US: Palestine Booted from NY Flag Display

teleSUR | December 14, 2015

A Palestinian flag has been removed from a street display in a town in New York State, after some residents expressed anti-Palestine sentiments.

A Palestine advocacy group condemned the removal Monday, saying it is part of a broader suppression of any recognition of Palestine.

The flag was removed from a major shopping corridor in Yonkers, NY earlier this month, after at least one public complaint. The flag was part of a display that included dozens of international flags, including the Israeli flag.

“At first glance, this incident is typical of the ‘Palestine exception to free speech.’ It exactly fits the pattern we’ve documented throughout the country,” Radhika Sainath, a staff attorney at Palestine Legal (PL) told teleSUR.

Palestine Legal provides legal aid to Palestine solidarity activists in the United States, and has warned of a growing campaign by pro-Israel groups to shut down discussion of Palestinian rights.

“When people express support for Palestine, or even acknowledge its existence, Israel advocates complain and our civic institutions are quick to respond by shutting down (free) speech,” Sainath said.

The flag was singled out by Yonkers residents who allegedly claimed Palestine is an enemy of the United States, according to one local reporter.

“Palestine is certainly not a friend of the United States,” columnist Eric Schoen told local news outlet lohud.com.

“A couple of people who brought it to my attention were quite upset,” Schoen said.

The business group that oversees the shopping corridor, the South Broadway Business Improvement District, has maintained the flag was taken down as it didn’t represent a sovereign state.

However, the corridor also boasts the flag of Puerto Rico, a U.S. territory.

Palestine Legal has argued the flag’s removal mirrors similar incidents nationwide.

“Earlier this year, Lincolnwood, Illinois canceled its annual diversity month over the inclusion of a Palestinian flag in the celebration,” Palestine Legal said in a statement to teleSUR.

As far back as 2013, another incident allegedly occurred at a Texas high school, when according to Palestine Legal, “School administrators told Palestinian student Malak Abdallahi she could not carry her flag during a during a traditional ceremony where students carry their nation’s flag.”

“She later won the right to carry the flag,” they noted.

Palestine Legal also recently published a report documenting what it concluded is a nationwide campaign to suppress Palestinian rights advocacy on university campuses.

In an interview with teleSUR ahead of the report’s release, Palestine Legal Director Dima Khalidi warned that Palestine solidarity activists can face “substantial” blowback from institutions and student groups for their advocacy.

“It can harm their reputation, it can harm their employment prospects, it can lead to bullying, racial attacks and even law enforcement scrutiny,” Khalidi said.

DONALD TRUMP IS ELECTABLE AS PRESIDENT, BUT…

By John Chuckman | Aletho News | December 15, 2015

I think it entirely possible Donald Trump could be elected President. I am not in favor of it – but then neither am I in favor of any of the other candidates on offer – yet I do think his election is increasingly possible. America displays every four years – almost like a temporary clothesline erected on the front lawn of the White House loaded with soiled and tattered undergarments – the sheer poverty of its political system. Every four years, a gang of mediocrities and thugs spend vast amounts of money to say, from coast to coast, nothing worth hearing.

Sometimes I wonder why anyone bothers to run for office in a long, costly, and exhausting contest which if won means four years of taking directions from the Pentagon and seventeen security agencies. America is not a democracy, and the last president who actually tried to exert some significant influence on affairs left much of the right side of his head in the streets of Dallas. But ego is a mighty powerful motivator, and the gang engaged in national American politics has plenty of it, even if few other redeeming qualities.

Trump could make Hillary Clinton regret she ever shared a stage to debate with him, especially a Hillary Clinton whose past has finally begun to catch up with her, now finally wounded by her long record of dark intrigues and vicious lies. Trump is no angel by comparison, but his focus has been on making money and aggrandizing his name, things most Americans respect. He has no political record for which to account or apologize.

He has said many things which make him sound like a juvenile given to insulting people’s appearances, and he has some proposals which would prove impossible for anyone to implement, yet somehow he has hit on some issues which find a welcome hearing by many, especially unsophisticated people who might even once have been Democratic voters. Americans are tired of unresponsive politicians, something of which they have stables full. They are also tired of the bewildering events in a world at the center of which invariably the United States finds itself. Most Americans never voted for such things and have no interest in them. Only dishonest appeals about supporting the troops keep them from rebelling, and their own increasingly difficult economic lives generate a lot of stress. America is full of frustrated and angry people, many of them not even sure what it is they are so angry about and many of whom have no time or patience to understand the world in which they live. Hard-hitting simplicities are music to the ears.

One of the sharpest ironies of Trump is that not all of his views are simplicities. Some are dead-on assessments of things which could have been avoided and leaders who failed the country. So this man comes bundled with a wide-ranging group of political goods, far more so than anyone I can recall in recent times. Just think of the simple-minded recitals of senior American politician after senior American politician. They all sound rather like Sarah Palin reciting her money-generated mantra but with differing levels of sophistication and vocabulary. She is the basic template while other models come with little tweaks and feature, but they all say nothing worth hearing. There is a very real reason for that: under America’s establishment-run, aristocratic political system, there is almost zero latitude for change either in domestic or foreign affairs, except in the field of war where more seems always welcome.

No matter what you think of Trump’s views – and the author should confess he is not an admirer of most of them – many people find it utterly refreshing to hear him touch subjects none of the usual Washington politicians touch. He goes far beyond the pathetic high-school recitation of lines by Sarah Palin. Or, I might add, the paid lies of men like Newt Gingrich and scores of others who will literally speak in absurdities in return for multi-million dollar campaign contributions. I only mention Newt because the last time he tried to campaign, he ran around the country saying there really was no such thing as a Palestinian, his quid pro quo for nearly twenty million dollars in funds from a man with claustrophobic ties to Israel.

Just think of the all the bland, say-nothing-worth-hearing types, epitomized by Jeb Bush who resembles nothing so much as a well-groomed hamster both in the sounds he makes and in his blinking-into-the-camera, insipid-smile looks. And think of all the grotesque liars who run for high office in America never telling people what really motivates or enables them or what special interests pay their way. It all really is a parody of democracy.

