Algeriepatriotique interviews Gilad Atzmon: “Dieudonné has proved to be resilient to Jewish nationalist terror”

Interview by Mohamed El-Ghazi, M. Ait Amara | January 18, 2014

Your fight against Zionism provokes critics against you in Israel and in the West. Your detractors conflate consciously between “anti-Zionism” and “anti-Semitism.” What is the difference between these two concepts?

Gilad Atzmon: “anti-Semitism” is a misleading notion that refers generally to criticism of Jews as ‘people’, ‘ethnicity’ or ‘race.’ Such criticism that is biologically driven hardly exists nowadays.

Anti-Zionism, is a different kind of fish — it refers broadly to criticism of the Jewish state, its politics, policies and ideology.

But the truth is that I do not fit in any of those categories. Although I criticize Israel harshly and more than often, I am actually interested in the true meaning of Jewish identity, culture, politics and ideology. I believe that as long as people operate politically under the Jewish banner we are entitled to question their motives, politics  and philosophy. Israel defines itself as “The Jewish state,” hence, its Jewishness must be examined.

I am indeed critical of the Jewish state, but I am often also critical of Jewish Left and even the Jewish so-called ‘anti’-Zionists. I basically disapprove of all  ‘Jews-only’ clubs, whether they are on the Left or the Right. I would argue that like Zionism and Israel, Jewish anti-Zionism is racially driven and Judeo-centric to the bone. It is primarily committed to Jewish tribal interests rather than to the Palestinian cause. In my book The Wandering Who I obviously produce enough evidence to support this claim.

Do You consider Zionists as the main cause behind the global financial crisis? How?

Not exactly, in The Wandering Who I contend that a financial bubble was created in the USA by the Federal Reserve in order to divert the attention from a military blunder in Iraq (a neocon Zionist war). But I actually argue that rather than a ‘conspiracy,’ the credit crunch was, in fact, an accident. The bubble burst unexpectedly…

We tend to believe that Zionism is limited to the colonization of Palestine in order to create a state there. Now, you say that it is “a global movement fed by a unique tribal solidarity”. What do you mean by “tribal solidarity”?

To start with, your terminology is slightly inaccurate. Zionism is not a colonial movement, in spite of the fact that many of us are using the term. Colonialism is defined as a material exchange between a mother state and a settler state. In the case of Zionism we can easily identify the ‘settler state’ but it is far more difficult to find or identify who is the ‘mummy’. Also the Jewish re-settlement in Palestine was spiritually and ideologically driven rather than being economically motivated.

However, with Jewish lobbies operating aggressively in most Western capitals (AIPAC, CFI, CRIF etc’), promoting global Zionist interests and advocating global wars against Iran and Syria, it is really impossible to avoid the fact that Zionism is now a global movement with global interests.

Tribal solidarity, in that respect, is also very easy to grasp. It refers to the vast support world Jewry lends to their national movement and tribally driven campaigns.

Could Zionism prevail creating “global conflicts,” as you say? In other words, why can’t Zionism pursue peace?

Because Jewish secular identity is defined by negation. The Godless political Jew (as opposed to the orthodox one) is defined by the animosity evoked in others. Jews need enemies and thus the continued existence of the Jewish state in the Middle East may lead to many more sectarian wars in the region in the future. But again it isn’t just Israel or Zionist politics. The Judification of the Palestinian ‘solidarity’ movement introduced us to vile witch-hunts consistent with the vile Jewish herem (excommunication) culture. In the last few years we have seen the UK PSC expelling activists and even Palestinians from its ranks. As I say above, Jewish politics is defined by negation, as such, it can only promote wars.

If Israel was created by the British capitalists to control oil production and transportation in the Middle East in the early twentieth century, how could Zionism take the West hostage several decades later? What led to this reversal of roles?

I don’t agree.  Israel wasn’t created by the British Empire and oil wasn’t at all the logos behind the Balfour Declaration. This is a popular banal materialist Marxist fantasy that doesn’t hold water and is set to deceive.

Zionist lobbies managed to squeeze the Balfour declaration out of the British Empire  at the peak of WWI promising to bring the USA into the war in return. Britain needed the USA to join the war effort  in order to break the stalemate on the Western front. Promising Palestine to the Jews seemed a little price to pay. The Balfour Declaration in that regard was there to appease the American Germanic patriotic Jewish financial elite who were quick change their allegiance from Germany to Britain. The message is clear, the Jewish lobby in the USA was already amongst the most influential political bodies in the USA and Britain as early as 1917.

The Western media is resistant to any criticism of Zionism. Currently, Dieudonné is attacked from every possible side in France. How do you explain this relentlessness media and political onslaught against this comedian?

Dieudonné has proved to be resilient to Jewish nationalist terror. All attempts to destroy him achieved the opposite, it only helped him to refine his humour and criticism of Jewish power. By now Dieudonné has managed to expose the lethal continuum between the Jewish Lobby, the so-called Palestinian solidarity movement and the French imaginary ‘Left’ establishment. Is it really a surprise that the ‘socialist’ government that just a few weeks ago shamelessly attempted to jeopardize the negotiation with Iran in a desperate attempt  to appease the Israeli government is now chasing a black comedian who refuses to subscribe to the primacy of Jewish suffering?

Unlike welded and well-organized Zionists, the anti-Zionist movements seem scattered. Why don’t the latter have a strong organization to fight this sprawling group that “kills in the name of Jewish suffering,” as you say?

The Zionification of the Palestinian solidarity movement, which I have been monitoring for more than a decade, is pretty much completed. It located Jewish tribal interests at the centre of the Palestinian struggle. Instead of caring for Palestine, solidarity organisations are now primarily concerned with the fight against ‘anti-semitism’. The Palestine solidarity movement is now operating as a controlled opposition. It is funded largely by liberal Zionists, such as George Soros and his Open Society Institute, who also funds the pro-Israeli Jstreet. The same Soros funds most Palestinian NGOs and even the BDS Movement. We are seeing the emergence of a little Palestine solidarity industry that is set to achieve nothing and is actually very good at it (achieving nothing).

But on the other hand, there are some very positive developments:

More and more people out there see the real picture. And I actually take some credit for it. More and more people are becoming sensitive to Jewish lobby activity and Zionist advocacy of global conflicts. More and more people grasp the role of the Left. They see the Guardian’s attempt to vindicate war criminal Sharon. In short, more and more people grasp that Palestine is here, in Paris, in London, in Athens and in Detroit.

As it stands, we are all Palestinians. The vast popular support of Dieudonne is a clear message to AIPAC, CRIF and CFI – beware, the party comes to an end. Enough is enough.

I would be very happy to see the Jewish lobby, both Zionist and the so-called ‘anti-’, coming to terms with the current change, but I doubt it. Being an avid reader of Jewish history and Left’s impotence, I predict that the Lobby will become more aggressive and I am really concerned with the inevitable consequences to Jews and the rest of us.

Palestinian Declaration

By Nahida Izzat | January 19, 2014

An invitation to All Palestinians and their supporters to unite under the banner of LIBERATION, affirming our Inalienable Rights and clarifying our aims and aspirations to ourselves and to the world For the sake of historical truth, and for defending, preserving and protecting the rights of future Palestinian children, we present this document:

