The State Department has reportedly rejected a request by the US ambassador to Israel, David Friedman, to stop referring to Israel’s control of the West Bank as an “occupation.” The final say is with Donald Trump, though.
The issue is being discussed, and President Trump will ultimately take the final decision, according to Israeli public broadcasting channel Kan. A State Department official said in response to the report that there has been no change in US policy regarding the West Bank, according to the Jerusalem Post.
Friedman’s alleged request comes as Washington’s attempts to find a solution to the Israeli-Palestinian conflict have not borne fruit. World leaders have questioned the US’s role as a peace broker in the region after Trump declared Jerusalem the capital of Israel on December 6 – sparking an international backlash and a rebuke by the UN General Assembly. Washington had earlier vetoed a UN Security Council resolution which demanded Trump’s decision be withdrawn.
The State Department has previously had to walk back a number of inflammatory statements made by Friedman about the West Bank. In September, he described Israel’s military control of Palestinian territories as “an alleged occupation.” Later that same month, Friedman said that Israel only occupies 2 percent of the West Bank and that illegal Israeli settlements in the territory are part of the Jewish State – prompting State Department spokesperson Heather Nauert to clarify that “our position on that hasn’t changed” and “the comment does not represent a shift in US policy.”
Israel seized the West Bank in 1967 during the Six-Day War. According to estimates by international bodies and NGOs, approximately 60 percent of the territory is fully occupied by Israel. The UN Security Council has adopted resolutions stating that Israel’s occupation of Palestinian territories has “no legal validity,” and calling for the “withdrawal of Israeli armed forces from territories occupied in the recent conflict.” The State Department refers to “occupied territories” in its own reports, including in a human rights report from last year.
Friedman, an Orthodox Jew and former bankruptcy lawyer who worked for Trump’s real estate empire, has been an outspoken advocate for Israel’s claim to Jerusalem. Although lacking a formal background in diplomacy, he was a top adviser to Trump’s presidential campaign, vowing that a Trump White House would recognize Jerusalem as Israel’s capital and relocate the US embassy in Tel Aviv to the contested holy city. Friedman has previously accused Barack Obama of “anti-Semitism” and likened one liberal Israeli anti-occupation group, J Street, to Kapos – Jewish “collaborators” who were appointed to supervise forced labor in Nazi concentration camps.
RAMALLAH – Israeli forces detained a 17-year-old Palestinian girl from the Nabi Saleh village in northwestern Ramallah in the central occupied West Bank on Tuesday morning before dawn.
Israeli forces raided the home of the al-Tamimi family, well-known internationally for their activism against the Israeli occupation, and detained Ahed al-Tamimi, 17.
Israeli forces also confiscated computers, mobile phones and cameras from the house during the raid.
According to locals, Ahed was arrested over a video went viral on social media of her slapping an armed Israeli officer during a raid on Nabi Saleh.
Ahed Tamimi is well-known across Palestine and the Arab world for videos of her, since her childhood, defiantly resisting Israeli soldiers who clash with Palestinians in her village nearly every week.
Two years ago, her family made headlines when an Israeli soldier violently attempted to arrest her younger brother , who had one arm in a cast at the time. Ahed and her mother managed to pull the soldier of her brother and free him.
Israeli military raids into Palestinian cities, towns, and refugee camps are a near daily occurrence.
According to the Palestinian Prisoner’s Society (PPS), since US President Donald Trump’s announcement recognizing Jerusalem as Israel’s capital, Israeli forces have detained 450 Palestinians, including 138 minors, and nine women.
Prisoners rights group Addameer recorded 6,198 Palestinians were detained by Israel as of October. The group has estimated that some 40 percent of Palestinian men will be detained by Israel at some point in their lives.

Palestinian organizer Bassem Tamimi, a prominent land defender in the village of Nabi Saleh, was seized by Israeli occupation forces – joining his wife, Nariman, and his daughter, Ahed – was also seized by Israeli occupation forces today, 20 December.