You might think a brash and independent-minded guy like Trump is just the answer to changing some of that, and I can well understand the hopes, but there are very powerful barriers in American society as it now has come to be organized against such hopes being realized. The first day of sitting at a huge polished conference table, greatly outnumbered by arrogant country-club security chiefs with secret budgets you cannot imagine and rigid generals whose uniforms glitter almost like Christmas trees, might just test the mettle of a Trump. Add to that the heads of great corporations each worth hundreds of billions of dollars making private appointments. And then the polished heads of mighty special interest lobby groups used to getting their way. And just who are your allies and confidants in opposing some of the things they demand? You have no political background from which you would have built such relations.

It’s a daunting and dreary picture, and you have to remember, these powerful people who compose the formidable American aristocracy are the very ones who allowed and encouraged the ugly situations into which America is straight-jacketed.

Despite Trump’s freshness and energy, a Trump victory could prove a disaster. Not because he would flirt with atomic war, something Obama now already does regularly, or create vast new domestic schemes. Of course, the scheme of building a fence across Mexico and rounding up and returning all illegal migrants is vast indeed – a virtual moon-landing project from scratch – but this author thinks it would fortunately prove impossible. Even if the American aristocracy permitted him to pursue such a Don Quixote project, it would only be in order to gain his compliance in other, far more important and consequential matters such as the vast, destabilizing, and murderous wars in the Middle East and the bullying of Russia and China.

On top of all that, Trump has made some deadly serious enemies, and number one on the list is Israel and its supporters who view him as not adequately friendly to Israel’s interests.

When Trump, for example, speaks, entirely sensibly, about leaving Syria for Putin to sort out, he goes dead against a dark and costly scheme which was in part created by Israel. They want Assad dead. They want Syria Balkanized much as Iraq is. And they are enjoying the stolen, discount-priced oil they get indirectly from ISIS through Turkey.

And they don’t want Russia gaining genuine influence in the Mideast, the United States being Israel’s source of seemingly inexhaustible assistance, permission, and protection – the provider of vast subsidies of every kind imaginable. Moreover, Netanyahu and other leaders in Israel have long striven to have Israel assume a geopolitical role in the Mideast as a kind of miniature replica of what the United States is in the world, a bully hegemon. There’s no room in that picture for Russia.

If you read the kind of columnists who regularly serve as apologists for Israel’s brutality – there’s at least one filling that role on the staff of every mainline newspaper – you find a universally negative attitude towards Trump. It has nothing to do with conservatism versus liberalism, and it certainly has nothing to do with human rights. The columnists use words about human rights to make their view more palatable to the general population of readers and to serve as a smokescreen for what it is with which they are really defending.

After all, Israel’s Netanyahu is perhaps the world’s most flagrant violator of human rights, holding about five million people completely against their will with absolutely no rights or freedoms, periodically stealing their homes and land, violating the sanctity of their religious places, and frequently just killing large batches of them – always undoubtedly with an eye to making them so miserable that they will pick up and leave. The people of Gaza are not even allowed to import cement to repair Israel’s recent destruction of their homes and institutions. I simply do not know of crueler circumstances in the world completely tolerated by America’s aristocracy.

There have been several ugly outbursts recently, including one from an executive of Colorado’s American Civil Liberties Union who was yelling about assassinating Trump voters, words I just could not believe when I first read them.

But then in past years we have had extremist defenders of Israel propose many horrible measures including one from an American lawyer who proposed summarily killing the entire families of any Palestinian acting as a “terrorist,” so the raving speech is not without precedent. The executive’s words communicate the intense level of hate which simmers. I am sure this disturbed man – since forced to quit – is not the only one with such thoughts bubbling like sewerage through his mind.

Always admirers of political hamsters and gerbils as candidates with dark eminences behind them doing the necessary filth, the Bush-Cheney model if you will, or indeed the Eisenhower-Dulles or Reagan-Casey one – the Republicans will make every effort to stop Trump with backstage political manipulations, such as a brokered convention, but they may well not succeed, his position being made quite strong by the possibility of his running as a third-party candidate, and one with huge financial resources to boot.

But if they fail, and he wins, look out for the darkest possibilities.

All this is quite terrible, but that is simply what America is today, terrible.

Attack on Freedom: Activists to Take Spain to ECHR Over ‘Gag Law’

Sputnik – 14.12.2015

A group of lawyers and journalists are taking Spain to the European Court of Human Rights (ECHR) over the country’s controversial “gag law,” which activists say is an attack on freedom of speech and information rights.

The coalition of activists, known as ‘Defender a quien defiende’ (DqD) launched a triple lawsuit with the ECHR, calling for the immediate repeal of the law.

The highly controversial Citizen Security Law, dubbed the ‘gag law’ by critics, was passed by the governing Popular Party (PP) earlier this year and came into action in July, despite widespread protests and demonstrations.

DqD has labeled the law “authoritarian,” with critics arguing that it restricts the right to legitimate protest and allows authorities to harshly crack down on any form of anti-government demonstration.

Under the law, the vague description of “disrespecting a police officer” can attract a fine of US$662 (€600), while those guilty of staging an “unauthorized protest” can be hit with financial penalties as high as US$662,000 (€600,000).

Many photojournalists have taken aim at the law, which also makes it illegal to photograph a police officer, with many arguing that it severely affects their ability to do their job.

DqD argues that such provisions “violate” basic freedoms, expressions and the right to protest, in turn restricting journalists and photojournalists from subsequently sharing certain pieces of information with the public.

“They are particularly affected since the law jeopardizes their main function: to report on events of public relevance,” the lawsuit states.

Photojournalists are “obliged by police to stop filming or photographing police actions for fear of being penalized,” the lawsuit says, amid fears that it may allow instances of police misconduct to go undocumented and unreported.

The law has already attracted controversy since it came into effect in July after a man was fined US$662 (€600) for calling police “slackers” on social media.

In another controversial instance a woman was fined US$883 (€800) for taking a photo of a police car parked illegally in a disabled zone, however the fine was later scrapped.