  • Whereas, no foreign government, international institution or individual, has any form of legitimacy or jurisdiction to dispossess any other Nation by distributing their land and property,
  • Whereas, all colonial dealings regarding Palestine, whether by the “League of Nations” or the subsequent land confiscations by British colonial forces, as well as coerced transactions by early Zionists, did not invalidate the irrefutable fact that Palestine is the sole indigenous representative of all people of Palestine, settled and anchored culturally to the land since time immemorial,
  • Whereas, the religious component of Palestine’s cultural heritage is the central heritage for 31% of people who are Christians, 23 % who are Muslims, and  0.2 % who are Jews. Therefore, Jewish Zionists arguably attempted to usurp and destroy the heritage of almost 55% of humankind, namely Christians and Muslims, contrary to historical Palestinian society, known for its social cohesion, irrespective of religion, and for protecting all monuments and all worshipers of all faiths, prior to the Jewish-zionist invasion,
  • Whereas, we the Palestinian Nation, the sole indigenous people of historic Palestine, had neither been consulted with, nor did we agree to or undersign any partition of our homeland, Palestine, when the UN put partition to the vote in the General Assembly in 1948. The UN has never done so again,
  • Whereas, the UN General Assembly adopted resolution (181) recommending the adoption and implementation of the Partition Plan, allocating to “Israel” a defined area significantly smaller than the areas was overridden by Zionist Terror groups such as Irgun and Haganah, using ethnic cleansing, genocidal massacres, and massive destruction of over 530 Biblical villages and cities in the spring of 1948,
  • Whereas, the admission of “Israel” to the UN was conditional on its implementation of Resolutions 194, i.e., ceasing aggression and allowing the Palestinian refugees to return to their homes and properties, as well as implementing Resolution 181 of the partition plan, (which Israel did not commit itself to any specific action or timeframe, and later rejected the resolutions all together),
  • Whereas, the decision to partition Palestine was never passed through the UN Security Council, which renders it non-binding, (serving only as advisory),
  • Whereas, Zionism, as materialised and manifested by the Jewish state of “Israel”, is a colonial settler ideology, advocating the ethnic cleansing of Palestinians and confiscating their properties, abrogating their basic rights, and establishing an exclusive Jewish state in Historic Palestine,
  • Whereas, seven decades on, Jewish-Zionist terrorism, massacres, torture, imprisonment of civilian populations, torture of children, collective punishment, theft, land robbery, destruction of cultural heritage, ethnic cleansing, and slow-motion genocide, have only intensified,
  • Whereas, their offspring have had a full century (since the beginning of the first Jewish-Zionist invasion) to learn to coexist peacefully; yet they, along with the new-comers, choose to continue on the same path of aggression, oppression, exclusivity, and racism,
  • Whereas, the vast majority of Palestinians have been living in forced exile, forbidden to exercise their basic Human Right of Returning to their homes in their own homeland, and denied their basic human right of holding their National Identity,
  • Whereas, the entire humanity has the moral maturity which makes it unacceptable to acquire land and property by wars of conquest and aggression,
  • Whereas, we the Palestinian Nation have been victims of almost one century of insanely sadistic cruelty, assassinations of pregnant mothers, torture of children, psycho-terror, loss of land, loss of peace, security and independence, loss of health, destruction of our architectural and archeological cultural heritage, loss of collective and personal property, loss of economic means (i.e. loss of earning and sustenance), all at the hands and policies of a foreign and psychopathic body of Jewish Zionist terrorists and their international network of accomplices, for more than seven decades,
  • Whereas, myriads of Jewish-Zionist funds and foundations continue to raise and collect sums in the billions from international Jewish communities, to finance (either overtly or covertly) the destruction of our nation and our homeland, by means of a full spectrum destruction, be it genocide, be it destruction of landscape, be it destruction of architectural and cultural heritage, be it imprisonment and torture of children, be it systematic programs of assassination of social and political leader, be it use of toxic weapons,
  • Whereas, calling “Israel” a mere apartheid system which could be “fixed” with some cosmetic arrangements, such as granting Palestinians “Israeli” citizenship to “upgrade” their status from “occupied” to “slaves” in their own homeland, and demanding marginal improvement of the treatment of Palestinians, does not constitute in any form or shape a realistic approach enabling a viable project wherein even the most elementary basis of Justice could be established,
  • Whereas, participating in absolving individuals guilty of Crimes Against Humanity and other ongoing crimes since over seven decades, and whitewashing these crimes, is not only a betrayal to all things human and moral, but also is the fertile ground for justifying future repetition and amplification of such crimes,

For those reasons, we hereby, the undersigned Palestinians and our supporters affirm the following:

Palestine is located from the Mediterranean Sea to the River Jordan and cannot be divided, leased, given away or sold.

Palestinians, whether living in any part of historic Palestine or in forced exile, are one people and shall not be divided.

The Palestinian Nation is the only one owning the land of Palestine, with the human right of full and unrestrained sovereignty over our historic land, Palestine.

That the “Nakba” with its massacres and daily atrocities, continues to this day, beginning with the forceful uprooting of our people by terror organizations such as Irgun and Haganah in 1948.

The lapse of time since the beginning or this “Nakba” (the word means “catastrophe”) does not diminish our inalienable rights in Palestine, including the inalienable right to return to our homes and properties, and to participate in the re-building and development of our society and its institutions, and adopt any political, economic and Judicial system we Palestinians would chose.

Our people inside and outside of Palestine form one Nation, and yearn for their reunification in their ancestral homeland, Palestine.

Contrary to the defamation we have been subjected to, we have always been an extremely tolerant nation, and we yearn to restore this quality to our land and country, for the benefit of all humankind, irrespective of religion or cultural origin.

We Palestinians, just as any other nation under attack and occupied, have the ultimate and unabridged right to define our aims, choose our strategy and tactics of resistance suitable for achieving our liberation from our oppressor, and the reinstatement of our rights, and establishing diplomatic and commercial relations with neighboring countries and beyond.

Palestinians have the moral and legal right to pursue the legal prosecution of the usurpers and destroyers of our land within the recognized international laws. It is ominously dangerous for everyone’s security, to refuse to prosecute perpetrators of terrorism, crimes against humanity, atrocities, and the systematic fomenting of wars and racial and religious hatred. It is ominously dangerous to step back from such prosecution under the ludicrous grounds that the perpetrators would merit leniency on grounds of being Jewish.

Only the Palestinian people through our legitimate institutions and elected representatives can speak for our rights and aspirations.

No organization, party, group or individual is empowered to cede our rights to historic Palestine. In fact, we explicitly express here our intention, as soon as we recover our rights, to prosecute anyone who engaged or attempted to cede land and rights without having any mandate to do so.

Only the Palestinian people gathered in Palestine and in exile can determine their future and the future of the country.

We the signatories of this document, call for either the creation of a new Liberation Party, or the rejuvenation of the PLO, as the only recognized and accepted legitimate organization of the Palestinian people. Such an organization must be strengthened to unify the people and their capabilities, in order to be justified to speak on their behalf, and structure our fight for liberation.

This party, (whether the PLO or otherwise), must unambiguously stand for, and implement a program for liberation of all of Palestine. It must be democratic, accountable, transparent and truly representative of the entire spectrum of the Palestinian Nation.

The aims and aspirations of Palestinians are not confined to a symbolic change of “Zionist regime” or a declaration of abandonment of Zionism by the Jewish-Zionist occupiers, but rather to the Full liberation of Palestine and the restoration of all our inalienable rights.

We call for a just and peaceful solution; we acknowledge that the only real road to peace is the full and unconditional liberation of Palestine, (which also means liberation from the supremacist ideology that is imposing its cruel occupation) and liberation from the racist Jewish-Zionist experiment, Liberation from the violence of colonizers and liberation from the perpetrators.

That will inevitably mean a return to the original, peaceful society Palestine was before the Zionist invasion, albeit embracing all technological and societal developments.

Our true and sincere aspirations are long lasting peace, justice and freedom.

We believe that restoring Palestine for all its people will lay out the true foundations of Palestinian society, and inscribe us harmoniously in the international community, contrary to the present day occupation entity, “Israel,” which is the root cause of so many difficulties and excesses in the world community, whether in the UN or elsewhere, where “Israel” and its multinational lobby groups are fomenting wars and racial-religious friction, making international cooperation extremely difficult.

As Palestinians, we are grateful and appreciative of the hard work of all our supporters; however, we are under no obligation to hold back our march for freedom, to curtail our aims or to abandon our rights for the sake of accommodating and not offending some of the Jewish supporters who still believe that “Israel” has the right to exist as a Jewish state inside the 1948 borders.

Palestinians have the ultimate right to choose their vision for their future, of a free Palestine, including the type of government, writing of our constitution, constructing and implementing legal and systems, all of which stems from and corresponds to our ethics and reflects and protects our culture.

A Palestinian legal team of professionals and advisors must be established to prepare the legal framework and procedures, upon which laws of immigration and citizenship are defined, on the basis of which Palestinian citizenship are granted, including defining who has a Right to Remain in liberated Palestine, depending on the place of birth and providing s/he never participated in  former Israeli occupation apparatus and its crimes, and is able to respect Palestinian law, and adopt a conduct respective of the community around.

