Rouhani: Iran to stay in JCPOA, reap benefits when UN arms embargo ends next year

President Hassan Rouhani says Iran intends to stay in the 2015 nuclear deal despite US violations, arguing that the accord will be put to good use next year when a long-running arms embargo against Tehran comes to an end.

Rouhani said Monday Iran could respond to America’s exit from the Joint Comprehensive Plan of Action (JCPOA) in different manners, including leaving the deal altogether or keeping it at any price, but it decided to take the middle-ground option.

“By continuing the JCPOA, we will fulfill a major objective in terms of politics, security and defense,” he told a large crowd of people during a visit to the eastern province of Kerman.

Noting that for years Iran has been banned by the United Nations from buying and selling any kinds of weapons, Rouhani said the arms embargo will end next year according to the deal and the UN Security Council Resolution 2231, which endorses it.

“This is one of the important effects of this deal. Otherwise, we could leave the deal today but the kind of benefit we stand to reap next year will no longer exist,” he said.

“We can leave now but then the UNSC resolutions [that were revoked under the deal] will return,” the president said, adding “We need to think where do the country’s interests lie.”

Iran, he said, did not want to stay fully committed to the deal while the others “sit on their hands” and do nothing.

“Therefore we took the middle ground to keep the JCPOA and preserve it while cutting back on what we had agreed to do under the agreement step by step,” he said.

Since May, Iran has been scaling down its nuclear deal commitments in retaliation for Washington’s 2018 pullout from the deal and the failure of three European signatories — the UK, France and Germany — to protect bilateral trade against American sanctions.

In the first three stages of its measured response, Iran enriched uranium beyond the 300kg limit set by the deal and ramped up enrichment to levels upon the pre-defined 3.67-percent cap. It also expanded nuclear research to areas banned in the agreement.

The fourth step, which was unleashed last week, was the injection of uranium hexafluoride (UF6) gas into centrifuges at the Fordow underground enrichment facility.

Tehran says its reciprocal measures do not violate the JCPOA and are based on Articles 26 and 36 of the agreement itself, which detail mechanisms to deal with non-compliance.

Iranian authorities have suggested that the measures will be reversible as soon as Europe finds practical ways to shield the Iranian economy from the sanctions.

Rouhani said Monday Iran’s nuclear capability is “better than ever,” noting that Iranian nuclear experts have never stopped research and development work since the JCPOA was first signed in 2015.

“We will stand up to our enemies with full power. We haven’t done anything illegal and we are not willing to bow to your orders,” he said.

Touching on disparaging statements by Western countries, Rouhani said, “Are you mad we restarted Fordow? Are you mad with the resumption of nuclear enrichment? Are you mad at us for speeding up the Arak heavy water [facility]? Then you should fulfill your commitments as well.”

Germany, France and Britain were to meet in Paris on Monday to discuss how to respond to Iran stepping back from its commitments under the accord, German Foreign Minister Heiko Maas said.

“We are very concerned to see that there are other uranium enrichments that Iran has not only announced, but is also carrying out,” Maas said as he arrived for talks with fellow EU foreign ministers in Brussels.

“We want to preserve the JCPOA but Iran will have to return to his obligations and comply with them. Otherwise we will reserve for ourselves all the mechanisms laid down in the agreement,” he said.

Maas was apparently threatening to trigger a dispute mechanism in the 2015 nuclear deal, which could open the way to renewed UN sanctions.

Founder of ‘White Helmets’ James Le Mesurier Found Dead in Istanbul

A law enforcement source has confirmed the death of James Le Mesurier at his home in Istanbul. However, the source added that at this time, it remains “unclear whether he was murdered, or committed suicide.”

Le Mesurier, a former MI6 officer, created the controversial ‘urban search and rescue’ organisation in 2013. The White Helmets have been repeatedly accused of staging fake attacks in the conflict in Syria in a bid to prompt a Western-backed military intervention in the war-torn country.

The White Helmets’ official Twitter account has confirmed Le Mesurier’s passing, saying the group was ‘shocked and saddened’ by the news and expressing its “deepest condolences to the James family.” The group commended the former intelligence agent’s “humanitarian efforts which Syrians will always remember.”

Earlier, an anonymous diplomat was quoted by Reuters as saying that Le Mesurier’s body had been found early Monday morning at his home in the city’s Beyoglu district.

Sözcü, a major Turkish daily newspaper, reported, citing police sources, that Le Mesurier may have killed himself, and that he had been taking anti-depressant medication for some time ahead of Monday’s incident.

Sabah, another major Turkish paper, also reported, citing law enforcement, that police consider suicide the most likely cause of Le Mesurier’s death, with the former spy possibly jumping to his death from the balcony of his 3rd floor apartment. No traces of gunshot or knife wounds were found his body, police told Sabah.

A source close to the investigation later said that there was no evidence of any unauthorised persons being near his residence at the time of his death.

Le Mesurier’s wife was quoted by Sabah as saying that she and her husband had dinner together on Sunday. “After that we took sleeping pills and went to bed. A few hours later I woke up from the ringing of our doorbell. It was the police. They told me that my husband had fallen from the balcony and died.”