The timing of the ECHR lawsuit, which is to be officially launched with a press conference on Tuesday, comes at a critical time for the ruling controversial Popular Party (PP) ahead of the country’s December 20 election.

All three major opposition parties have vowed to scrap the highly unpopular law if they win power, with some analysts saying the controversy around the matter could influence swing voters who remain undecided on who to vote for in the national election.

ISM calls for internationals to volunteer in Palestine

International Solidarity Movement | December 14, 2015

Occupied Palestine – Today, Palestinians are facing an enormous amount of pressure in their lives due to the growing violence of Israeli forces. Israeli politicians have fueled the motivation to kill Palestinians by making open statements encouraging Israeli citizens to become executioners.

Since the beginning of October, Israeli occupation forces have started to exceed their abuse of power by carrying out a series of extrajudicial killings of Palestinians, in a manner that is completely unjustified and, in most cases, constituting crimes of war.

In addition, Israeli forces are applying measures of collective punishment towards the families of Palestinians who are killed in this unlawful manner. In many cases, the army does not return their bodies to their families, preventing them from carrying out their funerals. Furthermore, Israel has been demolishing the houses of these families, leaving many people homeless.

When you come to Palestine, there are many things you can do.

In Al-Khalil (Hebron), we need volunteers to continue walking children to school and monitor the three checkpoints were the children cross two times a day, on their way to school and back home. Our presence there is crucial because we witness and document what we see and can show the world what is happening on the ground. We do our best to prevent Palestinians from being harassed, and more importantly, to show them we are there in solidarity with them.

ISMwork2-600x411

One of our volunteers walks a group of children to school in al-Khalil

In Jerusalem, you will document human rights violations and report them in the media. You will be present in checkpoints such as Qalandya, the Shufat Refugee Camp, and nearby villages. You will monitor violence from settlers and police in the old city during the day, and the monthly settler march were settlers roam in the streets of the old city at night. During these marches, Palestinians are forced to close their shops and face the danger of being attacked.

In the area of Jerusalem, you will also monitor schools and hospitals. In addition, there are many child arrests that need to be covered in the media, where you will visit the families and write their stories. In Jerusalem there are also many home demolitions and evacuations that you will need to document and report in the media.

In Tulkarem, which has recently seen regular violent attacks from the Israeli army towards university students inside the campus while they are studying and attending exams, we need volunteers on the ground to continue documenting these crimes of war and create awareness on the situation. Furthermore, in Tulkarem, the army is threatening to permanently close gate 623 that gives access to farmers to their land, in other words, to their sustenance for living. This gate needs international human rights defenders to monitor on a daily basis from 7:00 to 8:00 in the morning.

In Nablus, several houses have been demolished since October. We need to continue being present and reporting on these human rights violations when they arise. You will visit the families who suffer from being left homeless, and write their stories.

In the city of Ramallah we receive calls from prisoners’ families to attend military court hearings, in the Ofer military prison. We believe that being present in these hearings can put pressure on the Israeli authorities and decrease their abuse of power when giving sentences to Palestinian political prisoners.

Moreover, all throughout the West Bank, in cities and villages, the popular committees organize regular demonstrations were the ISM is called to participate.

As ISM is a Palestinian led movement all our actions are initiated on invitations from or initiative of Palestinians following their lead and wishes.

When you come to Palestine, try to bring your computer with you and a camera, as you will need it for the media work. To plan your trip to the West Bank, please read our traveling information.

We ask our volunteers to commit for a minimum of two weeks after completing our two day training, but keep in mind that we always prefer to have volunteers stay for longer periods of time.

When you decide to come to Palestine to join us, or if you have any further questions, please write us to palreports@gmail.com.

In solidarity,
ISM Team

Extend draft registration to women — or end it?

By Edward Hasbrouck | The Practical Nomad | December 11, 2015

Congress will soon have to choose whether to amend the Military Selective Service Act to extend draft registration to women, to end all draft registration, or to allow registration to end by court order.

When the Supreme Court upheld the current males-only draft registration in 1981, it based its decision on the ineligibility of women, at that time, for combat assignments, and on the “deference” of the courts to Congress and the President in such military matters. The factual predicate to that decision has now changed, with the announcement last week that women in the military will be eligible for all combat jobs.

On Tuesday of this week, by scheduling coincidence, the 9th Circuit Court of Appeals heard oral argument (which had been scheduled for that date months earlier) in one of several lawsuits challenging the Constitutionality of males-only draft registration that were filed two years ago when the military first began opening combat assignments to women.

From watching the oral argument, it seems likely that the Court of Appeals will send this case back to the U.S. District Court in Los Angeles for consideration of whether males-only draft registration is still Constitutional.

The complaint was dismissed by the a U.S. District Court judge in Los Angeles who found that (1) the controversy was not yet “ripe” for decision and (2) the plaintiff’s lacked standing to complain.

On “ripeness”, it seems clear from the oral argument that the 9th Circuit judges think that if the case wasn’t ripe when it was dismissed in 2013, it is now in light of the latest changes to military policy. There would be no point to upholding the dismissal of the original complaint, when an identical new complaint could immediately be refiled, and would be ripe for decision.

On standing, the issue is that none of the plaintiffs in this case are men who can claim that they are being harmed because they didn’t register. There are a named plaintiff, who says he registered, and an organizational plaintiff. But the plaintiffs argued that they have as much basis to claim standing as the plaintiffs in the case the Supreme Court decided in 1981, who were similarly situated. In addition, plaintiffs’ counsel argued very persuasively that the continuing obligation to provide notice of address changes is a continuing harm that gives registrants continuing standing to challenge that registration requirement.

If I’ve read the tea leaves correctly, this means that in a matter of weeks or months — probably before but possibly not until after the November elections — the 9th Circuit will overturn the dismissal of the complaint, and remand this case to the U.S. District Court. The next step after that would be a status conference in Los Angeles to schedule further proceedings (discovery, briefing, etc.) on the merits of the reinstated complaint.

