“Guantánamo North” – NDAA Indefinite Detention Coming Soon to a Town Near You?

By Chris Anders | ACLU | June 6, 2014

Top senators thought you wouldn’t notice. Behind closed doors, they wrote up new indefinite detention and Guantánamo provisions in the annual defense policy bill, and then waited 11 days to quietly file the bill.

But we now have the bill, and everyone can read it. And everyone should understand what is in this new National Defense Authorization Act (NDAA) before the full Senate makes a big mistake and paves the way for Guantánamo-style indefinite detention being brought to the United States itself.

The new Senate NDAA:

Brings Indefinite Detention to the U.S. Itself: The bill now says that detainees may be brought to the United States for “detention pursuant to the Authorization for Use of Military Force” (AUMF). In plain English, that means the policy of indefinite detention by the military, without charge or trial, could be carried out here at home. Right now, the number of people in the U.S. in military indefinite detention is zero. If the bill is enacted, that number could immediately jump to 100 or more.

Bolsters Claims of NDAA and AUMF Indefinite Detention Authority: The AUMF is the basis for the indefinite detention authority included in the NDAA that Congress passed nearly three years ago. Indefinite detention is wrong today and certainly cannot be sustained past the end of U.S. combat in the Afghan war. But passing a new Senate NDAA that relies on detention authority based on the AUMF, just as the U.S. combat role in the war is winding down, could be used by the government to bolster its claim that indefinite detention can just keep on going. Even when any actual U.S. combat is over.

Requires Report on Even More NDAA and AUMF Indefinite Detention Authority: As if the government didn’t already have enough claims of indefinite detention authority, the Senate NDAA asks the administration to let Congress know what more indefinite detention authority it wants.

Tries to Strip Federal Courts of Ability to Decide Challenges to Harmful Conditions: In a stunning provision, the Senate NDAA tries to strip federal courts of their ability to “hear or consider” any challenge related to harmful treatment or conditions by detainees brought to the United States. This provision tries to gut our system of checks and balances by cutting out the courts.

Violates Supreme Court Decision by Stripping Habeas Rights from Detainees Left at Guantánamo: In a classic example of why it is never a good idea for a committee to legislate behind closed doors, the Senate NDAA includes language inadvertently stripping habeas rights from any Guantánamo detainee who is not moved to the United States. Habeas is the very fundamental protection of being able to have a judge decide whether it is legal or illegal to hold someone in prison. While this is almost certainly the product of sloppy drafting, the result squarely contradicts the Supreme Court’s decision in Boumediene v. Bush, in which the Court said Guantanamo detainees have a constitutional right to habeas.

Blocks Most Cleared Detainees from Going Home: The Senate NDAA would block the transfer home of the vast majority of cleared detainees by imposing a blanket ban on transfers to Yemen, instead of continuing to allow the secretary of defense to make decisions on an individual basis. That would mean dozens of detainees cleared for transfer would remain trapped in limbo.

There is a right way and a wrong way to close Guantánamo. Charging and trying in court anyone who committed a crime – and sending anyone who isn’t charged with a crime back home or to another country – is the right way to close Guantánamo. Simply moving all of the bad Guantánamo policies to the U.S. itself is the wrong way.

The Senate NDAA gets it very wrong. We urge all senators to say “NO” to these provisions.

Intelligence agencies have direct access to telecoms infrastructure, Vodafone reveals

RT | June 6, 2014

Government intelligence agencies have direct access to telecommunication companies’ infrastructure which allows them to spy and record phone calls leaving no paper trail, the UK’s largest mobile phone company Vodafone has revealed.

The British operator said wires have been attached to its phone networks in some of the 29 countries in which it operates in Europe, as well as around the world, the Guardian reported. Governments similarly connect to other telecom groups, reportedly allowing them to listen to or record live conversations. In some cases, the surveillance agencies can also track the whereabouts of a customer.

“For governments to access phone calls at the flick of a switch is unprecedented and terrifying,” Liberty director Shami Chakrabarti told the Guardian. “Snowden revealed the internet was already treated as fair game. Bluster that all is well is wearing pretty thin – our analogue laws need a digital overhaul.”

But now Vodafone is pushing back against government surveillance through direct access to the pipes. On Friday, it will publish its first Law Enforcement Disclosure Report about how governments spy on people through the company’s infrastructure.