All Palestinian refugees and their descendants have the unconditional right to come back home; we, the rightful indigenous owners are also entitled to the reinstatement of All confiscated (stolen) land and property, compensation for all our losses over the many years of exile, and we are also entitled to Palestinian citizenship wherever we are.

We Palestinians have not given up before, and have no intention to give up now. We will continue to pursue the course of JUSTICE and LIBERATION by all means deemed necessary and appropriate, by upholding universal humanist ethics, within the frame of International Law.

Thus, our vision for a just and peaceful settlement entails:

REVOKING ISRAEL’S UN MEMBERSHIP:

The settler/colonial occupation is in breach of all foundational UN Charters, and has violated and defied more UN resolutions and charter principles than any other country. This illegitimate entity has none of the qualifications necessary, neither moral nor legal nor political, required to obtain and maintain UN membership. Its current membership represents a mockery of international law, and is a disgrace to humanity. Israel’s UN membership should have never been granted in the first place. The revocation of Israel’s UN membership is a necessity, as a step towards the rehabilitation of the already-battered framework of International Law. Concurrently, all of Israel’s institutions, laws, policies and practices must be abolished, since they discriminate against people based on religion and ethnicity.

FULL LIBERATION of HISTORIC PALESTINE:

Liberation means full sovereignty of the Palestinian Nation over their historic land, Palestine. Liberation also implies the irrevocable dissolution of the so called “state of Israel” and all its institutions. Palestine, known as “The Holy Land”, must be free from racist atrocities. Contrary to all failed attempts, road-maps and fake negotiations which serve as dilatory measure enabling more land grabs and atrocities. The concept of full liberation and full sovereignty for Palestinians carries only advantages; including the ability to prosecute “Israeli” criminals for Crimes against Humanity. To bring reason to the Holy Land, it is necessary to first recognize the fact that the Jewish-Zionist occupation is the sole reason there is strife in this land in the first place, and secondly, it is necessary to look back at the status pro ante, to realize that the institution of a liberated Palestine will inevitably reflect Palestinian peaceful culture and inclusive social fabric, thereby endlessly more apt to be a good standing member of the UN, and a good neighbor and partner to the world.

FULL SOVEREIGNTY of the Palestinian Nation over their ancestral country:

The Palestinian Nation has like any other nation has the aspiration and the right to select a political system, to adopt a constitution and re-construct the country. For the sake of international peace and security, it is time to return Palestine to its peaceful owners.

PROSECUTION OF WAR CRIMINALS:

A Palestinian judiciary and immigration system, will respectively prosecute former Israeli criminals and their associates, and/or grant or decline (on an individual basis), a Right to Remain in Palestine, based on criteria solely to be defined by said Immigration and Integration Services. This system should be put into place immediately.

RETURN, RESTITUTION and COMPENSATIONS:

Palestinian refugees have the unconditional Right of Return. Palestine and the Palestinian Nation at large, are entitled to full and unconditional restitution of the land and property whenever possible, coupled with appropriate compensation for more than seven decades of deprivation and slow genocide, cultural destruction, and a whole array of atrocities and usurpation.

PALESTINIAN CITIZENSHIP and NATURALISATION:

In the future democratic state of Palestine situated from the Mediterranean Sea to the River Jordan, Palestinians are the rightful citizens. Palestinians include those who live in the occupied homeland, and include all refugees living abroad and their descendants, all those have unrestricted right to Palestinian citizenship. For former Jewish Israelis, plans should be set on course to grant or decline on an individual basis a right to remain, based on criteria defined by an Immigration and Integration Service. Such criteria could take into consideration place of birth and the irrefutable proof of non-participation in the former Israeli occupation apparatus and its crimes, and the demonstration during a certain period, of the candidate’s ability and willingness to be law-abiding; respecting land, culture and his/her compatriots irrespective of religion or race. Subsequently the right to remain would be followed by unrestricted Palestinian citizenship, with equal rights. The whole procedure would be within the future framework of Palestinian Laws of Immigration and Naturalization. Undoubtedly, Palestinian immigration policies will adhere to international norms. We hereby, call upon our friends and supporters -who hold the tragedy of Palestine, the dispossession of Palestinians of their own ancestral land dear at their heart-, to reflect upon the meaning of justice in the context of a history saturated with war crimes and crimes against humanity.

We consider any negotiations that do not lead to implementation of the above null and void.

Also, we consider any and all individuals and institutions that do not adhere to our call as illegitimate representatives of our people and rights.

Thus, we call upon our people and institutions to rally behind this APPEAL and to work diligently to implement it.

We, also call upon our friends and supporters to join us in our declaration and our endeavours.

Furthermore, we call upon Jewish organizations and individuals, to take their responsibility seriously, we invite them to actively participate in restoring justice, righting the wrong, and facilitating the peaceful resolve of this chronic injustice by engaging positively, effectively and wholeheartedly to bring real change of “facts on the ground”, thus offering a remedy for healing of the Holy Land and its people, once and for all.

Moreover, we suggest they create a new Jewish fund, with agreement of every donor, to support the full and unconditional liberation in an effort to begin the lengthy process for Restitution, Reparation and Compensation for the Palestinians. A long overdue process, that will inevitably erase the seven decades long and ongoing Jewish Zionist crimes against the land of Palestine and its indigenous people.

Peaceful protest ends in deportation and imprisonment

International Solidarity Movement | January 20, 2014

Occupied Palestine – On Saturday 18th January during a peaceful protest in the Jordan Valley, 19-year-old Ahmad Walid Atatreh, a Palestinian activist and 24-year-old Sven W, a German activist who lives in Switzerland, were arrested and beaten after a march held in Jiftlik Adam Junction. Ahmad is a law student, studying at Al-Quds University in Jerusalem.

The march in Jiftlik was organized in protest against a legislation bill recently approved in the Knesset to annex the Jordan Valley to the current state of Israel. While the Israeli government declares that the move is purely for security reasons, the large number of illegal agricultural settlements and theft of Palestinian water rights demonstrate that the motives are largely economic.

Almost 95% of the Jordan Valley lies in Area C, under full Israeli civil and military control. Palestinian Bedouin herders suffer repeated demolitions of their homes and animal shelters, and water tanks are frequently confiscated. A large section of the area is reserved as a firing zone and residents are often forcibly removed from their homes to make way for military exercises.

Approximately 60 people gathered in the Jordan Valley and began a protest holding banners and chanting against the Israeli occupation of Palestine. As the march ended, Israeli forces invaded the area and began to arrest Palestinian demonstrators. Sven W and a British volunteer succeeded in stopping the detention of a Palestinian youth and in the process were both arrested by the Israeli army.

The two international activists were violently pushed to the ground by an Israeli soldier and handcuffed. The British activist managed to escape detention, whilst Sven was blindfolded and forced to kneel on the ground.

One Israeli soldier purposefully pushed Sven’s face in dirty water before taking him behind a military jeep and repeatedly kicking him in the ribs. Ahmad was also beaten after his arrest and received injuries to his knee. The British activist received a similar assault before escaping detention.

During the arrests, Israeli soldiers fired live ammunition into the air, and on several occasions pointed their rifles at protesters’ faces.

Sven and Ahmad were blindfolded for 3 hours and were driven to an Israeli military base. While they were blindfolded, Israeli forces attempted to intimidate and frighten the activists by pointing guns in their faces.

At the military base Sven was told he was a “terrorist” and was arrested because he “threw stones”.

Sven is committed to non-violent resistance and during this particular demonstration, no stones were thrown.

Both activists were taken to a ‘medical’ room in the military base where their blindfolds were briefly removed, although their handcuffs remained. Sven told the Israeli soldiers that he had a headache after being unable to see for such a long period of time, and also that his ribs were sore due to the beating he received after his arrest. According to Sven this information was noted down although Israeli forces did nothing to assist with his pain. During this time in the medical room, many Israeli soldiers entered and took pictures of both Sven and Ahmad using their mobile phones.