Some other lawsuit might make it to a decision sooner. But once a court looks at one of these cases on the merits, the outcome seems a foregone conclusion, as the Pentagon’s own analysis released last week suggests. It’s highly likely that a court ruling in this or another case will, sooner rather than later, force Congress to choose whether to extend draft registration to women, or to let a court decision ending registration stand.

Under current law, courts can’t order women to register. So if a Federal court finds that males-only registration is illegally discriminatory, registration will have to end unless Congress amends the law to extend the registration requirement to women.

Last Sunday, the New York Times dismissed this issue, editorializing that Congress could “easily” change the law to require young women, as well as young men, to register.

But it’s not so simple as all that. It won’t be enough just to change the law. Draft registration is not self-implementing. Extending registration to women will also require getting women to comply with the law, and enforcing the law if women don’t comply voluntarily.

Thirty-five years of failure by the government to get young men to comply with the draft registration law, and the complete abandonment of any attempt to enforce that law more than 25 years ago, suggest that getting young women to register for a draft is likely to be much more difficult than the Times’ editorial board has realized.

As some of my readers know, although it’s not my most frequent topic in this blog, I spent most of the 1980s, starting just about the time I left the University of Chicago, as an organizer with the National Resistance Committee and an editor of its newspaper, Resistance News.

When draft registration was reinstated in 1980 after a five-year hiatus, our most optimistic prediction was that half a million men in the first age cohorts required to register might not sign up. A month after the initial mass registration period, the first independent analysis of registration data revealed that more than a million of these young men had not heeded the call to register. [“Million Snub Draft”, Boston Globe, August 27, 1980, page 1; the original banner headline in the Globe was apparently added in page makeup and is missing from the wire service versions and the fragment of the article in the Globe’s digital archive.]

Desperate to scare up enough registrations to “maintain the credibility of the system”, as one internal Justice Department memo put it, the government eventually decided to try to intimidate the mass of nonregistrants through “well-publicized prosecutions” of a few of those they considered the “most vocal” resisters. As one of twenty nonregistrants who were singled out for indictment in 1982-1986, I was convicted and spent four and a half months in a Federal Prison Camp in 1983-1984.

(I was prosecuted by Robert Mueller, then a junior Assistant U.S. Attorney in Boston and later the Director of the FBI. My case was Mueller’s first high-profile trial, and my head was a significant early stepping stone in his political climb. Mueller’s boss, then U.S. Attorney and later Governor William F. Weld, also attended my trial — annoying my mother by sitting next to her — to observe Mueller’s performance in court.)

But despite convictions and prison sentences, these show trials backfired and were quickly abandoned. They called attention to the resistance to draft registration, made clear that there was safety in numbers, and showed that the government could prove the “willfulness” of only those nonregistrants who made public statements (which were essential to the cases against us in court) acknowledging that we knew we were supposed to register.

Nobody has been prosecuted for refusing to register since 1986. But the government has never been able to find a face-saving way to end registration and shut down the Selective Service System without admitting that its scare tactics failed, or dealing with the implications of young people’s insistence on making their own choices about which wars they are willing to fight.

Today, many young people register only because of laws that link draft registration to drivers licensing in some states, and to eligibility for student aid. The resistance by many states to implementing the Federal “REAL-ID Act” (which I discussed in this presentation at the Cato Institute earlier this year), and the repeated failures, including once again this year, of proposals to link drivers’ licenses to draft registration in the most populous state, California, suggest some of the limitations of this carrot-and-stick approach.

(Today, as I’ve discussed elsewhere, nonregistration is most concentrated among those poor young men of color who see little hope of going to college even with the limited available government aid, and especially among undocumented young men who are categorically ineligible for the government programs linked to draft registration, but who are still required to register.)

Many of the people who registered under these financial pressures would resist if actually drafted, and many of these nominal registrations have been effectively invalidated by unreported address changes, even though they are counted in Selective Service “compliance” statistics.

President Obama, who was in the first age group required to register, has said that he registered for the draft. But he hasn’t commented on whether he informed the Selective Service System every time he changed addresses until his 26th birthday, as is required by the law and as is essential for registration records to be of any use in the event of a draft. Few people did so in the 1980s, or do so now. The only audit of Selective Service address records, in 1982, found that 20-40% of the addresses on file with the SSS for registrants in the age groups that would be drafted first were already outdated, and up to 75% for those registrants in their last year of potential eligibility to be drafted.

Many, perhaps most, induction notices sent to current registrants would wind up in the dead-letter office. Without being able to prove that anyone knew they were supposed to tell the Selective Service System when they moved, it’s impossible to enforce the change-of-address notification requirement.

Is there any reason to think that young women would be more willing to sign up to be drafted than young men have been? I doubt it. When President Carter announced his proposal to reinstate draft registration in his State of the Union address in 1980, some of the strongest initial grassroots opposition came from women. Many women remained active in the resistance even after the bill approved by Congress was narrowed to require only men to register, though the press tended to focus on male resisters.

Women have been among those health care workers most concerned about Selective Service preparations for for a draft of doctors, nurses, and many other medical professionals, which would include women but would be based on professional licensing lists rather than on self-registration of potential draftees.

Women share many of men’s reasons not to register, and have other reasons of their own. There are both feminist and sexist arguments against subjecting women to the draft and draft registration.

Are the government’s arguments for why young women (or men) should register for the draft, and promise to fight for or against whomever they are told, any more persuasive today than ever? I don’t think so.

Draft registration was reinstated in 1980 in response to the Soviet invasion of Afghanistan, to prepare for U.S. intervention in support of the fighters who were then called the “mujahideen” and who would later christen themselves the Taliban and Al Qaeda. That the U.S. government put me in prison for refusing to agree to fight on the side of the Taliban doesn’t say much for its judgment of which wars to intervene in, or on which side. Today, people of all ages and genders question why the U.S. is supporting the fundamentalist (and supremely sexist) monarchy in Saudi Arabia, or the dictatorship in Yemen, among others.

Congress should have no illusions. Extending draft registration to women will provoke at least as much resistance as did draft registration for men in 1980. It will force the government, once again, to choose whether to turn the country into a police state to round up all those who fail to register on demand, or to try (probably unsuccessfully) to terrorize them into compliance through show trials and incarceration of a few of the people seen as “leaders” of the resistance.

