for fewer clouds and more sunshine and a build-up of heat in the ocean as a precursor of El Niño. The spread of warm waters across the Pacific, together with changing winds, in turn promotes evaporative cooling of the ocean, moistening the atmosphere and fueling tropical storms and convection over and around the anomalously warm waters. The changed atmospheric heating alters the jet streams and storm tracks and controls weather patterns for the duration of the El Niño event. The loss of heat can in turn lead to La Niña.

A strong La Niña event in 2007–2008 extended into the 2008–2009 northern winter, causing cooler than normal weather across much of the Northern Hemisphere. By June 2009, the situation had reversed as the next, comparatively moderate El Niño emerged. Multiple storms barreled into Southern California in January 2010, consistent with expectations from the El Niño. These storms also caused significant snowfall and precipitation across the American Southwest, South and up the Eastern Seaboard.

There seems to be a lot of confusion regarding ocean temperatures these days. Recently, new estimates of the past temperatures have been published. On in particular, that shows a sudden jump in the 2002-2003 time, prompted Real Climate to post a plot of ocean heat content. This is a contradiction of a 2009 paper by Craig Loehle in Energy & Environment that found global ocean cooling since 2003. The linear component of the model used showed a trend of -0.35 (±0.2) x 1022 Joules per year, shown in the plot below.

The Loehle study showed an unambiguous cooling trend.

“The model, fit to the smoothed data, gave an excellent fit (r = 0.922, R2 = 0.85) and showed clearly that there is an annual periodicity in the data, probably due to the north-south asymmetry in ocean area and the effect of orbital variations over the year,” the study states. The Loehle study was based on ocean heat content anomaly (OHCA) data compiled by Josh Willis et al. Indeed, it was the 2008 paper “Assessing the Globally Averaged Sea Level Budget on Seasonal and Interannual Time Scales,” by Willis, Chambers and Nerem, that prompted this comment by Roger Pielke Sr.:

Global warming, as diagnosed by upper ocean heat content has not been occurring since 2004. It is impossible to know if this lack of warming will continue but these observations are inconsistent with the predictions of long-term global climate predictions, such as reported in the 2007 IPCC report.

Since then, the debate over ocean heat and ocean levels has raged. Claims and counter claims, studies finding warming and studies finding cooling. Now it looks like the warming proponents are throwing in the towel on surface temperature increase (this is the temperature trend, not normal, cyclic variability). In a reply to questions from Dr. Pielke, Dr. Willis said:

There is still a good deal of uncertainty in observational estimates of ocean heat content during the 1990s and into the early part of the 2000s. This is because of known biases in the XBT data set, which are the dominant source of ocean temperature data up until 2003 or 2004. Numerous authors have attempted to correct these biases, but substantial difference remain in the “corrected” data. As a result, the period from 1993 to 2003 still has uncertainties that are probably larger than the natural or anthropogenic signals in ocean heat content that happen over a period of 1 to 3 years. However, the decadal trend of 10 to 15 years seems to be large enough to see despite the uncertainties.

So, despite the confusion caused by changing from XBT (Expendable Bathythermograph) measurements to measurements by the Argos satellite-based location and data collection system, it still looks like the upper portions of the ocean are cooling. Such data discontinuities when changing sensor types or measurement methods is not new, the same type of flap erupted over radiosonde data a decade ago. Even so, the debate about the missing ocean heat is far from over.

The new claim is the missing heat, that climate change supporters so desperately want to find, has gone deep. Dr Pielke has exchanged a series of comments with Dr. Trenberth over his recent paper on the Climate Science website:

Trenberth’s [and co-author, NCAR scientist John Fasullo], however, are grasping for an explanation other than the actual real world implication of the absence of this heat.

  • First, if the heat was being sequestered deeper in the ocean (lower than about 700m), than we would have seen it transit through the upper ocean where the data coverage has been good since at least 2005. The other reservoirs where heat could be stored are closely monitored as well (e.g. continental ice) as well as being relatively small in comparison with the ocean.
  • Second, the melting of glaciers and continental ice can be only a very small component of the heat change (e.g. see Table 1 in Levitus et al 2001 “Anthropogenic warming of Earth’s climate system”. Science).

Thus, a large amount heat (measured as Joules) does not appear to be stored anywhere; it just is not there.