Ahmad and Sven were then blindfolded again and driven to a police station in the illegal settlement of Ariel, neither activist was given any information with regard to where they were being taken or allowed to contact legal representation. During this drive Israeli forces stopped the car, tightened Ahmad’s blindfold and stole a camera from Sven’s bag, using it to take pictures of the two blindfolded men.

When they arrived at Ariel, Sven was finally informed of the three charges against him, assaulting an Israeli soldier, attempting to steal a rifle from a soldier and blocking a highway and therefore ‘”endangering” lives (however at no moment was anyone blocking the main highway, activists were gathered at the side of the road). The same charges were also given to Ahmad and are completely fabricated for both activists.

Sven and Ahmad spent the night in Ariel police station along with five other Palestinian prisoners. The light was kept on all night with Israeli forces constantly entering the cell, ensuring that none of the prisoners were able to sleep. At one point Sven was woken by a police officer and told he would have court in the morning.

Under Israeli law internationals must be taken before a judge within 24 hours.

In the morning of the 19th, Sven repeatedly asked when he would be transferred for his court hearing and he was ignored by Israeli police. At this point neither Sven nor Ahmad were allowed to contact legal representation. Ahmad also requested to speak to his lawyer and was told that unless he gave information about the demonstration he would not be allowed to contact anyone.

At 5pm, Sven was transferred from Ariel police station to a terminal at Ben Gurion airport. He was never taken before a judge and was instead asked to sign a piece of paper saying he agreed to be deported to Germany, although he has been living in Switzerland for the last 4 years.

Sven refused to sign unless he was allowed to speak to legal representation. Finally he was allowed to make a phone call, though was unable to get through to his lawyer and therefore unwilling to sign the document.

Sven was transferred to a prison in Ramle, near Tel Aviv, which is where he currently resides. He is expected to be deported on Thursday. When Sven left the illegal settlement of Ariel, Ahmad was still imprisoned. He has now been transferred to Hadarim prison in Netanya and should attend Salem court within the next few days. However he has still not been allowed to contact his lawyer, the first time Ahmad will speak to him will be when he is taken before a judge.

When Sven is deported this week, he will be the third international activist in less than two weeks to be arrested and deported by Israeli forces.  Vincent Mainville and Fabio Theodule were arrested on the 8th January and deported a week later. Their arrest was ruled illegal by an Israeli court in Jerusalem, although this did not stop their transfer to the immigration center.

3 Israeli airstrikes on Gaza injure motorcyclist, child

Ma’an – 19/01/2014

GAZA CITY – A young Palestinian man and a child were injured on Sunday morning after Israeli air forces launched three strikes across the Gaza Strip.

An Israeli airstrike in the northern Gaza Strip hit a motorcyclist on Saftawi Street near Jabaliya, injuring the driver and a number of passersby.

Two other airstrikes in the central and southern Gaza Strip left no reported injuries.

Spokesman for the Gaza Strip Ministry of Health Ahraf al-Qidra told reporters that the motorcyclist was a 22-year-old man, and that he was taken to al-Shifa Hospital in Gaza City after he sustained serious injuries.

Al-Qidra added that a 12-year-old boy was taken to Kamal Udwan Hospital in Jabaliya, and that doctors said he suffered moderate wounds.

A statement by Israeli forces said that they had “successfully targeted a terrorist operative” named Ahmad Saad, who they described as “a senior operative in the ‘Palestinian Islamic Jihad'” organization.

The statement added that Saad was a specialist “in rocket launching” and is “personally responsible for the launching of 5 rockets towards Ashkelon” on Thursday.

Also on Sunday morning, Israeli air forces bombed two sites in the central and southern Gaza Strip used as training sites for Palestinian militants.

Witnesses told Ma’an that at least three missiles hit a military training site in the town of Bani Suheila east of Khan Younis in the southern Gaza Strip.

The site and neighboring civilian houses sustained material damage, but no injuries were reported.

Less than 10 minutes later, another Israeli airstrike targeted a training site of the Hamas’ military wing the al-Qassam Brigades near Nuseirat refugee camp in the central Gaza Strip.

No injuries were reported in that strike either.

An Israeli military spokesperson said the attacks came after a homemade shell fired from the Gaza Strip landed in the Western Negev.

The airstrikes come only days after four Palestinian children and a woman were injured in Israeli bombing in the Gaza Strip early on Thursday, and a day after after Israeli forces opened fire on Palestinian protesters near the border, injuring two.

The Gaza Strip has been under a severe economic blockade imposed by the State of Israel since 2006.

Report: Israel increases use of torture in interrogation centers

Palestine Information Center – 17/01/2014

d8a7d8b9d8aad982d8a7d984_41GAZA — The Israeli occupation authority escalated its violation of international laws and human rights conventions in its jails and interrogation centers, human rights report said.

Palestine Center for Prisoners’ Studies revealed that many Palestinian prisoners including women and children have been subjected to torture in Israeli jails and interrogation centers.

Israeli torture techniques include beating, blindfolding, hanging, strip search, Shabh (stress position) where prisoners are made to sit on a small chair with their head hooded and hands tied behind their back, pouring hot or very cold water over the head, according to the report.

The human rights center documented several cases of tortured prisoners who were deprived of sleep and forced into painful positions for long periods in addition to many practices that violate Convention on the Rights of the Child.

The report revealed that Israeli doctors are involved in torture practices against prisoners through submitting false medical files that deny torture crimes before courts.

Theses on Zionism

A Response to Joseph Massad’s “Theses on Zionism”

By HARRY CLARK | CounterPunch | January 17, 2014

This is a response to Joseph Massad’s  “Theses on Zionism” in Electronic Intifada on December 9, 2013.

I.

In pre-modern times, Jews lived in separate communities, governed by their religious authorities, with corporate rights and obligations, determined by royal or aristocratic authority. The Enlightenment and emancipation ended the subjugation of west European Jews to Judaic authorities, and to gentile regulation. Jews were admitted, gradually but inevitably, to full citizenship in their states of residence, equal to their fellow citizens. The US was created on a modern, liberal basis, with no trace of pre-modern Jewish status. Anti-semitism existed but liberalism was the prevailing trend before World War I. In modern terms, Jews became a religious minority, or secular citizens. Jews embraced  modernity wholeheartedly. Western Jews became some of its leading proponents; east European Jews emigrated by the million from oppressed, traditional societies to the US.

II.

Zionism was a response not only to anti-Semitism but to liberal modernity. Zionism opposed the assimilation and integration of Jews, and held that anti-Semitism was irrevocable and natural. “The Jews comprise a distinctive element among the nations under which they dwell, and as such can neither assimilate nor be readily digested by any nation.” We “must give up contending against these hostile impulses [anti-Semitism].” Resistance is “a waste of time and energy.” “The civil and political emancipation of the Jews is not sufficient to raise them in the estimation of the peoples.” “The proper, the only solution, is in the creation of a Jewish nationality, of a people living upon its own soil, the auto-emancipation of the Jews; their return to the ranks of the nations by the acquisition of a Jewish homeland.” (Leon Pinsker, Auto-emancipation)

III.

Zionism adopted anti-Semitic ideas and tactics and cooperated with anti-Semites practically. Herzl frequented anti-Semitic salons in Paris, and sought Russian czarist support for Zionism with Ottoman Turkey in return for silencing Russian Jewish protest. After the October, 1917 Russian revolution Zionism presented itself to the western powers as Jewish anti-Bolshevism. In the Russian civil war Zionists allied with anti-Semitic White forces who committed pogroms when they lost to the Bolsheviks. In 1933 the Zionist movement broke the promising Jewish-led boycott of Nazi Germany with the Transfer Agreement, which sold German exports through Palestine. Zionism opposed relief for Jews on humanitarian grounds because it detracted from Zionist national aims in Palestine. Zionism was an elite project of national renewal, concerned with “the problems of Judaism, not the problems of Jewry,”  in Ahad Ha’am’s words.

IV.