He was arrested as he attended the hearing for his daughter Ahed in Ofer military court, where her detention was extended for 10 days for further interrogation. This came one day after both Ahed and then her mother were arrested by occupation forces following attacks on them in Israeli media for protesting and defending their land from Israeli occupation soldiers who had shot another local boy, 14-year-old Mohammed Tamimi, in the head with a rubber-coated metal bullet.
In overnight, violent raids, occupation forces seized a cousin of the family, Nour Tamimi, 21, from her family home in Nabi Saleh. This means that Ahed and both of her parents, Nariman and Bassem – all of whom are leading land defenders in Nabi Saleh – are currently seized by the Israeli occupation forces. … continue
BETHLEHEM – The mother of a Palestinian teenage girl, who was detained from her home by Israeli forces before dawn on Tuesday, was reportedly detained at an Israeli police station when seeking information about her daughter’s whereabouts.
Official Palestinian Authority (PA)-owned Wafa news agency reported that Nariman al-Tamimi was detained by Israeli officers on Tuesday morning at the Benyamin police station, north of Ramallah in the central occupied West Bank.
Nariman was attempting to seek information about her 17-year-old daughter Ahed, who was arrested from their home in the village of Nabi Saleh hours earlier.
The whereabouts of both Nariman and Ahed remained unknown.
The al-Tamimi family is well-known internationally for their activism against the Israeli occupation, with Ahed in particular being the subject of several viral videos in which she defiantly stands up to Israeli soldiers who regularly raid her village in the central West Bank Ramallah district.

RAMALLAH – Fourteen-year-old Muhammad Fadel al-Tamimi remains in a medically-induced coma as of Tuesday, days after he was hot in the face with a rubber-coated steel bullet by Israeli forces.
The Palestinian teenager, a resident of the central occupied West Bank town of Nabi Saleh, was injured during clashes in his village on Friday.
According to locals, the bullet settled in the boy’s skull after it entered his face below his nose and broke his jaw.
The teenager is currently being held in the ICU of the al-Istishari Hospital in Ramallah.
Al-Tamimi, a former prisoner, was detained when he was 13 years old, and was previously injured several times during weekly clashes in his village.
His cousin, 17-year-old Ahed al-Tamimi, was detained on Tuesday morning by Israeli forces for slapping and kicking Israeli soldiers on the same day that Muhammad was injured.

Some 70 per cent of Palestinians in the Israeli-occupied West Bank and Gaza Strip want President Mahmoud Abbas to resign immediately, according to a new poll by the Palestinian Centre for Policy and Survey Research conducted 7-10 December.
The poll, conducted in the occupied Palestinian territory (oPt) in the immediate aftermath of US President Donald Trump’s decision to recognise Jerusalem as the capital of Israel, makes grim reading for Abbas, with those demanding his resignation up three points from September.
Abbas’ net satisfaction rating, meanwhile, has dropped one point to minus 35, with just 31 per cent satisfied with his performance, compared to 66 per cent who are dissatisfied.
When asked about who should succeed Abbas, 35 per cent expressed a preference for Marwan Barghouthi, 22 per cent would vote for Ismail Haniyeh, while Mohammad Dahlan attracted the support of just seven per cent of Palestinians (15 per cent in Gaza and one per cent in the West Bank).
With regards to the national unity file, 38 per cent of Palestinians in the oPt are satisfied and 55 per cent are dissatisfied with the performance of the reconciliation government. Fifty per cent are optimistic and 45 per cent are pessimistic about the success of reconciliation; three months ago, optimism stood at 31 per cent and pessimism at 61 per cent.
Some 81 per cent of Palestinians in the oPt want the reconciliation government to pay the salaries of the civil employees of the former Hamas government, while only 14 per cent do not it to do so. The same number (81 per cent) want the reconciliation government to pay the salaries of the security sector employees of the former Hamas government.
With regards to Abbas’ call for “one government, one gun”, only 22 per cent of those polled support the disbanding of Palestinian factions’ armed wings in the Gaza Strip, and 72 per cent want those armed groups to remain in place.