“I do not agree with your comments. We are well aware that there are well over a dozen estimates of ocean heat content and they are all different yet based on the same data,” said Dr. Trenberth in reply. “There are clearly problems in the analysis phase and I don’t believe any are correct.” Clear admission that climate scientists are groping in the dark here.

“I do not see how such large amounts of heat could have transited to depths below 700m since 2005 without being detected.,” responded Pielke, adding in a conciliatory way: “I am very supportive, however, of your recognition that it is heat in Joules that we should be monitoring as a primary metric to monitor global warming. Our research has shown significant biases in the use of the global average surface temperature for this purpose.”

Research done over the last several years has found that the return currents of the meridional overturning current (MOC) do not behave as previously thought (see “Conveyor Belt Model Broken”). More recently, it has been shown that the great ocean conveyor belt varies in ways unpredicted and previously unsuspected (see “Ocean Conveyor Belt Confounds Climate Science”). During the first 1-year period since new deep sea sensors became operational (measurements from March 2004 through March 2005) the strength of the MOC varied by more than a factor of 8. It still remains unclear how much the meridional overturning circulation varies from year to year, but the old model was clearly wrong.

New sensors reveal unsuspected behavior. Source CSIRO.

Now, the ocean is suspected of harboring hidden heat that scientists claim has gone missing. Some claim the heat is not there, while others, like Trenberth and Fasullo, fear that the missing heat will “come back to haunt us.” One thing is certain—those old claims of “settled science” and a “consensus among the world’s scientists” seem to have come back to haunt their originators. The overstatements made by the IPCC and its supporters in the past stand revealed for the empty lies they always were.

Trenberth and Fasullo state that it is imperative to get better measurements of the energy flowing through Earth’s climate system. Improved analysis of energy in the atmosphere and oceans might help researchers better understand and possibly even predict unusual weather patterns, such as the unexpectedly cold weather across much of the United States, Europe, and Asia over the past winter. But for now, no scientist can claim that we truly understand what is going on in Earth’s oceans—and that means climate science cannot claim to understand what is going to happen to Earth’s climate.

International activist arrested on false accusations in Sheikh Jarrah

Illegal colonist throws eggs in a separate incident
International Solidarity Movement | 19th April 2010

At approximately 11.30pm on the 18th April, a British ISM activist, Robin Brown, was arrested in Sheikh Jarrah having been falsely accused by Israeli settlers of attacking them with tear gas. Those present in the hours leading up to his arrest insist this cannot possibly be true. Brown was released from police custody at 3am on the 19th – recognition from the police that there was absolutely no evidence to support the settlers’ accusations.

Earlier in the evening, settlers had attempted to destroy a mural that was recently painted in the front garden of the Al Kurd home, half of which is occupied by settlers. Running past the wall, they threw cupfuls of white paint at the mural before fleeing down the street. Despite their later claims to police, there was no confrontation in the street between them and the Palestinian residents of the neighbourhood, or the international activists who were also present.

The previous night, Israeli settlers attacked local residents in the street, pepper spraying two of them. As the police say that, when called to the area on the night of the 18th, a settler did show signs of having been gassed, it seems possible that this was inflicted upon him by a fellow settler, still in possession of the pepper spray used the night before. The police who arrested and interrogated Brown found no traces of any kind of gas or spray on his hands, clothes or bag, proof that, if any gas was used, it did not come from him.

Brown says, “It is clear that settlers have decided to try to find ways to get rid of the international activists who sit in solidarity with Sheikh Jarrah residents, and who document the violence and harassment that is inflicted upon them by the settlers. Settlers frequently make up lies in an attempt to get Palestinians arrested. It’s no surprise that they’re now doing the same to internationals”.

Gen McChrystal: No Proof Iran Sending Fighters or Weapons to Afghanistan

By Jason Ditz, April 16, 2010

Despite several claims made to the contrary over the past several months, US commander Gen. Stanley McChrystal today conceded that there was no proof that the Iranian government has been sending fighters or weapons to Afghanistan.

At the same time McChrystal did note that some weapons and ammunition have crossed the border from Iran to Afghanistan and that some Taliban may have even trained inside Iran, but that they were not “operationally significant” amounts.

Secretary of Defense Robert Gates had last month accused Iran of supporting the Taliban behind the scenes, despite Iran’s formal ties with the Karzai government and long history of animosity [toward the Taliban].