“These pipes exist, the direct access model exists,” the telecom giant’s group privacy officer, Stephen Deadman told the Guardian. “We are making a call to end direct access as a means of government agencies obtaining people’s communication data. Without an official warrant, there is no external visibility. If we receive a demand we can push back against the agency. The fact that a government has to issue a piece of paper is an important constraint on how powers are used.”

“We need to debate how we are balancing the needs of law enforcement with the fundamental rights and freedoms of the citizens,” Deadman said.

The problem with many of the laws on the books that governments use to receive the warrants is “most of the legislation on privacy and surveillance predates the internet and needs to be updated,” the Guardian wrote, citing the report’s introduction.

Agencies do not have to identify the targeted customers to the telecom companies in any way, and the direct-access systems do not require warrants.

“These are the nightmare scenarios that we were imagining,” Gus Hosein, executive director of Privacy International, which has brought legal action against the British government over mass surveillance, told the Guardian.

“I never thought the telcos [telecommunications companies] would be so complicit,” he said. “It’s a brave step by Vodafone and hopefully the other telcos will become more brave with disclosure, but what we need is for them to be braver about fighting back against the illegal requests and the laws themselves.”

In its report, the company asks for the direct-access pipes to be disconnected, for countries to outlaw the practice and for governments to “discourage agencies and authorities from seeking direct access to an operator’s communications infrastructure without a lawful mandate.”

Vodafone began working on the report last autumn, in the wake of the first Snowden leaks about government spying. It insists that its comprehensive survey of government warrant applications is not because of consumer backlash, the Guardian reported, though analysts contend that losing customers’ trust could cost the company tens of millions of pounds.

But Vodafone isn’t opening up about everything. One of the first of the Snowden revelations last June was about Project Tempora, which allows the Government Communications Headquarters (GCHQ) spy agency to intercept and store for 30 days huge volumes of data, like emails, social network posts, phone calls and much more, culled from international fiber-optic cables. On the one-year anniversary of the first Snowden leak the location of secret GCHQ bases in Oman tapping into underwater cables was revealed. The Vodafone report makes no mention of revelations about its participation in secret GCHQ operations.

Israel Begins Arrest Campaign Against Popular Resistance Activists

mahmoud_zwahre_340_220

By Chris Carlson | International Middle East Media Center | June 5, 2014

Yesterday, at 4:30 am, Popular Resistance activist Mahmoud Zwahre was again arrested by the Israeli army, at his house in Al Ma’asara, just southwest of Bethlehem.

An attempt to arrest Zwahre was made previously during the weekly Friday protest in the village. This week, on Wednesday, a large group of Israeli soldiers raided Zwahre’s home, just before dawn.

Mahmoud Zwahre, according to the Palestinian News Network (PNN), is an activist and coordinator for the Popular Committee Against the Wall and the Settlements in Al Ma’asara. Soldiers surrounded the Zwahre residence and declared it a closed military zone, as they proceeded to tear through the contents of the house, terrorizing the children and abusing Mahmoud in front of his family.

He was arrested, blindfolded, and taken to an unknown destination — essentially, and by all rights, amounting to a kidnapping.

(Al Ma’asara is a small Palestinian village located in Area B of the central occupied West Bank. Though Area B is officially recognized to be under joint Israeli-Palestinian security control, the 1967 Israeli occupation of the West Bank, Gaza Strip and East Jerusalem has yet to be granted legitimacy by the international community.)

Munther Amira, director of the board of the Popular Struggle Coordination Committee Against the Wall and the Settlements (PSCC) in the Palestinian territories, explained in an interview with the PNN that the Israeli occupation increasingly targets activists of Popular Resistance and their activities:

The activities of Popular Resistance are peaceful and designed to highlight the suffering of the Palestinian people through the Israeli occupation practices of racism and violation of international law. Nevertheless, the PSCC has documented the rough and violent reactions by Israeli soldiers against the protests and marches organized by the Popular Struggle Committees in the various provinces of the country.

The committee denounces the arrest of its coordinator Mahmoud Zwahre, and calls for his release.

Secret Trials: UK Holds A Secret Terror Trial, As US Appeals Court Holds Secret Hearing In Terror Case

By Mike Masnick | Techdirt | June 5, 2014

To have a functioning judiciary in an open democracy, part of the point is to make sure that court proceedings are open to the public. Yes, there may be certain instances where certain aspects must be kept secret, but the default should be open and public. Unfortunately, in both the US and UK this week, it appears that when it comes to the bogeyman word “terrorism,” courts are willing to go dark. The more serious situation is over in the UK, where it has just come out that a secret terrorism trial is being held — the first one in centuries. Even the names of the two defendants are not known (they’re listed as merely AB and CD). Journalists had even been barred from mentioning the existence of the trial, until a gag order was just overturned. Note that the Guardian’s page linked above had to turn off comments for legal reasons. Journalist Tim Cook has also spoken out eloquently about why this cannot stand.