Police are continuing their investigation.

Founder of Terrorists’ ‘Propaganda Arm’

Le Mesurier, a British private security specialist and former UK military intelligence officer, founded the White Helmets in Turkey in March 2013. Before that, he served as an intelligence officer in other theatres of conflict, including a stint in Pristina, Kosovo soon after the NATO intervention in 1999. In the 2000s, he went on to serve as vice president of special projects at the Olive Group, a private mercenary organisation which later merged with Blackwater-Academi into Constellis Holdings.

In a 2014 interview, Le Mesurier said that he spontaneously raised about $300,000 in initial funding from the UK, the US and other countries and trained 25 vetted operatives to create the White Helmets after witnessing the suffering in Syria, with the group soon accumulating over $150 million in cash after Western NGOs, Gulf countries, several European countries and Japan sent money and supplies to help the group. The group continues to enjoy widespread publicity and support in Western countries, and is a UK-registered non-governmental organisation.

Syria considers the White Helmets a “terrorist organisation,” citing the group’s regular operations in areas controlled by jihadist militants, including al-Qaeda offshoot the Nusra Front, as well as its creation of video fakes which seem designed to prompt Western military intervention in Syria. Independent journalists have repeatedly accused the group of serving as ‘al-Nusra’s propaganda arm‘, given its alleged ties to the militants.

In April 2018, the US, UK and France launched a series of air and cruise missile strikes against Syria following the publication of a White Helmets video appearing to show that a horrific chemical attack that had taken place in Douma, a city in the Damascus suburbs about 10 km from the capital. The Douma attack was later debunked by verified testimony from multiple eyewitnesses who appeared in the video, including that of an 11-year-old boy who revealed that he and his mother had been given food to participate in the video. Since that time, Damascus and its allies have repeatedly voiced concerns about the possibility of more fake videos and false flag attacks by the groups designed to prompt Western intervention.

Last week, the Russian Foreign Ministry urged London to investigate Le Mesurier’s possible ties to al-Qaeda. At a briefing on Friday, Foreign Ministry spokeswoman Maria Zakharova pointed to independent research indicating the former spy’s possible links to terrorist organisations going back to his work in Kosovo. “There is data suggesting that there were al-Qaeda members among his team there,” Zakharova said, adding that Moscow would “very much like to hear what London has to say about these facts.”

Earlier this year, Britain’s Home Office announced that some 100 volunteers and family members from the White Helmets had been resettled in the UK after being evacuated from Syria last year with the help of British government officials.

Is Extreme Daily Rainfall Getting Worse In England?

As expected, the media has been full of claims that This week’s floods in S Yorkshire were due to global warming. I even have heard my old neighbour saying we “never used to have rain like this” and how it was “tropical”.

There is an easy way, however, to check if daily rainfall is getting more extreme in England. KNMI’s Climate Explorer produces graphs of daily rainfall, and below are all of the long running sites in England, with at least 80 years data. (Data for most stations goes up to 2017):

Inevitably it is a mixed bag, but ironically Sheffield is the only station where the data shows a noticeable upward trend. Other northern sites such as Bradford and Durham don’t offer evidence of any such trend.

Southern stations, such as Oxford and Rothamsted, seem to show extreme daily rainfall on the decrease.

The most extreme events are, of course, still only weather events, so we should not read too much into any of the charts.

But they do seem to give the lie to the claim that global warming is making heavy rainfall worse.

CNN enlists help of fraudster Browder & Integrity Initiative ‘experts’ to fan Russia meddling claims in UK

While the yet to be published report on alleged Russian meddling into Brexit is in the center of political drama in the UK, CNN got the scoop from pundits– usual suspects when it comes to Russiagate narrative.

The Russiagate in the US might have fizzled out, but CNN apparently has no intention to give up on the stale narrative – and is now peddling it across the ocean. The Saturday’s scoop delves into the testimonies submitted by “witnesses” during a UK parliamentary investigation into the alleged Russian meddling in the 2016 Brexit referendum and 2017 general election. While the report, prepared by the Intelligence and Security Committee (ISC) has not been released yet, and previous reports failed to turn up any damning proof of Russia’s influence, CNN’s bombshell conveniently revolves around the testimony of Bill Browder, financier wanted for tax fraud in Russia and one of the leading champions of anti-Russian sanctions.

CNN says that Browder’s was one of two written testimonies the channel got its hands on, in addition to having been “briefed” on oral testimonies provided by two other witnesses.

While one might argue that Browder, a self-proclaimed “No. 1 foreign enemy” of Russian President Vladimir Putin, is a person whose words should hardly be taken at face value, especially, in matters related to Russia, CNN does not offer any critical analysis, but rather serves as a mouthpiece for the disgraced entrepreneur.