Though the flow of arms back and forth across the long, largely unguarded border is perhaps unsurprising, the claims of training camps operating in the area around Zahedan suggest that the more reasonable explanation is that Taliban receiving training there could well be forging ties with the Sunni insurgency in the Sistan-Balochistan region as opposed to the Iranian government.

Oxburgh’s 5 page Climategate book report gets a failing grade

Watts Up With That | 14 04 2010

I’ve read blog posts longer than this report. The Global Warming Policy Foundation of London has this to say about it:

Another Unsatisfactory Rushed Job

Press release

LONDON, 14 April 2010 – The Global Warming Policy Foundation regrets that the Oxburgh Panel has been rushed and therefore extremely superficial. The body of the report is hardly five pages long. The Panel should have taken more time to arrive at more balanced and more trustworthy conclusions as there was no need to rush the inquiry.

The Panel worked by interviewing and questioning staff members of CRU, but failed to interview critical researchers who have been working in the same field for many years. The Panel even ignored, as it admits, to properly review their written evidence.

We welcome the acknowledgement by the Panel that the Urban Heat Island effect on surface temperatures records in and around large cities is important but poorly understood. We also welcome the admission that the IPCC ignored the expressions of uncertainty in CRU papers.

We also note, in the context of the long-term temperature record, its comment that “the potential for misleading results arising from selection bias is very great in this area. It is regrettable that so few professional statisticians have been involved in this work.”

In general, the report is being politely kind to CRU, but in essence rather critical of the disorganised and amateurish use of statistics. It is hardly an endorsement of the quality of the research being carried out at what is supposed to be the world’s leading unit which has received so much government funding.

Given the huge economic and social implications, one would expect that an independent audit would be more rigorous and more even-handed than the Oxburgh panel.

– end

Steve McIntyre writes that he wasn’t interviewed:

Oxburgh’s Trick to Hide the Trick

The Oxburgh report ” is a flimsy and embarrassing 5-pages.

They did not interview me (nor, to my knowledge, any other CRU critics or targets). The committee was announced on March 22 and their “report” is dated April 12 – three weeks end to end – less time than even the Parliamentary Committee. They took no evidence. Their list of references is 11 CRU papers, five on tree rings, six on CRUTEM. Notably missing from the “sample” are their 1000-year reconstructions: Jones et al 1998, Mann and Jones 2003, Jones and Mann 2004, etc.)

They did not discuss specifically discuss or report on any of the incidents of arbitrary adjustment (“bodging”), cherry picking and deletion of adverse data, mentioned in my submissions to the Science and Technology Committee and the Muir Russell Committee. I’ll report on these issues later in the day as they’ll take a little time to review. First, let’s observe Oxburgh’s trick to hide the “trick”.

Long before Climategate, Climate Audit readers knew that you had to watch the pea under the thimble whenever you’re dealing with the Team. This is true with Oxburgh of Globe International as well.

Oxburgh of Globe International alludes to the “trick..to hide the decline” in veiled terms as follows:

CRU publications repeatedly emphasize the discrepancy between instrumental and tree-based proxy reconstructions of temperature during the late 20th century, but presentations of this work by the IPCC and others have sometimes neglected to highlight this issue. While we find this regrettable, we could find no such fault with the peer-reviewed papers we examined.

Without specifically mentioning the famous “trick …to hide the decline”, Oxburgh subsumes the “trick” as “regrettable” “neglect” by “IPCC and others”.

But watch the pea under Oxburgh’s thimble.

The Oxburgh Report regrettably neglected to highlight the fact that CRU scientists Briffa and Jones, together with Michael Mann, were the IPCC authors responsible for this “regrettable neglect” in the Third Assessment Report. They also regrettably neglected to report that CRU scientist Briffa was the IPCC author responsible for the corresponding section in AR4.

Oxburgh pretends that the fault lay with “IPCC and others”, but this pretence is itself a trick. CRU was up to its elbows in the relevant IPCC presentations that “regrettably” “neglected” to show the divergent data in their graphics.

Katyn and ‘The Good War’

By Patrick J. Buchanan | April 13, 2010

The decapitation of the Polish government last weekend, including President Lech Kaczynski and the military leadership, on that flight to Smolensk to commemorate the Katyn Massacre, brings to mind the terrible and tragic days and deeds of what many yet call the Good War.

From Russian reports, the Polish pilot waved off four commands from air traffic control to divert to Moscow or Minsk. The airfield at Smolensk was fogged in. There is speculation that Kaczynski, fiercely nationalistic and distrustful of Russians, may have defiantly ordered his pilot to land, rather than delay the 70th anniversary of Katyn. The symbolism is inescapable.

