Hillary Clinton’s Iran Weapons Lie Is ‘Tough Talk’

Covering Hillary Clinton’s trip to India, USA Today’s Richard Wolf writes (5/8/12):
Fielding rapid-fire questions at a town-hall-style event in Kolkata, she denounced Iran’s nuclear arms program and urged India to reduce its Iranian oil imports further.
“We appreciate what has been done, and of course we want to keep the pressure on Iran,” she said.
When I read that I thought, “Here we go again, another outlet misstating the basic facts about the Iran debate.”
Then I checked the transcript of the Clinton’s town hall, and that is indeed what she said, in response to a question about U.S. pressuring India to stop buying oil from Iran:
That’s a very good question, and let me give you a little context for that question. When President Obama took over in 2009, we knew Iran’s continuing development of a nuclear weapons program would be very destabilizing in the region, because there would be an arms race with the nations in the region who have pre-existing enmity between themselves and Iran. And it would also cause a great threat to Israel.
USA Today should have noted that there is no evidence that Iran has any nuclear weapons program at all–as U.S. intelligence and the Pentagon secretary have acknowledged. That’s what newspapers should do when politicians mislead. Instead, the paper puts this headline over the piece: “Clinton Wraps Asia Trip with Tough Talk on Iran.”
“Tough talk” is a weak way to describe a government official’s misrepresentation of the facts.

The Israel Lobby Never Sleeps

There has been no media reporting on H.R.4133 — United States-Israel Enhanced Security Cooperation Act of 2012 introduced into the House of Representatives of the 112th Congress on March 5th “To express the sense of Congress regarding the United States-Israel strategic relationship, to direct the President to submit to Congress reports on United States actions to enhance this relationship and to assist in the defense of Israel, and for other purposes.” The sponsors include Eric Cantor, Ileana Ros-Lehtinen, and Howard Berman (all of whom are Jewish) and also Steny Hoyer of Maryland, who is Norwegian but might as well be Jewish given his frequently expressed love for Israel. The bill provides Israel with a blank check drawn on the US taxpayer to maintain its “qualitative military superiority” over all of its neighbors combined. It is scheduled for passage on a “suspension of the rules,” which means it will not actually be voted on and will be approved by consent of Congress.
It is perhaps no coincidence that on Monday the Republicans in the guise of the redoubtable Howard “Buck” McKeon released their proposal for increased defense spending (yes, increased) for 2013. It includes a cool $1 billion for Israel to upgrade its missile defenses. That’s on top of the $3 billion it already receives plus numerous co-production programs that are off the books and defense spending that is not considered to be part of the annual grant. Perhaps “Buck” should consider changing his sobriquet to “Warbucks.” Buck is not Jewish but he is a Mormon, perhaps a sign of what will be coming if we are so unlucky as to vote into office the born again Hawk Mitt Romney. Mitt has a foreign policy team consisting of more than thirty stalwarts, mostly drawn from the Bush Administration, and nearly all of whom are neocons. It features Robert Kaplan, John Bolton, and Dan Senor.
Israel and its partisan hacks in Congress are utterly shameless. At a time when the country is screaming for some measure of restraint in government spending, Israel is the one budget line that only sees increases.

Chicago’s Greeks and Jews watching realignment in Mediterranean with shared interest, concern