I cannot say how broken-hearted I am about the prospect of a major criminal trial involving two men charged with serious terrorism offences being held entirely in secret for the first time in modern British legal history. I have spent my entire journalistic life campaigning against courtroom secrecy and this represents a nadir and indication of abject failure.

But the proposal is being contested by the process of law; albeit very limited and garrotted by the lack of a constitutional paradigm for freedom of the media and expression. We have been paying the price for not having a First Amendment for many years. Now we are entering the endgame of something beyond the dissolution of open justice.

Meanwhile, back here in the good, old United States, where we do have a First Amendment, at least we know that Adel Daoud is on trial. But the 7th Circuit Court of appeals kicked everyone out of the courtroom to hold a “secret hearing” with just the DOJ. As we wrote a few months ago, Daoud’s lawyers are asking to actually see the FISA court orders that were used to gather evidence against their client — and the DOJ is flipping out about that. While some of the hearings were held openly, at one point, Judge Richard Posner abruptly kicked everyone but the DOJ out, including Daoud’s lawyers.

As the arguments concluded, Judge Richard Posner announced the public portion of the proceedings had concluded and ordered the stately courtroom cleared so the three-judge panel could hold a “secret hearing.” Daoud’s attorney, Thomas Anthony Durkin, rose to object, but Posner did not acknowledge him. Deputy U.S. marshals then ordered everyone out – including Durkin, his co-counsel and reporters.

Only those with the proper security clearance — including U.S. Attorney Zachary Fardon, his first assistant, Gary Shapiro, and about a dozen FBI and U.S. Department of Justice officials – were allowed back in the courtroom before it was locked for the secret session.

Some reporters tried to ask what was going on, but Posner simply told them “No!” and kicked them out. Daoud’s lawyer was similarly perplexed:

“Not only do I not get to be there, but I didn’t even get to object,” Durkin said. “I had to object over the fact that I couldn’t even make an objection.”

As the article notes, this is highly unusual. While in national security cases, certain information may be filed under seal, or certain portions may be held “in camera” without reporters or the public, it’s not at all common to have just one side present. And while you may say that it makes sense in this case, where the three judge panel has to determine whether or not it’s appropriate to share the FISC orders with Daoud’s lawyers, it’s still somewhat troubling to see the ease with which secret court proceedings may occur.

Israeli restrictions ‘preventing Gaza unity government meeting’

Ma’an – 04/06/2014

BETHLEHEM – Ministers of the new Palestinian unity government are planning a cabinet meeting in the Gaza Strip, but Israel continues to deny them permits to travel, a government spokesman said Tuesday.

Ehab Bseiso told Ma’an that the ministers want to meet in Gaza to discuss the situation in the blockaded enclave, but that Israel has revoked the VIP status of Palestinian government members.

Meanwhile, four members of the new unity government still have not been officially sworn into office, given that Israel rejected their requests to travel to Ramallah for Monday’s inauguration ceremony, Bseiso said.

He said the government is trying to find a legal way for Gaza ministers to be sworn in despite Israeli restrictions.

The four Gaza-based ministers are Mamoon Abu Shahla as minister of labor, Haifa al-Agha as minister of women’s affairs, Mufeed al-Hasayna as minister of housing and public works, and Salim al-Saqqa as minister of justice.

The four ministers partook in the government’s first official meeting on Tuesday via video conference call.

Though Israeli officials were furious over the creation of a unified West Bank-Gaza government, the US, the UN, and the EU expressed support for the new Palestinian government as long as it respected previous agreements, was committed to nonviolence, and recognized Israel.

Hamas ceded power over Gaza to the new government on Monday after signing a historic reconciliation deal with the Fatah-led PLO in April.

181 people killed, 293 injured in Kiev military op in eastern Ukraine

RT | June 3, 2014

Kiev’s military operation in eastern Ukraine has left 181 people killed, including 59 of ruling regime troops, and 293 injured, according to the country’s Prosecutor General.

Oleg Makhnitsky announced the recent figures at a press conference. However, it was not clear whether the death toll included casualties among self-defense forces.