Regardless of whether Congress or the President think that young women “should” be ready to be drafted, the only realistic choice for Congress is not to extend draft registration to women, but to end it for all.

That’s not likely to be part of the terms of debate, however, unless opponents of draft resistance — including young women who won’t register voluntarily, and older people who support them — make it an issue.

In 1981, the decision of whether to continue — and whether to enforce — the draft registration program that had been reinstated during the Carter administration was a “wedge issue” that divided hawks from libertarians within the Reagan administration and its supporters.

One of my friends and colleagues in the National Resistance Committee, Alex Reyes, has written about how awareness of plans for demonstrations in support of draft registration resistance precipitated this internal debate, and of how close it came to ending draft registration.

Today, whether to extend draft registration to women or end it entirely is likely to be a similar wedge issue dividing Democrats, Republicans, and military personnel. Will sexist warmongers support subjecting young women to the draft, or depriving the military of its “Plan B” for manpower by ending draft registration entirely? Will supporters of President Obama, or of a future President Hillary Clinton, see subjecting women to the draft as a step towards gender equity, or a step towards more of the gendered violence of war? And if they see it as both, how will they vote?

But there’s more at stake than the opportunity for partisan politicians to embarrass their opponents, and it will be up to draft registration resisters and supporters to make that point.

Draft registration of men has been a fiasco for the government since its resumption in 1980. The likelihood and imminence of a court ruling that males-only draft registration is now unconstitutional provides the perfect opportunity for Congress to end draft registration entirely.

Five Palestinian teens blackmailed into accepting 15 years prison term and exorbitant ‘fines’ for a crime that never happened

Hares-boys-600x240

The Hares Boys campaign | December 13, 2015

Hares, Salfit – It is with great sadness and anger that we hereby inform you of the outcome of the Hares Boys case: the five teenagers are being sentenced to 15 years in prison and are to pay a total of NIS 150,000 (~US $39,000 or €35,000) to the Israeli authorities. Failure to provide the exorbitant sum would, it is implied, result in more years of prison added to the boys’ sentences.

Ali Shamlawi, Mohammed Kleib, Mohammed Suleiman, Ammar Souf, and Tamer Souf have been kept in prison for 2 years and 8 months and are now being sentenced for a crime that never happened. The five teenagers (16-17 years old at the time) from the village of Hares (Salfit governorate, West Bank, occupied Palestine) were kidnapped from their homes by the Israeli army in March 2013. The teens were accused of throwing stones at illegal settler cars, one of which drove under a truck that was parked along Route 5 near the village of Hares. The driver’s children were injured during the accident and one of them died two years later after pneumonia complications. The boys denied throwing stones but were forced to sign ‘confessions’ following torturous interrogations at the hands of Israeli secret services. There was never any evidence of the boys’ guilt but it is sadly a reality in the Israeli military court system that does not comply with due process and convicts Palestinians at a 99.7% rate.

After almost 3 years of routine hearings at Israeli military courts, where the boys were initially accused of ‘attempted murder’, they were told on 26 November 2015 that they are now being charged with manslaughter and are being sentenced to prison terms of 15 years, provided their families pay ‘fines’ of NIS 30,000 [US $7,750 or € 7,100] each by the deadline of 28 January 2016. Failure to pay the amount requested by the Israeli military court would, it is understood, result in each boy’s sentence being prolonged, possibly to at least 25 years in prison.

There is no other way to describe this situation the five teens and their families have endured other than as criminal activity on behalf of the Israeli system of ‘justice’. Pressing the families to agree to a court ‘deal’ and threatening them with harsher sentences if they don’t accept is nothing less than extortion. Demanding that families pay large sums of money as a ‘fine’ or a ‘compensation’ to the occupying power is nothing less than a demand for ransom.

On behalf of the Free the Hares Boys campaign we condemn such acts of injustice committed by the Israeli military court.

We invite local and international human rights organizations, the world’s democratic government institutions and people of conscience to stand up to this injustice inflicted on the Palestinian people by the Israeli occupation and to demand justice for the Hares Boys. Please consider contacting your country’s diplomatic representatives in Tel Aviv or occupied Jerusalem; the Israeli Ministry of Justice; your local politicians; asking them to intervene and condemn such injustice and disrespect for the rule of law. Rights group urges end to Dutch sale of ‘attack dogs’ to Israel

Ma’an -December 13, 2015

BETHLEHEM – A Palestinian animal rights group has called on the international community to pressure the Dutch government to halt the sale of “attack dogs” to Israel.

168027_345x230Said Ahmad Safi, Executive Director of the Palestinian Animal League, said in a statement that dogs exported by European countries — especially the Netherlands — have long been used by the Israeli military as “living, breathing weapons — leading to devastating injuries on many civilians.”

Palestinian human rights organization, Al Haq, has reportedly carried out attempts to sway the Dutch government to place a ban on the export of the dogs for such use.

“As a result of communication between Al Haq and the Dutch government, officials in the Netherlands have suggested that they will consider placing restrictions on the export of dogs to Israel, but no firm decision has been reached, nor has any action been taken to date,” PAL said in a statement.

The restrictions would join one of several placed by European countries on trade with Israel, the European Union most recently passing a decision to label products made in illegal Israeli settlements in the occupied West Bank.

Such measures are part of a boycott, divestment, and sanctions movement (BDS) pushed by activists and increasingly by politicians, in effort to place pressure on Israel to stop ongoing violations against Palestinians.

South Florida Deputy Indicted for Killing Man After Winning Award for Killing Same Man

By Carlos Miller| PINAC | December 11, 2015

A South Florida sheriff’s deputy who received an award for bravery after shooting and killing a man in 2013 was indicted for that same shooting Thursday.

Broward County sheriff’s deputy Peter Peraza was charged with manslaughter with a firearm, a first-degree felony that could land him in jail for 30 years.

But only because a photo emerged in May 2015 that showed Jermaine McBean was wearing headphones when he was shot and killed.Prior to that photo surfacing, Broward sheriff investigators claimed that McBean had his headphones in his pocket.