A century ago, so many Greeks were arriving in Chicago that Hull House hired someone who spoke the language to learn their stories. Businesses run by Greeks were popping up west of the Loop in what is now Greektown and the UIC campus.
But the Jews found Chicago first, coming steadily from the 1840s onward.
What both groups have in common is a strong bond for their homelands – Greeks frequently sending money home to family members and buying land, Jews supporting the efforts to create a Jewish homeland in the Middle East and supporting Israel since its creation.
“We have two of the most significant diaspora groups in Chicago, both Jewish and Greek,” said Endy Zemenides, executive director of the Hellenic American Leadership Council in Chicago.
The instability in the eastern Mediterranean recent years has brought Greek and Jewish communities in Chicago and across the U.S. together through an emerging trilateral alliance among the U.S., Greece and Israel.
“There is a need for an alliance. What is happening in the Middle East is affecting what is going on regionally and globally,” said professor Eytan Gilboa, director of the Center for International Communication at Bar-Ilan University in Israel.
Gilboa, a world-renowned expert on international communication and U.S. policy in the Middle East was in Chicago this week as part of “Today’s Middle East: Challenges, Leadership, Communication,” which is charged with tackling a range of topics ranging from Iran’s weapons program to the special ties Israel has with Greece and Poland. The program ends Sunday.
At one of the events Wednesday, titled, “Greece, Israel and the United States: An Emerging Trilateral Alliance in the Middle East,” co-sponsored by the Greek consulate and National Strategy Forum, a set of panelists discussed challenges in the Middle East and the importance of strong ties among the countries.
“This is a strategic relationship; this is a relationship that will last forever. This is where the Greek, Israeli, Cypriot, and U.S. partnership can make a difference,” said Zemenides, whose group is one of the most influential Greek organizations in the U.S.
Gilboa and Zemenides stressed the importance of communicating to Greek and Jewish communities about the emerging alliance in face of challenges.
“Greeks and Jews have worked together for centuries,” Zemenides said. “If they work together you can influence U.S. policy and can create stability in the Eastern Mediterranean.”
Insecurities faced by Israel and Greece today stem from Turkish assertiveness in the Mediterranean, nuclear proliferation, Iran’s weapons program, piracy in the high seas, terrorism, the Arab Spring, energy security and economic crisis.
“If you look at the map there is geopolitical-strategic change taking place. You can then understand the reason for improved relations,” Gilboa said.
All these events have caused great instability: So how can the emerging trilateral alliance stabilize the region and ensure the interests of the U.S., Greece and Israel?
By increasing the economic, military and energy ties taking place today and in years to come.
In 2010 prime ministers from both countries visited the other as a way to signify stronger diplomatic relations.
Benjamin Netanyahu was the first Israeli prime minister to officially visit Greece. There he and his Greek counterpart, George Papandreou, discussed many topics such as an increase of military and economic ties.
This past April the U.S., Israel and Greece conducted joint military exercise in the Mediterranean named Noble Dina, simulating potential confrontations with Turkey.
On a less ominous note, Greece received a boost to its tourism sector last year thanks to 420,000 vacationing Israelis who took new non-stop flights from Israel to Greece. As Turkey and Israel’s relationship soured in 2009, Greece opened its doors to Israelis who normally vacation in Turkey.
On another front, energy cooperation among Israel, Greece and Cyprus has increased as well, with the discovery of natural gas off the shores of Israel and extending to Cyprus, Turkey and Lebanon. The area known as the Levant Basin Province has enough natural gas for globalwide use for one year. Officials say they realize that the cooperation among Cyprus, Greece and Israel over the find increases the possibility of future confrontations with Turkey.
Though Greece is located outside the Levant Basin, it has shared national and economic interests with Cyprus.
The Greek-Israeli relationship was not always so cozy.
Before 1990, Greece was the only European member nation that did not have full diplomatic relations with Israel. Before then, Greece’s foreign policy was influenced by Arab states with whom it had important economic ties.
“We need an-on-the ground realistic assessment, we are on the outside looking in,” said Richard Friedman, president and chair of the National Strategy Forum, who moderated the event.
“We have honed in on the difficult issues and the people who have assembled in this room suggests to me that we have informed citizens,” Friedman said in his closing remarks to the 50 Greek and Jewish leaders in the audience.
“That is the whole purpose that we are all here. That is why we welcome Bar-Ilan University. What we are doing here is communicating.”
According to both Gilboa and Zemenides, economic constraints on countries have made alliances such as these attractive. Greece, Israel, the U.S. and even Cyprus have navies that make them Mediterranean powers. Combined, they can increase their influence.
“This alliance is fundamentally, culturally, historically, geo-strategically on the same page and it has to be encouraged,” Zemenides said. “We have to have stability in the eastern Mediterranean otherwise the world is in trouble.”