The Prosecutor General has also added that over 220 people have been abducted, including 12 foreign citizens, since the uprising started in Lugansk and Donetsk Regions.

“Six hundred and seventy-five criminal enterprises connected with subversive activities, terrorist acts, and violation of the territorial integrity of Ukraine are currently being investigated,” Makhnitsky told the media.

Kiev has been conducting its “anti-terrorist operation” in eastern Ukraine since April, following a mass uprising against the coup-appointed government, demanding broader independence from the capital.

Following the May 11 referendums, in which the Lugansk People’s Republic and Donetsk People’s Republic voted for the two regions’ independence and proclaimed themselves sovereign states, the military operation by Kiev troops has intensified.

The day after the presidential elections on May 25, the likely winner, billionaire Petro Poroshenko, announced that the military operation in the southeast of the country would continue, demanding “it must be more effective, and military units must be better equipped.”

Just a few hours after the early results of the elections were announced, Ukrainian troops stepped up their military activity and deployed fighter jets and helicopters at Donetsk International Airport in an attempt to win it back from self-defense forces.

More than 50 civilians and as many self-defense troops were killed in the subsequent clashes, local militia estimated.

On Wednesday, May 28, Kiev troops targeted civilian quarters of Slavyansk, for the first time shelling one of the city’s schools and a kindergarten.

All the pupils and teachers were quickly evacuated from the school as the shell hit the roof and exploded right above the hall where children played.

The shelling also damaged a block of flats and a dormitory in the city’s teachers’ college, shattering glass in the windows of the college.

Shortly afterwards, the Ukrainian military shelled a children’s hospital, also in Slavyansk.

This past weekend, over a thousand people rallied in Donetsk demanding that children be protected from Kiev’s assault.

The Kiev forces quickly blamed the violence on self-defense units, which they refer to as “terrorists.”

Israel critic targeted by JDL in Canada

By Joshua Blakeney | Press TV | June 3, 2014

Since 2010, I have been Press TV’s Canadian correspondent based in Calgary, Alberta. I have been forced by the actions and statements of Canada’s ruling neoconservatives to hone in on the role Zionists and the organized Jewish community play in Canadian society.

Canada’s current government has shifted this country from being a comparatively benign and peaceful nation to being a warmongering de facto colony of Israel. I believe the evidence suggests this didn’t just happen by accident; the Zionization of Canada was a carefully planned, well-oiled operation.

If I was wrong in my analyses of the interface between Canada’s government and pro-Israel forces, I believe I would have been invited on one of the many Zionist-controlled media organs here, debated by some high-IQ Zionist intellectual and exposed as erroneous and foolish. I believe it is because we at Press TV are accurate in our analyses of Canadian power and politics that a segment of the organized Jewish community has decided to turn to coercion.

I would like to make available an email I received from the Jewish Defense League, a group described in an FBI report entitled “Terrorism 2000/2001” as a “violent extremist organization:”

“Mr Blakeney,

In the middle of the last century, Jews had no right or means of response when they were demonised, persecuted and attacked by your ideological soulmates. Today, the world is a very different place. When we are attacked by hate-filled antisemites like you, we respond with all the resources at our disposal, and with extreme prejudice.

You clearly enjoy indulging your pathological hatred of Jews, but there are three things that you should remember: The code that we live by is ‘never again’; our loathing of those who incite hatred against Jews is stronger than their hatred of us; we didn’t choose you as an enemy, you chose us.”

There are several fallacies committed in this unpleasant email. Firstly, I am not a “hate-filled anti-Semite.” I define Anti-Semitism as an “irrational hatred of all Jews generically.” You have to dislike all Jews and irrationally so to qualify as an Anti-Semite in my book. I merely oppose the actions, arguments and assumptions of those Jews who are oppressors, warmongers, apologists for Israel and proponents of a Zionist exeptionalist police state, etc. Some Jews agree with me, some almost agree with me and others evidently hate me. Either way, criticizing those in power, regardless of their ethnicity, is a natural right which I embrace zealously.

Unlike the JDL, who claim they intend to act with “extreme prejudice” against me, I’m guided by post-judice insofar as my conclusions are derived from an analysis of the factual record. My analyses are rational, logical and evidence based. Evidence emerged of Israeli involvement in 9/11 and then I deduced that Israel conducts false-flag terrorism against the US. The evidence came first, then my conclusion.