Regarding Trump’s policy shift on Jerusalem, a plurality of Palestinians (45 per cent) believe that “the most appropriate” Palestinian response is to stop all contacts with the US administration, submit a formal complaint to the International Criminal Court (ICC) and resort to an armed intifada.
Twenty-seven per cent want an end to contacts, the submission of a complaint to the ICC, and “non-violent resistance”. Twelve per cent want the Palestinian Authority to simply denounce the US step and stop contacts with the Trump administration, while another 12 per cent want just verbal condemnation.
A plurality of Palestinians (44 per cent) believe armed resistance is the most effective means of establishing a Palestinian state, 27 per cent think negotiation is the most effective means, and 23 per cent think non-violent resistance is the most effective. Three months ago, 35 per cent indicated that armed resistance is the answer and 33 per cent sided with negotiation.
While most Palestinians believe the Trump administration will not submit a plan for Israeli-Palestinian peace, 86 per cent believe that any such plan “will not meet Palestinian need to end occupation and build a state”. Nonetheless, 49 per cent think Abbas might accept the American peace plan if one is indeed submitted to him, while 42 per cent believe he will not accept it.
Regarding “public trust in the roles and positions of major Arab countries in the peace process and the US efforts to develop a regional agreement in the context of Palestinian-Israeli peace”, 82 per cent of Palestinians in the oPt say they do not trust the Saudi role, 75 per cent do not trust the Emirati role, and 70 per cent do not trust the Egyptian role.
The heart wrenching story of a mother’s loss is laid bare in “Today They Took My Son”. Released online yesterday to coincide with International Human Rights Day, Farah Nabulsi’s short film beams the pain and suffering of Palestinians in the occupied West Bank into the home of every viewer.
The story begins with Khalid, “the hero”, riding his bike through the narrow streets of a nameless town, his father’s voice narrating his adventure from somewhere in the background. Reminiscent of many a home video the world over, any sense of familiarity is quickly jolted away as the film cuts to documentary footage of a house demolition, of men in army uniforms surrounding an unknown figure, of the agony of an old, bearded man as he sits among the rubble of his home.
This juxtaposition of home video-style footage, of birthday cakes and makeshift football matches, and of raw, distressing scenes of Khalid’s arrest is an ongoing theme throughout the film. Narrated by his mother, her eyes dark and harrowed, she asks how “they who have taken everything else” could take her son away. “The body refuses to hear what it has always feared,” she says, as she runs in vain through the streets to the spot where Khalid was taken.
Yet these scenes are simultaneously all too recognisable. In fact, “Today They Took My Son” narrates a situation that has become daily reality for many Palestinians living in the West Bank, as the film points out, “every 12 hours, a Palestinian child is detained, interrogated, prosecuted and/or imprisoned”, according to a 2013 UNICEF report. Others have confirmed such figures, with Israeli human rights organisation B’Tselem estimating that as of August 2017 “331 Palestinian minors were held in Israeli prisons”.
The words of Khalid’s mother: “I know the earth will keep spinning around my pain, ignorant of all that has now changed in my world”, strike at the heart of the matter, that such accounts of suffering so often fall on deaf ears among the international community. For Farah Nabulsi, herself a Palestinian living in diaspora in London, “Today They Took My Son” is a vehicle for allowing others to see and feel what Palestinians in the Occupied Territories experience on a regular basis.
Nabulsi explains that although she “always thought she understood the injustices suffered by her people”, it wasn’t until she visited the territories and witnessed the treatment of children that she began to ask “what if that was my child?” As a mother of five, Nabulsi told the Institute for Middle East Understanding in an interview back in May that
There is nothing more excruciating in this life than not being able to help your child.
“These are people whose land was taken, whose homes were taken, whose dignity was taken, whose freedom has been taken, but to also have your children taken?”
What we are seeing is a systematised process of breaking a society through their children.