Clinton urges India to cut Iranian oil

US Secretary of State Hillary Clinton made a plea to energy-starved India on Monday to reduce its Iranian oil imports, as Washington struggles to get Asia’s economic powerhouses on board with its sanctions.
A US ban on Iranian oil is due to come into force at the end of June, with countries potentially facing sanctions if they continue to trade with the Islamic republic.
New Delhi has been hesitant to back the ban and is planning to trade in currencies other than dollars, therefore avoiding US sanctions.
Clinton told a town hall meeting in the eastern city of Kolkata that there’s an adequate supply in the market for India to find alternative sources of oil.
She noted India has taken some steps to reduce its imports from Iran, but said the US wants to see more.
“If there weren’t an adequate supply… we would understand, but we believe that there is adequate supply,” she said.
India, with an economic growth rate of about 7 percent, has an insatiable need for oil. About 9 percent of its oil imports are from Iran, though officials say it has reduced its dependency on Iranian oil in recent months.
“We appreciate what has been done and, of course, we want to keep the pressure on Iran,” Clinton said.
India remains dependent on the imports, and Iran is its second largest oil supplier after Saudi Arabia.
India and Iran reached an agreement earlier this year that would allow India to pay for about 45 percent of the purchases in rupees.
Tehran would then use the Indian currency to buy goods from Delhi.
Clinton said the US remained focused on putting global pressure on Iran.
“We believe, at this moment in time, the principle threat is a nuclear-armed Iran,” she said. “We need India to be part of the international effort.”
Clinton will head to Delhi later Monday, where she is expected to press India to push ahead with an economic program that would open the way to US conglomerates such as Walmart entering the fragile market.
The prime minister’s chief economic adviser said last month that no new reforms were likely before the next election in 2014.

Netanyahu’s Role in Crafting the “Strategic Asset” Myth

From the Cold War to the War on Terror, Israel and its partisans have stressed the Jewish state’s role as a strategic asset to the United States in the Middle East. A recent Haaretz article, however, provides further evidence that this claim is little more than a self-serving myth.
In the article titled “David Ben-Gurion’s diary invites a rethink of Benzion Netanyahu’s extreme Zionist image,” Israeli historian and journalist Tom Segev reveals that the current Israeli Prime Minister’s late father offered his propaganda services to Ben-Gurion’s government on at least two occasions. Writes Segev:
In 1956, Netanyahu proposed that Ben-Gurion employ him as a public diplomacy (hasbara) functionary, in the guise of a history professor, at one of the universities in America. He sought to work under the auspices of the Prime Minister’s Office, and tailor his activity to its policy.
Ben-Gurion’s diary notes Netanyahu’s experience in such “public diplomacy”:
He told of a series of meetings with American statesmen, among them Dean Acheson, who had been secretary of state in the Truman administration. It seems that he spoke with them primarily about the danger of Soviet penetration of the Middle East.
The diary doesn’t record whether or not Netanyahu got the job, but from 1957 to 1968 he worked as a professor in Dropsie College in Philadelphia. If his 1956 propaganda proposal had been turned down, it certainly didn’t deter him from trying again:
In June 1968 Netanyahu paid another visit to Ben-Gurion, by then in retirement, and once again proposed a plan for Israeli propaganda in America. We must take action against the American left, he said referring to what was then called the New Left. Almost all are communist Jews, Netanyahu told Ben-Gurion, and once more proposed concentrating Israeli propaganda on the danger of Soviet penetration of the Mideast: If the Soviet Union takes over the Middle East, it will control the United Nations, he suggested arguing, and praised two of the Israel supporters he had found on the right flank of the Republican Party: Barry Goldwater and Richard Nixon.
But if Israel really had been such an obvious strategic asset to the U.S. during the Cold War, there wouldn’t have been any need for Netanyahu and other hasbara agents to remind the Americans of Israel’s usefulness in countering “the danger of Soviet penetration,” would there?