The Zionist claims of a historical Jewish people,  attached to the “land of Israel,” and of modern “secular Jewish identity” are utterly untenable. Zionist racialism dates to the proto-Zionism of Moses Hess; the chauvinism of Heinrich Graetz contributed to German anti-Semitism; German Zionism was Jewish Romantic nationalism, embracing Jewish Blut und Boden. Theodor Herzl was steeped in the racism of European colonialism. Nazi and Zionist “race experts” consulted each other in the 1930s. Elmer Berger, an anti-Zionist rabbi, co-authored the 1977 UN resolution on Zionism as a form of racism.  “Jewish genetics” tries to build a biological basis for Zionism. Zionism’s fundamental opposition is not Jewish settler vs  Arab indigene in Palestine, but Jew vs gentile everywhere. Historian Noel Ignatiev called  Zionism Jewish race doctrine.

V.

There is no “progressive Zionism.” The leaders of “cultural Zionism” supported immigration and a Jewish majority. Zionist “culture” is founded on irreducible Jewish difference, separatism, alienation, and anti-gentilism, the counterpart of racialist anti-Semitism. The bi-nationalists wanted Jewish immigration leading to demographic parity and eventually majority, when Jews were a minority. The kibbutz was an instrument of exclusive Ashkenazi Jewish settlement in Palestine, and was inspired by 19th c. German  plans to counter a Polish “demographic threat” in the eastern Reich. Hitler might have conquered the Near East; the Judeocide happened because of Nazi Germany, not because there was no Jewish state. Israeli Hebrew ethnicity or nationality, secular and open to all, is the liberal replacement for Zionist Jewish nationality,

VI.

The classical left and liberal traditions descended from the Enlightenment and emancipation rejected Zionism categorically. American Reform Judaism once stated: “We consider ourselves no longer a nation, but a religious community, and, therefore expect neither a return to Palestine, nor… the restoration of any of the laws concerning the Jewish state.” Marxism upheld the international solidarity of the working class, viewed nationalism as reactionary, and Zionism as a colonial movement and tool of imperialism. The Yiddish labor movements in the Russian Empire and their immigrant offshoots also opposed Zionism. The late Israel Shahak referred to the “modern, secular Jewish tradition,” which he traced from Spinoza, who began the remarkable Jewish contribution to  modernity. Shahak viewed Zionism as a reaction against emancipation, and a longing for the ghetto.

VII.

Zionism was a marginal cult among western Jews until World War I. The Balfour Declaration and the British conquest of Palestine raised interest but it subsided, reviving only with the advent of Nazism. US Jews supported overwhelmingly the establishment of Israel in 1948, but liberal attitudes prevailed into the early 1960s. The success of liberalism and assimilation led to a “continuity crisis,” an effort to maintain separatism that was fatally supercharged by the June, 1967 war. Organized Jewry became and remains fanatically chauvinist, insular and pro-Israel. “The Holocaust” became an institution and part of Jewish identity, including classic Zionist dogma about irrevocable, murderous anti-Semitism. The organized Jewish communities and the Jewish state have constituted the Zionist Jewish people. The Volk has replaced liberalism as the Jewish social principle; the modern period of Jewish history has ended.

VIII.

The organized Jewish community is the core of US support for Israel, the “Zionocracy,” after the 19th c. “Slaveocracy” that wielded immense power until the Civil War. The Zionocracy has exercised quasi-sovereign influence on US foreign policy since the 1940s, when it secured US support for partition of Palestine and the Jewish state, against overwhelming military and diplomatic opposition. Israel’s “strategic value” during the later Cold War is mostly Zionist public relations. In the 1960s the Zionocracy concealed Israel’s nuclear weapons program, secured arms sales, and US support for Israel in 1967, against warnings by many US officials. The October, 1973 war and resulting oil price increases were the biggest shock to the world economy since 1945. The Carter Administration sought  a two-state solution to the Arab-Israeli conflict but the Zionocracy limited Carter’s diplomacy to a separate Egypt-Israel peace. Israel and the Zionocracy then opposed Iraq and supported Iran during their war in 1980s.

IX.

Zionism has been the chief ideological driver of US militarism since the end of the Cold War. The congressional vote for the 1991 Gulf War against Iraq was the closest since the War of 1812,  and the Zionocracy may have tipped the scales. The “dual containment” of Iran and Iraq in the 1990s was by and for the Zionocracy, over substantial business opposition. The 9/11 attacks, which led to the US invasions of Afghanistan and Iraq, and the destruction of civil liberties, were directed mainly against US patronage of Israel. The Zionocracy is the main source of Islamophobia in the US. The Jewish neoconservatives were the prime movers in the 2003 US invasion of Iraq. This greatly increased Iranian influence and escalated its antagonism with Saudi Arabia, and led to the present dissolution of Syria. The US has restarted diplomacy with Iran but the Zionocracy has passed overwhelmingly in the House and has majority sponsorship in the Senate for legislation that will destroy the opening and restore the war drive.

X.

Left and liberal Jewish opinion since 1967 has been as völkisch as the mainstream. Israel was not an issue for the Jewish members of the American New Left in the early 1960s, who sought to build a universalist movement. The New Left shattered in the late 1960s over internal differences, including attitudes toward Israel, after the June 1967 war.  A “Jewish left” arose, which purported to combine Jewish commitment with social justice, including some criticism of Israel. Today a loose school of  Jewish identity politics centered on Noam Chomsky imposes on the left terms of “anti-occupation”, “law and rights,” “solutions,” “progressive Zionism,” “Israel as US strategic asset,” and “anti-anti-Semitism”. This circumscribed critique conceals the US Zionocracy and Zionism itself, in contrast to the classical liberalism of the Enlightenment and emancipation, which rejected Zionism categorically. The modern period of Jewish history has ended on the left also.

XI.

A universalist critique would oppose Zionism, not “the occupation”; recognize Zionism as Jewish racialism, opposing Jew and gentile everywhere; acknowledge Zionism as the ideological driver of genocide and destruction in western Asia, and the source of Jewish chauvinism and separatism

in the US; reject the Zionist idea of “the Jewish people” in whose name the state of Israel and organized Jewry act; condemn the role of US organized Jewry and the Zionocracy as a quasi-sovereign, radicalizing force in US Middle East policy; and defend a secular realm in which we think and act together. It would do this in the name of the people of Jewish background who contributed so much to modernity, from Spinoza onward, whose legacy towers over Zionism. The failure to do this is catastrophic, comparable to the German Communist Party’s disastrous misreading of Hitler and Nazism, which  weakened the left and assisted their rise to power, and all that followed.

Harry Clark’s article “The End of Modern Jewish History,” which expands on these issues, will appear in Left Curve,  No. 38, forthcoming in April. He may be reached at his web site http://questionofpalestine.net

A New Year Just Like the Old Year

Jennifer Rubin Wants More War

By Philip Giraldi • The Unz Review • January 16, 2014

Israel’s friends frequently claim that critics hold Tel Aviv to a higher standard than they do other countries that have similar or worse records on human rights. Actually the truth is quite the reverse, with Israel frequently able to escape censure for actions that would normally result in the imposition of sanctions by the United Nations Security Council and condemnation by other international bodies. I am of course referring to the continued brutal Israeli occupation of much of what remains of Palestine and the ongoing colonization of land that is being appropriated illegally, activity that is only allowed to continue because of Washington’s willingness to protect Israel no matter what cost to other American interests.

Some of the gyrations that Israel’s supporters engage in would be describable as comic if the consequences of their obfuscation were not so serious. And there is no one better at throwing mud than Jennifer Rubin, the Washington Post’s designated “Right Turn” blogger who is one of those folks who believe that being in love with Israel is a core conservative value. Rubin can hardly write about any current issue without somehow turning the discussion to poor little Israel, or, alternatively, to evil Iran.

On January 5th, Rubin produced what for her might be considered a ruminative piece entitled “What mattered in 2013.” She found “two developments… more significant” than anything else that happened in the past year, namely gay marriage and the continued perfidy of those danged Muslims. Leaving the gay marriage issue aside, Jennifer sees “Iran and its junior partner Syria in ascendancy” while Bashar Al-Assad of Syria “murdered more than 130,000” of his own people and crossed red lines with “near impunity,” a “monstrous event [that] Elliott Abrams tells us, has ramifications far beyond Syria.”