In the belief that “the arts play a crucial role in changing the world”, Nabulsi hopes that, by documenting the suffering of Palestinians through accessible art forms, awareness and empathy can be brought about. By “giving voice to the silenced”, what the late Edward Said once termed “permission to narrate”, Nabulsi seeks to “rehumanise” the Palestinian situation and provide a counter narrative to that espoused by the powerful lobbyists and international players who seek to deny the Palestinian situation.
“Today They Took My Son” challenges any viewer, irrespective of their geography, family situation or political affiliation, to watch a mother’s heartbreak and not be moved. Her final line “When will he come back? Will he come back? What shall we tell him of the world when he does?” asks us all to consider our silence.
Israeli occupation forces seized at least 14 Palestinians throughout occupied Palestine in pre-dawn raids on Monday, 13 November, including former prisoner and long-term hunger striker Tareq Qa’adan, a prominent leader of the Palestinian Islamic Jihad Movement.
Qa’adan, 45, was seized after a 1:30 am raid on his home in the town of Arrabeh, south of Jenin. Occupation forces ransacked his home and interrogated him on the spot before seizing him. He has spent over 10 years in Israeli prions in previous detentions – mostly imprisoned without charge or trial – and is related to many other current and former prisoners; his sister, Mona Qa’adan, is also a freed prisoner and prominent activist.
Khader Adnan, prominent former prisoner and long-term hunger striker, said that evidence indicates that the Israeli occupation intends to transfer Qa’adan to administrative detention, imprisonment without charge or trial. He said that he is confident that imprisonment will not break Qa’adan’s will, and that “he adheres firmly to the defense of the Palestinian cause and homeland, even when the price is his freedom.”
The Islamic Jihad movement issued a statement on the detention of Qa’adan, saying that “this unjust detention…comes amid a wave of targeting and escalation by the occupation against the movement and our steadfast people…Our people have known him as a solid national leader who defends the rights of his people and the fundamentals of his cause. He is known for his positive and strong relationships with all political and national forces and their leaders, who has spent long years in detention in the occupation prisons and a hero of the battles of the open hunger strike.”
This was followed on Tuesday morning, 14 November, by raids across the occupied Palestinian West Bank in which Israeli occupation forces seized 18 Palestinians. In Deir Abu Mashaal village west of Ramallah, occupation fores once again engaged in collective punishment of Palestinian families. They stormed the home of the family of Baraa Saleh Atta, killed by occupation forces after he participated in an armed action in which several Israeli police were killed. They confiscated tens of thousands of shekels from the village and arrested Baraa’s brother Nidal. The stolen funds are those that were raised to help support the families of the three young men, whose homes were sealed off and demolished by occupation forces; the Israeli occupation accused that these funds were “supporting terrorism.”
They also raided the towns of Qabatiya, Zababdeh and Maysaloon near Jenin, while in Tulkarem, they seized former prisoner Muath Jaroun, ransacking his home. They also stationed themselves once again at Kadoorie University, where the presence of armed Israeli occupation forces has become a regular threat and barrier to education for Palestinian students.
The Israeli government is preparing a plan to double the number of Israeli colonists in the Jordan Valley of the occupied West bank.
The new plan was presented by Israeli “Housing Minister” Yoav Galant, who previously served as the Commander of the Southern Command in the Israel army, and aims at doubling the number of colonists in the Jordan Valley, to reach approximately 12000.
As part of his plan, the Israeli government would be providing serious incentives to entice Israeli families to live, build and work in the Jordan Valley, through direct cooperation with various government ministries, to control the entire area.
The Israeli Minister said that “Israel’s leaders all agree that the Jordan Valley, will always be part of the state under any possible future peace agreement.”
Mahdi Daraghma, a member of a Local Council in the Jordan Valley, said the army has already ordered the eviction of Palestinians from Ein al-Hilwa and Khirbet Um al-Jamal, and the al-Maleh area in the Northern Plains, within the coming eight days.
Daraghma added that the families received sixty orders to evacuate their dwellings, barns and agricultural sheds, an issue which would displace 200 Palestinians.