They also claimed that McBean had swung the gun around, making the deputies fear for their lives.

But the gun was an unloaded pellet gun he had just purchased at a pawn shop.

Not only did the photo prove the sheriff’s office to be lying, it provided evidence that perhaps McBean did not hear Peraza yelling at him to drop the gun.

In fact, even the man who called deputies on McBean, reporting a man walking down the street with a rifle slung over his shoulder, said McBean never pointed the gun at the deputies.

The photo did not surface for almost two years because the woman who took it feared retaliation.

According to an NBC News article from May:

But a newly emerged photo that shows headphones in McBean’s ears immediately after the 2013 shooting raises questions about the police version of events, including why the white earbuds were later found stuffed in the dead computer expert’s pocket.

And another aspect of the police account is also being contradicted — by a man who called 911 in alarm when he saw McBean walking around with the air rifle but who also says McBean never pointed it at police or anyone else.

Michael Russell McCarthy, 58, told NBC News that McBean had the Winchester Model 1000 Air Rifle balanced on his shoulders behind his neck, with his hand over both ends, and was turning around to face police when one officer began shooting.

“He [McBean] couldn’t have fired that gun from the position he was in. There was no possible way of firing it and at the same time hitting something,” McCarthy said. “I kind of blame myself, because if I hadn’t called it might not have happened.”

McBean was a 33-year-old computer engineer who had a masters degree in computer science. His LinkedIn page indicates a man who is serious about his career. He also had marijuana in his system as they always like to point out.

But the case seemed to have been forgotten about but a grand jury began looking at the evidence last week, more than two years after the July 31, 2013 shooting, determining on Thursday that there was enough evidence to charge Peraza.

The indictment marks the first time since 1980 that a Broward deputy was charged for an on-duty killing.

According to today’s NBC News article:

In videotaped statements to investigators, Peraza said he fired because he feared for his life.

“I’m outraged,” Peraza’s lawyer, Eric Schwartzreich, said of the indictment. “This was a justified shooting.”

Schwartzreich said his client was responding to 911 calls of a man with a gun and the air rifle McBean carried “looked very real.” He insisted McBean pointed it at the officer and that Peraza “was simply protecting what he perceived to be a threat.’

The lawyer suggested that anger over police shootings around the country led prosecutors to “steer this into the lion’s den” and said the charges against Peraza “could have a chilling effect on law enforcement officers anywhere.”

“My client should never have been indicted,” he said.

The sheriff’s department gave bravery awards to two of the officers involved in the shooting — including the deputy who fired the fatal shots — while the incident was still under investigation. The sheriff later told NBC News that was a mistake.

Like so many police reports we have seen over the years, the letter announcing the departmental award to Peraza completely overdramatized the situation, claiming that Peraza was only trying to protect himself and children who were in the area.

But as we’ve seen so many times over the years, it appears as if he didn’t want to lose his chance at being able to kill another human being.

And as we’ve seen so many times over the years, departmental awards handed out to officers are nothing more than a cheap motivational tool, if not an outright attempt to coverup a murder.

Chicago’s Embattled Mayor

By Stephen Lendman | The People’s Voice | December 13, 2015

Career Democrat party member, former congressman, Obama White House chief of staff, Chicago mayor Rahm Emanuel took office in May 2011 – reelected last April for another four-year term.

He’s notoriously hard-line, neoliberal and pro-Israeli to a fault. The late Chicago-based Citizens Committee to Clean up the Courts chairman Sherman Skolnick called him the “acting deputy chief for North America of Mossad.”

His father, Benjamin, was involved in smuggling weapons to the Jewish Irgun underground terrorist group (co-led by future Israeli prime minister Menachem Begin) in Palestine pre-1948.

Their elements were notoriously involved in bombing Jerusalem’s King David Hotel (July 1946 – slaughtering 92 Brits, Arabs and Jews, along with wounding 58 others), as well as the horrific Deir Yassin massacre (April 1948), randomly killing up to 120 defenseless Palestinians mercilessly, including women and children, dozens more in continued fighting – part of the future state of Israel’s genocidal ethnic cleansing master plan.

Emmanuel is a former civilian IDF volunteer during the 1991 Gulf War. It’s believed he holds dual citizenships – a dubious status for any US politician.

Throughout his political career, he’s been unabashedly pro-war, neoliberal and anti-populist. His abrasive style alienates him from anyone opposing his hard-line views.

Chicago notoriously earned a reputation as the police repression capital of America. A Gitmo type operation on the city’s west side is Exhibit A – operating off-the-books in a nondescript Homan Square warehouse, the domestic equivalent of a CIA or Pentagon black site.

Mostly Blacks are lawlessly arrested, detained, painfully shackled, interrogated, terrorized and beaten without access to counsel for a day or longer – to coerce confessions to offenses never committed or ones too minor to matter.

City police have virtual carte blanche authority to operate with impunity. Responsibility goes right to the top – Emanuel complicit with what goes on, likely much more illegally than now known, including cops killing Chicagoans unaccountably.

In late November, a seven-minute video surfaced, showing officer Jason Van Dyke extrajudicially executing 17-year-old Lanquan McDonald – guilty of being Black, threatening no one, innocent of any crime.

Van Dyke lawlessly shot him 16 times, twice in the back first, mostly as he lay dying. The incident occurred on October 20, 2014. Coverup and denial followed, police authorities calling cold-blooded murder justifiable self-defense.

Emanuel and other city officials lost a 13-month Freedom of Information Act (FOIA) lawsuit battle to prevent release of the video. It’s damning.

A knife planted on McDonald’s body was exposed as a Big Lie. Video evidence showed him moving away from Van Dyke unarmed when gunned down from behind in cold blood.

Chicagoans are justifiably outraged. Thousands have been protesting outside City Hall for days, calling for Emanuel’s resignation, along with complicit city and police officials.

Police chief Garry McCarthy was sacked. So was chief of detectives Dean Andrews. Protesters want Cook County State’s Attorney Anita Alvarez removed for complicity in months of coverup.

