Antonio Buehler Found Not Guilty After Austin Cop Breaks Blue Code of Silence, Testifying on his Behalf

By Ben Keller | PINAC | October 29, 2014

From left to right, surprise witness Jermaine Hopkins, an Austin police officer who testified on Antonio Buehler’s behalf, attorney Millie Thompson and Antonio Buehler, who was found not guilty for a 2011 case where he was arrested for photographing Austin police.

Deliberations in the trial of Peaceful Streets Project founder Antonio Buehler lasted five hours before a Texas jury returned with a not guilty verdict Wednesday after an Austin police officer surprisingly testified on Buehler’s behalf – most likely losing his job in the process.

Buehler was on trial for an incident that occured on New Years Eve of 2012 where he witnessed Austin officers abusing the passenger of a vehicle during a routine DWI stop. The stop was being conducted by the now-infamous officers Patrick Oborski and Robert Snider when Buehler began taking pictures, sparking a verbal confrontation.

Buehler probed the officers with questions as he took pictures of the male officers holding the female passengers in a torture hold, known as the Strappado where her arms were cuffed behind her back and pulled upwards. Buehler can be heard in the video asking officers, “What are you doing?” Buehler described the hold as ‘being meant for causing extreme pain.”

The photo that got Antonio Buehler arrested

The verbal confrontation turned into a physical struggle as Oborski aggressively approached Buehler. Buehler put his hands in the air to show he wasn’t a threat to any of the officers. Buehler then began asking Oborski, “why are you touching me?”

Oborski then gave Buehler an unlawful order to put his hands behind his back. Buehler never did that. And Oborski then wrestled Buehler to the ground. Later that night, Antonio was booked into jail on felony charges claiming that Buehler spit in Oborski’s face, where he faced a potential 2-10 years in prison.

That, of course, never happened. But luckily, someone was filming across the street to prove that it never happened.

The biggest bombshell came when Oborski testified against himself. He testified to the jury that it was actually just a little bit of ‘spittle’ and that when Buehler was asking him questions that he had managed to somehow get a little ‘spittle’ on his face. This implies what Buehler and others have been saying for three years now. That Buehler never spit in that cop’s face. Oborski made it all up and tried to send him to prison for contempt of cop. The video is proof of that.

The gravity of this case carries many implications, not only about the character of the Austin Police Department throughout the ranks, but the trial also holds implications for a future civl lawsuit against Oborski. In Texas, it’s typically, according to most lawyers here, a tough row to hoe if you want to sue the government. Tort laws make it seemingly more difficult than most states.

But the judge in Buehler’s civil case allowed that Obroski can be sued in his personal capacity and that the claim Buehler filed against Oborski can go forward.

Surprise cop witness

There were a few surprises throughout this trial (perhaps well thought out by Buehler and his legal team). If any one is ever relentless about the notion that there really aren’t any good cops, it’s Buehler. But during this trial, Buehler surprised the prosecution with a star witness, Austin police officer Jermaine Hopkins, who was told by APD brass that if he testified, he would lose his job by October 30th, which is today.

Hopkins testified anyway, telling jurors that Buehler had broken no law and that his fellow officers had violated his Constitutional rights by arresting him.

Hopkins has a hearing tomorrow to determine his fate with the department. He said he sent Buehler an email after seeing his case and wanted to testify out of concern that Buehler’s rights were being violated.

Hopkins said in an interview with PINAC after the verdict that there are some good things about his department, but ultimately he has no regrets and that he did the right thing by testifying. He also said if he could change anything it would be “accountability at the administrative level.”

When asked by a bystander in the courtroom what his future holds, Hopkins said he is thinking about going to law school.

Another surprise occurred at the beginning of the trial when one juror asked to be released from the jury citing personal troubles. Buehler’s attorney, Millie Thompson said the juror was having symptoms of mental illness including paranoia and an inability to make a decision in a jury, because of fear from a group.

Although, the juror never specified to the court any particular group. Thompson said she didn’t object to the juror being dismissed. But she did object to the state’s request for a mistrial.

The Judge sided with Thompson and the trial went on with only five jurors.

The deciding jury was made up of two males and three females, one who worked as a writer for Beavis and Butthead. None were interested in commenting to PINAC or any other media outlet. But we caught up with Buehler and Hopkins outside the courtroom.

When asked after the trial what the future holds for Buehler’s activist group, Peaceful Streets Project, a group that films on duty cops, Buehler replied, “Hopefully, to grow it.”

But he also has three more charges to fight as well as a civil suit to pursue as he explains in the video.

SodaStream closes illegal settlement factory but remains actively complicit in the displacement of Palestinians

Palestinian Students’ Campaign for the Academic Boycott of Israel | October 30, 2014

Palestinian boycott, divestment and sanctions (BDS) activists today welcomed the news that SodaStream has announced it is to close its factory in the illegal Israeli settlement of Mishor Adumim following a high profile boycott campaign against the company.

“SodaStream’s announcement today shows that the boycott, divestment and sanctions (BDS) movement is increasingly capable of holding corporate criminals to account for their participation in Israeli apartheid and colonialism,” said Rafeef Ziadah, a spokesperson for the Palestinian Boycott, Divestment and Sanctions National Committee (BNC), the broad coalition of Palestinian civil society organisations that leads and supports the BDS movement.

“BDS campaign pressure has forced retailers across Europe and North America to drop SodaStream, and the company’s share price has tumbled in recent months as our movement has caused increasing reputational damage to the SodaStream brand,” she added.

The news of this major success against a company famed for its role in illegal Israeli settlements broke amidst intensifying demonstrations against Israel’s policies of colonisation in Jerusalem.

Grassroots boycott activism saw SodaStream dropped by major retailers across North America and Europe including Macy’s in the US and John Lewis in the UK.