In his testimony, Browder paints the Russian government as a nefarious entity whose tentacles are reaching further than one could imagine. “The Russian state effectively uses the Western persons… taking advantage of their identities, skills, expertise and contacts in the West to infiltrate Western societies,” Browder says in his statement, while accusing the Kremlin of organizing a money-laundering scheme by recruiting Dubai-based UK citizens and warning that the network of supposed Russia stooges should be acted upon immediately unless “will have serious detrimental effects on the UK democratic process, rule of law and integrity of the financial systems.”

In addition to Browder, CNN also turns to  Edward Lucas with Institute of Statecraft, the NGO behind Integrity Initiative, a state-funded covert project exposed last year as a Europe-wide anti-Russian psy-op.

Perhaps, it’s no surprise that, according to CNN, Lucas cared enough to give a two-hour and 45-minute long oral testimony alongside Chris Donnely, the head of Institute of Statecraft, while calling on the UK authorities to band together with other countries to fight Russian “subversion.”

Among other veterans of the Russiagate who generously shared their expertise with the ISC was Christopher Steele, a former British spy, who compiled a dossier on US President Donald Trump, that was later used by FBI to surveil his camping despite being completely unverified and loaded with salacious gossip.

The 50-page yet unreleased report has become the talk of the town in the UK after opposition accused Downing Street of stalling its publication as rumors swirl that it could reveal Moscow’s sinister role in swaying the Brexit vote.

The report was submitted to the government on October 17, and was due to be published on Monday. However the report likely won’t be made public until after December 12 general election as it was not approved by PM Boris Johnson’s cabinet before the legislature was dissolved on Tuesday.

Willy Wimmer: ‘We are on a path of war again’

Three decades after the fall of the Berlin Wall, one of the symbols of the Cold War, Europe remains divided because it chose confrontation over a common future, Willy Wimmer, Germany’s former State Secretary for Defense believes.

Germany is marking 30 years since the fall of the Berlin Wall – a symbol of division, perhaps, not just for Germans but for all Europeans, who saw the continent split between the Western and the Soviet bloc. The wall’s destruction has since turned into a symbol of German reunification. Yet, Europe itself has failed to achieve the genuine unity that was a dream of the people who tore it down back on November 9, 1989.

Wimmer is a long-term member of the German parliament and the former vice-head of the OSCE Assembly, who also was a high-ranking official with the German Defense Ministry at the time of reunification and oversaw the integration of West and East Germany’s Armed Forces.

He believes that instead of striving for a “Common House” uniting all the European nations, the politicians drew new lines in the sand, setting their nations on a path to fresh conflict. The hopes that filled the hearts of the people following the end of the Cold War have been ultimately dashed, he said, while calling the present European and NATO policies towards Russia a “disaster”.

Below are some more of his thoughts on the issue, which he shared with RT.

Anglo-Saxon ‘division’ strategy instead of Gorbachev’s ‘Common House’

The reason for the new Cold War is absolutely clear. If we had followed the policies of [the last Soviet leader] Mikhail Gorbachev, [former German Chancellor] Helmut Kohl and even [the former US President] George H. W. Bush, we would have entered an era of cooperation. It is for this reason that I mention the “common European House” – the big idea of Mikhail Gorbachev.

It is a kind of Anglo-Saxon policy not to have cooperation on the European continent – mainly between the Russians, the French, the Poles and the Germans. They want to have a line of confrontation in this area and therefore are against all promises. [As a result] NATO was extended to the East.

I was responsible for the organization of the German Armed Forces on the German territory following reunification. We did not want foreign troops in former East Germany. We did not want to have British or French troops there; we wanted to have only German ones. We wanted to explain to the world that there was no desire to enlarge NATO up to the new borders with Russia that were created in 1992.

It was against all the ideas we had after reunification. What is happening now is some kind of Anglo-Saxon policy that was created even before WWI. We are on the path of war again. That is so much against the will of our people.

This is also against the will of the Dutch, the French, the Spanish and the Italians. We see it as a disaster that a US president that is willing to cooperate with the Russian President Vladimir Putin – President [Donald] Trump – has to face such a disastrous policy organized by the US deep state, which is against our national interests and the national interests of all other western Europeans.

“The remains of the Berlin Wall are not only the symbol of German reunification or the end of the division in Europe. It is a symbol of missed hopes and forgotten expectations when it comes to the great idea of Mikhail Gorbachev to help build a common European House.”

As long as we live, the German people will remember with great gratitude the Soviet Secretary General and its leader, as well as the Russian population. We always said that a key for German reunification was in Moscow. Moscow handed it over to us and therefore we have to face responsibility for the future.

Links to Russia re-established

The role of Mikhail Gorbachev is still akin to that of a saint to the Germans. People in Germany like Mr. Gorbachev and they like his idea of a common European House. We see it as a disaster in Germany that, together with NATO, we are preparing some kind of a common European battleground again.

Gorbachev is a kind of a hero for Germans. I travel a lot in all parts of Germany and when I come to the Eastern part I see another big issue for them. For 20 years after unification, it was very difficult to talk to them about the Russians and their relationship to Russia. They almost ignored such talk because of the past.

But, when you now come to Rostock, Dresden or Leipzig they are learning Russian again, they go to theaters to watch Russian performances and listen to Russian music. They have re-established their links with Russia, and if they could do what they want to do, they would be the big economic partners of Russia these days.