Equally misguided is to characterize my alleged “hatred of Jews” as “pathological.” The usage of psychoanalytic verbiage to quash criticism of Jews is the product of Sigmund Freud and members of the Frankfurt School, Jewish thinkers who popularized their ethnocentric doctrines in the first half of the 20th Century. By describing my criticism of certain Jews as “pathological,” the writer of the email exempts himself from addressing the content of my criticisms. If my criticisms are the product of a psychopathology, then they have no relation to the real world and thus need not be addressed. How convenient.

Some academicians and law experts have advised me to take this threatening email to the authorities here in Canada. However, I am intuitively averse to having the state decide which emails are good and which are bad. I’d rather engage in debate and dialogue with my interlocutors. Furthermore, it seems unlikely that Canada’s current regime would ever prosecute Jewish ethnic activists like the members of the JDL. That would be in contravention of the Jewish-exceptionalist ideology that seemingly governs this country at the present time.

The Canadian state has defenestrated the values of British Common Law that once guided Canadian society (such as freedom of speech, freedom of expression, adversarial argumentation, habeas corpus and freedom of movement) in favor of the eliminationist ideology of Jewish exceptionalism. Critics of Jews find themselves arrested for “hate speech” or “inciting genocide” and non-Canadian citizens are barred from the country or deported.

For example, it has now been demonstrated that Canada’s ruling neoconservatives barred pro-Palestinian peace activist and parliamentarian George Galloway from Canada in 2009 at the behest of the JDL. This is one reason I don’t fear the JDL per se; there was a time when they had no political clout and thus had to actively engage in their own thuggery and aggression toward those whose perspectives they sought to suppress. Now they have Canada’s MPs and politicized police forces at their disposal to do their dirty work for them. If Mr. Galloway had turned up at the Canadian border in mid-2009, the police would have arrested and incarcerated the six-times-elected British MP, based on lobbying efforts by the JDL. In this epoch, the JDL can sit back and let Israel’s client regime in Ottawa do all the work.

The extent of the Zionization of Canada is revealed by the very presence of the JDL in this country. The militant organization is reportedly proscribed in the US and in many EU countries. In spite of this, periodically Meir Weinstein, leader of the JDL in Canada, pops up on our TV screens as if he is a moderate Canadian political pundit. Quite what the members of the JDL contribute to Canadian society other than aggressive censoriousness and ethnic tension is unclear.

In 1995 German ethnic-activist and historian Ernst Zundel had his house firebombed by Zionist terrorists who disagreed with his historical conclusions. A group called the Jewish Armed Resistance Movement claimed responsibility for the attack but the Toronto Star later claimed that the group had ties to the JDL. Instead of locking up those aggressors who arrogated to themselves the right to revoke Mr. Zundel’s freedom of speech and destroy his property, the police incarcerated Zundel under so-called anti-terrorism legislation, which was later found to be unconstitutional.

Another falsehood in the email is the claim that “we didn’t choose you as an enemy, you chose us.” I grew up in a philo-Semitic household with holidays to Israel and visits to Auschwitz (and I’m not even Jewish!). It was primarily Israel’s oppression of the Palestinians and proven involvement in false flag attacks on Western countries that spurred me to voice criticism of certain Jews. Within recent days, Australia’s former Prime Minister Malcolm Fraser has confirmed that Israel deliberately attacked the USS Liberty in June 1967. Is he a “pathological” “antisemite” too?

So, to repeat, my conclusions are post-judicial not prejudicial (I actually pre-judged Jews favorably). The Zionists want to use countries like Britain, Canada and the US as playthings to advance Israeli geopolitical goals, expending the blood and treasure of us stupid goyim rather than that of Jews. Certain Zionist fanatics in my view declared war on my historically philo-Semitic people not vice-versa.

I’m keen to engage in dialogue with my detractors. It seems because I have the moral high ground and evidence on my side that some Zionists are now resorting to coercion to silence me.

In my view, the pen is mightier than the sword. The JDL should take a leaf out of my book instead of trying to eliminate anybody who criticizes them and their fellow Zionist ideologues.

Israel gags famous nuclear whistleblower invited to speak at human rights conference

RT | June 2, 2014

A decade after his release from prison for leaking information on Israel’s nuclear weapon program, Mordechai Vanunu has been denied permission to attend a human rights conference in London.

Vanunu, who was released in 2004 after spending 18 years in prison for leaking details of Israel’s nuclear program to British media, had planned to visit the UK capital for three days to attend a conference sponsored by Amnesty International and address the British parliament, Haaretz, the Israeli daily reported on Monday.