SodaStream was forced to close its flagship store in Brighton in the UK as a result of regular pickets of the store.

Soros Fund Management, the family office of the billionaire investor George Soros, sold its stake in SodaStream following BDS pressure.

SodaStream’s share price fell dramatically in recent months as sales dried up, particularly in North America.

After reaching a high of $64 per share in October 2013, the stock fell to around $20 per share this month. SodaStream has estimated its third quarter revenue will be $125 million, down almost 14 percent from the same period last year.

But Ziadah warned that SodaStream will still remain actively complicit in the displacement of Palestinians and will remain a focus of boycott campaigning.

“Even if this announced closure goes ahead, SodaStream will remain implicated in the displacement of Palestinians. Its new Lehavim factory is close to Rahat, a planned township in the Naqab (Negev) desert, where Palestinian Bedouins are being forcefully transferred against their will. Sodastream, as a beneficiary of this plan, is complicit with this violation of human rights,” she said.

SodaStream’s participation in Israel’s forced displacement of Palestinians gained international notoriety when A-list celebrity Scarlett Johansson signed up to be a brand ambassador for the company. Following an international campaign urging Oxfam end its relationship with Johansson for endorsing SodaStream, the actor decided to quit Oxfam.

SodaStream has also come under fire for its treatment of Palestinian workers in its West Bank factory, as Ziadah explains:

“Any suggestion that SodaStream is employing Palestinians in an illegal Israeli settlement on stolen Palestinian land out of the kindness of its heart is ludicrous.”

“Palestinian workers are paid far less than their Israeli counterparts and SodaStream recently fired 60 Palestinians following a dispute over food for the breaking of the Ramadan fast. Workers have previously said they are treated ‘like slaves’”.

“Palestinians are forced to work inside settlements in sub-standard conditions because of Israel’s deliberate destruction of the Palestinian economy. There’s an urgent need for the creation of decent and dignified jobs within the Palestinian economy.”

SodaStream have said all workers will be offered jobs at its new plant, although Israel’s apartheid wall and severe restrictions on movement will make the commute to the new plant difficult for its Palestinian workers.

All of the main Palestinian trade unions have called for boycott and are members of the Palestinian BDS National Committee, the civil society coalition that leads the BDS movement and helped to initiate the campaign against SodaStream.

Reseacher: Peruvian Government Has Political Debt with Forced Sterilization Victims

teleSUR | October 29, 2014

Eighteen years have passed and those who were forcefully sterilized in Peru have obtained no justice even though the issue was key for the electoral victory of current president Ollanta Humala.

On Wednesday, author and researcher Alejandra Ballon accused the current administration of president Ollanta Humala of using the case of forced sterilizations for political gain and failing to follow through with seeking justice for the victims.

Ballon is the author of the first book on the issue, released earlier this month with the support of the National Library of Peru. It is titled Memoirs of the Peruvian Case of Forced Sterilizations.

Crimes Against Humanity

Over 300,000 people, mostly indigenous women, were forcefully sterilized by the Fujimori regime during the 1990s. The program sought to reduce the number of children in poor rural indigenous families by deceiving and threatening them and even operating on them without them knowing. For those reasons the crimes are being described as genocide.

Sometimes, the signature of the victim’s relatives was used to go ahead with the process without consent. Sometimes the victims were operated on secretly after giving birth. The program was implemented nationally but the methods were not systematic. However, the government gave official quotas to each post for specific periods of time and medical personal were required to comply.

The results were brutal. There are several reports on the effects of such crimes including psychological and physical impairments of the victims and the effects on their relatives. “Women lost their physical strength and could no longer work as farmers, but also many were abandoned by their male partners, and forced to emigrate to the cities,” explained Ballon.

“It is not only the irreversibility of the operation and that women were made sterile against their will, but on top of that there are physical, mental, family, community, agricultural and cultural consequences,” asserts Ballon.

She described a case in Huancabamba where many women were dedicated to sewing using an ancestral, pre-Incan method called Cahihua, which uses the stomach. “It is one of the cultural legacies that we have in the country and we should take care of it,” argues Ballon. However, she explained that this sewing method uses a tool that places pressure on a person’s belly, and after being operated, the pain from the scar would not allow them to sew in that traditional manner. Ballon discovered this problem in 2012 but no systematic method has been implemented to be able to find all the other ways in which this criminal program has affected people’s lives.

The Case of Victoria Vigo

Victoria Vigo is one of the women who was forcefully sterilized. Right after a miscarriage in 1996, doctors secretly mutilated her reproductive organs to comply with the sterilization quota ordered by the regime.

She explains how she found out about her operation. “The doctor who was next to me and taking care of me told another doctor that what is happening is that my baby has passed away,” she explained, and the new doctor “turned around and told me ‘don’t worry you are young and you can have another baby.’” But the first doctor responded, ‘No, she has already been sterilized,’ and that is how I found out what they did to me,” says Victoria.

Victoria explains her feelings at the time. “When one loses a child, a longing to have another child stays… When you lose something you immediately want it. I wanted to have a child … but friends who are doctors talked with me and told me, no Victoria, it is irreversible,” she said.

Political Debt of President Humala

Ollanta Humala picked up the struggle for justice for these cases during his presidential bid. Many believe that such a move gave him the edge to win the election in the second round. He was running against Keiko Fujimori, daughter of Alberto Fujimori, the dictator in charge of the country when the sterilizations took place. During a presidential debate, Humala raised the issue and used it to attack Keiko. However, little has been done after his victory to investigate and obtain justice.

For those reasons, the victims are saying Humala only used them for political gain and he has no interest in their struggle or pain. Ballon has come out in their support. She argues that current president Ollanta Humala has a political debt with these women because he was partly able to win the election by promising in depth investigations into the matter.