Things have really changed for the Russian Federation and with regard to Russia. People in Dresden, Saxony’s capital, are absolutely proud that Russian President Vladimir Putin once served there. That is the reality these days, despite what the mainstream media say.

‘Russiagate’ may be over in the US, but in the UK it’s just beginning

‘It’s only a matter of time’ it occurred to me as I cast a glance over Dominic Cummings’ profile on Wikipedia a couple of months’ back. The mere mention that Cummings, Boris Johnson’s trusted advisor had spent several years in Russia, spoke Russian and enjoyed a bit of Dostoevsky was surely more than enough ammunition for the UK opposition, given the way ‘Russia’ has become almost a dirty word in itself over the last few years in the British and US political discourse. There was a half-hearted attempt to link Boris Johnson to Russian money in the Tory leadership race, but it didn’t gain much traction. But now with the Brexit election campaign kicking off, the gloves are off and we can only expect that every possible method of undermining each other will be used by the Conservatives and Labour parties alike.

We have perhaps not seen quite the hysteria over supposed Russian interference in elections here in the UK, as was in the US, but there were rumours of it after the vote to Leave the EU in the 2016 referendum. The general rule of thumb seems to be that if the result is not what the establishment wants or expects, then surely Russia must be to blame. After all, what could the alternative explanation be? That politicians are out of touch with the electorate? Surely not. This time, no sooner has the general election campaign begun, than the ‘Russia’ word has been used already to smear the Conservatives. The party has been accused by former attorney general Dominic Grieve of suppressing a parliamentary report into Russian interference in UK politics which it is said is being held up only by the PM’s office. Apparently the report normally takes 10 days to be cleared, but Johnson’s team has said it won’t be revealed until after the December election. Speculation is rife therefore about the contents of the report and how damaging they are to the Tory party. It has already been reported that the report details substantial donations made to the party by ‘Russians’.

This is where things get a bit ridiculous. For now the approach seems to be rather 2 + 2 = 5. Russians = Russian state sponsored interference. Anything remotely linked to Russia is automatically, thanks to the mainstream media and strategies used by UK foreign office initiatives such as the ‘Integrity Initiative’, branded as subversive and not to be trusted. Anti-Semitism is not to be tolerated at any cost within political parties but anti-Russian sentiments are, it seems, wholly acceptable.

There is an important aspect of Russian donations to the Conservative party which seems to escape most people. Most of the Russians in the UK, unlike other immigrants like the Polish community, are wealthy individuals who, like most affluent people, want to ensure that they retain their riches. The Conservative party is the very political party that represents their values and unlike Labour, does not threaten to raise taxes on their businesses. Any decision therefore by Russian businessmen to support the Tories ought to be taken at face value and not judged in the way that donations by other nationalities are also not judged. And yet, for political reasons, it seems that any possibility of linking politicians to ‘the Russian enemy’ will be utilised in what has become a very dirty game in recent years.

For once, you may say, it’s not Jeremy Corbyn who is being branded a ‘Soviet sleeper’ or ‘Putin propagandist’. Instead of Corbyn’s face being plastered over backgrounds of Red Square in a Russian-style hat in the media, it’s now Boris Johnson. While Labour has faced the brunt of such smear campaigns since Corbyn came to power, now it’s the Tories’ turn – they deserve it, you could say. But the reality is that, as the Russiagate saga proved in the US, with desperate attempts by the Democrats to link Donald Trump to Russia, it is a fruitless exercise in terms of influencing public opinion but on the other hand, greatly harms our relationship with Russia.

Coming back to Dominic Cummings, and already UK Shadow Foreign Secretary Emily Thornberry has written to the government asking questions about the time Cummings spent in Russia from 1994 to 1997 after he graduated, and whether he has been through appropriate ‘security checks’. It’s as if now, any individual spending time in Russia has automatically been up to mischief, regardless of how long ago it was. Thornberry was apparently approached by an ‘official-level whistleblower’ who raised ‘serious concerns’ about just what Cummings was up to back then. Well anyone who knows anything about Russia knows that in the 90s it was a dynamic and rather anarchic place, but a great place for business opportunities. A quick scan of Wikipedia suggests business ventures was exactly what Cummings was engaged in there, and I’m sure he had a fun time of it. But it was a very different place to Russia today, and to imply that just because he lived in Russia over twenty years ago he shouldn’t be trusted is quite frankly ridiculous.

But this is where we’re at now in politics. It’s been a while since UK politics was sensible. Now in the Brexit era, anything goes and Russia remains an easy scapegoat. And nothing one sees or hears suggests this is likely to change in the near future…

Labour Party MP panned for hinting Tory adviser could be ‘Russian Spy’

The Labour Party has pressed Foreign Secretary Dominic Raab over security clearances granted to adviser Dominic Cummings, citing “serious concerns” over his time spent in Russia. Where have we heard this before?