Abrams, a convicted felon and notorious liar but true blue for Israel, believes that inaction in Syria “has been noted in Jerusalem” and will send a signal and encourage Moscow and Beijing to challenge Washington.

Hezbollah meanwhile has “expanded its missile cache” and obtained “a strategic victory” together with Iran and will win in Syria while the US president “thinks up reasons not to act.”

Iran is behind all the instability, benefiting from “advanced centrifuges” and “international acquiescence” it is “on the cusp of obtaining a nuclear arms capability” even as it “pursues terrorism.” Rubin notes that “Sanctions have not dislodged the regime nor caused it to rethink its nuclear arms ambitions” but then goes on to recommend that “Congress can pass sanctions over White House objections and thereby force Iran to capitulate” because “If Congress finds a nuclear-armed Iran horrifying and wants to avoid a Middle East war it will need to pass a final sanctions bill, the last chance to peacefully disarm that mullahs.”

In another blog item posted on the following day, Jennifer is at it again, describing “Middle East bedlam.” She excoriates Secretary of State John Kerry for his eminently sensible suggestion “that Iran might join Syrian peace talks in Geneva” which she describes as “rewarding bad behavior” before stating that Washington has “no will to check Iranian hegemonic ambitions in the region.”

Three hours later, Rubin was at it again explaining how “Iran sanctions opponents [are] desperate,” noting that as of that time 49 senators had signed on to the new Iran bill, which would put an end to talks intended to resolve outstanding issues relating to the Iranian nuclear program. Interestingly, she observes that four “traditionally pro-Israel democrats” had yet to sign, suggesting that she appreciates very well that all the rationalizations about how Iran is a threat to the US are bogus and that it is all about Israel, just as it always is for her.

Rubin observes that the “anti-sanctions crowd remains a gaggle made up of far-left activists, State Department sycophants and reluctant Democratic chairmen dragooned into opposing the measure by the White House.” The lefties, apparently, have been suborned into opposing the measure by a “hit squad and consistently anti-Israel gang” in the progressive media while the “small cadre of ex-State Department and intelligence community hacks” fill out the roster of those who hate American National Security, apparently a subset of American Exceptionalism. Thank God true American heroes like Senators Schumer, Gillibrand, Cardin and Menendez are “showing fortitude on sanctions” and doing what it takes to “dismantle [Iran’s] illegal nuclear weapons program.”

Three days later Rubin again describes how “Obama Iran gambit is unraveling.” She describes the negotiations in Geneva as “a giant stall by Iran to allow it to progress with its nuclear weapons program while getting sanctions relief.” How does she know that? She quotes no less an authority than Mark Dubowitz, a Canadian who claims to be an expert on the Middle East because he lived there but it turns out that he only resided in Israel. He is currently president of the neocon Foundation for Defense of Democracies and heads a staff of 32 dedicated to finding more punishing ways to sanction Iran. Dubowitz claims that “Iran is building an industrial-size nuclear infrastructure that will give it multiple overt and covert pathways to a bomb.” Rubin adds that “either president Obama was snookered or he is snookering us” before quoting Josh Block, a former AIPAC communications director currently heading The Israel Project, who claims that “the ‘interim deal’ is actually just another stalling tactic by Iran… [but] Congress is not fooled. The American people are not fooled. Iran is playing us for the fool.” Block, for what it’s worth, is an Israel Firster who believes that anyone who uses the expression Israel Firster is a “borderline anti-Semite.”

Rubin concludes by warning that “… Congress needs to step forward and exercise leadership. If not, Iran will have gotten the bomb, relief from sanctions, encouragement for its hegemonic ambitions and a nuclear blackmail card. In fact, it’s most of the way there.”

First of all, it is perhaps not surprising that everywhere one turns with Jennifer Rubin Israel comes up, but she lacks the integrity required to appreciate that most of the criticisms she levels against the feckless Arabs and Iranians would apply equally or even more to Israel’s behavior. I sometimes think that it would be a wake-up call for her and her associates if one were able to arrange for all 100 Senators to vote anonymously, without fear of being exposed, on whether or not they really think that Iran threatens the United States. I would bet that an overwhelming number would indicate “no.” But, unfortunately, congress does not vote secretly. A veto proof majority of Senators now appear to be willing to vote for new Iran sanctions, the result of “a massive phone campaign by Concerned Women for America (CWA), a 500,000-member Christian and Zionist conservative group” and by the Emergency Committee for Israel. The White House is correctly warning that voting for new sanctions equates to voting for war.

So the question becomes “Why is the United States inching away from a possible agreement with Iran, a country that has been unfairly designated enemy number one since 1978?” I would suggest that Jennifer Rubin and the hacks (her term) that she assembles to say what she wants to hear have been a major element in pressuring congress and the rest of the media to line up squarely behind Israel, no matter what the issue and no matter what the genuine US interests might be. Rubin proudly reports that former Senator Scott Brown recently e-mailed her “One of the things I miss most [since leaving the Senate] is not being able to fight for Israel.” One has to wonder why any American Senator should be saying anything like that, but the irony apparently eludes Rubin.

And Jennifer is not above repeating over and over again her basic themes: that Iran wants to destroy Israel, that it has a nuclear weapons program, and that its intentions are both aggressive and hegemonic. Unfortunately all of her power points are either flat out false or not demonstrated by available evidence. According to the US intelligence community, Iran abandoned plans for a nuclear weapon in 2003 and does not currently have a program to develop one. Even Israeli intelligence agrees that is so. And Iran has never actually threatened to attack Israel. In fact, it hasn’t attacked anyone since the seventeenth century.

When Rubin launches her diatribes, she assumes that the reader agrees that Iran has a nuclear weapons program and that it is a somehow a threat to the rest of the Middle East as well as to Europe and the United States. She piles surmise upon innuendo while making no real effort to explain how Iran with its miniscule military budget and surrounded by enemies is actually a threat, possibly because it is an impossible case to make. And as for poor beleaguered Israel, with its more than 200 secret nukes and delivery systems, she certainly must know that Iran could be destroyed in a matter of hours if Prime Minister Benjamin Netanyahu should choose to give the order. Given the fact that the breathtakingly belligerent Netanyahu is far nuttier than anyone running around loose in Iran, he is the real threat to peace that comes out of the Middle East, but it is a tale that Jennifer Rubin is unlikely to tell.

Britain says every state should join the ICC apart from Palestine

By David Morrison | Friends of Lebanon | January 16, 2014

It is British policy to extend the jurisdiction of the International Criminal Court (ICC) to every corner of the earth, except the Palestinian territories occupied by Israel since 1967, that is, the West Bank, including East Jerusalem, and Gaza.

And it is not as if the Occupying Power isn’t committing acts that Britain regards as illegal in these territories, in particular, settlement building.  British policy on this issue as stated on the FCO website is as follows:

“Our position on Israeli settlements in the Occupied Palestinian Territories is clear: they are illegal under international law, an obstacle to peace and make a two-state solution harder to achieve.” [1]

Settlement building is a war crime

Though the British Government never says so explicitly, settlement building is a war crime under the Rome Statute which defines the offences that can be prosecuted by the ICC.  It is a war crime because it involves the Occupying Power transferring some of its own civilian population to the territory it occupies.  And under Article 8.2(b)(viii) of the Rome Statute “the transfer, directly or indirectly, by the Occupying Power of parts of its own civilian population into the territory it occupies” [2] is a war crime.

Since there is no doubt that Israel has transferred well over 500,000 Israeli civilians into territory it occupies, and that the process is still going on, there is a prima facie case that Israelis responsible for the settlement building programme, including the present Prime Minister Benyamin Netanyahu, are guilty of war crimes.  It may be that Americans and others who fund settlement building are guilty of aiding and abetting war crimes.

Yet the British Government is opposed to Palestine becoming a party to the Rome Statute so that it is possible that Israelis responsible for settlement building will be brought to account for what the British Government itself regards as illegal actions.

Challenging impunity around the world

In July last year, the British Foreign Office launched an ICC strategy paper [3], which expressed Britain’s enthusiastic support for international systems of justice in general and the ICC in particular.