For it was Polish defiance of Adolf Hitler’s demand to negotiate the return of Danzig, a German town put under Polish control after World War I, that gave birth to the Hitler-Stalin Pact, which led to Katyn.

After the German invasion on Sept. 1, 1939, ignited the war, Joseph Stalin attacked Poland from the east on Sept. 17, capturing much of the Polish officer corps.

In April 1940, on Stalin’s order, the Soviet Secret Police, the NKVD, murdered virtually the entire leadership of the nation, including 8,000 officers and near twice that number of intellectuals and civilian leaders. Some 4,000 were shot with their hands tied behind their backs in Katyn Forest.

The Germans unearthed the bodies in 1943 and invited the Red Cross in to examine the site. Through newspapers found on the corpses, the date of the atrocity was fixed as more than a year before the German army invaded the Soviet Union.

When Polish patriots, whose sons had flown with the Royal Air Force in the Battle of Britain, went to Winston Churchill to demand that he get answers from Stalin about the atrocity, he brushed them off.

“There is no sense prowling around the three-year-old graves of Smolensk,” said the Great Man.

At Stalin’s request, Churchill bullied the Poles into acceding to Soviet annexation of all the Polish land Stalin had been awarded for signing his pact with Hitler.

At the Nuremberg trials, the Russian delegation, led by Andrei Vishinsky, the prosecutor who did Stalin’s dirty work in the purge trials, charged the Germans with the massacre.

This presented a problem for the Americans and British who knew the truth. They finessed the issue by leaving the charge unresolved.

Before, during, and after the Nuremberg trials that would convict the Nazis of “crimes against humanity,” one of the greatest crimes against humanity in history was being committed. Fifteen million Germans – old men, women, children – were driven like cattle out of ancestral homes in Prussia, Pomerania, Brandenburg, Silesia, and the Sudetenland.

As human rights champion Alfred de Zayas wrote in his courageous Nemesis at Potsdam: The Anglo-Americans and the Expulsion of the Germans, perhaps 2 million died in the exodus. Few German women in Eastern Europe escaped rape.

The Allies turned a blind eye to the monstrous atrocity, as ancient names vanished. Memel became Klaipeda. Prussia disappeared. Koenigsberg, the city of Immanuel Kant, became Kaliningrad. Danzig became Gdansk. Breslau became Wroclaw.

“The Germans deserved it, for what they did,” comes the retort.

Undeniably, the Nazi atrocities were numerous and horrible – against Poles, Ukrainians, Russians, Jews.

Yet, it was innocent Germans who paid for the crimes of the guilty Germans.

What happened in Eastern and Central Europe from 1939 to 1948 provided proof, if any more were really needed, of the truth of W.H. Auden’s insight in his poem “September 1, 1939″: “Those to whom evil is done do evil in return.”

At war’s end, Churchill and Harry Truman agreed to repatriate 2 million Soviet prisoners of war to Stalin, none of whom wished to go back. For return to Russia meant death at the railhead or a short, brutal life at slave labor in the Gulag Archipelago.

Operation Keelhaul was the name given the Allied collusion with the Red Army in transferring these terrified POWs back to their deaths at the hands of the same Soviet butchers who had done the murdering at Katyn.

On Sept. 3, 1939, Britain and France declared war on Germany to restore the integrity and independence of Poland. For this great goal they converted a German-Polish clash that lasted three weeks into a world war lasting six years.

And was Poland saved? No. Poland was crucified.

As a consequence of the war begun on her behalf, millions of Poles – Jews and Catholics alike – perished, the Katyn massacre was carried out, the Home Army was annihilated, the nation suffered five years of Nazi rule and almost half a century of communist persecution.

The tragedy of today is that it was men of the postwar generation, like Lech Kaczynski, who kept the faith of their fathers and led Poland out of that darkness into the sunlight of freedom, who died seeking to pay homage to their fathers who suffered one of the greatest crimes of that bloodiest of centuries.

U.S. Banks Hid Risk by Lowering Debt Before Reporting, WSJ Says

By Chris Peterson and James Gunsalus | Bloomberg | April 9, 2010

U.S. banks masked their true risk levels by temporarily lowering debt before reporting it, the Wall Street Journal said, citing data provided by the Federal Reserve Bank of New York.