Emanuel’s administration is a cesspool of corruption and other forms of lawlessness, perhaps the worst in city history – ill-serving the vast majority of Chicagoans.

On Thursday, state Rep. La Shawn Ford said “(p)eople are (being) hurt. People have died. People feel they are forgotten about in” a city serving powerful monied interests exclusively.

He introduced legislation to amend state law, authorizing a recall election, letting Chicagoans decide up or down if Emanuel should stay or go.

On Thursday, city medical students staged a silent “die-in” outside City Hall for 16 minutes – symbolizing 16 bullets Van Dyke fired into McDonald’s body.

They lay supine, at least one holding a sign saying: “DO NO HARM.” A much larger “die-in” protest occurred Thursday evening.

Some critics called for abolishing the so-called Independent Police Review Authority (IPRA) – notorious for covering up cop killings. A criminal code of silence prevails.

Almost never are officers responsible for killing civilians held accountable. Even the right-wing Chicago Tribune said “it’s common knowledge that Chicago’s system of investigating shootings by officers is flawed…at so many levels…by design…”

Critics want a new independent, citizen-controlled police audit authority established, empowered to sue the city administration and police so killer cops and their superiors up the chain of command to the top can be held accountable for crimes too serious to ignore.

An Illinois Better Government Association study, covering the period 2010 – 2014, called Chicago tops among America’s largest cities in fatal shootings by police, most often targeting defenseless Black males.

Rarely do incidents make headlines. Video evidence showing officer Van Dyke murdering McDonald in cold blood is a rare exception – whether enough to convict him another issue altogether.

Almost never are cops prosecuted imprisoned, especially in cases involving extrajudicial assassinations. Emanuel’s hollow apology for McDonald’s murder and duplicitous promised “complete and total reform of the system” fooled no one.

Protesters outside City Hall chanted “no more killer cops” and “Rahm must go.” Chance for real reform by his or any other city administration is virtually zero.

Last of Chicago’s saloon keeper aldermen, Paddy Bowler, was right, saying: “Chicago ain’t ready for reform” – for sure not with Emanuel as mayor.

We’re all terrorists now

By Sam Gerrans | RT | December 12, 2015

The concept of terrorism has been extended from carrying out physical acts in which innocent people are killed, to wrong opinions, sweaty palms and disagreement with government. If you want to find a terrorist, soon all you will have to do is look in the mirror.

Words are political. They change shape to suite agendas.

In the 1970s, ‘terrorist’ meant a paid-up member of the IRA, the Irgun, ETA and the like. These were bad people perpetrating evil and indiscriminate deeds upon a defenceless public. They used bombs, worked in cells, and killed people without warning before fading into the shadows.

Although the UK had legislation specifically geared to deal with what is called terrorism on the books, people deemed terrorists, when they were caught, were prosecuted under existing laws – i.e. for actual crimes they had committed.

Bobby Sands, for example, who fought and died for the IRA cause, was incarcerated for nothing more sinister than owning illegal firearms.

Since 9/11 and the implementation of the so-called Patriot Act (and equivalent legislation in other countries), the definition of terrorism is itself becoming a source of terror.

As part of this process, we are being taught to live with the new nomenclature of ‘terror suspect’; that is you haven’t done anything wrong, but you might.

The Independent reports that: “315 terror suspects were arrested between September 2014 and September 2015, according to new figures from the Home Office.”

The same article continues: “[…] it seems what we are seeing is an increase in terrorism-related fear rather than terrorism itself – totally understandable of course in itself, but not when it leads to the kind of heavy-handed policing that can actually radicalize more people.”

Read another way: the British Government is harassing increasing numbers of innocent people and generating both fear and the chance of more ‘radicalization’ thereby.

The no-fly list

The Huffington Post reports that one can be identified and placed on a ‘no-fly list’ for any number of reasons.

It tells us: “government officials have secretly characterized an unknown number of individuals as threats or potential threats to national security. In 2013 alone, 468,749 watch-list nominations were submitted to the National Counterterrorism Center. It rejected only one percent of the recommendations.”

This is nearly half-a-million US citizens in one year; this means they are finding almost 1,400 new American enemies a day.

The article goes on to list seven criteria government agencies use to put a person on a list. These criteria are vague and admit to the broadest and most subjective interpretation; in short they break down to: we don’t like the cut of your jib.

Yes, some life-failed bureaucrat you will never meet can decide – extra judicially – that you may not travel on an aeroplane.

The no-gun list

If there is to be no due process, why stop there?

Obama certainly agrees. The Guardian tells us: “Closing the No-Fly List loophole is a no-brainer,” Barack Obama tweeted on Tuesday, arguing that Congress should pass laws to prevent anyone on the government’s terrorist watch list from buying a gun.”

I see: the president calmly tweets that revoking the Constitution he swore to uphold is a “no brainer,” and we can all go about our business.

Terrorist events

Since Obama is so concerned with guns, he might want to do something about all the smoking guns that feature so prominently in the so-called terrorist attacks on US soil.

RT’s Marina Portnaya did a piece on the release of a report, which identifies the FBI as the mastermind of 95 percent of all domestic terrorism in the US.

Judge Andrew Napolitano, senior judicial analyst for Fox News, concurs. He tells us that of the 20 terrorist attacks the FBI claims to have foiled on US soil, three were thwarted by members of the public and the remaining 17 were masterminded and carried out by the FBI itself.

Who is a terrorist?

The so-called War on Terror is worldwide.

For its part, the French government is educating its population to spot a terrorist.

The Independent gives us these bonmots: “The French government has launched a campaign which appears to warn parents that their children may have been recruited by terrorists if they stop eating baguettes.”

Other tell-tale signs of nascent radicalism include deciding not to watch television.

US airport security staff operate on a much more scientific basis. The Telegraph reports on a leaked document revealing: “Excessive yawning, strong body odour and arrogance are among the suspicious signs that US airport staff are trained to associate with potential terrorists.”

Excessive yawning? Remember that if find yourself on a stopover in a US airport on a long-haul flight.

Other warning signs include: “protruding or throbbing neck arteries, whistling, excessive laughter, and verbally expressing contempt for the screening process.”