According to the UK media, citing a letter sent to Raab by Shadow Foreign Secretary Emily Thornberry, the Labour Party has been approached with “serious concerns by an official-level whistleblower” about the three years Cummings – Prime Minister Boris Johnson’s senior adviser – spent in Russia after graduation in 1994.

In the letter, Thornberry asks Raab to comment on Cummings’ security clearance, and for more information about the purpose of his visit to post-Soviet Russia and the “relationships” he may have built there, as well as his relationships with the Conservative Friends of Russia group.

The “serious concerns” mentioned in the letter are unknown, and even Thornberry herself wrote “we make no claim to know the veracity of the claims.”

Copies of the letter have also been sent to Mark Sedwill, head of the civil service, as well as the heads of MI5 and MI6 and the chair of the intelligence and security committee (ISC), Dominic Grieve, UK media writes.

Accusations of “Russian asset” are lobbed around Washington like confetti, and an unknown whistleblower with “serious concern” triggered impeachment calls against President Donald Trump. However, such accusations have remained a mostly American phenomenon.

Until now, that is. “Is Dominic Cummings a Russian Spy? Hidden in plain sight,” Labour MP David Lammy tweeted on Sunday.

Commenters were unimpressed. “Is this the best you’ve got? The country is in crisis and you are peddling this comedy,” one wrote. “You went to Brussels, does that make you an EU Spy?” another jibed.

Cummings’ work in Russia was less cloak and dagger than Thornberry’s letter makes out. Upon graduation from Oxford – where he studied Russian history – Cummings worked to set up an airline connecting the Russian city of Samsara with Vienna in Austria. The airline itself made only one flight and went bust in 1998, when Russia’s rouble collapsed. Sounds like impressive work for a supposed Russian spy. Further incriminating ‘evidence’ against Cummings is found in his reported fondness for Russian literature, and in the fact that he speaks (broken) Russian.

The Cabinet Office has responded that it does “not comment on individuals’ security clearance,” as has Downing Street.

But it remains to be seen whether that will stop some hotheads from calling for a show trial.  Better burn your copy of ‘Anna Karenina’ now and cancel your flights to Moscow, lest you too be labeled a “Russian Spy.”

Brexit: Soros Insists His ‘Stay’ Campaign Contributions Were ‘Educational’, Not Partisan

Hedge fund billionaire and convicted insider trader George Soros believes his involvement in the UK’s Brexit debate is just “political philanthropy,” and told The Guardian that Britain’s continued membership in the European Union would make a defence of ‘European values’ easier to accomplish.

“Brexit is a process of disintegration that hurts both sides. It hurts Britain more on a pro rata basis and Europe more in absolute terms. Most importantly, European values can be better defended if the two of them are united,” Soros said.

“My contributions were not used for partisan or electoral purposes. They were used to educate the British public,” he added, brushing off concerns expressed by numerous politicians that his Open Society Foundations were engaging in meddling in the internal affairs of other countries.

Soros made headlines in the run-up to the Brexit vote in 2016 when he warned that a vote to leave the bloc might cause a Europe-wide economic meltdown and make the EU’s disintegration “practically unavoidable.”

Two years later, the financier garnered controversy in the UK after making a £400,000 donation to ‘Best of Britain’, a group aimed at stopping Britain’s exit from the bloc. Pro-Brexiteers slammed the donation as a “secret plot” and an attempt to stage a “coup… against the democratic will of the people.”

Nigel Farage, leader of the Brexit Party and member of the European Parliament, has been one of the most outspoken UK-based critics of Soros, once describing him as the “biggest danger to the entire Western world.”

Britons voted to leave the EU on June 23, 2016, with approximately 52 percent voting in favour of exiting the bloc, while 48 percent sought to remain.

30+ Years of Political Interference

Soros has been spending his fortune on trying to bring forth political and social change for at least three decades, providing cash to anti-communist movements spreading in Eastern Europe in the 1980s in countries including Hungary and Poland, and spending hundreds of millions of dollars on efforts to institute political, economic and institution reforms across Eastern Europe and the former Soviet Union starting in the early 1990s, including over $100 million in Russia alone. Since then, his activities have spread to over 60 countries around the world.

Soros was convicted of insider trading by a French court in 2002 and forced to pay a fine of €2.2 million. His conviction was upheld by the European Court of Human Rights in 2011.

On September 16, 1992, Soros successfully staged a run on the pound, forcing the British government to withdraw from the European Exchange Rate Mechanism, and leading to an estimated  billion pounds in losses to Britain’s economy. Soros earned his first billion dollars from the day’s events.

Russia banned Soros’s Open Society Foundations in 2015, when the OSF was listed as an organisation whose activities pose a threat to the country’s national security.

London Times runs fake Browder story by acolytes Ben Brandon & Alex Bailin

Ben Brandon and Alex Bailin are London lawyers who have co-authored a fake story based on fabrications by William Browder about Russia’s legal action against his tax evasion and the death of his accountant, Sergei Magnitsky. The writers of this London Times op ed managed to put eight lies into just five opening lines.