Goldman Sachs Group Inc., Morgan Stanley, JPMorgan Chase & Co., Bank of America Corp., Citigroup Inc. and 13 other banks all understated the amount of debt used to pay for securities trades by cutting them by an average of 42 percent at the end of five quarterly periods; the debt levels were then boosted midway through each quarter, the newspaper said.

After the collapse of Lehman Brothers Holdings Inc., spurred in part by excessive borrowing, in 2008, banks have become more concerned that reporting high debt levels could jeopardize share prices and credit ratings, the Journal said. While not illegal, the practice can distort investors’ impression of risk being taken by banks, the report said.

Hong Kong-based spokespeople for Goldman Sachs, Morgan Stanley, JPMorgan and Citigroup declined to comment on the Fed data or the report. Banks not identified in the report confirmed that they temporarily cut borrowings at the end of a quarter and some noted their regulatory filings tell investors debt levels can rise and fall during the quarter, the Journal said.

Regulation of the financing activity data documented by the New York Fed falls under the auspice of the Securities and Exchange Commission, the U.S. brokerage watchdog, the report said, citing an unidentified official at the Federal Reserve Board. The New York Fed declined to comment, it said.

The SEC has inquired with about 24 large financial firms about the practice, indicating the agency is interested in finding accounting techniques that could mask a firm’s risk- taking, according to the Journal.

Fed data that captures the accounting shows it has occurred periodically since recording started in 2001, though not as consistently as in 2009, the paper said.

Protectionism didn’t cause the Great Depression

By Ian Fletcher | Online Journal | April 8, 2010

The debate over free trade is riddled with myth after myth. One that keeps resurfacing again and again, no matter how many times it is discredited, is the idea that protectionism caused the Great Depression. One occasionally even hears that the same protectionism — specifically the Smoot-Hawley tariff of 1930 — was responsible in significant part for World War Two! This is nonsense dreamed up for propaganda purposes by free traders, and can easily be debunked.

Let’s start by reminding ourselves of a basic fact: the Depression’s cause was monetary. The Federal Reserve had allowed the money supply to balloon excessively during the late 1920s, piling up in the stock market as a bubble. The Fed then panicked, miscalculated, and let the money supply collapse by a third by 1933, depriving the economy of the liquidity it needed to breathe. Trade had nothing to do with it.

The Smoot-Hawley tariff was simply too small a policy change to have so large an effect as triggering a depression. For a start, it only applied to about one-third of America’s trade: about 1.3 percent of our GDP. One point three percent! America’s average tariff on goods subject to tariff went from 44.6 to 53.2 percent — not a very big jump at all. America’s tariffs were higher in almost every year from 1821 to 1914. Our tariffs went up in 1861, 1864, 1890, and 1922 without producing global depressions, and the great recessions of 1873 and 1893 spread worldwide without needing the help of any tariff increases.

If Smoot-Hawley had caused a global trade disaster, it would necessarily have been by triggering a sharp decline in American imports of goods subject to the increased tariff. Did this happen? The data say no.

In the words of economic historian, former member of the U.S. International Trade Commission, and avowed free trader Prof. Alfred E. Eckes, “Official data show that higher U.S. tariffs had little impact on American imports. From 1929 to 1932, imports of dutiable and duty-free goods fell almost the same percentage, suggesting that higher tariffs had little impact on most trading partners . . . The sharpest drop in exports involved commodity-exporting countries, including some like Brazil, largely unaffected by higher U.S. tariffs.”

World trade did indeed decline, but this was due to the Depression itself, not higher American tariffs. This is no surprise, as declines in the values of the currencies of America’s major trading partners wiped away much of the effect of the tariff anyway.

In light of the facts noted above, it is, in fact, true that just about every serious economist or economic historian — as opposed to the ideologues of the editorial pages or the think tanks — who has examined this question in detail has come to the same conclusion. This is not a liberal vs. conservative issue, either: famous economists who have denied that Smoot-Hawley caused the Depression range from Milton Friedman on the right to Paul Krugman on the left.