He also said that the new orders were issued on November 1st, and the families only received them on the evening of November 9th.
This means that the Israeli army could invade these communities and displace the families at any given moment.
Israel’s colonies in the occupied territories, including in and around East Jerusalem and the Jordan Valley, are illegal under International Law, and the Fourth Geneva Convention.
Four Palestinian institutions that work on prisoners’ rights, the Addameer Prisoner Support and Human Rights Association, Al-Mezan Center for Human Rights, Palestinian Prisoners’ Society, and the Prisoners’ Affairs Commission, issued the below report on the arrests of 483 Palestinians by Israeli occupation forces in October 2017. English translation by Samidoun Palestinian Prisoner Solidarity Network.
International law provides special protections to civilian populations under occupation. One aspect of such protection includes safeguards against arbitrary detention and other measures aimed at preserving and maintaining the human dignity of people inside and outside detention centers.
In violation of its most basic obligations under international humanitarian law and international human rights law, Israeli occupation forces continued their policy of arbitrary detention of hundreds of civilians from the occupied Palestinian territory in October 2017.
Arbitrary arrests and detention are serious phenomena that continue to be carried out by occupation authorities in various Palestinian governorates and affect all sectors of society, especially children and women.
Part 1: Statistics of arrests
(Note: the figures in this report are based on the monitoring and documentation by the institutions involved in its preparation.)
In October 2017, Israeli occupation forces arrested 483 Palestinians from the occupied Palestinian territories (OPT), including 125 children, eight women and four journalists.
According to the monitoring and documentation conducted by the four Palestinian institutions, the Israeli occupation authorities arrested 137 Palestinians from Jerusalem governorate, 80 from al-Khalil, 82 from Jenin, 52 from Ramallah and El-Bireh, 32 from Bethlehem, 28 from Qalqilya, 20 from Nablus, 15 from Tubas, 15 from Tulkarem, eight from Jericho, seven from Salfit and seven from the Gaza Strip.
In the context of the policy of administrative detention – imprisonment without charge or trial – the occupation authorities issued 86 administrative detention orders, including 35 new orders. Thus, the total number of Palestinian political prisoners in Israeli jails reached 6300, including 59 women, among them 11 minor girls. There are approximately 250 Palestinian children in Israeli jails and 450 Palestinians held without charge or trial under administrative detention.
Part 2: Detention of Children
The Israeli occupation courts in Jerusalem continue to issue sentences of house arrest againt Jerusalemite children, which deprives these children of their right to education. A child who has been sentenced to house imprisonment is forbidden from leaving the home, except for approved medical visits with their guardian and after informing the authorities. This forces parents to become jailers of their children, causing them deep pain.
Even more, the Israeli courts do not hesitate to issue sentences of imprisonment for children under 15 in the “sheltering center,” where eight Palestinian children are currently held. (Shadi Farrah, Adam Mohammed Sub Laban, Burhan Mohammed Abu Shaker, Ahmed al-Zaatari, Ali Ehab Alqam, Mohammed Ayman Abdel-Razaq, Yazan Mohammed al-Husseini and Mahmoud Naim Ashayer.)
Isolated Childhood
The mother of the child Shadi Farrah, 14, from Kufr Aqab in Jerusalem, said that he has been held in what the authorities call a “sheltering center” since his abdution by occupation forces along with fellow child prisoner Ahmad al-Zaatari about two years ago as they returned from school. The Israeli court later claimed that they were found to have a knife when searched. The occupation court held over 20 sessions in the trial of her son and he was considered the youngest prisoner in Israeli prisons.
She added that her son suffers from very difficult and complex psychological conditions in prison at his young age and needs psychological and moral support in particular as he is held in a “reform” institution accompanied by “criminal” prisoners.
Part 3: Arrests and allegations of “incitement” on Facebook
The phenomenon of the arrest of Palestinians for posting on Facebook under the pretet of “incitement” constitutes a new, punitive policy of the occupation authorities to bring as many children and young people as possible in prisons. Since the beginning of 2017, 220 Palestinians have been arrested and imprisoned on charges of publication of articles and opinions on Facebook and social media pages.