Sarkozy and Hollande on Middle East: La Même Chose

When the frontrunners in France’s presidential race took their seats on Thursday evening for a final televised debate, they did so with battle lines firmly entrenched.
Incumbent President Nicolas Sarkozy and Socialist Party leader Francois Hollande had spent the previous month on a vitriolic campaign trail exposing deep rifts among the French electorate over the economy, immigration, and nuclear energy.
But the most significant player in Sunday’s election, which most opinion polls predict will go down to the wire, was not even in the studio.
Both Hollande and Sarkozy are mindful that the 6.4 million who voted for Marine Le Pen of the far right National front will have a large bearing on the outcome of Sunday’s run-off. That’s why they have sought to echo Le Pen’s strident anti-immigration rhetoric which reached out to disenchanted voters and hardliners alike.
Hollande vowed to cut economic migration at a time when France is feeling the pinch from the eurozone’s financial turmoil. Sarkozy went one step further, referencing Le Pen by name and claiming only he had the experience and gumption to put a meaningful cap on immigration’s pall over France by cutting the number of people entering the country in half.
Judy Dempsey, a senior associate at Carnegie Europe, said although immigration was being touted as a domestic stand from both candidates, using the issue as a sweetener to attract far-right voters could have an adverse effect on France internationally.
“Immigration is foreign policy and when they speak about immigration now in France it’s fortress Europe,” she said. “[Hollande and Sarkozy] don’t see immigration in a positive sense and it sends completely the wrong signal to the younger generation and the emerging business community in the Middle East.”
It was not until the final minutes of Thursday’s debate that the issue of foreign policy was raised. Here, both candidates demurred.
Sarkozy was quick to point out how he took the lead as France led the way in a number of international decisions while in office.
France’s president has often sought to paint himself as a highly experienced operator in the realm of global diplomacy. As well as inheriting French involvement in NATO’s Afghanistan mission, Sarkozy oversaw the stationing of French troops in the Middle East and Africa, largely in a peacekeeping capacity.
He played a prominent role in meditation between Tbilisi and Moscow in 2008 when the fight over Abkhazia and South Ossetia threatened to boil over into all out war.
And last year, Sarkozy’s France spearheaded NATO’s campaign for military intervention in Libya.
Sarkozy avoided mentioning Libya in Thursday’s debate after embarrassing allegations that his 2007 presidential campaign had received an offer of funding from Tripoli. Sarkozy is seeking legal action over the claim, but thought better of opening that particular can of worms in the closing moments of a potentially election-changing televised appearance.
Hollande’s public statements indicate striking Middle Eastern policy similarities to the current government. Like Sarkozy, Hollande has declared that an Iranian nuclear missile would be unacceptable for Europe. Like Sarkozy, Hollande has called for a two-state solution in Palestine while trumpeting Israeli security as a key French concern.
The Socialist leader has been necessarily vague over French foreign policy. He currently lacks a dedicated adviser for overseas affairs. Instead of laying out detailed plans for France’s global relations, the Socialist challenger has made a point of criticizing Sarkozy in this regard.
Looking ahead to the next term in office, Hollande has struck a remarkably similar tone to the current government.
Sarkozy and French Foreign Minister Alain Juppe have been among the most hawkish European officials to address the Syrian crisis, closing the French Embassy in Damascus and calling multiple times for President Bashar Assad to leave office. Sarkozy has issued incessant calls for a full ceasefire in Syria, and has somewhat ominously compared the restive city of Homs to Benghazi, Libya’s erstwhile rebel stronghold.
Hollande, for his part, declared last month that he would support military intervention in Syria, “if done within a [United Nations] framework.” Juppe has offered words to the same effect in recent weeks.