Israeli Interior Minister Gideon Sa’ar and Attorney General Yehuda Weinstein, however, refused to approve the trip. Vanunu petitioned the High Court of Justice to reverse the decision, but judging by previous appeals that does not seem likely.

Since leaving prison in June 2004, the nuclear technician has been forbidden to leave the country or speak with foreigners without permission from the Shin Bet security service.

The High Court has rejected seven successive petitions presented by Vanunu’s lawyers to reverse course. Most recently, in December 2013, the court said the top-secret material they were shown proves that Vanunu “still has a treasure of classified information and hasn’t recanted his intent to disseminate this information.”

In last week’s petition, Vanunu’s attorney, Avigdor Feldman, reiterated the argument he has made in previous petitions: their client’s information no longer presents much of a threat to Israel’s national security.

“The information about Israel’s nuclear capabilities that has been published since the petitioner’s release is incomparably greater, both quantitatively and qualitatively, than anything the petitioner could add today, more than 20 years after he stopped working at the Dimona nuclear reactor,” Feldman wrote.

Feldman further argued that preventing Vanunu from traveling abroad actually works more to Israel’s disadvantage because, he said, the petitioner’s failure to appear at the Amnesty conference and the British parliament “would spark international protests against this severe administrative restriction on Citizen Vanunu.”

Although Vanunu is no longer behind bars, his lawyers say he is, for all intent and purposes, still a prisoner.

“It’s true the petitioner was released from jail, but his freedom is still limited,” the petition said. “This is a harsh punishment that has been imposed on the petitioner. It’s not enough that he served a lengthy prison sentence; now, he is restrained, and his freedom limited, as if he hadn’t finished serving his sentence.”

Feldman told Haaretz that – to the best of his knowledge – the constraints imposed on their client has no precedent anywhere in the world. The ban on speaking with foreigners without the security service’s permission “would surely be acceptable in North Korea, but not in a country that defines itself as the only democracy in the Middle East,” he complained.

In 2012, Nobel-Prize winning German poet Gunter Grass praised Vanunu in a poem entitled ‘A Hero in Our Time’, in which Grass describes the former worker at Israel’s Dimona nuclear facility as a “hero” and a “model,” admiring his decision to pass Israeli nuclear secrets to the Sunday Times in 1986.

Meanwhile, Vanunu’s lawyer had harsh words for the High Court for continuing the restrictions for the last decade on the basis of material that neither he nor Vanunu were authorized to see, “and about which it’s doubtful that any of the Supreme Court justices understood anything,” but which they nevertheless accepted as evidence that “Vanunu, who worked at the Dimona nuclear reactor 40 years ago, knows information that would almost certainly endanger Israel’s security.”

Israeli officials, meanwhile, insist that Vanunu’s determination to threaten national security has not subsided, and the information in his possession is still relevant.

Sa’ar wrote in his rejection of Vanunu’s request, “Your client retains the ability to cause… damage, which would be irreversible, via the information in his possession that hasn’t yet been published, and which, as has been proven in court, is still relevant even today.”

Following the failed petition to travel abroad in December, Vanunu’s lawyer said his client merely wishes to leave the country to “marry his girlfriend and live out his life quietly.”

The Justice Ministry said that in accordance with the court’s instructions, it would file a response to the latest petition by June 10.

To President Obama: Let’s just assume for a moment we have a climate crisis

By Paul Driessen | Watts Up With That? | June 2, 2014

As we start hurricane season today, we note the unprecedented 3142 day drought of major hurricane landfalls, shattering a record that goes back to the year 1900.

Despite clear evidence to the contrary, president Obama is now warning us that “storms like Hurricane Sandy will become more frequent as climate change intensifies.” It’s merely the latest in the administration’s seemingly endless stream of headline-grabbing scare stories, designed to justify the job-killing, economy-strangling, family-bashing rules for vehicles, power plants, cement kilns, refineries, factories, farms, shopping malls and countless other facilities that are or soon will be regulated by Environmental Protection Agency fiat. We need to keep one vitally important fact in mind.