The Israeli military courts in the West Bank base these charges of “incitement” on Article 85 (1)(f) and (g) of the Defense (Emergency) Regulations of 1945, which forbids the authorship or possession of any illegal book, account, journal, publication or advertisement.
In the event that Palestinians from Jerusalem are convicted of incitement, the occupation bases its charges on Article 144, section (d)(2) of the Penal Code of 1977, where paragraph (a) stipulates that:
Publishing publications for the commission of an act of violence or terrorism, or in sympathy or encouragement for acts of violence or terrorism, or displaying support for such acts, and in accordance with the contents and circumstances of the publication, being that there is a real possibility that this publication would lead to acts of violence or terrorism, can result in imprisonment for 5 years.
During October 2017, the prisoner Abdel-Salam Jihad al-Masri, 23, from the village of Aqaba near Tubas, was transferred to administrative detention for four months after serving a sentence of three months imprisonment. Al-Masri was seized by Israeli forces on 1 August 2017 and accused of incitement for posting on his Facebook page. He was sentenced to 3 months imprisonment and a fine of 2,000 NIS ($500 USD) for incitement. On 17 October 2017, he was taken once more to the Israeli military court, sent back to prison and told that he was transferred to administrative detention for four more months, on the grounds that he is a threat to the security of the occupation state, ostensibly because of his writings on Facebook.
The occupation authorities claim that the imprisonment of activists on the basis of writing on social media is the only means to prevent a danger to the security of the occupation, but it seems to have become a clear means by the occupation of silencing voices and violating the right of expression, and to create new policies to serve as a tool of arrests and repression in order to deny Palestinian freedom of expression. Facebook is an electronic space that does not reflect factual acts. It is a space where writers express themselves poetically and emotionally. It is not acceptable for this to be used as an excuse to restrict freedom of expression or muzzle Palestinian voices. It is not an acceptable or reasonable conclusion for occupation courts to interpret Facebook posts as actual acts rather than writing on screens; it is a wrongful and unfair comparison.
Section 4: Legal Analysis
This report presents the legal protections under international humanitarian and human rights law to detainees, related to the types of Israeli violations during the reporting period and the legal rules that prohibit such violations, as follows:
1 – The arbitrary detention of Palestinian citizens violates the legal guarantees related to the prohibition of arbitrary detention in international human rights law, including article 9 of the 1948 Universal Declaration of Human Rights and articles 9 and 10 of the International Covenant on Civil and Political Rights (1976).
2 – The policy of administrative detention by the occupation state, in which detention is carried out on the basis of secret evidence and without any charge against the detainee, constitutes a direct violation of fair trial guarantees under the following legal principles:
a) It is contrary to Article 11 (1) of the 1948 Universal Declaration of Human Rights, which states that: “Everyone charged with a penal offense has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense.”
b) It constitutes a grave violation of articles 9 and 14 of the International Covenant on Civil and Political Rights of 1976, which guarantees everyone the right to a fair trial, to be informed of the charges against them and to be able to defend themselves. (Note: The Occupying Power acceded to the ICCPR in October 1991, and shall be bound by it.)
c) The failure to disclose any charges against the person detained under the administrative detention order precludes every possibility of verifying the compliance of the occupying state with Article 78 of the Fourth Geneva Convention of 1949, which states that “If the Occupying Power considers it necessary, for imperative reasons of security, to take safety measures concerning protected persons, it may, at the most, subject them to assigned residence or to internment.” It is impossible to verify whether this detention is permitted without knowing what the reasons have been and are.
d) Failure to inform the detained person of the charges against them constitutes a violation of Article 71 of the Fourth Geneva Convention of 1949, which obliges the occupying power to report charges without delay. They also constitute a violation of article 10 of the Body of Principles for the Protection of All Persons in Any Form of Detention or Imprisonment of 1988, which requires the same.