According to Thomas Klau, senior policy fellow at the European Council on Foreign Relations, both Sarkozy and Hollande will wait and see what happens in Syria before veering from the French course of public criticism of the Damascus government.
“The current government and Juppe have been very active on the Syria dossier and doing all they could to get Russia to move its stance,” Klau told Al-Akhbar. “I wouldn’t expect the French policy to be different under Hollande. Much of his policy will be determined by events on the ground and the success – or the lack of it – from the [U.N./Arab League Envoy Kofi] Annan’s mediation effort.”
Dempsey added that Hollande had raised the prospect of military intervention in Syria “because he can say it without the responsibility” of having to go through with it. As a permanent member of the U.N. Security Council, France still has some global clout, but not nearly enough to convince Russia or China to bless any advance on Syria. Both candidates know and accept this, and continuity in the French approach to Damascus is more likely than meaningful change.
In a similar way, with Paris’ pro-Israel lobby as influential among the Socialists as they are in Sarkozy’s UMP party, Hollande, should he win, is unlikely to depart from France’s current line on Palestine.
In spite of a few diplomatic gaffes, including branding Israeli Prime Minister Benjamin Netanyahu “a liar,” Sarkozy has spent much of the last five years offering support to Israeli officials. Hollande, with influential pro-Israeli figures such as Dominique Strauss-Kahn having the ear of many Parisian socialists, will have a hard time departing from such engagement.
“Nicolas Sarkozy was personally convinced that the national interest of Israel was very close to French national interest,” Klau said. “With Francois Hollande, his attitude isn’t very significant. Neither of them place themselves in the Arabist tradition of French foreign policy, which has lost relevance anyway.”
So if foreign policy has provided so few soundbites in the French presidential election, it is because both candidates are largely in assent.
That is not to say Sarkozy and Hollande agree on every foreign policy area.
Hollande used Thursday’s debate to repeat a campaign promise that, if elected, he would withdraw all French troops serving with NATO from Afghanistan by the end of 2012 – a full year ahead of a planned pullout, and much to the chagrin of Sarkozy. The French president has said he’d prefer not to renege on the current withdrawal timetable agreed with NATO.
In recent months, Sarkozy has faced the wrath of Turkey, one of France’s major trading partners, by pursuing legislation that would make it illegal to deny the Armenian Genocide. Amid opprobrium from Ankara, the president has pushed ahead with the controversial bill, which critics have denounced as a cynical attempt to get France’s estimated 400,000 ethnic Armenians on his side ahead of elections.
Sarkozy has made no secret of his objection to Turkey applying for EU membership, and fallout over the genocide bill is just the latest of a series of spats with Ankara during his time in office. Hollande also indicated he would oppose Turkish EU accession if elected, but, significantly for officials in Ankara, he has not ruled out future negotiations.
“Sarkozy is openly hostile to the notion that Turkey should join the EU, whereas the Socialist position is that that door should remain open,” said Klau.
France’s poor diplomatic ties with Ankara can be counted as a black mark against Sarkozy’s foreign policy initiatives, something Hollande should seek to take advantage of, according to Dempsey.
“Sarkozy had something near contempt for Turkey and there is no love lost between Ankara and Paris,” she said. “This would change slowly under Hollande. It’s time France considered [engagement with Turkey] as its long-term strategic interest but that is one thing that Hollande might be able to change if he wins.”
With France mired in discontent over domestic issues, it is no surprise that neither Hollande nor Sarkozy has been overly willing to share their opinions on global affairs.
But whoever inherits control of one of NATO’s largest troop contributing countries will need to keep plans in place.