A key element of British policy set out in the paper is the extension of the jurisdiction of the ICC by encouraging states that are not party to the Rome Statute of the ICC to join, with the objective of the ICC eventually acquiring universal jurisdiction. The paper explains that the British Government intends to:

  • “Work with other States Parties to encourage more states to ratify and accede to the Rome Statute and to fully implement its provisions in domestic law. …
  • “Urge States not party to the Rome Statute to consider ratifying or acceding to the Treaty …”

The paper explains:

  • “Widening the reach of the Court beyond the current 122 States Parties will increase accountability and help challenge impunity.”

Inappropriate to challenge Israeli impunity

This enthusiasm for extending ICC jurisdiction was sadly missing when Foreign Minister William Hague spoke in the House of Commons a few months later on 28 November 2012.  Then, he offered UK support for a UN General Assembly resolution granting Palestine statehood, providing Palestinian leaders promised, amongst other things, that if Palestine acquired statehood it would not become a party to the Rome Statute.

Here’s what he told the House of Commons:

“Our country is a strong supporter, across all parties, of international justice and the International Criminal Court. We would ultimately like to see a Palestinian state represented throughout all the organs of the United Nations. However, we judge that if the Palestinians were to build on this resolution by pursuing ICC jurisdiction over the occupied territories at this stage, it could make a return to negotiations impossible.” [4]

Yes, believe it or believe it not, it is British policy to extend the jurisdiction of the ICC to every corner of the earth, except the Palestinian territories occupied by Israel since 1967.  There it is apparently inappropriate for Britain to challenge impunity.

Two days later, when in retaliation for the UN granting statehood to Palestine, Israel announced plans for yet more building in settlements, William Hague reacted as follows:

“I am extremely concerned by reports that the Israeli Cabinet plans to approve the building of 3000 new housing units in illegal settlements in the West Bank and East Jerusalem. Israeli settlements are illegal under international law and undermine trust between the parties.” [5]

Dare I suggest that, if settlements are illegal under international law, then, if at all possible, those responsible should be tried in an international court and, if found guilty, punished appropriately?  Dare I suggest that, to this end, Palestine should be encouraged to accept the jurisdiction of the ICC?

Palestinian Authority tried to grant the ICC jurisdiction

In January 2009, the Palestinian Authority tried to grant the ICC jurisdiction over the occupied territories so that it would be possible for Israelis to be prosecuted by it for actions against Gaza during Operation Cast Lead.

The ICC can prosecute individuals for genocide, war crimes or crimes against humanity, as defined in the Rome Statute of the Court [2]. It acquires jurisdiction in respect of these crimes by states granting it jurisdiction under Article 12 of the Statute.  A state can grant jurisdiction to the Court

(a)  by becoming a Party to the Statute (Article 12(1)) or

(b)  by making an ad hoc declaration accepting the Court’s jurisdiction (Article 12(3)).

The ICC can try individuals for genocide, war crimes or crimes against humanity, committed in the territories of states (or by its nationals anywhere) that have granted the Court jurisdiction.

On 21 January 2009, the Palestinian Authority made an ad hoc declaration to the Court under Article 12(3) in the following terms:

“In conformity with Article 12, paragraph 3 of the Statute of the International Criminal Court, the Government of Palestine hereby recognizes the jurisdiction of the Court for the purposes of identifying, prosecuting and judging the authors and accomplices of acts committed in the territory of Palestine since 1 July 2002” [6].

It took the ICC Prosecutor over three years (until April 2012) to decide that the Court couldn’t accept the jurisdiction offered.  This decision hung on whether or not Palestine was a “state” within the meaning of Article 12(3), which says that a “State may, by declaration lodged with the Registrar, accept the exercise of jurisdiction by the Court with respect to the crime in question”.

Strangely, the Prosecutor concluded that it wasn’t up to him to decide whether or not Palestine was a “state”, within the meaning of Article 12(3), saying that “competence for determining the term “state” within the meaning of article 12 rests, in the first instance, with the United Nations Secretary General who, in case of doubt, will defer to the guidance of General Assembly” [7].

However, now that the UN General Assembly passed resolution A/RES/67/19 [8] accepting Palestine as a state, there is little doubt that Palestine can simply become a Party to the Statute under Article 12(1).  Given that Palestine has been accepted as a state by the UN, it is almost certain that the answer would be YES.

During a public discussion held at the Academie Diplomatique Internationale in Paris on 20 March 2013, Fatou Bensouda, the Prosecutor of the International Criminal Court, said that it was clear that ICC membership for the State of Palestine was Palestine’s for the asking (see John Whitbeck, Palestine and the ICC, Al Jazeera, 16 April 2013 [9]).

Whitbeck also reported Fatou Bensouda’s view on the issue of retroactivity, that is, whether individuals could be prosecuted for past crimes committed before Palestine becomes a party to the Rome Statute.  She said that she did not think that retroactivity could extend back to the birth of the court in 2002 and if any retroactivity was permitted, it would not be earlier than 29 November 2012, when the UN General Assembly recognised Palestine as a state.

Palestine to join other UN bodies?

A year has passed since Palestine was granted statehood by the UN General Assembly.  It was generally expected that, having achieved that, the Palestinian Authority would press ahead to join other bodies associated with the UN, of which there are about 20, including the ICC.

There is little doubt that, had it done so, it would have been admitted to all of them. Remember that in October 2011, a year before it achieved statehood and in the teeth of fierce opposition from the US and Israel, it was admitted to full membership of UNESCO by 107 votes to 14 with 52 abstentions.

But, it hasn’t done so, because there has been fierce pressure on it not to do so, especially from the US.  And, it has now promised theUS that it will not apply for membership of any of these bodies until April 2014 during the 9 month period of “negotiations” with Israel, brokered by the US Secretary of State, John Kerry.

It is absolutely outrageous that the US, with the support of Britain and others, has pressurised Palestinians into forgoing a possible legal means of redress against the illegal actions by the power that has held them under military occupation for almost 50 years.

Comoros asks ICC to prosecute Israelis re Mavi Marmara

On a brighter note, there is a possibility that Israelis may be arraigned before the ICC for the Israeli military assault on the Mavi Marmara on 31 May 2010.  This took place in international waters, when it was part of a humanitarian aid convoy to Gaza, and resulted in the deaths of 9 civilian passengers.

This is possible because the Mavi Marmara was registered in the Comoros Islands and the Union of the Comoros is a state party to the Rome Statute.  Under Article 12(2)(a) of the Rome Statute, the ICC has jurisdiction in respect of crimes committed, not only in the territory of a state party, but also on ships or aircraft registered in a state party.  On 14 May 2013, the Union of the Comoros requested that the ICC mount an investigation into the Mavi Marmara assault.

This request has been made under Article 14 of the Rome Statute which states:

“A State Party may refer to the Prosecutor a situation in which one or more crimes within the jurisdiction of the Court appear to have been committed requesting the Prosecutor to investigate the situation for the purpose of determining whether one or more specific persons should be charged with the commission of such crimes.” [2]

On 14 May 2013, lawyers representing the Union of the Comoros presented a document to the ICC prosecutor, under Article 14, requesting her “to initiate an investigation into the crimes committed within the Court’s jurisdiction, arising from [the Mavi Marmara] raid’’[10].  The document sought to make a case that Israeli military personnel committed war crimes (for example, ‘wilful killing’ under Article 8(2)(a)(i) of the Rome Statute) and crimes against humanity under Article 7.

The prosecutor has to conduct a preliminary examination in order to establish whether the ICC’s criteria for opening an investigation are met.  That examination is ongoing at the time of writing.

Ariel Sharon: His Sabra and Shatila Legacy – An Eye Witness Account

By Felicity Arbuthnot and Dr. Ang Swee Chai | Palestine Chronicle | January 15, 2014

As Israel buried Ariel Sharon amid eulogies from world figures, Tony Blair, a Butcher of Baghdad, paid a tribute to the Butcher of Beirut which included the line that Sharon: “didn’t think of peace as a dreamer, but did dream of peace.” Also that: “ … he sought peace with the same iron determination” as he had fought (read slaughtered, across the Middle East.) Re-writing history does not come more blatant, but Blair was ever good at fantasy, think “weapons of mass destruction” and “forty five minutes.”