Failures of Society

Ballon goes further than pointing out the failures of Humala. She calls these cases the “gravest violations committed against indigenous woman since the colonial times.”

“We are not understanding as a society what we can learn about ourselves through these women. They can tell us about how it was done so that we can learn who we are, what are we doing and to what point can we prevent a future possibility of repeating it.”

Ballon explains that the implementation of the program also shows chauvinism in society. Out of the 300,000 sterilized people, 22,000 were males. “There was gender discrimination in the program even though a man can procreate hundreds of kids and a woman has a limited number of children she can have,” points out Ballon. She concludes that “this is not a result of only the program but the social constructs of the country.”

In a similar way, racism must have been operating in society to permit such crimes. Ballon uses postcolonial theory to explain why indigenous populations, Quechua speaking, were the main target. She explains how hierarchies and racism imposed during colonial times have made committing and justifying such crimes against indigenous populations possible.

The National Library of Peru is investing in a collection of books, including Ballon’s, called La Palabra del Mudo (The Mute Person’s Word) that are using postcolonial theory to record and give voice to those who have not been included in the official histories. The ultimate goals are to strengthen democracy, recover memories, and construct new and inclusive narratives about Peru.

Torture in Israeli prisons: 200 methods used against Palestinian prisoners

palestinians-being-arrested-by-israeli-soldiers-palestinian-prisoners-detainees

Methods range between severe beatings, putting prisoners under cold water followed by hot water, cuffing or restraining them with their arms behind them and then tying them to a door or window for long periods of time, often lasting hours.
MEMO | October 29, 2014

Hundreds of torture methods used against Palestinian prisoners during interrogations conducted in Israeli prisoners have been observed by human rights organisations and prisoners’ rights associations.

A report by the United Nations lists around 200 methods of torture. The Israeli rights group B’Tselem listed around 105 torture methods. Regardless of the number, all these reports indicate a grave level of violations perpetrated against Palestinians following their arrest.

Fouad Khuffash, director of the Ahrar Centre for Prisoners’ Studies and Human Rights, suggests that torture can be divided into two categories; physical and psychological. Some believe that psychological torture is less harmful than physical torture, but the mental scars left by both can leave prisoners traumatised long after their release.

Khuffash adds: “Torture in Israeli prisons is systematic and starts from the moment a prisoner is arrested, not from the moment they begin interrogation. This is a premeditated and staged scenario that changes according to the case of the detainee and the nature of their file. Investigators alternate and play various roles assigned in advance to each investigator.”

Fahd Abu Al-Hajj, director of the Abu Jihad Centre for Prisoner Affairs at the University of Jerusalem, noted that there are 73 methods of interrogation considered to be the “most popular” in Israeli jails. These methods demonstrate the barbarism of the occupation and its lack of respect for basic standards of human rights, he stated.

He added: “Nothing evidences this more than the repeated death of prisoners under interrogation, the most recent of which was the death of the prisoner Raed Al-Jabari.”

Al-Hajj believes that the use of torture is systematic, adopted by the Israeli intelligence services and that no prisoner detained in any Israeli prison is spared.

He also explained that these methods range between severe beatings, putting prisoners under cold water followed by hot water, cuffing or restraining them with their arms behind them and then tying them to a door or window for long periods of time, often lasting hours. Prisoners are also made to sit on chairs and beaten with sticks until they lose consciousness. These beatings may target sensitive areas of their bodies which have the potential to leave long-term negative effects, sometimes leading to chronic diseases.

Forms of torture

Israeli human rights organisation B’Tselem acknowledged in its report that 105 torture methods are used against Palestinian detainees which are considered serious violations of human rights. A UN human rights committee described the torture in Israeli prisons as “crossing the line”, noting that Israel’s brutal methods of torture included breaking backs, pulling fingers apart and twisting testicles.

Israeli intelligence bases their torture of detainees on the so-called secret guidelines that were approved in 1987, after the outbreak of the first Intifada. These guidelines allow them to apply “moderate” physical and psychological pressure on prisoners. This gives a legal cover to the torture practiced by Israeli intelligence agents.

In the last 10 years, interrogators have decreased their use of torture, moving away from physical torture and instead used harsh psychological methods that can leave enduring scars, while continuing to use direct physical torture of varying degrees.

Mohammed Kilani, who has experienced many interrogations, noted that his solitary confinement which exceeded two months during which he was forced to remain chained to a chair, was the harshest method of torture he has suffered.

He also added that throughout the entire prison system across the globe, there exists no torture method that has not been thought of or used by the Israeli authorities at some point.

According to statistics, around 72 prisoners were killed as a result of torture in Israeli prisons since 1967, out of a total number of over 200 prisoners who died behind bars.

The first prisoner to die as a result of being tortured was Yousef Al-Jabali who died on January 4 1968 in a Nablus prison. Many prisoners have since followed him, such as Qassem Abu Akar, Ibrahim Al-Rai, Abdul Samad Harizat, Attia Za’anin, Mustafa Akkawi, and others, including the most recent, Raed Al-Jabari.

SOME HARD FACTS ABOUT TERROR

By John Chuckman | October 27, 2014

We are having an outbreak of reports in the Canadian press about “home grown” terrorists, “radicalized” young men of Muslim faith traveling out of the country to participate in extremist groups abroad, a relatively insignificant phenomenon which has received inordinate publicity. In any event, if you give the matter some thought, you realize that this “news” is a kind of empty publicity, noise about something as old and familiar as human life itself, although it has been bestowed with a new name intended to frighten us into supporting measures outside the framework of a society of laws.