Co-author Brandon is the lawyer representing the U.S. in its request to extradite war-crimes whistleblower- publisher Julian Assange. This raises questions about the connection between the U.S. and the U.K. in the promotion of the Browder/Magnitsky hoax and the attack against Assange.

Here is their story. And my proof of their fabrications.

We must not lag behind the rest of the world when it comes to holding human rights abusers and corrupt regimes to account.

Sergei Magnitsky, a young lawyer, was hired in 2008 by Bill Browder, the chief executive of Hermitage Capital, to investigate a tax fraud on his fund. Having diligently uncovered a large scale embezzlement by influential Russian officials, Mr Magnitsky was arrested and mistreated in prison in an attempt to pressure him into withdrawing his testimony.

He refused to retract and was beaten to death.

My Response

Dear Messrs Brandon and Bailin, I assume that as lawyers you think it’s a good idea to check out what people claim, since even clients lie. Therefore, please consider the evidence below, not what convicted fraudster William Browder apparently told you.

[1] Lawyer: Magnitsky was an accountant. Browder acknowledges in his deposition in US federal court 2015 that Magnitsky didn’t have a law degree or go to law school. See him say it in a video clip. In his own interrogations, Magnitsky is identified as an auditor.

[2] Hired in 2008: Magnitsky worked for the accounting/law firm Firestone Duncan which Browder hired in 1997 to handle his company accounts and tax filings. The Russian court found that Magnitsky in the interests of Browder in 1997-2002 implemented an illegal tax evasion scheme using firms registered in Kalmykia and managed by Hermitage Capital. (See article) Browder claims he hired Magnitsky in 2007, so Brandon and Bailin get even that fabrication wrong.

[3] To investigate a tax fraud: See above. He was hired in 1997, ten years before the 2007 tax refund fraud. Magnitsky’s 2006 interrogation was about Browder’s company tax evasion. See his testimony and the cited article. And the fraud wasn’t on his fund, it was on the Russian Treasury. Fraudsters scammed the Russian Treasury by obtaining a $230mil tax refund based on fraudulent lawsuits.

[4] Uncovered embezzlement: The tax fraud, which is not properly described as an embezzlement as it was a fraud on the Russian Treasury, not on a company, was first reported by Rimma Starova in April 2008. The Russian newspaper Vedomosti and the New York Times reported it in July 2008. Magnitsky mentioned in testimony only in his October 2008 interrogation.

[5] Influential Russian officials: There are no Russian officials accused in any of the reports, by Starova, the newspapers or by Magnitsky. Read the documents.

[6] Mistreated: He suffered the same poor conditions as other inmates.

[7] pressure him into withdrawing his testimony: There is no evidence he was pressured to withdraw testimony. Or do you have any?

[8] Beaten to death: There is no evidence he was beaten to death. Or do you have any?

The only on-site independent report, by the Moscow Public Oversight Commission, indicates terrible prison conditions and failure to provide needed medical care. The Physicians for Human Rights (Cambridge Mass) report, cites the POC report and is addressed to Browder, who gave PHR 44 documents to back up his claims. It reached the same conclusion.

Browder’s initial statements about Magnitsky’s death, in 2009 and 2010, mention no beatings.

Check out his talk at Chatham House, in your home town. “I don’t know what they were thinking. I don’t know whether they killed him deliberately on the night of the 18th, or if he died of neglect.”

And the video of his address to the San Diego Law School the next year. “They put him into a straight-jacket, put him into an isolation room and waited outside the door for 1hr18 minutes until he died.”

He invented the beating death in 2011 when he decided to create and lobby for the Magnitsky Act in the U.S. Congress to stop Russian authorities from pursuing him for $100 million in evaded taxes and illicit stock buys.

Ironically, though he uses the U.S. to build a wall against Russian tax collectors, he gave up his American citizenship in 1998 to avoid paying taxes. He is listed by CBS News as a “tax expatriate.”

If you are serious lawyers and investigators, you will examine the evidence and respond. (And change your story.)

The rest of the op ed is to support unspecified steps to hold to account those who benefit from human rights abuses and corruption. No mention of the persecutors of Julian Assange or the beneficiaries of the U.K.’s worldwide system of tax havens. The real purpose appears to be to repeat the Browder hoax in the lede.

I sent copies of the article to Brandon and Bailin. No response.

I also sent a complaint to IPSO the British Independent Press Standards Organization.

It calls itself “the independent regulator of most of the UK’s newspapers and magazines.” It says: We hold newspapers and magazines to account for their actions, protect individual rights, uphold high standards of journalism and help to maintain freedom of expression for the press.

Killing Julian Assange: Justice Denied When Exposing Official Wrongdoing

The hideous treatment of WikiLeaks founder Julian Assange continues and many observers are citing his case as being symptomatic of developing “police state” tendencies in both the United States and in Europe, where rule of law is being subordinated to political expediency.

Julian Assange was the founder and editor-in-chief of the controversial news and information site WikiLeaks. As the name implies, after 2006 the site became famous, or perhaps notorious, for its publication of materials that have been leaked to it by government officials and other sources who consider the information to be of value to the public but unlikely to be accepted by the mainstream media, which has become increasingly corporatized and timid.