Every one of these “looming calamities” is based on assumptions, assertions and computer models that represent the real world about as well as the special-effects T-rexes and raptors do in Jurassic Park.  The data on hurricanes says otherwise:

hurricane_landfall_daysbtCat3plus2014

hurricane_us_landfalls_1900to2013

Climate modelers and disaster proponents remind me of the four guys who were marooned on an island, after their plane went down. The engineer began drawing plans for a boat; the lumberjack cut trees to build it; the pilot plotted a course to the nearest known civilization. But the economist just sat there. The exasperated workers asked him why he wasn’t helping.

“I don’t see the problem,” he replied. “Why can’t we just assume we have a boat, get on it and leave?”

In the case of climate change, those making the assumptions demand that we act immediately to avert planetary crises based solely on their computer model predictions. It’s like demanding that governments enact laws to safeguard us from velociraptors, after Jurassic Park scientists found that dinosaur DNA could be extracted from fossilized mosquitoes … and brought the carnivores back to special-effects life.

Climate models help improve our conceptual understandings of climate systems and the forces that drive climate change. However, they are terrible at predicting Earth’s temperature and other components of its climate. They should never be used to set or justify policies, laws and regulations – such as what the Environmental Protection Agency is about to impose on CO2 emissions from coal-fired power plants.

Even our best climate scientists still have only a limited grasp of Earth’s highly complex and chaotic climate systems, and the many interrelated solar, cosmic, oceanic, atmospheric, terrestrial and other forces that control climate and weather. Even the best models are only as good as that understanding.

Worse, the models and the science behind them have been horribly politicized. The Intergovernmental Panel on Climate Change was ostensibly organized in 1988 to examine possible human influences on Earth’s climate. In reality, Swedish meteorologist Bert Bolin and environmental activist groups wanted to use global warming to drive an anti-hydrocarbon, limited-growth agenda. That meant they somehow had to find a human influence on the climate – even if the best they could come up with was “The balance of evidence suggests a discernible human influence on global climate.” [emphasis added]

“Discernible” (ie, detectable) soon metamorphosed into “dominant,” which quickly morphed into the absurd notion that greenhouse gas (GHG) emissions have now replaced natural forces and become the only factors influencing climate change. They are certainly the only factors that climate activists and alarmists want to talk about, while they attempt to silence debate, criticism and skepticism. They use the models to generate scary “scenarios” that are presented as actual predictions of future calamities.

They predict, project or forecast that heat waves will intensify, droughts and floods will be stronger and more frequent, hurricanes will be more frequent and violent, sea levels will rise four feet by 2100 [versus eight inches since 1880], forest fires will worsen, and countless animal species will disappear. Unlikely.

Natural forces obviously caused the Medieval Warm Period, the Little Ice Age and the Pleistocene Ice Ages. (A slab of limestone that I dug up has numerous striations – scratches – left by the last mile-thick glacier that covered what is now my home town in Wisconsin.) After long denying it, the IPCC finally acknowledged that the LIA did occur, and that it was a worldwide agricultural and human disaster.

However, the models and computer algorithms the IPCC and EPA rely on still do not include the proper magnitude of solar cycles and other powerful natural forces that influence climate changes. They assume “positive feedbacks” from GHGs that trap heat, but understate the reflective and thus cooling effects of clouds. They display a global warming bias throughout – bolstered by temperature data contaminated by “urban heat island” effects, due to measuring stations being located too close to human heat sources. They assume Earth’s climate is now controlled almost entirely by rising human CO2/GHG emissions.

It’s no wonder the models, modelers and alarmists totally failed to predict the nearly-18-year absence of global warming – or that the modeled predictions diverge further from actual temperature measurements with every passing year. It’s no wonder modelers cannot tell us which aspects of global warming, global cooling, climate change and “climate disruption” are due to humans, and which are the result of natural forces. It’s hardly surprising that they cannot replicate (“hindcast”) the global temperature record from 1950 to 1995, without “fudging” their data and computer codes– or that they are wrong almost every time.

In 2000, Britain’s Met Office said cold winters would be a thing of the past, and “children just aren’t going to know what snow is.” The 2010 and 2012 winters were the coldest and snowiest in centuries. In 2013, Met Office scholars said the coming winter would be extremely dry; the forecast left towns, families and government agencies totally unprepared for the immense rains and floods that followed.

In 2007, Australia’s climate commissioner predicted Brisbane and other cities would never again have sufficient rain to fill their reservoirs. The forecast ignored previous drought and flood cycles, and was demolished by record rains in 2011, 2013 and 2014. Forecasts of Arctic and Antarctic meltdowns have ignored the long history of warmer and colder cycles, and ice buildups and breakups.