Surgeon, Dr Swee Chai Ang went to help the wounded of Beirut after the 1982 Israeli invasion and witnessed the Sabra and Shatila massacre of unarmed men woman and children, Palestinian and Lebanese, between the 15th-18th September,1982.

In her book “From Beirut to Jerusalem”, she describes the reality:

“As I walked through the camp alleys looking at the shattered homes (many of these houses had just been rebuilt following earlier bombardments by Israel) I wanted to cry aloud, but was too exhausted emotionally even to do that. How could little children come back to live in the room where their relatives were tortured and then killed? If the Palestinian Red Crescent Society could not function legally, who was going to look after the widows and orphans?

“Suddenly, someone threw his arms around me. It was Mahmoud, a little child who had broken his wrist while trying to help his father rebuild their broken home. He had survived and his wrist had mended, but now his father was dead. Mahmoud cried, but he was glad I was alive because, from his hiding place during the massacre, he had seen the soldiers taking us away. He thought they had killed me.

“Soon I was surrounded by a whole lot of children. Kids without homes, without parents, without futures. But they were the children of Sabra and the children of Shatila. One of them spotted my pocket camera, and wanted a picture taken. Then they all stood together, wanting their pictures taken. “They wanted me to show their picture to the people of the world. Even if they were killed and the camps were demolished, the world would know that they were the children of Sabra and Shatila, and were not afraid. As I focused my camera, they all held up their hands and made victory signs, right in front of their destroyed homes, where many had been killed. Dear little friends, you taught me what courage and struggle are about.”

Dr Swee Chai Ang founded Medical Aid for Palestine as a result of her experiences in Beirut and Sabra and Shatila. On the eve of Ariel Sharon’s burial, she wrote the following. It is published with her permission:

The passing of Ariel Sharon brought back the memories of the horrors of the Sabra Shatilla massacre of September,’82. I arrived in August that year as a volunteer surgeon to help the war victims of Lebanon. The people in Lebanon were wounded, made homeless and lost precious friends and families as the result of ten weeks of ruthless bombardment. That was the “Operation Peace for Galilee”, launched by Sharon who was then the Defence Minister of Israel in June 1982.

No one knew how many were killed as the result of that offensive – the London newspapers estimated a thirty thousand with many times more made homeless. When a ceasefire was agreed with the evacuation of the Palestine Liberation Organisation, Sharon broke that ceasefire and drove tanks under air-cover launching a land invasion into Lebanon’s capitol Beirut. Part of the tanks sealed Sabra Shatilla and prevented the helpless civilian victims from escaping, while sending in Israel’s allies into the camps to carry out the most brutal massacre of defenceless women, children and old people under Israel’s watch. The blame was quickly and deliberately shifted to the Lebanese as perpetrators of the massacres, so that today no one can mention that massacre without blaming the Lebanese Phalange, yet forgetting the Israeli organisers of that event.

I worked in Gaza Hospital in Sabra Shatilla during the massacre trying to save the lives of a few dozen people, but outside the hospital hundreds were killed. My patients and I knew that Sharon and his officers were in control, and without them the massacre would not be possible. The residents of Sabra Shatilla could at least have escaped. Now more than 30 years later, we know that the killers were brought in by Israeli armoured cars and tanks, obeyed Israeli commands, their paths lit by Israeli military flares, and some of them also wore Israeli uniforms. The mutilated bodies of the victims were thrown into mass graves by Israeli bulldozers.

This Sharon continued on to be Israeli Prime Minister, and built the Wall which imprisoned the Palestinians in the West Bank. Sharon’s Wall cut through their lands, separating people from their homes, children from their schools, farmers from their orchards,  patients from hospitals, husbands from wives, and children from parents. He marched into the Al-Aqsa Mosque in Jerusalem 2000 with fully armed Israeli soldiers and tried to have the West believe that his intention was for peace.

He was responsible for other massacres such as in Jenin, Qibya and Khan Yunis just to name a few. The older generation in Khan Yunis in Gaza remembers that he killed all the grown men in the massacre of 1956 and left only the women and children to bury the dead.

I thought these facts should be publicised. Those who eulogise Sharon in his role of building Israel should also remember that he built his nation over the dead bodies of the Palestinian people, and the continued dispossession of those who are still alive.

Israel to free 2 Jerusalem prisoners on condition of exile

Ma’an – 15/01/2014

260439_345x230JERUSALEM – Israeli authorities on Wednesday agreed to free two Palestinian Jerusalemites on the condition that they be deported from Jerusalem, a prisoners’ committee spokesman said.

Amjad Abu Asab, a spokesman for a committee that represents Jerusalemite prisoners, told Ma’an that Israel agreed to free a member of the Palestinian Legislative Council and a former Minister of Jerusalem Affairs.

Abu Asab said that lawmaker Muhammad Tutah and former minister Khalid Abu Arafah have been detained for two years on the charge of entering Jerusalem “illegally,” after Israel revoked their Jerusalem IDs.

Both Tutah and Abu Arafah have also been accused of being leaders of the Hamas movement in the Jerusalem area, Abu Asab said.

The Israeli Supreme Court ruled that the 24-month imprisonment was sufficient punishment, and that the two should be released, giving the Israeli military prosecution a week to respond, he said.

The response came Wednesday that the prisoners would be released but would have to leave Jerusalem.

The two were detained by undercover Israeli forces on Jan. 23, 2012, from offices of the International Red Cross Committee in Jerusalem, Abu Asab said.

Israel annexed East Jerusalem in 1980 in a move never recognized by the international community.

Today, the Palestinian population numbers 293,000 in a city which counts roughly 800,000 residents, UN figures show.

In 2012, Israel’s Interior Ministry revoked the residency status of 116 Jerusalem Palestinians, bringing the total number over 46 years to more than 14,000 people, according to the Association for Civil Rights in Israel.

Academic delegation to Palestine endures 10-hour interrogation

Ma’an – 15/01/2014

BETHLEHEM – Members of an academic delegation were held for 10 hours by Israeli security forces when crossing into Palestine from Jordan, a statement said Tuesday.

A delegation of six academics and a labor activist came to the West Bank to conduct meetings with Palestinian scholars “in order to better understand conditions on the ground and to facilitate future collaborations,” one of the members said in a statement.

University of Illinois professor Junaid Rana said that on Sunday, four members of the delegation were held and interrogated by Israeli security forces, Interior Ministry employees, and the military for over 10 hours at the border.

“They were pressed about their scholarly research, academic networks, family backgrounds, nationalities, and ethnic origins,” Rana said.

“The Israeli security officer demanded contact and cell phone information and two delegates were coerced into accessing their email accounts using Israeli security computers.”

Additionally, the members were asked about previous travel to Arab countries.

“Rana was also asked why he attended a conference on ‘Transnational American Studies’ at the American University of Beirut in Lebanon, and whether he had any political writings related to Israel,” the statement said.

It continued by condemning the interrogation: “Such actions are a clear violation of academic freedom, including the freedom to travel for scholarly research, and demonstrate tactics of intimidation and harassment of scholarly inquiry.”

Some of the delegates who were held belong to US academic associations — such as American Studies Association, Association of Asian American Studies, and Native American and Indigenous Studies Association — that have endorsed an academic and cultural boycott of “Israeli institutions that are complicit in the continued colonization of Palestine.”

Three of the delegates were also personal supporters of the Boycott, Divestment, and Sanctions movement, the statement said.

“The delegation recognizes that their experiences on January 12, 2014, pales in comparison with the everyday surveillance and criminalization of Palestinian academics who are consistently denied the freedoms to research, publish, and travel,” Rana added.

Palestinians, in addition to other Arabs, Muslims, and pro-Palestinian activists, are often held for hours — and sometimes denied entry — at border crossings controlled by Israel.

In December, the American Studies Association announced its decision to boycott of Israeli academic institutions.

A statement from the organization read at the time: “The ASA’s endorsement of the academic boycott emerges from the context of US military and other support for Israel; Israel’s violation of international law and UN resolutions; the documented impact of the Israeli occupation on Palestinian scholars and students; the extent to which Israeli institutions of higher education are a party to state policies that violate human rights; and finally, the support of such a resolution by a majority of ASA members.”