WikiLeaks became known to a global audience back in 2010 when it obtained from US Army enlisted soldier Bradley Manning a large quantity of classified documents relating to the various wars that the United States was fighting in Asia. Some of the material included what might be regarded as war crimes.

WikiLeaks again became front page news over the 2016 presidential election, when the website released the emails of candidate Hillary Clinton and her campaign manager John Podesta. The emails revealed how Clinton and her team collaborated with the Democratic National Committee to ensure that she would be nominated rather than Bernie Sanders. It should be noted that the material released by WikiLeaks was largely documentary and factual in nature, i.e. it was not “fake news.”

Because he is a journalist ostensibly protected by the First Amendment guarantee of free speech, the handling of the “threat” posed by journalist Assange is inevitably somewhat different than a leak by a government official, referred to as a whistleblower. Assange has been vilified as an “enemy of the state,” likely even a Russian agent, and was initially pursued by Swedish authorities after claims of a rape, later withdrawn, were made against him. To avoid arrest, he was given asylum by a friendly Ecuadorean government seven years ago in London. The British police had an active warrant to arrest him immediately as he had failed to make a bail hearing after he obtained asylum, which is indeed what took place when Quito revoked his protected status in April.

As it turned out, Julian Assange was not exactly alone when he was in the Ecuadorean Embassy. All of his communications, including with his lawyers, were being intercepted by a Spanish security company hired for the purpose allegedly by the CIA. There apparently was also a CIA plan to kidnap Assange. In a normal court in a normal country, the government case would have been thrown out on constitutional and legal grounds, but that was not so in this instance. The United States has persisted in its demands to obtain the extradition of Assange from Britain and London seems to be more than willing to play along. Assange is undeniably hated by the American political Establishment and even much of the media in bipartisan fashion, with the Democrats blaming him for Hillary Clinton’s loss while Secretary of State Mike Pompeo has labeled him a “fraud, a coward and an enemy.” WikiLeaks itself is regarded by the White House as a “hostile non-government intelligence service.” Sending Julian Assange to prison for the rest of his life may be called justice, but it is really revenge against someone who has exposed government lies. Some American politicians have even asserted that jail is too good for Assange, insisting that he should instead be executed.

The actual charges laid out in the US indictment are for alleged conspiracy with Chelsea Manning to publish the “Iraq War Logs,” the “Afghan War Logs” and the US State Department cables. On May 23rd, the United States government further charged Assange with violating the Espionage Act of 1917, which criminalizes any exposure of classified US government information anywhere in the world by anyone. Its use would create a precedent: any investigative journalist who exposes US government malfeasance could be similarly charged.

Assange is currently incarcerated in solitary confinement at high-security Belmarsh prison. It is possible that the Justice Department, after it obtains Assange through extradition, will attempt to make the case that Assange actively colluded with the Russian government, a conspiracy to “defraud the United States” to put it in legalese. Assange is unlikely to receive anything approaching a fair trial no matter what the charges are.

Assange’s prison term ended on September 22nd, but an earlier procedural hearing at Westminster Magistrates’ Court had already decided that a full hearing on extradition to the US would not begin until February 25th, 2020. District Judge Vanessa Baraitser ruled that Assange would not be released even though the prison term had ended, because he was a flight risk. His status in the prison system was duly changed from a serving prisoner to a person facing extradition and his final hearing would be at the high security Belmarsh Magistrates’ Court rather than in a normal civil court. Belmarsh is where terrorists are routinely tried and the proceedings there permit only minimal public and media scrutiny.

Most recently, on October 21st, 2019, Assange was again in Westminster Magistrates’ Court for a “case management hearing” regarding his possible extradition to the US, Judge Baraitser denied a defense team request for a three-month delay so that they could gather evidence in light of the fact that Assange had been denied access to his own papers and documents in order to prepare his defense. British government prosecutor James Lewis QC and the five US “representatives” present opposed any delay in the extradition proceedings and were supported by Judge Baraitser, denying any delay in the proceedings.

Another procedural hearing will take place on December 19th followed by the full extradition hearing in February, at which time Assange will presumably be turned over to US Marshalls for transportation to the Federal prison in Virginia to await trial. That is, of course, assuming that he lives that long as his health has visibly deteriorated and there have been claims that he has been tortured by the British authorities.

Former British Ambassador Craig Murray, who knows Julian Assange well, was present when he appeared in court on the 21st. Murray was shocked by Assange’s appearance, noting that he had lost weight and looked like he had aged considerably. He was walking with a pronounced limp and when the judge asked him questions, to include his name and date of birth, he had trouble responding. Murray described him as a “shambling, incoherent wreck” and also concluded that “one of the greatest journalists and most important dissidents of our times is being tortured to death by the state, before our eyes.”