3. The use of home imprisonment against children deprives them of going to school, which is harmful to their right to education, guaranteed under article 13 of the International Covenant on Economic, Social of Cultural Rights of 1976. Denial of that right violates article 28 of the Convention on the Rights of the Child of 1990.
4. The arrest of Palestinians for posting on social media is a violation of their freedom of expression under Article 19 of the International Covenant on Civil and Politicl Rights and the Universal Declaration of Human Rights.
Conclusions:
This report sustains a number of findings, through our analysis of the practices of occupation authorities and the reality of Palestinian detainees in Israeli prisons, as follows:
1) The occupying forces are continuing their gross and systematic violations of international humanitarian and human rights law.
2) These Israeli violations have resulted in severe suffering for Palestinian detainees in Israeli prisons.
3) The silence of the international community has encouraged the occupying power to increase their violations against Palestinian detainees.
4) The High Contracting Parties to the Geneva Conventions have failed to fulfill their duties and have in fact encouraged the occupation authorities to escalate their violations.
Recommendations:
At the conclusion of the report, this series of recommendations is based on the above-mentioned facts and the systematic and gross violations of international humanitarian and human rights law by the occupying power, as follows:

1) Formation of a fact-finding committee by the UN Human Rights Council on Israeli violations against detainees.
2) Activate the mechanisms of accountability by the international community towards the perpetrators of violations in fulfillment of its legal and ethical obligations.
3) The High Contracting Parties to the Geneva Conventions must uphold their responsibilities and pressure the occupying power to respect international humanitarian law.
4) International contracting committees of the Conventions must activate their role to pressure the occupying state to respect the standards for prisoners’ rights.
Recommendations at the local level:
1) Activating local solidarity campaigns with Palestinian prisoners.
2) Media support for detainees through intensified media campaigns.
A UN human rights expert has accused Israel of violating a number of international laws and resolutions while suggesting legal action, including travel bans, against the Middle Eastern state. Tel Aviv countered by saying the UNHRC “has lost all touch with reality.”
“Israel’s role as occupier in the Palestinian Territory – the West Bank, including East Jerusalem, and Gaza – has crossed a red line into illegality,” said Canadian law professor Michael Lynk, who is the UN’s Special Rapporteur on the situation of human rights in the Occupied Palestinian Territories.
Presenting his latest report to the UN General Assembly in New York, the expert described Israel’s actions in the region as “the longest-lasting military occupation in the modern world.” He then suggested the UN proceed with relevant international legal processes to force Israel change its policy, which so far “shows no signs of ending.”
In order to do so, the UN should seek to proclaim the occupation of Palestine illegal. As a first step, he suggests that the UN request the International Court of Justice to offer its assessment of the situation.
As things stand, Israel is regarded “as the lawful occupant of the Palestinian territories,” he pointed out, saying that this position does not correspond with reality.
Israel’s actions are “in defiance of 40 plus resolutions of the [UN] Security Council, 100 plus resolutions of the General Assembly, and rulings of the International Court of Justice,” Lynk underlined. He added that the current “focus” on the Israeli-Palestinian issue “is not anti-Israel, it’s an anti-occupation.”
Once Israel’s actions are officially pronounced illegal, the international community could put pressure on Tel Aviv through suspending certain forms of cooperation.
“Only when the Israelis need visas to travel abroad and don’t receive them, only when the EU trade with Israel is limited and only when cooperation in academic, military and economic fields with Israel comes to an end – only then will we see a real change,” Lynk explained at a news conference Thursday.
Israel’s envoy to the UN, Danny Danon, strongly condemned the special rapporteur’s claims, saying the UN body Lynk represents “has lost its legitimacy.”
“[UNHRC] focuses obsessively on attacking Israel instead of working on resolving the real human rights problems plaguing the world,” Danon said in a statement as quoted by the Israeli media. “The Council has lost all touch with reality,” he added.