The truth is that young men, at least a certain portion of them, have always traveled abroad to join causes and wars. It’s about as ordinary a phenomenon as playing team sports or joining clubs. In many cases, we end up praising them for their bravery and idealism, as was certainly the case with the many thousands of Europeans, Americans, and Canadians who traveled to Spain in the 1930s to volunteer in the civil war against General Franco. In other cases, we condemn and imprison them and sometimes even execute them as part of the losing side, as America has been doing in its rampage through the Middle East.

In the 1950s and 1960s, the emergence of new, independent nations from the British Empire drew thousands of young men to Africa to fight as mercenaries or volunteers. Apartheid South Africa used to run classified ads in newspapers abroad to attract young men in its battle against the African National Congress. Young Jewish men in the past went to Israel to join the IDF out of some sense of brotherhood, and they do so still. The French Foreign Legion gained almost mythical status as a place for young men to leave things behind, embracing an undefined sense of purpose and brotherhood. Young European adventurers, often young noblemen with hopes of gaining glory, sailed across the Atlantic in the 1770s to volunteer in the American colonies’ revolt against the British Empire, far more of them than Washington’s meagre army could use.

Magnetic leaders like Napoleon or Castro or Nasser attracted countless volunteers from abroad in their heyday. Our history books don’t dwell on the fact but large numbers of young men from many countries volunteered for Hitler’s invading legions. The phenomenon does not depend on the high or noble nature of the cause, although the luster and publicity around grand causes undoubtedly attracts a still wider range of young men.

Young men often just want to escape from every-day, humdrum life, a boring marriage, a nothing job, or, as in the case of the Foreign Legion, to leave a criminal or failed past behind in hopes of high adventure, a new identity, and a fresh start in life. The genuine nature of a cause often matters little because young men’s fantasies convert grubby deeds into mythic stuff at least for a time. Young men in the Foreign Legion were actually fighting for a brutal imperialism in North Africa. Volunteers to the IDF only assist in the oppression of an abused people, not in the protection of the Jewish people. Those who joined Napoleon thought they were spreading liberté, égalité et fraternité across a mummified old-order Europe, but they were helping one of history’s great bloody soldier-conquerors glorify himself and do what it was he lusted after doing.

Mental illness also intrudes into terrorist matters, all things unusual or different being grist for the big dumb mill of the press. In Canada, during the wave of empty chatter about “home-grown terrorists,” there were two isolated incidents of murder in different parts of the country, one of a policeman and one of a reservist in the military. Immediately the press began a completely uninformative and patience-exhausting round of speculation about the dark nature of the perpetrators, complete with interviews of various self-proclaimed “terrorism experts,” men, as it generally turns out, who run security firms and are out drumming up business. In both cases, we finally learned through the fog of misinformation generated by the press, that the young dead men were deeply mentally disturbed, their acts having no more political significance than the crazed men set on suicide who first kill their wives or children or the boys who periodically show up heavily armed at school, shooting their way through classmates.

And of course, it is almost invariably males who do these things, our prisons containing about ten men for every woman. The violence we see in professional football, hockey, or boxing being almost an exclusive male domain. Women rarely commit murder, males being responsible for almost all of it, with young males being responsible for an extraordinarily disproportionate share.

Aside from the psychotic and deeply depressed, there is a certain segment of young men in every society who are simply attracted to opportunities for legal killing, rape, and mayhem – this being the truly ugly side of every war and conflict that we never mention in our sentimental world-war memorial services or high school textbooks. These men are variously termed sociopaths or psychopaths, and they appear to exist naturally in some proportion in any population. They enjoy killing, inflicting pain, and the sense of supreme power over the lives of others, and they are incapable of sympathy for their victims or remorse for their acts. They only fear being caught, and war provides a wonderful legal playground for them.

The bloodiest, most brutal and pointless war of the last half century, America’s grotesque slaughter in Vietnam, attracted thousands of volunteers from other countries to join in the gruesome fun – acts which included everything from raping girls and then shooting them to throwing men out of helicopters. Even then-peaceful Canada, whose prime minister, Lester Pearson, bravely turned down Lyndon Johnson’s bullying demands to send troops (charmer that Johnson was, he is said to have grabbed our Nobel Peace Prize-winning leader by the lapels during a meeting and pushed him against a wall), saw hundreds of adventure-seeking young men, on their own, join the American holocaust, which would see three million horribly slaughtered, countless wounded, and an ancient agricultural land overwhelmed with America’s landmines, cluster bombs, and poisons.

Today we call people terrorists as easily as we more accurately might have called them reckless or mad. The word terrorist has been given an almost frightening, superstitious connotation much resembling the word witch in the seventeenth century when any poor old soul who suffered from a mental illness like schizophrenia might be burnt alive for her mumblings and delusions. Today, the same people we once burnt would be sent to a homeless shelter or a psychiatric hospital. Another aspect of the word terrorist is related to what Stalin used to say when he expected his officials to launch a new purge to keep the country terrorized into submission. The Vozhd would say something about “wreckers” or “wreckers of the revolution” and his minions would busy themselves demonstrating alacrity in finding large numbers to consign to prison or death. All of our press and government spokespeople now use terrorist with those two meanings, and to the extent that they do, we should recognize the foolishness of their speech and its danger to a free society.

Of course, anyone who commits violent crime needs dealing with, and we do have laws covering every form of violent crime and what is judged the degree of culpability. But creating a special class or type of crime, somehow understood to be different in nature from other crimes, and thereby requiring extraordinary measures of espionage and policing and imprisonment and standards of evidence, is a shabby, dishonest, and cowardly political act. It is a political act in exactly the sense best explained by George Orwell.