The Lutfallah II Arms-Smuggling Scandal

It would be an incautious stretch to suggest any sort of parity between Watergate and the unfolding Lutfallah II arms shipment-to-Syria drama, that each day brings more revelations. But some of what we are daily learning about the who, what and why of Lutfallah II reminds some of us of a Watergate, type atmosphere including “bit by bit, drip by drip” revelations, denials, setting up fall guys and remarkable examples of incompetence.
The still unfolding Lutfallah II weapons running misadventure, in which a claimed Syrian-owned vessel registered in Sierra Leone but apparently flying the Egyptian flag, was detained off the Lebanese port of Batoun, by the Lebanese Army Marines because it was sailing too high in the water, and appeared “suspicious,” and was then found to contain 300,000 pounds of weapons may erupt unpredictably with serious political consequences for the region.
“Deepthroat”, the FBI mole who met secretly with Woodward & Bernstein and leaked confidential US government information to the duo, as revenge against President Nixon for rejecting him as successor to the deceased FBI Director, J.Edgar Hoover, outed himself in 2005. “Deepthroat”, after a quarter century of hundreds of sleuths trying to divine, if he/she even existed, turned out to be none other than Deputy Director of the FBI, William Mark Felt, Sr. “Deepthroat” repeated advice to the Washington Post reporters was to “Follow the Money!”
They did. The rest is history.
If a ‘deep throat’ appears in Libya, Qatar of elsewhere, and offering advice to reporters who appear in Benghazi and Misrata in order to dig into what really happened, it might be that he will counsel: “Follow the weapons”.
Eyewitness Hassan Diab is a Libyan researcher who has been working with a group of American and International lawyers preparing a case against NATO to be filed with the International Criminal Court. Hassan and three of his friends actually saw the ship Lutfallah II being loaded in Benghazi, Libya. Hassan claims that it is well known at the docks that Qatar and Saudi Arabia control a total of five warehouses in the area of Benghazi & Misrata and supplied the weapons and money to hire the Lutfallah II container vessel.
Libyans in the area are reporting that the intercepted arms are from both Gadaffi stockpiles left over from NATO’s Libya campaign and some from the Qatar-Saudi six month weapons pipelines into Libya. When NATO declared a cessation of its bombing on Halloween night, October 31, 2011 the scramble for weapons began and Qatar stored and purchased whatever weapons came to its notice and from various militias who were willing to do business.
Libyans and foreign dock workers at Benghazi Port, who observed the Lutfallah II being loaded, saw three containers filled with 150 tons of weapons put on board, although the initial plan, according to the owner of the boat was to ship as many as 15 containers. It is estimated that they would have carried more than 2000 tons of weapons.
A Lebanese judicial source, who is a sitting judge based at Beirut’s La Maison des Avocates and advises the Lebanese government on procedural rules that ought to be followed in this case, confirmed to me and also to the Beirut Daily, As-Safir, that the Lutfallah II shipment was funded by two Syrian businessmen living in Saudi Arabia. In addition, the ship’s captain in Syria is the gentleman who claimed ownership of the shipment. All are affiliated with the Syrian opposition and all are seeking regime change in Syria.
According to a late breaking report, all have been arrested and remain in custody despite claims that they thought the cargo was general merchandise. Libya does not export anything much but its light crude oil and the Lutfallah II is clearly no oil tanker. Crew members of the container ship are facing trial on charges of illegal gun-running.
The owner reportedly told his interrogators, including Military Prosecutor Judge Saqr, that “It would be against Lebanese law and international maritime law for me to demand to examine the content of the containers.” Some international lawyers would argue that the law is exactly the opposite in both, and that international law establishes not just the owner’s right to inspect cargo being carried on his ships–for hazardous or contraband cargo etc– but that maritime law clearly mandates his responsibility to do so. Likewise, his insurance company.
Denials
The US-Saudi backed Future Movement was not involved in the arms shipment according to party official Mustafa Allouch. However, he later told Lebanon’s OTV that “The Syrian people have the right to find the appropriate means to defend themselves.” The Free Syrian Army has denied any links to the weapons-carrying vessel.
Hezbollah official Ammar Musawi praised the Lebanese army for its seizure of a Syria-bound illegal arms shipment and urged the authorities “to prevent Lebanon from turning into a conduit of destruction toward its neighbor”. “For the sake of Lebanon’s stability, I urge our authorities to exert greater effort to prevent Lebanon from turning into an arena through which the tools of crime cross into Syria, as the involvement of some Lebanese in fueling the situation in Syrian will have negative repercussions on Lebanon,” Hezbollah International Relations Director said.
On 5/2/12, Syria’s ambassador to Lebanon, Ali Abdel-Karim, following a meeting with Lebanese Foreign Minister Adnan Mansour, accused Gulf countries, including Qatar and Saudi Arabia, of being behind the Syria-bound arms shipments.