However, according to the UN special rapporteur, calls to end the occupation of Palestine also emanate from within Israel. The UN official in particular cited the publisher of Israel’s Haaretz newspaper, Amos Schocken, who said international pressure “is precisely the force” that can help change things in the crisis.
The UN has recently included some of the biggest Israeli and international firms operating in the West Bank, East Jerusalem and the Golan Heights on a blacklist of those violating “international law and UN resolutions.”
Some 130 Israeli companies as well as dozens of international firms and corporations have already received warnings from the UN High Commissioner for Human Rights, Zeid bin Ra’ad al-Hussein, on impending inclusion on the list, according to the Israeli outlet, Ynet News.
Earlier in October, Israel approved construction of over 30 new settlements in the UNESCO-protected city of Hebron, which is the largest Palestinian community in the West Bank.
BETHLEHEM – Israeli forces on Wednesday set up an iron gate at the entrance of private Palestinian graveyard in the southern occupied West Bank Bethlehem-area village of al-Walaja.
Locals told Ma’an that the plot of land where the gate was set up around belongs to Ahmad Barghouthi, and holds the graves of several of his family members.
Israeli forces reportedly told Barghouthi that the land is located inside the route for Israel’s separation wall, therefore cutting off his access to the graveyard.
An Israeli army spokesperson told Ma’an they were looking into reports.
Meanwhile, Israeli forces on Tuesday reportedly delivered a demolition notice to an under-construction two-story home in the village, according to official Palestinian Authority (PA)-owned Wafa news agency.
Residents of al-Walaja lost over three-quarters of their lands since the state of Israel was established in 1948, when most of the village’s residents became refugees.
During Israel’s military takeover of East Jerusalem and the West Bank in 1967, 50 percent of al-Walaja’s lands were annexed to the Jerusalem municipality.
Meanwhile, Israel’s separation wall encircles al-Walaja, the hometown of slain Palestinian activist Basel al-Araj, and swathes of land have been reappropriated by the Israeli government for the construction and expansion of the illegal Israeli settlements of Gilo, Har Gilo, and Givat Yael.
The Israeli government has also planned to confiscate hundreds of acres from al-Walaja for the establishment of a national park.
“On October 13th, 2017, 16 children and 2 adults were ambushed and arrested by the Israeli soldiers from the Givati Brigade. The 18 arrested were initially detained in a cage in checkpoint 56, cable-tied, kicked, and hit. 2 were released, whilst the remaining 16 were transferred to an Israeli police station where they were subjected to further physical and psychological violence. All 16 were eventually released without charge, but not before threats were made to their families and the safety of their homes.”

The seizing of the children took place in the West Bank city of Hebron. The report goes on to describe arrests of minors as “a consistent reality of the occupation and tactic of the Israeli occupation forces,” and it also cites a report from a human rights organization showing that 130 children were arrested in August of 2017 alone.
One of those detained in the October 13 roundup was 12-year-old Abdullah Dwaik. That’s Abdullah in the brown sweater being led away in the photo above. You can also see him in the video below giving an account of what took place after he was taken into custody. Following the initial arrest, he and the others were transported to a military base where they were handcuffed and blindfolded.
I’m not sure exactly where Abdullah’s grandparents live–I’m not familiar with the place name–but Bab Al Zawyeh, the place he calls “home,” is a neighborhood in central Hebron.
I also do not know who the “Ofer the settler” Abdullah refers to (and who he says hit one of the boys) is, though possibly he’s the man profiled in the following video…
In any event, the Christian Peacemakers report goes on to make some additional crucial points:
Children should never be blindfolded, hooded or painfully restrained;
Children should never be subjected to violent, threatening or coercive conduct;
Children must be able to consult with a lawyer prior to interrogation;
Children should have a parent or guardian present prior to and during their interrogation;
Children should not be arrested at night;
Children should be properly informed of their right to silence;
All interrogations should be audio-visually recorded;
No child should be transferred out of the West Bank in violation of the Fourth Geneva Convention.
Israel has violated all of these principles.