The same fact can be ascertained by looking at Smoot-Hawley’s impact on the world economy at large. As the economic historian (and free trader) William Bernstein puts it in his book A Splendid Exchange: How Trade Shaped the World, “Between 1929 and 1932, real GDP fell 17 percent worldwide, and by 26 percent in the United States, but most economic historians now believe that only a miniscule part of that huge loss of both world GDP and the United States’ GDP can be ascribed to the tariff wars . . . At the time of Smoot-Hawley’s passage, trade volume accounted for only about 9 percent of world economic output. Had all international trade been eliminated, and had no domestic use for the previously exported goods been found, world GDP would have fallen by the same amount — 9 percent. Between 1930 and 1933, worldwide trade volume fell off by one-third to one-half. Depending on how the falloff is measured, this computes to 3 to 5 percent of world GDP, and these losses were partially made up by more expensive domestic goods. Thus, the damage done could not possibly have exceeded 1 or 2 percent of world GDP — nowhere near the 17 percent falloff seen during the Great Depression . . . The inescapable conclusion: contrary to public perception, Smoot-Hawley did not cause, or even significantly deepen, the Great Depression.”

The oft-bandied idea that Smoot-Hawley started a global trade war of endless cycles of tit-for-tat retaliation is also mythical. According to the official State Department report on this very question in 1931: “With the exception of discriminations in France, the extent of discrimination against American commerce is very slight . . . By far the largest number of countries do not discriminate against the commerce of the United States in any way.”

That is to say, foreign nations did indeed raise their tariffs after the passage of Smoot, but this was a broad-brush response to the Depression itself, aimed at all other foreign nations without distinction, not a retaliation against the U.S. for its own tariff. The doom-loop of spiraling tit-for-tat retaliation between trading partners that paralyses free traders with fear today simply did not happen.

The myth of Smoot-Hawley continues to poison U.S. policymaking even today, as it renders the U.S. government fearful of retaliating against problems like Chinese currency manipulation. But hopefully, the present controversy over free trade will eventually provoke enough public debate that this hoary myth can finally be put to bed forever. “It really shows what’s been going on in the Arctic – it’s falling apart”

GE sponsors 15-year-old on polar trip

Shortly after twice reporting a temperature of -34 C, he suggests that the ice is “falling apart” around him.

Skiing and trekking to the North Pole: Parker Liautaud blogs to save the earth – Update

Parker Liautaud, 15 years old, is reporting on his progress skiing his way to the North Pole. He has made his goal to become the youngest person to ski to the North Pole, and to use that attempt to bring greater awareness to the urgent environmental issues of the arctic.
…
And more importantly for his purpose of letting the world see the ravages of global warming on the arctic – There was a lot of open water today. It really shows what’s been going on in the Arctic – it’s falling apart. Right now we’re camping on this patch of old ice, but all around us is open water, broken and thin ice. To our north there’s a massive pan of very thin ice. Everything is freshly frozen, if not open.

That’s called “leads” kid, part of the regular landscape well before your trip. Oh but wait…what is the Temperature? Thanks to Twitter reports we know.

Twitter / Parker Liautaud: Temp -34, Windchill -42. W …
Temp -34, Windchill -42. We did about 11 Nm today, it was a really good day. We have about 35 Nm left, and about 5 before we’re half way. 3:00 PM Apr 4th via API   [His previous tweet also reported a temperature of -34]

Son of Venture Capitalist Gets Foursquare Badge for Polar Trip – DealBook Blog – NYTimes.com

Normally if you’re the teenage child of a multimillionaire, you might expect a nice car or designer clothing as a present, VentureBeat reported.

But if you’re the 15-year-old scion of Bernard Liautaud, who founded and later sold Business Objects to SAP for $6.78 billion and is now a partner at Balderton Capital, you can probably do a lot better.
…
Mr. Liautaud fils rounded up a sponsorship from G.E. for a trip to the North Pole promoting environmental awareness.

Of course, anybody can go to the North Pole, and blog about it, by paying a tour guide like this one that is with the 15 year old right now.

From the San Fransisco Examiner “offbeat places” blog:

Parker’s journey is part of an expedition that is open to the public. For more than 10 years, Doug Stoup has been guiding teams across the frozen Arctic Ocean and Antarctica. From numerous ‘Last Degree‘ treks to his most recent 660-mile  epic journey to the South Pole.

Cost: €25,700 but for a quickie (I’ll bet you didn’t know you could do this as a quickie), fly from Longyearbyen to Ice Station Barneo, then take a helicopter to 89.599? North. Spend some quality time on the ice for photos and celebration and then return. Cost: €16,900.

I always like to encourage young minds in science, but this is just a glorified field trip with a guide. What a bunch of suckers GE is for paying for such an expedition.

The ice from Cryosphere Today looks better than 30 years ago.