The template for this kind of state activity comes directly from Israel. It long ago succeeded in changing the outside perception of events since 1948 from that of a relatively powerless people having their homes and lands taken with great brutality. Everyone knows instinctively that people treated in that fashion have every right in international law and custom to fight their oppressors. We call them at various times and circumstances freedom fighters, guerillas, resistance fighters, or irregulars. But in this case, they were transformed into terrorists who seek only to destroy law-abiding, democratic Israel – unspeakably evil beings intent on attacking the imported Ozzie-and-Harriet peacefulness of white-picket fence neighborhoods constructed on other people’s property. It truly is a case of the world turned on its head.

It does make things so much easier when you shoot someone or bulldoze their home or send them to prison indefinitely with no trial and subject to torture, if you first have demonized them, much as in the case of witches or wreckers, with terrorist being this generation’s choice demonizing word. And when Israel kills some people whose identity as “terrorists” might be seen as very doubtful, the victims magically become militants, a Newspeak word which strives to make the killing of anyone from boys to grandfathers palatable, our shabby press in the West having adopted the word in its reportage without so much as blinking an eye, much less asking a question. This has been Israel’s day-in, day-out pattern of government for decades, but now it has managed to export to the United States the same pattern of behavior. The United States, after all, is a nation given to Captain Ahab-like obsessions, as it has demonstrated many times in its history, Muslims now having displaced the Communists it pursued with relentless fury for decades at home and abroad. And when the United States embraces a new obsession, its dependents in Europe, Canada, Australia, and other places are bullied into embracing it too. America has many avenues for pressuring the acceptance and recognition of its latest craze or special interest or dark operation and to quiet the criticism which would naturally flow from those who disagree and think for themselves.

Were America not enthralled with this voodoo about terror, Europe and others would quickly fall away, and Israel’s ugly behavior would be left in a glaring spotlight, much as South Africa’s once was.

It is the force of these considerations in part which leads so many to question the true nature of what happened on 9/11, for that set of events was pivotal in having American public opinion embrace extraordinary, anti-democratic, and anti-human rights measures. I do not subscribe to the (not-uncommon) conspiracy notion that the American government was complicit in 9/11, using it as a kind of Nazi Reichstag Fire to ignite the mindless war on terror and a crusade through the Middle East to overturn governments unfriendly to Israel. I do very much believe though that the full story of that event has never been told, and, as always, that can only mean highly embarrassing or compromising facts are being suppressed. The immense body of confidential information in Washington on all matters of state – literally tens of billions of documents – would largely disappear if it weren’t for considerations of embarrassment and compromise, the need for genuine government secrecy being much rarer than many assume.

A free society does not recognize crimes deemed in some way to be different or more heinous or extraordinary: it maintains and enforces sensible, well-reasoned laws which apply equally to all. It does not create criminal laws which reflect political pressure or special interests. The United States, now on a new hunt for a great white whale, has virtually re-created East Germany’s dreaded Stasi, only in a much more sophisticated and far-reaching form. It meshes with the all-pervasive secret state police apparatus Israel has constructed in the Middle East with infinite care since 1948. Now, over all our lives there is something, not answerable to any electorate, working to dissimulate, to intimidate, and to generate fear as nothing of which the Soviet Union was remotely capable. It influences all of our laws and customs, even attempting to shape the way we speak and think.

Palestine, Israel and the ADL

By Robert Fantina | CounterPunch | October 29, 2014

On October 24 of this year, the Anti-Defamation League (ADL) which, according to its website, “…was founded in 1913 ‘to stop the defamation of the Jewish people and to secure justice and fair treatment to all’,” printed an overview of what it called ‘Anti-Israel Activity on Campus After Operation Protective Edge: A Preview of the 2014-2015 Academic Year’. This article provides information about student groups that were appalled at Israeli cruelty during that country’s so-called ‘Operation Protective Edge’, the ridiculous name of the most recent invasion and carpet bombing of the Gaza Strip. It discusses the increase in student activity opposing Israeli policies, and projects that it will probably only continue to grow.

It is certainly true that opposition to Israel’s decades-long, brutal occupation of Palestine is growing. But the ADL made some statements in the article that belie belief. A look at one sentence suffices: “Student groups that constitute today’s anti-Israel movement hurl a multitude of hateful accusations against Israel, falsely claiming that Israel is guilty of apartheid, ethnic cleansing, genocide, and a number of other war crimes in an effort to demonize Israel.”

Let us break this amazing sentence down into its component parts, and see what we can learn from it.

‘Student groups that constitute today’s anti-Israel movement’. Certainly, it can’t be denied that college campuses not only in the United States, but also throughout the world are seeing more opposition to Israeli practices. But such groups do not constitute this movement; they are simply a part of greater, ad-hoc organizations around the world that are finally waking up to Israel’s unspeakable cruelties.

‘Hurl a multitude of hateful accusations against Israel’. It would not be difficult to diffuse these ‘hateful’ accusations. If Israel is indeed innocent of these charges, all it would need to have done would be to have cooperated with any of the international investigations of the last few years, or that are currently ongoing, into its practices. If Israel has nothing to hide, why not show the facts to the world? On the other hand, if the facts are already there for all the world to see, why not try calling them ‘hateful accusations’ and see if that accomplishes anything?

“Falsely claiming that Israel is guilty of apartheid, ethnic cleansing, genocide, and a number of other war crimes”. Are these false claims? A quick Internet search shows this definition for apartheid: ‘any system or practice that separates people according to race, caste, etc.’. Palestinians in the West Bank cannot drive on the same roads that Israeli’s use. They are hindered in their daily activities by countless checkpoints that Israelis establish and man arbitrarily. A Palestinian arrested in the West Bank may spend months incarcerated without charge, and without access to legal representation. An Israeli arrested in the West Bank is either charged or released within hours, and has access to legal representation immediately. Palestinians in the Gaza Strip and the West Bank need to ask permission from Israel to farm their own lands, and to harvest their own crops. No such restrictions or requirements are placed on Israelis.