Many questions remain in need of answers. Any serious first year law student would ask the questions that presumably Lebanese investigating judges and the media will ask. A few of the more obvious ones would include:
Who funded the shipment discovered in the cargo bay of the Lutfallah II? Who had custody over the original 12 containers of what was planned, according to the jailed owner, as a shipment of over two million tons of “general merchandise”?
Who supplied the weapons and from which warehouse locations in Libya were they taken? Who controls the warehouses? Who made the decision to hold back 12 of the original contract and why? Where are the 12 containers? Who prepared the ships manifest? What was the involvement, if any, of the Syrian owner of the Lutfallah II? Why was the Lutfallah II not searched at the port of Alexandria as well as Turkey? It docked at both. Why was it given ‘green light passage’ by Israel and UNIFIL?
Eyewitnesses claim some activity on the Lutfallah II was evident while it was docked in Turkey? What was the activity? Which, if any, Lebanese politicians and political parties were involved. Who was to meet and take custody of the shipment once it arrived at the Tripoli, Lebanon dock?Which land routes into Syria were to be used following the offloading of the cargo at Tripoli Port?
It is not for this observer to offer advice to investigative journalists, whether free-lance or corporate, but as a fairly long-term US Congressional aid in the post-Watergate era who actually read the transcripts of US Senator Howard Baker’s Watergate Hearings, I would have thought that one or more might want to book a flight to Benghazi, Libya, toute de suite, with an inclination to: Follow the Money and follow the Weapons!

Time to Make Warrantless Home Video Surveillance Extinct

It seems that the government’s thirst for high tech surveillance can’t be quenched. First, came the NSA’s warrantless wiretap program. Then it was CISPA. Now, its warrantless video surveillance in the home. And just like we stood up against the NSA and CISPA, yesterday we told the Ninth Circuit Court of Appeals that invasive warrantless home video surveillance violates the Fourth Amendment.
Ricky Wahchumwah, a tribal member of the Yakima Nation, was suspected of selling bald and gold eagle feathers, as well as the feathers and pelts of other migratory birds, in violation of federal law. As part of its investigation, an undercover agent from the U.S. Fish and Wildlife Service went to Wahchumwah’s house, pretending to be interested in buying feathers and pelts. Wahchumwah let him in his house, not knowing that the agent was secretly recording everything with a tiny video camera hidden in his clothes. The agent proceeded to capture two hours of video of Wachumwah’s home, including interactions between Wachumwah and his partner and children, and was even left alone by Wachumwah for periods of time, who did not suspect he was being recorded.
Charged with violating the Bald and Golden Eagle Protection Act and the Lacey Act, Wahchumwah moved to suppress the video evidence as an unreasonable search under the Fourth Amendment. The trial judge denied his motion, ruling that since Wahchumwah let the agent into his house, and the agent could testify to everything he saw in the house, Wahchumwah had no expectation of privacy. Wahchumwah appealed this decision to the Ninth Circuit, and we filed an amicus brief supporting him.
As we explain in our brief, a video camera can capture far more detail than a human eye. And unlike the human mind, a video camera doesn’t forget. After all, if an officer’s observations were sufficient, there would be no need for the video camera in the first place. Building on the Supreme Court’s landmark decision in United States v. Jones, which ruled the Fourth Amendment prohibited the warrantless use of GPS surveillance to monitor a person’s car on public roads for 28 days, we make two main arguments.
First, the initial appellate opinion in Jones issued by the D.C. Circuit (at the time called United States v. Maynard) explained that although a person may reveal discrete parts of his movements when driving in public, “the whole of one’s movements over the course of a month is not actually exposed to the public because the likelihood anyone will observe all those movements is effectively nil.” While the Supreme Court affirmed the D.C. Circuit under a trespass theory instead, the D.C. Circuit’s astute point applies equally to video surveillance. Even if Wahchumwah permitted the undercover agent into his home, it would be extremely unlikely that Wahchumwah, or anyone else, would expect that his house guest was secretly video recording every little detail. And that meant even if Wahchumwah consented to the agent entering his house, he certainly did not consent to secret video surveillance.
Second, as Justice Sotomayor said in her concurring opinion in Jones, the fact that technology allows the government to cheaply and efficiently aggregate data in ways that were impractical in the past has the potential to “alter the relationship between citizen and government in a way that is inimical to democratic society.” While it is technically possible to follow someone for 28 days continuously, it is expensive and difficult. GPS technology now allows the government to track someone wherever they go and as long as they want, all from the comforts of the police station. A video camera does the same thing. Sure, its possible for someone to enter a house and write down everything they remembered seeing hours later when they leave the house. But a video camera is capable of aggregating an enormous amount of data that would be difficult for human senses to replicate. When a video camera secretly enters the home, it can capture things like the mail on your coffee table, the books on a shelf, or the pictures on your wall. And the whole point of a camera is to record and save for another day, allowing the government to not have to rely on the human mind’s tendency to forget. It can rewind again and again to examine every minute detail of the house.
In the past, such intensive video surveillance was reserved for serious, violent crimes. Today, its being used by Fish and Wildlife officers to investigate misdemeanors. A search warrant requirement strikes the right balance between the government’s need to investigate crime, and the public’s right to privacy — particularly in the home, the most private of all places. Hopefully, the Ninth Circuit will reverse the trial court, and eradicate this invasive warrantless surveillance once and for all.