The Bonneville Power Administration said manmade warming will cause Columbia River Basin snowpack to melt faster, future precipitation to fall as rain, reservoirs to be overwhelmed – and yet water levels will be well below normal year round. President Obama insists that global temperatures will soar, wildfires will be more frequent and devastating, floods and droughts will be more frequent and disastrous, rising seas will inundate coastal cities as Arctic and Antarctic ice shelves melt and disintegrate, and 97% of scientists agree. Every claim is based on models or bald-faced assertions unsupported by evidence.

And still the IPCC says it has “very high confidence” (the highest level it assigns) to the supposed agreement between computer model forecasts and actual observations. The greater the divergence from reality, the higher its “confidence” climbs. Meanwhile, climate researchers and modelers from Nebraska, Penn State, Great Britain and other “learned institutions” continue to focus on alleged human influences on Earth’s climate. They know they will likely lose their government, foundation and other funding – and will certainly be harassed and vilified by EPA, environmentalists, politicians, and their ideological and pedagogical peers – if they examine natural forces too closely.

Thus they input erroneous data, simplistic assumptions, personal biases, and political and financial calculations, letting models spew out specious scenarios and phony forecasts: garbage in, garbage out.

The modelers owe it to humanity to get it right – so that we can predict, prepare for, mitigate and adapt to whatever future climate conditions nature (or humans) might throw at us. They cannot possibly do that without first understanding, inputting and modeling natural factors along with human influences.

Above all, these supposed modeling experts and climate scientists need to terminate their biases and their evangelism of political agendas that seek to slash fossil fuel use, “transform” our energy and economic systems, redistribute wealth [upward], reduce our standards of living, and “permit” African and other impoverished nations to enter the modern era only in a “sustainable manner,” as defined by callous elitists.

The climate catastrophe camp’s focus on CO2 is based on the fact that it is a byproduct of detested hydrocarbon use. But this trace gas (a mere 0.04% of Earth’s atmosphere) makes life on our planet possible. More carbon dioxide means crops, forests and grasslands grow faster and better. CO2’s role in climate change is speculative – and contradicted by real-world measurements, observations and history.

Computer models, scenarios and predictions of planetary Armageddon are little more than faulty, corrupt, even fraudulent pseudo-science. They have consistently forecast what has not happened on Planet Earth, and failed to forecast what did happen.

They must no longer be allowed to justify EPA’s job-killing, economy-strangling, family-bashing rules for vehicles, power plants, cement kilns, refineries, factories, farms, shopping malls and countless other facilities that are or soon will be regulated by agency fiat.

In its monthly report on Israeli violations, the Ahrar Center for Detainees’ Studies and Human Rights has reported that Israeli soldiers killed two Palestinians in May, and kidnapped 370.

The Center said that the army shot and killed Nadim Nuwwara, 17, and Mohammad Abu Thaher, 20, near the Ofer Israeli military roadblock, near the central West Bank city of Ramallah. The two were killed on May 15, during Nakba Day protests.

Israeli army sharpshooters killed the two following clashes with the army as the Palestinians marked the Nakba Day. Video footage showed the two walking away, with their backs to the army location, when they were killed.

As for arrests carried out by the Israeli occupation army, the Center said that 370 Palestinians were kidnapped in the West Bank, Jerusalem and the Gaza Strip.

In Jerusalem, soldiers kidnapped 118 Palestinians, the highest number of arrests in May, while 86 Palestinians were kidnapped in the Hebron district, 40 in Nablus, 30 in Bethlehem, 27 in Ramallah, 27 in Jenin, 16 in Qalqilia, 8 in Salfit, 4 in Tulkarem, and two in Tubas.

In addition, 12 Palestinians were kidnapped in the besieged Gaza Strip; three of them were kidnapped near the border fence, and nine were Palestinian fishers were kidnapped by the Israeli Navy in Palestinian territorial waters.

Also in May, the army kidnapped five Palestinian women in different parts of occupied Palestine, and released three of them, while two remained under interrogation.

Head of the Ahrar Center, Fuad al-Khoffash, stated that Israel is escalating the arrests, especially amongst young Palestinians, and that Israeli interrogators continue to use cruel interrogation methods, and extreme torture, in direct violation of International Law and all related human rights treaties.

He added that the arrests are happening while Administrative Detainees, held by Israel under arbitrary orders without charges or trial, are ongoing with their hunger strike despite the fact that many detainees are facing life-threatening conditions, and serious complications.