The full list of 17 ‘fear factors’ staff are trained to spot include: arriving late for a flight, sweaty palms, and a pale face indicating the recent shaving of a beard.

More government

Naturally, the only rational response to this exploding bomb of suspicion is more government. Was there ever any doubt?

The UK government’s website tells you exactly what to do in the event of a terrorist attack: Step 1: run. Step 2: Hide. Step 3: Tell the authorities. Step 4: Wait for armed police to arrive (and keep your hands where they can see them). Step 5: Be ready for those authorities to point guns at you and treat you ‘firmly’ (i.e. brutalize you).

No mention of repealing UK gun laws so that British adults can defend themselves, of course.

Imagine what would happen to any real terrorist threat in Britain if one in three Britons carried a handgun.

No. What we need is more government; more intrusion by the very agencies that not only benefit from the events they pretend to protect us from (and use said events to take away our rights), but which – according to all objective analysis – are also central in bringing those events to pass.

So terrorism has morphed from real actions which killed people – the destruction of the King David Hotel by the Irgun or the Iranian Embassy siege – to intuitions about people, sweaty palms and the non-eating of French bread.

The simple definition for such a subjective and arbitrary application of power is this: tyranny.

Why stop there?

Since there is no place for principle or due process in this new tyranny, insanity must follow.

Under such a regime things just are because someone – in this case an opinion-leader – says they are.

For his part, supposed science guy Bill Nye makes a strong connection between what he calls ‘climate change’ and what he terms ‘terrorism’.

The Huffington Post reports: “Nye’s reasoning hinges on a water shortage in Syria, which researchers have blamed on climate change. As Nye explained, the shortage has stunted farming and pushed young people to look for work in more densely populated areas.

“Young people have gone to big cities looking for work. There’s not enough work for everybody, so the disaffected youths, as we say – the young people who don’t believe in the system, believe the system has failed, don’t believe in the economy – are more easily engaged and more easily recruited by terrorist organizations, and then they end up part way around the world in Paris shooting people,” Nye asserts.

The Independent breathlessly informs us that one of the country’s most senior advisers on health has warned: “Obesity is such a threat to women it should be treated as a “national risk” – like terrorism, natural disasters and cyber attacks.”

And Obama claims that the ‘climate change’ conference in Paris (the only outcome of which will doubtless be more government control for them and more taxes for us), offered the chance to show the ‘terrorists’ that the world was standing together against them.

Sound insane? That’s because it is; until we realise that none of this has anything to do with genuine science or actual terrorists – or if there is any correspondence it is purely coincidental.

We are living through a revolution, a play for total power; or in modern parlance: full-spectrum dominance.

And we have been here before. Last time round it was called Communism. It accused its critics of being counter-revolutionaries or reactionaries. And it murdered those people – and many besides – in their tens of millions.

This time round it is called Freedom.

And if you disagree with it, or don’t smile fast enough or wide enough – or suffer from body odour or weigh too much – today it can stop you from getting on a plane. Tomorrow it may deny you the right to defend yourself.

After that, it may decide on some new arbitrary method of protecting everyone else from you.

Still think your government is there to protect you?

I hope so.

Or you may be a terrorist.

Is my iPhone listening to me?

PrivacySOS – 12/11/2015

applecreepyThe other night I was getting ready to leave my partner’s house to go home. I know how to get from their place to mine without any assistance, so I didn’t look up directions on my phone. I didn’t text anyone to say I was about to go home. Some nights I stay over at my partner’s place and some nights I don’t. In other words, it seemed like there was no way my phone could have known that I was about to get into my car and drive back to my place. And yet, as I walked out the door, I looked at my iPhone and found a push notification alerting me that traffic to my home address was looking normal.

I did not like that. How the hell did my phone know I was about to drive home? Did it listen to me?

Even though I work full time as a privacy advocate, there are lots of things on my mind, so I sort of forgot about this incident—that is, until this morning, when it happened again.

I normally take public transit or bike to work. This morning I was running a little late and my roommate suggested we drive to get coffee together. I said aloud, “If the bus is on time, I can take it. Otherwise could you drop me off downtown?” She agreed.

As I walked toward the door to leave I looked down at my phone. Again, there was a push notification from Apple Maps (an app I have never once used). It read: “16 minutes to Congress St.; Traffic is normal right now.” This time I took a screenshot, posted at right.

How on earth could my iPhone have known that I wasn’t going to take the bus this morning, and that I was going to drive downtown instead?

Apple’s website includes a page on location tracking and privacy. On that page, it says:

Frequent Locations: To learn places that are significant to you, your iOS device will keep track of places you have recently been, as well as how often and when you visited them. This data is kept solely on your device and won’t be sent to Apple without your consent. It will be used to provide you with personalized services, such as predictive traffic routing.

But in both cases, these alerts appeared only after I had verbally announced my intention to drive somewhere, either home or to work. In neither case was this a routine event; I often sleep over at my partner’s place, and I usually take public transit or ride my bike to work. Therefore the only possibility that makes any sense to me is that my phone is listening, heard me tell my partner I was going home and ask if my roommate could drop me off at work, and then provided me with up to date traffic reports to those two destinations.

In neither case was it desirable. I don’t appreciate it; if I want to know what traffic looks like, I’ll check it out myself. I don’t want my phone listening to me. I’ve never once used Siri in part because of that preference.

Of course, it could be a (two-time) fluke, so I’m curious to hear from others with iPhones. If you’ve had a similar experience, let me know. Also please get in touch if you know how my phone might be deducing these intensely personal things about me, if it’s not actually listening.

Location information is extremely sensitive. That’s made chillingly clear when your phone, practically an extra limb for many of us, starts giving you information about not just where you are or in response to commands you’ve given it, but about where you’re about to go, without having been asked.

Update: CNET explains how you can turn off predictive traffic alerts. That’s great, but the predictive traffic alert feature doesn’t fully explain these two incidents. After all, there’s nothing routine about the trips I was making. And I gave the phone no indication that I was about to drive somewhere, besides talking about driving in the vicinity of the phone.