South African telecom to face US sanctions over Iran, Syria operations

Africa’s largest mobile telecommunications company, the MTN Group, is reportedly in danger of being subjected to sanctions by the United States over its telecom activities in Iran and Syria.
According to a report published by the South Africa-based Mail and Guardian newspaper on April 30, US President Barack Obama issued an executive order last week that allowed American authorities for the first time to impose sanctions on individuals or entities providing technological services to Iran and Syria.
Under the order, the new sanctions would include a US visa ban and financial restrictions against agencies and individuals.
The South Africa-based MTN Group had announced in early March that it had no plans to abandon its operations in Iran despite facing difficulties over the US-led sanctions against Tehran.
“We are guided by [the] South African government policies internationally, in the same way US companies are prohibited from doing business in Iran. Unless the government says (otherwise), we will just have to manage,” the company’s boss Sifiso Dabengwa said.
The United States has already subjected to sanctions foreign entities that are in various forms of business with Iran.
On March 30, US President Barack Obama gave the green light for the previously-announced sanctions against foreign banks and other financial institutions by or through which Iran’s oil is purchased.

White House sets sights on evaders of Iran, Syria sanctions

President Obama is beefing up the administration’s sanctions on Iran and Syria, issuing an executive order targeting anyone who tries to skirt the crackdown.
The order, issued Tuesday, would allow the government to punish any individuals who either violate current sanctions against the two countries or help facilitate such an evasion by others.
Violators would be publicly outed by the government and effectively barred from entering the United States or participating in the U.S. financial system.
The order “provides Treasury additional means to impose serious consequences on foreign persons who seek to evade our sanctions and undermine international efforts to bring pressure to bear on the Iranian and Syrian regimes,” said David Cohen, the Treasury’s undersecretary for terrorism and financial intelligence. “Whoever tries to evade our sanctions does so at the expense of the people of Syria and Iran, and they will be held accountable.”
Once the Treasury identifies someone who is trying to avert the sanctions, anyone under U.S. jurisdiction would be prohibited from doing business with them. The Treasury said the new order helps ensure that Americans do not accidentally undercut the sanctions.
Obama notified Congress of the move in letters sent to the Speaker of the House and the President of the Senate.
The move marks the latest attempt by the White House to put pressure on the two nations. In February, another executive order levied new sanctions on Iran and its central bank.
Under that order, any Iranian assets held by U.S. citizens or companies were effectively frozen, and any transactions conducted by U.S. citizens with Iranian entities would be seized or frozen. … Full article