Is Israel guilty of ethnic cleansing? Going to the same Internet source, this is how ‘ethnic cleansing’ is defined: “The elimination of an unwanted ethnic group or groups from a society, as by genocide or forced migration.” Israel was established in 1948 only after the forced removal (‘migration’) of 750,000 Palestinians from their ancestral homes. In the decades since that time, Palestinian homes have been, and continue to be, routinely demolished to make room for illegal Israeli settlements, in which only Israelis can live.

Now let us look at the charge of genocide. Returning again to the same dictionary site, genocide is defined thusly: “The deliberate and systematic extermination of a national, racial, political or cultural group.” When three-quarters of a million Palestinians were forcibly removed from their homes in 1947 and 1948, at least 10,000 of them were killed. Hundreds of Palestinian villages were completely destroyed, leaving no trace of mosques, museums, schools, cemeteries or other signs of Palestinian culture. Since then, countless mosques, schools and other vital structures of Palestinian culture have been obliterated by Israel, in order to make room for more, Israeli-only, illegal settlements. Ironically, in June of 2011, Israel bulldozed the ancient Muslim cemetery, Ma’man Allah, in order to build a ‘Museum of Tolerance’ on the site.

During Israel’s recent horrific bombing of the Gaza Strip, many more ancient mosques were destroyed, further decimating Palestinian culture.

These student groups accuse Israel of ‘a number of other war crimes’, says the ADL article. According to International Law, an occupying force (Israel) cannot move permanent settlers into the occupied territory. Israeli Prime Murderer Benjamin Netanyahu has stated flatly that he has no intention of giving up the West Bank, where over 500,000 settlers live illegally. It is also in violation of international law to remove residents from their property, something Israel does routinely, and has done for decades, causing the displacement of hundreds of thousands of Palestinians, many who had to leave their homes for refugee camps.

International law also says that in war time, schools, hospitals, residences, places of worship and press and media facilities cannot be bombed. During the recent bombing of the Gaza Strip, Israel bombed all of these, as well as clearly-defined United Nations refugee centers, with apparent impunity.

All possible care, according to international law, must be taken to prevent civilian casualties. Yet IDF (Israeli Defense Forces) soldiers (read: terrorists) blatantly targeted children playing a beach, killing them in front of international reporters.

The protection of the occupied people is also a requirement of international law. Yet in the West Bank, IDF soldiers and illegal settlers constantly harass Palestinians, and routinely shoot and kill Palestinians, including children. When this happens, if there is any international outcry at all, Israel says it is ‘investigating’. Yet nothing substantive ever comes of these ‘investigations’.

Like many other organizations that exist ostensibly to protect poor, vulnerable little Israel from the non-existent power of its enemies, the ADL attempts to defend the indefensible. The many crimes that Israel commits on a daily basis may once have been hidden behind a wall of secrecy. But that was before Facebook, Instagram, Twitter and other social media enabled everyone with a cell phone and an internet connection to broadcast facts to the world. People around the globe see the horrors that Israel perpetrates, and understand it as all the things the ADL denies: apartheid, ethnic cleansing, genocide, and a number of other war crimes.

That students are waking up and taking action is another positive sign for Palestine. That Israel is becoming more and more isolated in the world community, with more and more countries recognizing Palestine and sanctioning Israel, is also very positive. That the ADL and other similar organizations are in panic mode, no longer able to defend a cruel, racist, apartheid regime, bodes well for a better future for Palestine.

Perhaps Israel felt it could once again bomb the Gaza Strip, and kill youths in the West Bank who have no weapons other than stones, with complete impunity. It must not be blamed for believing so; that was the model that was followed for years, and Israel can’t be faulted for not paying attention to sea changes that were occurring. Now that those changes have hit it in the face, full force, it can’t avoid seeing them. This new knowledge makes Israel all the more dangerous; any wild animal cornered will lash out, however erratically, in instinctive defense. Yet like the cornered animal that is eventually captured and controlled, this is what Israel can realistically expect. It will take time, but the process has begun, and it cannot be stopped now. Despite all Israel’s efforts to obliterate Palestine, it will fail; Palestine will be free.

Denied land access, Palestinians miss olive harvest

Ma’an – 29/10/2014

AL-JANIYA (AFP) — Abbas Yousef points wistfully towards his olive trees, which are bearing their annual fruit. Yet again, the 70-year-old Palestinian farmer will be unable to make the autumn harvest.

Yousef’s olive groves lie on land either side of an Israeli settlement in the northern occupied West Bank. For years, he has been denied access by the army, and the settlers have plowed it, uprooting many of his trees.

For the 1,400 residents of al-Janiya — Yousef’s village — attacks by settlers who have uprooted trees and burnt Palestinian farmland have become a daily occurrence, he says.

“Each time I try to get to my olive groves, an Israeli soldier tells me I can’t go, because it’s been designated a ‘closed military zone,'” Yousef says.

“My father planted those trees, seed by seed, and I toiled over the land,” he sighs, pointing to one section of his land, now farmed by settlers.

This year, for the first time since 2000, Yousef was allowed access to his land, but only for two days — not nearly enough time to gather all the olives during the harvest that begins in early October.

When he got there, he found 400 of his trees had been uprooted.

UN figures show that since the start of the year, around 7,500 trees have been damaged or uprooted across the West Bank.

‘Now it’s my land’

Arik Ascherman, president of Israeli rights group Rabbis for Human Rights, says Yousef’s experience is common and in danger of becoming the norm in the West Bank.

“They start by preventing Palestinians from accessing their land, then they cultivate it themselves, and then they say ‘Now it’s my land,'” he explains.