The British court was oblivious to Assange’s poor condition, with Judge Baraitser telling the clearly struggling prisoner that if he were incapable of following proceedings, then his lawyers could explain what had happened to him later. Objections to what was happening made by both Assange and his lawyers were dismissed by the Crown’s legal representatives, often after discussions with the American officials present, a process described in full by Murray, who, after describing the miscarriage of justice he had just witnessed observed that Julian Assange is being “slowly killed in public sight and arraigned on a charge of publishing the truth about government wrongdoing.” He concluded that “Unless Julian is released shortly he will be destroyed. If the state can do this, then who is next?” Indeed.

Rights groups slam Bahrain for torturing 9 female activists in detention

Rights groups have slammed the Bahraini regime over the detention and mistreatment of nine female activists, saying that the United States and Britain are complicit in Manama’s human rights abuses.

The report, prepared by the London-based Bahrain Institute for Rights and Democracy (BIRD) and Americans for Democracy & Human Rights in Bahrain (ADHRB) last month, was presented during a congressional panel event in Washington, DC, on Tuesday.

The 138-page report examines the cases of nine female political prisoners all arrested, interrogated, and convicted between February 2017 and January 2019.

Speaking during the panel, ADHRB Legal Officer Bridget Quitter said the women had been targeted as part of Bahrain’s “systematic” crackdown on free speech.

“The ill-treatment and torture, coercive interrogation tactics, unfair trial, substandard conditions of detention are not merely coincidental, but part of a systematic repression of the Bahraini population,” she said. “These women were targeted for their opinions or those of their relatives.”

The study revealed that the women had been arrested without search warrants, some of which took place during “highly militarized police raids.” The women faced physical, psychological and sexual abuse during their interrogation, according to the report.

Of the nine women, three are still held in prison in dire conditions, such as being denied access to medical care. The other six have been released after serving their prison terms.

Speaking on Tuesday, Quitter explained that the female activists had been convicted based on forced confessions, and even threatened with rape and death if they refused to comply.

“They were subjected to rights violations from the moment of their arrest, through their interrogation and torture, unfair trials and detention in conditions which fail to meet international standards,” Quitter said.

The report also highlighted how Manama had been using “broad interpretations of counter-terror laws” to facilitate the conviction of the female activists, going as far as revoking citizenship in a number of cases.

“Bahrain has created a system which whitewashes and conceals human rights abuses,” Quitter said.

The Al Khalifah regime has been mounting a heavy-handed security crackdown since a popular uprising began in the country in mid-February 2011.

The protest campaign is demanding that a just system representing all Bahrainis replace the Al Khalifah ruling dynasty.

Enjoying extensive assistance from the Saudi kingdom and the backing of London and Washington, however, the Manama regime has sought to crush any perceived threat to its authoritarian rule.

The report, which was presented on Capitol Hill on Tuesday, also revealed that UK-funded and trained “oversight bodies” have “consistently whitewashed” Bahrain’s human rights abuses. London actively ignores that “taxpayer money” is being used to support such initiatives, it added.

The report also said that the US government provides “funding, training, and assistance to Bahraini government bodies implicated in human rights abuses.”

The rights groups have called on Bahrain to release the three remaining female prisoners and urged the US and UK to cooperate in improving human rights conditions in the country.

“Major Revelation” from OPCW whistleblower: Jonathan Steele speaking to the BBC

The following is a transcription of an interview given by Jonathan Steele (former Senior Middle East Correspondent for the Guardian ) to Paul Henley, on the BBC World Service programme, Weekend, on 27 October 2019.

Jonathan Steele: “I was in Brussels last week … I attended a briefing by a whistleblower from the Organisation for the Prohibition of Chemical Weapons. He was one of the inspectors who was sent out to Douma in Syria in April last year to check into the allegations by the rebels that Syrian aeroplanes had dropped two canisters of chlorine gas, killing up to 43 people. He claims he was in charge of picking up the samples in the affected areas, and in neutral areas, to check whether there were chlorine derivatives there …

Paul Henley: And?

JS: … and he found that there was no difference. So it rather suggested there was no chemical gas attack, because in the buildings where the people allegedly died there was no extra chlorinated organic chemicals than in the normal streets elsewhere. And I put this to the OPCW for comment, and they haven’t yet replied. But it rather suggests that a lot of this was propaganda…

PH: Propaganda led by?

JS: … led by the rebel side to try and bring in American planes, which in fact did happen. American, British and French planes bombed Damascus a few days after these reports. And actually this is the second whistle blower to come forward. A few months ago there was a leaked report by the person who looked into the ballistics, as to whether these cylinders had been dropped by planes, looking at the damage of the building and the damage on the side of the cylinders. And he decided, concluded, that the higher probability was that these cylinders were placed on the ground, rather than from planes.

PH: This would be a major revelation…

JS: … it would be a major revelation …

PH: … given the number of people rubbishing the idea that these could have been fake videos at the time.

JS: Well, these two scientists, I think they’re non-political – they wouldn’t have been sent to Douma, if they’d had strong political views, by the OPCW. They want to speak to the Conference of the Member States in November, next month, and give their views, and be allowed to come forward publicly with their concerns. Because they’ve tried to raise them internally and been – they say they’ve been – suppressed, their views have been suppressed.