Since Israel took over the West Bank in 1967, 135 Jewish settlements have been built there as well as around 100 unauthorized outposts, which are considered illegal even under Israeli law, UN figures show.

All settlements built on occupied territory are illegal under international law.

Figures compiled by the Yesha Settlers Council show there are some 380,000 Israelis living in the West Bank — a number which has more than tripled in the two decades since the Oslo peace accords were signed in 1993.

The attacks against olive groves, which make up half of all cultivated Palestinian farmland, threaten a crucial source of livelihood.

Olive farming and olive oil production bring in around a quarter of Palestinian agricultural revenue, according to the UN’s top humanitarian official for the occupied territories, James Rawley.

The harvest is increasingly threatened by both settlement building and by Israel’s vast separation barrier — in some parts an eight-meter-high (25 foot) concrete wall — whose construction began in 2002.

Some 85 percent of the barrier’s route runs inside the West Bank, rather than along the internationally recognized Green Line, cutting off Palestinians from 30 percent of their land, according to a UN spokeswoman.

For Ahmed Diwan, a farmer who lives in Biddu village east of Ramallah, the problem is not limited to olives.

He says he has also missed the grape harvest, the almonds, the apples, and vine leaves — “a symbol of Palestinian cuisine” — due to a lack of access to his land.

Diwan holds out little hope for this year’s olive harvest as he packs his farming equipment into his car.

“We’re only allowed access to our olive groves two days this year. We can’t maintain the trees or harvest in that time!”

End of an era?

Israel has granted access to farmers for a total of 37 days so far this year, the UN says.

Even those who do have limited access to their farmland are subjected to violent attacks by settlers, who are often armed.

So far this year, 88 attacks have been recorded and 142 farmers injured, according to the UN.

The elderly Yousef was one of the victims.

“About 50 settlers turned up. We were four farmers, people of around my age. We were no match for them,” he recalls.

“In the end it was the Israeli soldiers who got us out to protect us from the settlers.”

The violence is making “entire villages” which had been self-sufficient for decades dependent on international aid, the UN says.

A disillusioned younger generation is turning away from the age-old family tradition.

“Farming is finished. The young people don’t want to work on the land. They’re scared of being killed by settlers,” Yousef says.

Settler violence against Palestinians and their property is a regular occurrence in the West Bank and East Jerusalem, but settlers are rarely held accountable by Israeli law enforcement.

Philly Cop Threatens to Beat Teen for Making Eye Contact

By Carlos Miller | PINAC | October 27, 2014

A Philadelphia cop was caught on video threatening to beat a teenager walking home from school because he had made eye contact with the officer.

“Big man, do we have a problem?” the cop asks. “Because I notice that you keep trying to make eye contact with me. Is there a problem?”

The teens’ response is inaudible.

“Okay, well keep fucking walking,” the cop says. “The next time you look me in my fucking eye, I’m gonna beat the shit out you!”

The video, uploaded to Facebook earlier this month, is only 12 seconds long, but it was enough for his department to discipline him. Or so they say.

The department didn’t go as far as providing his name to the local media who inquired about the officer, so there is a good chance he will receive a slap on the wrist, if anything.

According to NBC Philadelphia:

Police told NBC10 they were aware of the incident and the officer in the video will be disciplined for his actions. However, they also did not reveal when and where the incident occurred or what led to it.

According to a law enforcement source, the officer belongs to the 19th District.

A Philadelphia Police official, who did not want to be identified, also commented on the video.

“The video does not reflect well on the officer,” the official said. “I have no doubt he had good reason to be exasperated but you have to maintain your professional demeanor.”

It isn’t clear if the teen was giving the cop  “dehumanizing stares,” which Miami-Dade police used to justify beating a teen who had been carrying a puppy on a beach last year.

Two journalists hit by Israeli rubber bullets while covering protest (VIDEO)

RT | October 28, 2014

An AP photographer and his Swiss colleague were hurt after Israeli border police fired a crowd control grenade at a group of journalists covering Palestinian protests in the West Bank.

The news agency’s Majdi Mohammed and Swiss freelance journalist Lazar Simeonov were injured during the Israeli forces’ suppression of protests, where they deployed rubber-coated bullets, stun grenades and tear gas.

The photographers were working in the West Bank town of Silwad, where Palestinians were protesting after the funeral of a 14-year-old boy, who was killed in an earlier clash with Israeli soldiers.

Mohammed told the Agency that as he was taking pictures, an armored car pulled up behind him and a border policeman stepped out and fired directly at him from a distance of 10 to 20 meters.

The officer fired a round that discharges a number of rubber-coated steel projectiles, which is basically a grenade designed to hurt small groups of people. Simeonov was injured by the same round.

“The impact was so strong that it made me fall to the ground,” Mohammed said. “The policeman aimed straight at us … even though we were clearly a group of media people and there were no protesters at all around us.”

Both journalists reported minor injuries and Simeonov’s camera was also damaged.

AP said it would lodge a protest with the Israeli government. John Daniszewski, AP’s senior managing editor for international news, said the incident showed “outrageous disregard for the safety of journalists” lawfully doing their jobs.

Israeli police spokesman, Micky Rosenfeld, said it was not immediately clear why the border patrol policeman had opened fire on the journalists. He added the police “dispersed hundreds of rioters,” some of whom threw firebombs and stones at the Israeli forces.

Nobel Peace Prize laureates call on Obama to release CIA torture report

RT | October 27, 2014

Twelve winners of the Nobel Peace Prize have urged fellow laureate, US President Barack Obama, to release a Senate report on the Central Intelligence Agency’s post-9/11 Rendition, Detention, and Interrogation Program, also known as the torture report.

The laureates revealed late Sunday an open letter that called for “full disclosure to the American people of the extent and use of torture and rendition by American soldiers, operatives, and contractors, as well as the authorization of torture and rendition by American officials.”

The letter, posted on TheCommunity.com, also asked for a concrete plan to close secret international “black site” prisons – used by the US to hide, hold, and interrogate post-9/11 detainees – as well as the US military prison at Guantanamo Bay, where many War on Terror captives languish with few or inconsistent legal maneuvers, if any at all, at their disposal.

The letter was signed by past Nobel winners José Ramos-Horta, Archbishop Desmond Tutu, F.W. De Klerk, Leymah Gbowee, Muhammad Yunus, John Hume, Bishop Carlos X. Belo, Betty Williams, Adolfo Perez Esquivel, Jody Williams, Oscar Arias Sanchez, and Mohammad ElBaradei.

“In recent decades, by accepting the flagrant use of torture and other violations of international law in the name of combating terrorism, American leaders have eroded the very freedoms and rights that generations of their young gave their lives to defend,” the laureates wrote.

“They have again set an example that will be followed by others; only now, it is one that will be used to justify the use of torture by regimes around the world, including against American soldiers in foreign lands. In losing their way, they have made us all vulnerable.”

The letter called on Obama, winner of the 2009 Nobel Peace Prize after less than a year in the White House, to follow principles of international law outlined in the UN Convention Against Torture and the Geneva Conventions.

The US Senate Intelligence Committee’s $40 million investigation into the CIA’s Rendition, Detention, and Interrogation Program – which was active from September 11, 2001 to 2006 – has found that the spy agency purposely deceived the US Justice Department to attain legal justification for the use of torture techniques, among other findings. The investigation and subsequent crafting of the report ran from March 2009 to December 2012.

Of that 6,000-page investigative report, the public will only see a 500-page, partially-redacted executive summary that is in the process of declassification.

According to sources familiar with the unreleased report, the CIA, and not top officials of the George W. Bush administration, are blamed for interrogation tactics that amount to torture based on international legal standards.

The report outlines 20 main conclusions about the CIA’s post-9/11 torture program which, according to the investigation, intentionally evaded White House, congressional, and intra-agency oversight.

Sneak and Peek: Government Authority Intended for Terrorism is Used for Other Purposes

By Mark Jaycox | EFF | October 26, 2014

The Patriot Act continues to wreak its havoc on civil liberties. Section 213 was included in the Patriot Act over the protests of privacy advocates and granted law enforcement the power to conduct a search while delaying notice to the suspect of the search. Known as a “sneak and peek” warrant, law enforcement was adamant Section 213 was needed to protect against terrorism. But the latest government report detailing the numbers of “sneak and peek” warrants reveals that out of a total of over 11,000 sneak and peek requests, only 51 were used for terrorism. Yet again, terrorism concerns appear to be trampling our civil liberties.

Throughout the Patriot Act debate the Department of Justice urged Congress to pass Section 213 because it needed the sneak and peak power to help investigate and prosecute terrorism crimes “without tipping off terrorists.” In 2005, FBI Director Robert Mueller continued the same exact talking point, emphasizing sneak and peek warrants were “an invaluable tool in the war on terror and our efforts to combat serious criminal conduct.”

A closer look at the number of sneak and peek warrants issued (a reporting requirement imposed by Congress) shows this is simply not the case. The last publicly available report about sneak and peek warrants was released in 2010; however, the Administrative Office of the US Courts has finally released reports from 2011, 2012, and 2013.

What do the reports reveal? Two things: 1) there has been an enormous increase in the use of sneak and peek warrants and 2) they are rarely used for terrorism cases.

First, the numbers: Law enforcement made 47 sneak-and-peek searches nationwide from September 2001 to April 2003. The 2010 report reveals 3,970 total requests were processed. Within three years that number jumped to 11,129. That’s an increase of over 7,000 requests. Exactly what privacy advocates argued in 2001 is happening: sneak and peak warrants are not just being used in exceptional circumstances—which was their original intent—but as an everyday investigative tool.

Second, the uses: Out of the 3,970 total requests from October 1, 2009 to September 30, 2010, 3,034 were for narcotics cases and only 37 for terrorism cases (about .9%). Since then, the numbers get worse. The 2011 report reveals a total of 6,775 requests. 5,093 were used for drugs, while only 31 (or .5%) were used for terrorism cases. The 2012 report follows a similar pattern: Only .6%, or 58 requests, dealt with terrorism cases. The 2013 report confirms the incredibly low numbers. Out of 11,129 reports only 51, or .5%, of requests were used for terrorism. The majority of requests were overwhelmingly for narcotics cases, which tapped out at 9,401 requests.

Section 213 may be less known than Section 215 of the Patriot Act (the clause the government is currently using to collect your phone records), but it’s just as important. The Supreme Court ruled in Wilson v. Arkansas and Richards v. Wisconsin that the Fourth Amendment requires police to generally “knock and announce” their entry into property as a means of notifying a homeowner of a search. The idea was to give the owner an opportunity to assert their Fourth Amendment rights. The court also explained that the rule could give way in situations where evidence was under threat of destruction or there were concerns for officer safety. Section 213 codified this practice into statute, taking delayed notice from a relatively rare occurrence into standard operating law enforcement procedure.

The numbers vindicate privacy advocates who urged Congress to shelve Section 213 during the Patriot Act debates. Proponents of Section 213 claimed sneak and peek warrants were needed to protect against terrorism. But just like we’ve seen elsewhere, these claims are false. The government will continue to argue for more surveillance authorities—like the need to update the Communications Assistance to Law Enforcement Act—under the guise of terrorism. But before we engage in any updates, the public must be convinced such updates are needed and won’t be used for non-terrorist purposes that chip away at our civil liberties.
